某財(cái)產(chǎn)保險(xiǎn)公司安裝工程一切險(xiǎn)合同條款(中英文)ERECTIONALLRISKSCLAUSES第一部分物質(zhì)損失Ⅰ.SECTIONⅠ-MATERIALDAMAGE（一）責(zé)任范圍1.Coverage1、在本保險(xiǎn)期限內(nèi)，若本保險(xiǎn)單明細(xì)表中分項(xiàng)列明的保險(xiǎn)財(cái)產(chǎn)在列明的工地范圍內(nèi)，因本保險(xiǎn)單除外責(zé)任以外的任何自然災(zāi)害或意外事故造成的物質(zhì)損壞或滅失（以下簡(jiǎn)稱“損失”），本公司按本保險(xiǎn)單的規(guī)定負(fù)責(zé)賠償。1.1TheCompanyshallindemnifytheInsuredinrespectofthephysicallossofordamagetothepropertyinsuredduringtheperiodofinsurancewithinthespecifiedwork-sitearisingfromanyNATURALHAZARDSorACCIDENTotherthanthosespecificallyexcluded,inthemannerandtotheextenthereinafterprovided.2、對(duì)經(jīng)本保險(xiǎn)單列明的因發(fā)生上述損失所產(chǎn)生的有關(guān)費(fèi)用，本公司亦可負(fù)責(zé)賠償。1.2TheCompanyshallalsoindemnifytheInsuredforthenecessarycostspecifiedintheScheduleandincurredfollowinguponanyeventgivingrisetoaclaimunderthisPolicy.3、本公司對(duì)每一保險(xiǎn)項(xiàng)目的賠償責(zé)任均不得超過(guò)本保險(xiǎn)單明細(xì)表中對(duì)應(yīng)列明的分項(xiàng)保險(xiǎn)金額以及本保險(xiǎn)單特別條款或批單中規(guī)定的其他適用的賠償限額。但在任何情況下，本公司在本保險(xiǎn)單項(xiàng)下承擔(dān)的對(duì)物質(zhì)損失的最高賠償責(zé)任不得超過(guò)本保險(xiǎn)單明細(xì)表中列明的總保險(xiǎn)金額。1.3TheliabilityoftheCompanyinrespectofeachiteminsuredshallnotexceedthesumsetcorrespondingtheretospecifiedintheSchedule,northelimitofindemnityspecifiedintheSpecialProvisionsorEndorsementswhereapplicable.ButinnocaseshallthemaximumliabilityoftheCompanyinrespectofmaterialdamageunderthissectionexceedthetotalsuminsuredspecifiedintheSchedule.定義DEFINITIONS自然災(zāi)害：指地震、海嘯、雷電、颶風(fēng)、臺(tái)風(fēng)、龍卷風(fēng)、風(fēng)暴、暴雨、洪水、水災(zāi)、凍災(zāi)、冰雹、地崩、山崩、雪崩、火山爆發(fā)、地面下陷下沉及其他人力不可抗拒的破壞力強(qiáng)大的自然現(xiàn)象。Thewords“NATURALHAZARDS”shallforthepurposeofthisPolicy,meanearthquake,tsunami,thunder-and-lightning,hurricane,typhoon,tornado,storm,tempest,flood,inundation,frost,hailstorm,landslide,rockslide,avalanche,volcanicexplosion,subsidenceofgroundandanyotherphenomenaofnaturewithstrongdestructivepowerandbeyondhumancontrol.意外事故：指不可預(yù)料的以及被保險(xiǎn)人無(wú)法控制并造成物質(zhì)損失或人身傷亡的突發(fā)性事件，包括火災(zāi)和爆炸。TheWord：“ACCIDENT”shallforthepurposeofthisPolicy,meananyunforeseen,uncontrollableandsuddeneventwhichleadstomaterialdamageorbodilyinjury,includingfireandexplosion.（二）除外責(zé)任2.Exclusions本公司對(duì)下列各項(xiàng)不負(fù)責(zé)賠償：TheCompanyshallnotbeliablefor:1、因設(shè)計(jì)錯(cuò)誤、鑄造或原材料缺陷或工藝不善引起的保險(xiǎn)財(cái)產(chǎn)本身的損失以及為換置、修理或矯正這些缺點(diǎn)錯(cuò)誤所支付的費(fèi)用；2.1lossofordamagetotheinsureditemsthemselvesduetofaultydesign,defectivecastingormaterialorbadworkmanshipandexpensesincurredforreplacing,repairingorrectifyingsuchdefectsormistakes;2、由于超負(fù)荷、超電壓、碰線、電弧、漏電、短路、大氣放電及其他電氣原因造成電氣設(shè)備或電氣用具本身的損失；2.2lossofordamagetotheinsuredelectricequipmentorapparatusduetooverloading,overvoltage,electriclinecontact,arcing,leakageofelectricity,shortcircuiting,electricitydischargedfromatmosphereandotherelectricphenomena;3、施工用機(jī)具、設(shè)備、機(jī)械裝置失靈造成的本身?yè)p失；2.3lossofordamagetotheconstructionplantandequipmentnotcausedbyexteriorinfluence;4、自然磨損、內(nèi)在或潛在缺陷、物質(zhì)本身變化、自燃、自熱、氧化、銹蝕、滲漏、鼠咬、蟲(chóng)蛀、大氣（氣候或氣溫）變化、正常水位變化或其他漸變?cè)蛟斐傻谋ｋU(xiǎn)財(cái)產(chǎn)自身的損失和費(fèi)用；2.4lossofordamagetotheinsureditemsthemselvesorexpensesarisingtherefromduetowearandtear,inherentorlatentdefect,changeinsubstance,spontaneouscombustion,naturalheating,oxidation