水暖電及中央通風(fēng)系統(tǒng)安裝施工合同CONTRACTOFINSTALLATIONOFWATER/ELECTRICITYANDCENTRALVENTILATIONSYSTEM合同簽訂日期：年月日DateofSignature:發(fā)包方：(甲方)Employer(partyA)承包方：（乙方）Contractor(partyB)甲乙雙方根據(jù)《中華人民共和國合同法》和《建筑安裝工程承包合同條例》的規(guī)定以及建筑工程的具體情況，就乙方承包甲方水暖電和中央通風(fēng)系統(tǒng)安裝項(xiàng)目施工事宜，雙方協(xié)商一致，簽訂本合同。Partieshereto,inaccordancewithLAWOFCONTRACT,REGULATIONOFCONTRACTINGWITHCONSTRUCTIONINSTALLATIONandparticularcase,havemademutualagreementontheissuesofpartyB‘scontractingtheprojects,frompartyA,ofwater,electricityandcentralventilationsystemandenterintothiscontract.第一條：工程概況ArticleOneOverview1、工程名稱：水暖電安裝工程、中央通風(fēng)系統(tǒng)安裝工程ProjectName:water,electricityandcentralventilationsystem2、工程地點(diǎn)：ProjectPlace:3、工程內(nèi)容及承包范圍：ProjectContentsandContractingScope:（一）、電氣工程（強(qiáng)、弱電）：ElectricityEngineering(StrongandWeakCurrent)1、照明系統(tǒng)：管路預(yù)留、預(yù)埋、穿線，燈具、插座、開關(guān)、配電箱、電度表箱安裝及調(diào)試等施工圖紙要求內(nèi)容。Lightingsystem:Thecontentswhicharestipulatedindrawingscomprisetheinstallationsandcommissioningofpipepresetting,pipeembedded,pipethreading,lamps,sockets,switches,distributionboxesandthelike.2、動(dòng)力電系統(tǒng)：管路及套管預(yù)留、預(yù)埋，電纜橋架安裝，線纜敷設(shè)，配電設(shè)備安裝及調(diào)試等施工圖紙要求內(nèi)容。ElectricPowerSystem:Thecontentsrequiredindrawingsofpipeandsleevepresetting,embedded,cabletrayinstallation,cablelaying,installationandcommissioningofdistributionandothers.3、弱電系統(tǒng):電視、電話、寬帶網(wǎng)、監(jiān)控：管路預(yù)留、預(yù)埋（含穿墻套管）及管路清掃等弱電施工圖紙要求內(nèi)容。WeakSystem:Thecontentswhicharestipulatedinthedrawingsofweakpowerfor(TV,telephone,broadbandandmonitoring);pipelinepresetting,embedded(includewallbushing)andpipecleaningandsoon.4、防雷接地系統(tǒng)：施工圖紙要求的全部施工內(nèi)容。LighteningProtectionSystem:AllprojectContentswhicharerequiredbytheconstructiondrawings.此外，所有與電氣工程（強(qiáng)、弱電）有關(guān)的工作均由乙方完成。Saveandexceptforabove,allworksconcerningelectricengineering(strongandweakcurrent)shouldbeaccomplishedbypartyB.（二）、水暖工程PlumbingEngineering1、給排水、消防用防水、穿（樓板）墻套管的預(yù)留、預(yù)埋，雨水管道、消防栓系統(tǒng)安裝、試壓、防腐、沖洗、調(diào)試及施工配合等施工圖紙要求內(nèi)容。Presettingandembeddingofdrainage,waterforfire-fightingandcasingthroughfloor/wall,andinstallation,pressuretest,anti-corrosion,flushing,commissioningrelevanttodrainage,waterforfire-fighting,presettingandembeddingofcasingthroughfloor/wall,waterpipe,firehydrantsystemandexecutioncooperationandotherworkswhicharerequiredbydrawings.2、室內(nèi)供暖：采暖系統(tǒng)用防水、穿（樓板）墻套管的預(yù)留、預(yù)埋，空調(diào)冷凝水管道的預(yù)留、預(yù)埋，該系統(tǒng)的安裝、試壓、防腐保溫、沖洗、調(diào)試及施工配合等施工圖紙要求內(nèi)容。IndoorHeating:Presettingandembeddingofpipecasingforpoof-waterinheatingsystem;presettingandembeddingofairconditioningcondensatepipelinewithwhichtheinstallation,pressuretest,anti-corrosion/heatpreservation,flushing,commissioningaswellascooperationandothercontentsstipulatedindrawings.