,rustandcorrosion,leakage,mice,insectsorvermin,changeinatmosphere,（climaticortemperature）conditions,changeinnormalwaterleveloranyotherprogressivelyoperatingcause;5、維修保養(yǎng)或正常檢修的費(fèi)用；2.5expensesofmaintenanceorupkeepornormaloverhaul;6、檔案、文件、帳薄、票據(jù)、現(xiàn)金、各種有價(jià)證券、圖表資料及包裝物料的損失；2.6lossofordamagetofiles,documents,accountbooks,bills,cash,securities,charts,dataandpackingmaterials;7、盤點(diǎn)時(shí)發(fā)現(xiàn)的短缺；2.7shortagediscoveredatthetimeoftakinganinventory;8、領(lǐng)有公共運(yùn)輸行駛執(zhí)照的，或已由其他保險(xiǎn)予以保障的車輛、船舶和飛機(jī)的損失；2.8lossofordamagetovehicles,shiporaircraftlicensedforgeneraltransportuseorhavingbeencoveredbyanyotherinsurance;9、除非另有約定，在保險(xiǎn)工程開(kāi)始以前已經(jīng)存在或形成的位于工地范圍內(nèi)或其周圍的屬于被保險(xiǎn)人的財(cái)產(chǎn)的損失；2.9unlessotherwiseagreedbytheCompanyinwritinglossofordamagetothepropertybelongingtotheInsuredwhichisexistingorformedwithinorinthevicinityofthesitebeforethecommencementoftheerectionwork;10、除非另有約定，在本保險(xiǎn)單保險(xiǎn)期限終止以前，保險(xiǎn)財(cái)產(chǎn)中已由工程所有人簽發(fā)完工驗(yàn)收證書(shū)或驗(yàn)收合格或?qū)嶋H占有或使用或接收的部分。2.10unlessotherwiseagreedbytheCompanyinwritinglossofordamagetoanypartorpartsofthepropertyinsuredforwhichacertificateofcompletionhasbeenissuedorwhichhavebeentestedaftercompletionoractuallyoccupiedorputintoserviceortakenoverbythePrincipalbeforetheexpirydateofthisPolicy.二、第二部分第三者責(zé)任險(xiǎn)Ⅱ.SECTIONⅡ-THIRDPARTYLIABILITY（一）責(zé)任范圍1.Coverage1、在本保險(xiǎn)期限內(nèi)，因發(fā)生與本保險(xiǎn)單所承保工程直接相關(guān)的意外事故引起工地內(nèi)及鄰近區(qū)域的第三者人身傷亡、疾病或財(cái)產(chǎn)損失，依法應(yīng)由被保險(xiǎn)人承擔(dān)的經(jīng)濟(jì)賠償責(zé)任，本公司按下列條款的規(guī)定負(fù)責(zé)賠償。1.1TheCompanyshallinthemannerhereinafterprovidedindemnifytheInsuredagainstsuchsumswhichtheInsuredshallbecomelegallyliabletopayasdamagesinrespectofdeathoforbodilyinjurytoorillnessofthirdparties,orlossofordamagetopropertybelongingtothirdpartiesinconsequenceofanaccidentoccurringindirectconnectionwiththeperformanceoftheerectionworkinsuredandhappeningonorinthevicinityofthesiteduringtheperiodofinsurance.2、對(duì)被保險(xiǎn)人因上述原因而支付的訴訟費(fèi)用以及事先經(jīng)本公司書(shū)面同意而支付的其他費(fèi)用，本公司亦負(fù)責(zé)賠償。1.2InrespectofanyclaimcoveredunderthisSection,theCompanyshallinadditionindemnifytheInsuredagainsttherelevantlegalcostspayablebytheInsuredandotherexpensesincurredwiththepriorwrittenconsentoftheCompany.3、本公司對(duì)每次事故引起的賠償金額以法院或政府有關(guān)部門根據(jù)現(xiàn)行法律裁定的應(yīng)由被保險(xiǎn)人償付的金額為準(zhǔn)。但在任何情況下，均不得超過(guò)本保險(xiǎn)單明細(xì)表中對(duì)應(yīng)列明的每次事故賠償限額。在本保險(xiǎn)期限內(nèi)，本公司在本保險(xiǎn)單項(xiàng)下對(duì)上述經(jīng)濟(jì)賠償?shù)淖罡哔r償責(zé)任不得超過(guò)本保險(xiǎn)單明細(xì)表中列明的累計(jì)賠償限額。1.3TheindemnificationmadebytheCompanyforanyoneaccidentshallbesubjecttotheamountstobepayablebytheInsuredwhicharedecidedinaccordancewiththelawbythecourtorthegovernmentaldepartmentconcerned.ProvidedalwaysthattheliabilityoftheCompanyunderthissectionshallinnocaseexceedthelimitsofindemnityforanyoneaccidentstatedintheSchedule,andduringthewholeperiodofinsurance,themaximumliabilityoftheCompanyunderthissectionshallinnocaseexceedthelimitofindemnityinaggregateasstatedintheSchedule.（二）除外責(zé)任2.Exclusions本公司對(duì)下列各項(xiàng)不負(fù)責(zé)賠償：TheCompanyshallnotbeliablefor:1、本保險(xiǎn)單物質(zhì)損失項(xiàng)下或本應(yīng)在該項(xiàng)下予以負(fù)責(zé)的損失及各種費(fèi)用；2.1lossordamageandexpensescoveredorcoverableunderSectionIofthisPolicy;1）工程所有人、承包人或其他關(guān)系方或他們所雇用的在工地現(xiàn)場(chǎng)從事與工程有關(guān)工作的職員、工人以及他們的家庭成員的人身傷亡或疾??；2.2.1deathoforbodilyinjurytoorillnessofthePrincipal（s）ortheContractor（s）oranyotherparty（ies）ortheiremployeesorworkmenengagedinconnectionwiththecontractworkonthesite,ormembersoftheirfamilies;2）工程所有人、承包人或其他關(guān)系方或他們所雇用的職員、工人所有的或由其照管、控制的財(cái)產(chǎn)發(fā)生的損失；2.2.2lossofordamagetopropertybelongingtoorheldincare,custodyorcontrolofthePrincipal（s）ortheContractor（s）oranyotherparty（ies）concernedortheiremployeesorworkmen;3）領(lǐng)有公共運(yùn)輸行駛執(zhí)照的車輛、船舶、飛機(jī)造成的事故；2.2.3anyaccidentcausedbyvehicles,shiporaircraftlicensedforgeneraltransportuse;4）被保險(xiǎn)人根據(jù)與他人的協(xié)議應(yīng)支付的賠償或其他款項(xiàng)，但即使沒(méi)有這種協(xié)議，被保險(xiǎn)人仍應(yīng)承擔(dān)的責(zé)任不在此限。2.2.4indemnificationorpaymentmadebytheInsuredinaccordancewithanyagreementbetweentheInsuredandotherparties,unlesssuchliabilitywouldhavebeenattachedtotheinsurednotwithstandingsuchagreement.三、總除外責(zé)任Ⅲ.GENERALEXCLUSIONS在本保險(xiǎn)單項(xiàng)下，本公司對(duì)下列各項(xiàng)不負(fù)責(zé)賠償：TheCompanyshallnotindemnifytheInsuredunderthisPolicyinrespectofloss,damage,expenses,orliabilitydirectlyorindirectlycausedbyorarisingoutoforaggravatedby:（一）1、戰(zhàn)爭(zhēng)、類似戰(zhàn)爭(zhēng)行為、敵對(duì)行為、武裝沖突、恐怖活動(dòng)、謀反、政變引起的任何損失、費(fèi)用和責(zé)任；1.1war,warlikeoperation,hostilities,armedconflicts,terrorism,conspiracyinsurrection,coupd'etat;2、政府命令或任何公共當(dāng)局的沒(méi)收、征用、銷毀或毀壞；1.2confiscation,requisition,destructionordamagebyanyactionororderofanygovernmentdejureordefactoorbyanypublicauthorities;3、罷工、暴動(dòng)、民眾騷亂引起的任何損失、費(fèi)用和責(zé)任；1.3strike,riot,civilcommotion;（二）被保險(xiǎn)人及其代表的故意行為或重大過(guò)失引起的任何損失、費(fèi)用和責(zé)任；2.intentionalactorgrossnegligenceoftheInsuredorhisrepresentative;（三）核裂變、核聚變、核武器、核材料、核幅射及放射性污染引起的任何損失、費(fèi)用和責(zé)任；3.nuclearfission,nuclearfusion,nuclearweapon,nuclearmaterial,nuclearradiationandradioactivecontamination;（四）大氣、土地、水污染及其他各種污染引起的任何損失、費(fèi)用和責(zé)任；4.pollutionofanykindordescriptionwhatsoeversuchasatmosphere,landandwaterpollutions;（五）工程部分停工或全部停工引起的任何損失、費(fèi)用和責(zé)任；5.cessationofworkwhethertotalorpartial;（六）罰金、延誤、喪失合同及其他后果損失；6.consequentiallossofanykindordescriptionwhatsoeverincludingpenalties,lossesduetodelayorlossofcontract;（七）保險(xiǎn)單明細(xì)表或有關(guān)條款中規(guī)定的應(yīng)由被保險(xiǎn)人自行負(fù)擔(dān)的免賠額。7.thedeductiblesstatedintheScheduletobebornebytheInsured.四、保險(xiǎn)金額Ⅳ.SUMINSURED（一）本保險(xiǎn)單明細(xì)表中列明的保險(xiǎn)金額應(yīng)不低于：1.ItisabasicrequirementofthisinsurancethatthesumsinsuredstatedintheScheduleshallnotbelessthan:1、安裝工程—保險(xiǎn)工程安裝完成時(shí)的總價(jià)值，包括設(shè)備費(fèi)用、原材料費(fèi)用、安裝費(fèi)、建造費(fèi)、運(yùn)輸費(fèi)和保險(xiǎn)費(fèi)、關(guān)稅、其他稅項(xiàng)和費(fèi)用，以及由工程所有人提供的原材料和設(shè)備的費(fèi)用；1.1Forerectionwork-thefullvalueoftheinsuredprojectatthecompletionoftheerectionincludingcostofequipments,materials,erectionandconstruction,freightandpremium,customsduty,anyotherduesandexpenses,andthecostofmaterialsorequipmentssuppliedbythePrincipal;2、施工用機(jī)器、裝置和機(jī)械設(shè)備—重置同型號(hào)、同負(fù)載的新機(jī)器、裝置和機(jī)械設(shè)備所需的費(fèi)用；1.2Forconstructionplantandequipment-thereplacementcostoftheinsureditemsbynewonesofthesamesizeandsamecapacity;3、其他保險(xiǎn)項(xiàng)目—由被保險(xiǎn)人與本公司商定的金額。1.3ForotherItemsInsured-thesumsagreeduponbetweentheInsuredandtheCompany.（二）若被保險(xiǎn)人是以保險(xiǎn)工程合同規(guī)定的工程概算總造價(jià)投保，被保險(xiǎn)人應(yīng)：2.Ifthesuminsuredinrespectoferectionworkisbasedontheestimatedcontractvaluestatedintheerectioncontract,theInsuredshall:1、在本保險(xiǎn)項(xiàng)下工程造價(jià)中包括的各項(xiàng)費(fèi)用因漲價(jià)或升值原因而超出原保險(xiǎn)工程造價(jià)時(shí)，必須盡快以書(shū)面通知本公司，本公司據(jù)此調(diào)整保險(xiǎn)金額；2.1immediatelynotifytheCompanyinwritingifthecontractvalueincludingallexpensesunderthisinsuranceexceedstheoriginalinsuredcontractvalueduetoriseinpriceorincrement,andtheCompanyshallthenadjustthesuminsuredaccordingly;2、在保險(xiǎn)期限內(nèi)對(duì)相應(yīng)的工程細(xì)節(jié)作出精確記錄，并允許本公司在合理的時(shí)候?qū)υ擁?xiàng)記錄進(jìn)行查驗(yàn)；2.2keepapreciserecordinwritingontheparticularsoftheworkconcernedduringtheperiodofinsuranceandallowtherepresentativeoftheCompanytoinspectandexaminesuchrecordatanyreasonabletime;3、若保險(xiǎn)工程的安裝期超過(guò)三年，必須從本保險(xiǎn)單生效日起每隔十二個(gè)月向本公司申報(bào)當(dāng)時(shí)的工程實(shí)際投入金額及調(diào)整后的工程總造價(jià)，本公司將據(jù)此調(diào)整保險(xiǎn)費(fèi)；2.3iftheerectionperiodoftheinsuredprojectislongerthanthirty-six（36）months,declaretotheCompanyatanintervalofeverytwelve（12）monthsfromtheinceptiondateofthePolicy,theactualamountoffundputintotheprojectbythetimeofdeclarationaswellasthenewestimatecontractvalue,ifitisrevisedtheCompanyshalladjustthepremiumaccordingly;4、在本保險(xiǎn)單列明的保險(xiǎn)期限屆滿后三個(gè)月內(nèi)向本公司申報(bào)最終的工程總價(jià)值，本公司據(jù)此以多退少補(bǔ)的方式對(duì)預(yù)收保險(xiǎn)費(fèi)進(jìn)行調(diào)整。2.4providetheCompanywiththeactualfinalcontractvaluewithinthree（3）monthsaftertheexpirydateofthisinsurance,andanydifferencebetweenthepremiumpaidinadvanceandthatpayableshallbepaidtoorrefundedbytheCompanyasthecasemaybe.否則，針對(duì)以上各條，本公司將視為保險(xiǎn)金額不足，一旦發(fā)生本保險(xiǎn)責(zé)任范圍內(nèi)的損失時(shí)，本公司將根據(jù)本保險(xiǎn)單總則中第（六）款的規(guī)定對(duì)各種損失按比例賠償。Otherwise,theCompanyshalltakeitthattheSumsInsuredarelessthantheamountsrequiredtobeinsuredandincaseoflossordamagefallingwithintheCoverage,theindemnificationshallbemadeproportionatelyaccordingtotheProvision（6）oftheGeneralConditionsofthisPolicy.五、保險(xiǎn)期限Ⅴ.PERIODOFINSURANCE（一）安裝期物質(zhì)損失及第三者責(zé)任保險(xiǎn)：1.MaterialDamageandThirdPartyLiabilityInsuranceduringtheErectionPeriod:1、本公司的保險(xiǎn)責(zé)任自保險(xiǎn)工程在工地動(dòng)工或用于保險(xiǎn)工程的材料、設(shè)備運(yùn)抵工地之時(shí)起始，至工程所有人對(duì)部分或全部工程簽發(fā)完工驗(yàn)收證書(shū)或驗(yàn)收合格，或工程所有人實(shí)際占有或使用或接收該部分或全部工程之時(shí)終止，以先發(fā)生者為準(zhǔn)。但在任何情況下，安工期保險(xiǎn)期限的起始或終止不得超出本保險(xiǎn)單明細(xì)表中列明的安工期保險(xiǎn)生效日或終止日。1.1TheliabilityoftheCompanyshallcommencenotwithstandinganydatetothecontraryspecifiedintheSchedule,directlyuponcommencementoftheprojectoraftertheunloadingoftheinsuredprojectmaterialsorequipmentsatthesiteandshallexpireimmediatelyafteracertificateofcompletionhasbeenissuedforpartorwholeoftheinsuredprojectorpartorwholeoftheinsuredprojecthasbeentestedaftercompletionoractuallyoccupiedorputintoserviceortakenoverbythePrincipal,whicheveristheearlier.InnocaseshalltheeffectivedatebeearlierorexpirydatebelaterrespectivelythanbothdatesspecifiedintheSchedule.2、不論安裝的保險(xiǎn)設(shè)備的有關(guān)合同中對(duì)試車和考核期如何規(guī)定，本公司僅在本保險(xiǎn)單明細(xì)表中列明的試車和考核期限內(nèi)對(duì)試車和考核所引發(fā)的損失、費(fèi)用和責(zé)任負(fù)責(zé)賠償；若保險(xiǎn)設(shè)備本身是在本次安裝前已被使用過(guò)的設(shè)備或轉(zhuǎn)手設(shè)備，則自其試車之時(shí)起，本公司對(duì)該項(xiàng)設(shè)備的保險(xiǎn)責(zé)任即行終止。1.2Notwithstandinganythingtothecontrarycontainedinthecontractconcerned,theCompanyshallonlybeliableforlossordamage,expensesandliabilitycausedorincurredbytestingorcommissioningarisingduringthetestingorcommissioningperiodstatedintheSchedule.Inthecaseofusingsecond-handitemsorequipments,theinsurancetosuchequipmentsshall,however,ceaseimmediatelyonthecommencementofthetest.3、上述保險(xiǎn)期限的展延，須事先獲得本公司的書(shū)面同意，否則，從本保險(xiǎn)單明細(xì)表中列明的安工期保險(xiǎn)期限終止日起至保證期終止日止期間內(nèi)發(fā)生的任何損失、費(fèi)用和責(zé)任，本公司不負(fù)責(zé)賠償。1.3AnyextensionsoftheperiodofinsuranceshallbesubjecttotheCompany'spriorconsentinwriting.Otherwise,theCompanyshallnotbeliableforanylossordamage,expenseandliabilityarisingduringtheperiodfromtheexpirydateoftheerectionperiodstatedintheScheduletotheexpirydateofthemaintenanceperiodspecifiedbelow.（二）保證期物質(zhì)損失保險(xiǎn)：2.MaterialDamageInsuranceduringtheMaintenancePeriod保證期的保險(xiǎn)期限與工程合同中規(guī)定的保證期一致，從工程所有人對(duì)部分或全部工程簽發(fā)完工驗(yàn)收證書(shū)或驗(yàn)收合格，或工程所有人實(shí)際占有或使用或接收該部分或全部工程時(shí)起算，以先發(fā)生者為準(zhǔn)。但在任何情況下，保證期的保險(xiǎn)期限不得超出本保險(xiǎn)單明細(xì)表中列明的保證期。Theperiodofinsurance,beingsubjecttothemaintenanceperiodspecifiedintheinsuredcontract,shallcommenceatthetimewhenacertificateofcompletionhasbeenissuedforpartorpartsoftheinsuredprojectorpartorpartsoftheinsuredprojecthavebeentestedaftercompletionoractuallyoccupiedorputintoserviceortakenoverbythePrincipal,whicheveristheearlier.Itishoweverprovidedthat,undernocircumstancesshallsuchperiodgobeyondthemaintenanceperiodstatedintheSchedule.六、賠償處理Ⅵ.TREATMENTOFCLAIM（一）對(duì)保險(xiǎn)財(cái)產(chǎn)遭受的損失，本公司可選擇以支付賠款或以修復(fù)、重置受損項(xiàng)目的方式予以賠償，但對(duì)保險(xiǎn)財(cái)產(chǎn)在修復(fù)或重置過(guò)程中發(fā)生的任何變更、性能增加或改進(jìn)所產(chǎn)生的額外費(fèi)用，本公司不負(fù)責(zé)賠償。1.TheCompanyshall,atitsoption,indemnifytheInsuredinrespectoflossofordamagetotheinsuredpropertyeitherbywayofpaymentincashorbywayofrepairorreplacementoftheitemslostordamaged;nevertheless,theextracostofanyalterations,additionsorimprovementsoccurringinthecourseofrepairorreplacementshallnotberecoverableunderthisPolicy.（二）在發(fā)生本保險(xiǎn)單物質(zhì)損失項(xiàng)下的損失后，本公司按下列方式確定賠償金額：2.IncaseofanylossordamagerecoverableundertheSectionIofthePolicy,theCompanyshallascertaintheamountofindemnityonthefollowingbasis:1、可以修復(fù)的部分損失——以將保險(xiǎn)財(cái)產(chǎn)修復(fù)至其基本恢復(fù)受損前狀態(tài)的費(fèi)用扣除殘值后的金額為準(zhǔn)。但若修復(fù)費(fèi)用等于或超過(guò)保險(xiǎn)財(cái)產(chǎn)損失前的價(jià)值時(shí)，則按下列第2項(xiàng)的規(guī)定處理；2.1Incaseofdamagewhichcanberepaired,theCompanyshallpaythecostofrepairsnecessarytorestorethedamageditemtoitsnearestconditionimmediatelyprecedingthedamageafterdeductingthesalvagevalue.If,however,thecostofrepairsequalsorexceedsthevalueoftheitemimmediatelybeforetheoccurrenceofthedamage,thesettlementsshallbemadeaccordingtotheprovisions2.2.2、全部損失或推定全損——以保險(xiǎn)財(cái)產(chǎn)損失前的實(shí)際價(jià)值扣除殘值后的金額為準(zhǔn)，但本公司有權(quán)不接受被保險(xiǎn)人對(duì)受損財(cái)產(chǎn)的委付；2.2Incaseofatotalorconstructivetotalloss,theCompanyshallpaytheamountoftheactualvalueoftheinsureditemsimmediatelybeforetheoccurrenceofthelossafterdeductingthesalvagevalue.However,theCompanymay,atitsoption,declinetheabandonmentofanydamagedpropertybytheInsured.3、任何屬于成對(duì)或成套的設(shè)備項(xiàng)目，若發(fā)生損失，本公司的賠償責(zé)任不超過(guò)該受損項(xiàng)目在所屬整對(duì)或整套設(shè)備項(xiàng)目的保險(xiǎn)金額中所占的比例；2.3Intheeventoflossofordamagetoanyequipmentiteminsuredformingpartofapairorset,theCompanyshallnotbeliableinrespectofeachofsuchitemlostordamagedformorethanitsproportionatepartofthesuminsuredonthecompletepairorset.4、發(fā)生損失后，被保險(xiǎn)人為減少損失而采取必要措施所產(chǎn)生的合理費(fèi)用，本公司可予以賠償，但本項(xiàng)費(fèi)用以保險(xiǎn)財(cái)產(chǎn)的保險(xiǎn)金額為限。2.4Intheeventofanylossoccurrence,theCompanyshallalsopaytheInsuredfortheexpensesreasonablyincurredfortakingnecessarymeasurestominimizelossordamagetotheleastextent,butinnocaseshalltheaggregateamountoftheindemnityandsuchexpensesreferredheretoexceedthesuminsuredoftheitemssustaininglossordamage.（三）本公司賠償損失后，由本公司出具批單將保險(xiǎn)金額從損失發(fā)生之日起相應(yīng)減少，并且不退還保險(xiǎn)金額減少部分的保險(xiǎn)費(fèi)。如被保險(xiǎn)人要求恢復(fù)至原保險(xiǎn)金額，應(yīng)按約定的保險(xiǎn)費(fèi)率加繳恢復(fù)部分從損失發(fā)生之日起至保險(xiǎn)期限終止之日止按日比例計(jì)算的保險(xiǎn)費(fèi)。3.Uponsettlementofaclaim,anendorsementshallbeissuedbytheCompanytoreducethesuminsuredcorrespondingtothepropertylostordamagedbytheamountsosettledfromthedateofloss,andnopremiumshallberefundedfortheamountsoreduced.IfreinstatementofthesuminsuredisrequiredbytheInsureduponsettlementoftheclaim,anadditionalpremiumforthereinstatedamountshallbechargedatanagreedrat,andbecalculatedonproratadailybasisfromthedateoflosstotheexpiryoftheinsurance.（四）在發(fā)生本保險(xiǎn)單第三者責(zé)任項(xiàng)下的索賠時(shí)：4.IntheeventofanyclaimrecoverableundertheSectionIIofthisPolicy:1、未經(jīng)本公司書(shū)面同意，被保險(xiǎn)人或其代表對(duì)索賠方不得作出任何責(zé)任承諾或拒絕、出價(jià)、約定、付款或賠償。在必要時(shí)，本公司有權(quán)以被保險(xiǎn)人的名義接辦對(duì)任何訴訟的抗辯或索賠的處理；4.1Noadmission,rejection,offer,promise,paymentorindemnityshallbemadeorgivenbyoronbehalfoftheInsuredorhisrepresentativewithoutthewrittenconsentoftheCompany.AndtheCompanyshallbeentitled,ifitsodesires,totakeoverandconductinthenameoftheInsuredthedefenceorsettlementofanyclaim;2、本公司有權(quán)以被保險(xiǎn)人的名義，為本公司的利益自付費(fèi)用向任何責(zé)任方提出索賠的要求。未經(jīng)本公司書(shū)面同意，被保險(xiǎn)人不得接受責(zé)任方就有關(guān)損失作出的付款或賠償安排或放棄對(duì)責(zé)任方的索賠權(quán)利，否則，由此引起的后果將由被保險(xiǎn)人承擔(dān)；4.2TheCompanyshallbeentitled,atitsownexpenseandforitsownbenefit,toprosecuteinthenameoftheInsuredanyclaimforindemnityagainstanypersons.WithoutthewrittenconsentoftheCompany,theInsuredshallnotacceptthepaymentorarrangementofindemnityinrespectofthelossordamageofferedbyanypartyheldresponsibleforsuchlossordamageandshallnotabandontherightofrecoveryfromsuchparty,otherwise,theInsuredshallbeliableforanyconsequencearisingtherefrom;3、在訴訟或處理索賠過(guò)程中，本公司有權(quán)自行處理任何訴訟或解決任何索賠案件，被保險(xiǎn)人有義務(wù)向本公司提供一切所需的資料和協(xié)助。4.3TheCompanyshallhavefulldiscretiontoconductanyproceedingsorsettleanyclaim,andtheInsuredshallgiveallsuchinformationandassistanceastheCompanymayrequire.（五）被保險(xiǎn)人請(qǐng)求索賠的權(quán)利，自其知道或者應(yīng)當(dāng)知道保險(xiǎn)事故發(fā)生之日起二年不行使而消滅。5.Thetimeofvalidityofaclaimunderthisinsuranceshallnotexceedaperiodoftwoyearscountingfromthedateofloss.七、被保險(xiǎn)人的義務(wù)Ⅶ.INSURED’SOBLIGATIONS被保險(xiǎn)人及其代表應(yīng)嚴(yán)格履行下列義務(wù)：ThefollowingObligationsshallbestrictlyfulfilledbytheInsuredandhisrepresentative:（一）在投保時(shí)，被保險(xiǎn)人及其代表應(yīng)對(duì)投保申請(qǐng)書(shū)中列明的事項(xiàng)以及本公司提出的其他事項(xiàng)作出真實(shí)、詳盡的說(shuō)明或描述；1.TheInsuredandhisrepresentative,whenapplyingforinsuranceshallmaketrueanswersordescriptionstothequestionsintheProposalandQuestionnaireortoanyotherquestionsraisedbytheCompany.（二）被保險(xiǎn)人或其代表應(yīng)根據(jù)本保險(xiǎn)單明細(xì)表和批單中的規(guī)定按期繳付保險(xiǎn)費(fèi)；2.TheInsuredandhisrepresentativeshallpaytotheCompanyinduecoursetheagreedpremiuminthemannerasprovidedintheScheduleandEndorsement.（三）在本保險(xiǎn)期限內(nèi)，被保險(xiǎn)人應(yīng)采取一切合理的預(yù)防措施，包括認(rèn)真考慮并付諸實(shí)施本公司代表提出的合理的防損建議，謹(jǐn)慎選用施工人員，遵守一切與施工有關(guān)的法規(guī)和安全操作規(guī)程，由此產(chǎn)生的一切費(fèi)用，均由被保險(xiǎn)人承擔(dān)；3.Duringtheperiodofinsurance,theInsuredshallathisownexpensetakeallreasonableprecautions,includingpayingsufficientattentiontoandputtingintopracticethereasonablerecommendationsoftheCompany,prudentlyselectingtheworkmenandemployeesandcomplyingwithallstatutoryregulationsandsafetyoperationproceduresrelativetotheperformanceoftheprojectinsured.（四）在發(fā)生引起或可能引起本保險(xiǎn)單項(xiàng)下索賠的事故時(shí)，被保險(xiǎn)人或其代表應(yīng)：4.InthheeveentoffanyoccurrrenceewhicchgivvesorrmighhtgivverissetoaclaaimunndertthisPPolicyy,theeInsuuredoorhissreprresenttativeeshalll:1、立即通知本公司司，并在七天天或經(jīng)本公司司書(shū)面同意延延長(zhǎng)的期限內(nèi)內(nèi)以書(shū)面報(bào)告告提供事故發(fā)發(fā)生的經(jīng)過(guò)、原原因和損失程程度；4.1NotiifythheCommpanyimmeddiatellyanddwithhinseeven（7）dayssoraanyfuurtherrperiiodassmaybeaggreedbythheCommpanyinwrritingg,furrnishawriittenreporrttoindiccatetthecoourse,,probbablereasoonanddexteentofflosssorddamagee;2、采取一切必要措措施防止損失失的進(jìn)一步擴(kuò)擴(kuò)大并將損失失減少到最低低程度；4.2Takeeallnecesssarymeasuuresttoavooidagggravaationofthhelosssordamaggeanddminiimizeittooleasstexttent;3、在本公司的代表表或檢驗(yàn)師進(jìn)進(jìn)行勘查之前前，保留事故故現(xiàn)場(chǎng)及有關(guān)關(guān)實(shí)物證據(jù)；；4.3PresservethesspotaaffecttedannddeffectivveparrtsbeeforeaninnspecttioniiscarrriedoutbbyarrepressentattiveoorsurrveyorrfrommtheCompaany;4、在保險(xiǎn)財(cái)產(chǎn)遭受受盜竊或惡意意破壞時(shí)，立立即向公安部部門報(bào)案；4.4InfoormthhePubblicSSecuriityBuureauimmeddiatellyincaseofloossorrdamaageduuetothefttorbburglaaryorrmaliicioussactss;5、在預(yù)知可能引起起訴訟時(shí)，立立即以書(shū)面形形式通知本公公司，并在接接到法院傳票票或其他法律律文件后，立立即將其送交交本公司；4.5ImmeediateelygiivenooticetothheCommpanyinwrritinggwhenneverhavinngknoowledggeofanyiimpenddingpproseccutionnincconnecctionwithanyaaccideentfoorwhiichthheremmaybeeliabbilityyundeerthiisPollicy,andfforwarrdtotheCCompannyeveeryleetterwrit,,summmonsoorproocessorottherccourtdocummentsonreeceiptttherreof;6、根據(jù)本公司的要要求提供作為為索賠依據(jù)的的所有證明文文件、資料和和單據(jù)。4.6furnnishaallsuuchinnformaationandddocumeentaryyeviddenceasthheCommpanymayrrequirreforrsuppportinngtheeclaiim.（五）若在某一保保險(xiǎn)財(cái)產(chǎn)中發(fā)發(fā)現(xiàn)的缺陷表表明或預(yù)示類類似缺陷亦存存在于其他保保險(xiǎn)財(cái)產(chǎn)中時(shí)時(shí)，被保險(xiǎn)人人應(yīng)立即自付付費(fèi)用進(jìn)行調(diào)調(diào)查并糾正該該缺陷。否則則，由類似缺缺陷造成的一一切損失應(yīng)由由被保險(xiǎn)人自自行承擔(dān)。5.Ifdiiscoveeryoffadeefectinannyproopertyyinsuuredsshallindiccateoorsugggestthatsimillardeefectexisttsinotherrproppertyinsurred,ttheInnsureddshalll,atthisowneexpensses,iinvesttigateeandrectiifyfoorthwiiththhedeffectiinsucchothherprropertty.Ottherwiise,aallloossorrdamaagearrisinggoutofthhesaiiddeffectsshallbeboornebbytheeInsuured.八、總則Ⅷ.GGENERAALCONNDITIOONS（一）保單效力1.PoolicyEffecct被保險(xiǎn)人嚴(yán)格地遵遵守和履行本本保險(xiǎn)單的各各項(xiàng)規(guī)定，是是本公司在本本保險(xiǎn)單項(xiàng)下下承擔(dān)賠償責(zé)責(zé)任的先決條條件。ThedueobserrvanceeandfulfiilmenttofttheteermsaandcoonditiionsoofthiisPollicyiinsofaraastheeyrellatettoanyythinggtobbedonneorcomplliedwwithbbytheeInsuuredsshallbeacondiitionpreceedenttoannyliaabilittyoftheCCompannyundderthhisPoolicy..（二）保單無(wú)效2.PoolicyVoidaance如果被保險(xiǎn)人或其其代表漏報(bào)、錯(cuò)錯(cuò)報(bào)、虛報(bào)或或隱瞞有關(guān)本本保險(xiǎn)的實(shí)質(zhì)質(zhì)性內(nèi)容，則則本保險(xiǎn)單無(wú)無(wú)效。ThisPollicysshallbevooidablleintheeeventofmiisreprresenttationn,missdescrriptioonornon-ddiscloosuremadebythheInssuredorhiisreppresenntativveinanymmateriialpaarticuulariinresspectofthhisinnsurannce.（三）保單終止3.PoolicyTermiinatioon除非經(jīng)本公司書(shū)面面同意，本保保險(xiǎn)單將在下下列情況下自自動(dòng)終止；UnlessiitscoontinuuancebeaddmitteedbytheCCompannyinwritiing,tthisPPolicyyshalllbeautommaticaallytterminnatedif:1.被保險(xiǎn)人喪失保險(xiǎn)險(xiǎn)利益；3..1theeinsuurableeinteerestofthheInssuredisloost;2.承保風(fēng)險(xiǎn)擴(kuò)大。33.2thherisskoflossordaamageisinncreassed.本保險(xiǎn)單終止后，本本公司將按日日比例退還被被保險(xiǎn)人本保保險(xiǎn)單項(xiàng)下未未到期部分的的保險(xiǎn)費(fèi)。AfterteerminaationofthhePollicy,theppremiuumshaallbeerefuundedtothheInssuredcalcuulateddonpproraatadaailybbasisfortthepeeriodtheddateoofterrminattionttotheedateeofeexpiryy.（四）權(quán)益喪失4.FoorfeittofBBenefiit如果任何索賠含有有虛假成分，或或被保險(xiǎn)人或或其代表在索索賠時(shí)采取欺欺詐手段企圖圖在本保險(xiǎn)單單項(xiàng)下獲取利利益，或任何何損失是由被被保險(xiǎn)人或其其代表的故意意行為或縱容容所致，被保保險(xiǎn)人將喪失失其在本保險(xiǎn)險(xiǎn)單項(xiàng)下的所所有權(quán)益。對(duì)對(duì)由此產(chǎn)生的的包括本公司司已支付的賠賠款在內(nèi)的一一切損失，應(yīng)應(yīng)由被保險(xiǎn)人人負(fù)責(zé)賠償。Ifthecclaimisinnanyrespeectfrraudullent,oriffanyfrauddulenttmeannsordeviccesarreuseedbytheIInsureedorhisrrepressentattivettoobttainaanybeenefittundeerthiisPollicyoorifanyllossoordammageiisocccasionnedbyytheintenntionaalacttoriintheeconnnivancceoftheIInsureedorhisrrepressentattive,theninannyoftheseecasees,allltheerighhtsanndbennefitssofttheInnsureddundeerthiisPollicysshallbefoorfeitted,aandalllconnsequeentloossesarisiingthherefrrominncludiingthheamoountoofclaaimpaaidbyytheCompaanyshhallbbeinddemniffiedbbytheeInsuured.（五）合理查驗(yàn)5.ReeasonaableIInspecction本公司的代表有權(quán)權(quán)在任何適當(dāng)當(dāng)?shù)臅r(shí)候?qū)Ρ１ｋU(xiǎn)財(cái)產(chǎn)的風(fēng)風(fēng)險(xiǎn)情況進(jìn)行行現(xiàn)場(chǎng)查驗(yàn)。被被保險(xiǎn)人應(yīng)提提供一切便利利及本公司要要求的用以評(píng)評(píng)估有關(guān)風(fēng)險(xiǎn)險(xiǎn)的詳情和資資料。但上述述查驗(yàn)并不構(gòu)構(gòu)成本公司對(duì)對(duì)被保險(xiǎn)人的的任何承諾。ThereprresenttativeeofttheCoompanyyshalllatanyssuitabbletiimebeeentiitledtoatttendthessiteaandinnspecttoreexaminnetheeriskkexpoosureofthheproopertyyinsuured.Fortthisppurposse,thheInssuredshalllprovvideffullaassisttanceandaalldeetailssandinforrmatioonreqquireddbyttheCoompanyyasmmaybeeneceessaryyfortheaassesssmentofthherissk.ThheaboovemeentionnedinnspecttionoorexaaminattionsshallinnoocirccumstaancesbeheeldassanyadmisssiontothheInssuredbythheCommpany..（六）比例賠償6.Avveragee在發(fā)生本保險(xiǎn)物質(zhì)質(zhì)損失項(xiàng)下的的損失時(shí)，若若受損保險(xiǎn)財(cái)財(cái)產(chǎn)的分項(xiàng)或或總保險(xiǎn)金額額低于對(duì)應(yīng)的的應(yīng)保險(xiǎn)金額額（見(jiàn)四、保保險(xiǎn)金額），其其差額部分視視為被保險(xiǎn)人人所自保，本本公司則按本本保險(xiǎn)單明細(xì)細(xì)表中列明的的保險(xiǎn)金額