（三）中央空調(diào)/通風(fēng)系統(tǒng)安裝InstallationofCentralAirConditioning/VentilationSystem1、該工程為水冷式中央空調(diào)安裝工程，包括場地施工、安裝、調(diào)試、檢測。TheprojectisainstallationWorkofwater-cooledcentralair-conditioningwhichisinclusiveofthesiteconstruction,installation,commissioningandtest.2、工程包括室內(nèi)風(fēng)機(jī)、風(fēng)管及配套設(shè)施的供貨及安裝。Theprojectincludethesupplyandinstallationofindoorfan,ductandancillaryfacilitiestherewith.第二條：工期ArticleTwoProjectPeriod合同簽訂之日起，工期為五個(gè)月。Projectperiodisfivemonthsasofthedateofconcludingthiscontract.第三條：工程質(zhì)量要求ArticleThreeRequirementforQuality工程質(zhì)量等級：優(yōu)良。Gradeofprojectqualityshallisgood.第四條:承包方式、合同價(jià)款及結(jié)算方式ArticleFourContractingManner,CostandSettlement1、承包方式：包工不包料Contractingmanner:Contractforlaborexceptofmaterial2、結(jié)算方式：按照工程決算結(jié)算合同價(jià)款。Settlement:Contractcostwillbemadesettlementonthefinalaccounting.第五條：甲方代表ArticleFivePartyA’sRepresentative1、甲方駐施工現(xiàn)場代表姓名：NameofpartyA’srepresentativeonthesite.第六條：乙方代表ArticleSixPartyB’sRepresentative1、乙方駐施工現(xiàn)場代表姓名：NameofpartyB’srepresentativeonthesite.第七條：甲方義務(wù)ArticleSevenPartyA’sLiabilities1、 委派現(xiàn)場管理代表，監(jiān)督檢查工程質(zhì)量、進(jìn)度，負(fù)責(zé)設(shè)計(jì)圖紙的變更、工程質(zhì)量驗(yàn)收及其他事宜，組織對工程竣工驗(yàn)收。如需變更圖紙或變更已施工的工程，甲方應(yīng)通知乙方，派專人協(xié)助乙方工程技術(shù)人員施工，負(fù)責(zé)與其他配套施工單位協(xié)調(diào)。Therepresentativeforthesitemanagement,whomdispatchedbypartyA,shalltakesupervisionandinspectionofqualityandprogressofproject,responsibleforvariationofdesigndrawings,qualityacceptanceandothermatters,inadditiontofinalacceptanceofproject.Incaseofalterationofdrawingsorprojectwhichbeingunderexecution,forwhich,partyAshouldgivenoticetopartyBanddispatchparticularpersonneltoassistpartyB’sengineeringtechniciansforconstructionthereonandliableforcoordinationwithotherconstructioncompanies.2、 甲方負(fù)責(zé)提供水源、電源，保證施工需要。PartyAshouldberesponsibleforprovisionofwaterandpowersoastoensureconstructionneeds.3、 甲方提供與其他工程相關(guān)資料，組織與其他施工隊(duì)協(xié)商。Shallprovidetheinformationconcernedtootherprojectandorganizeconsultationwithotherconstructionteams.第八條：乙方義務(wù)ArticleEightPartyB’sLiabilities1、 向甲方提交施工進(jìn)度計(jì)劃，并及時(shí)向甲方提交施工所需材料的數(shù)量計(jì)劃單。SubmitconstructionscheduletopartyAandprovideintimepartyAwithBillofMaterialPlanforthematerialswhicharenecessaryinconstruction.2、 按工程需要提供和維修一切與工程有關(guān)的設(shè)施等。Provisionandmaintenanceofallengineering-relatedfacilitiesasperthenecessityofconstruction.3、 負(fù)責(zé)安裝過程中的質(zhì)量，技術(shù)，變更及施工進(jìn)度、安全管理工作，負(fù)責(zé)安全工程技術(shù)資料的整編并向甲方報(bào)送施工完整的施工組織及專業(yè)的施工方案。Responsibleforquality,technologyduringinstallationandexecutionprogress,safetymanagement,preparationofengineeringfiles,inadditiontoprovidepartyAwiththeprogramsofcompleteworkingorganizationandprofessionalexecution.4、 施工期間的一切人身安全事故全由乙方負(fù)責(zé)，并負(fù)責(zé)保護(hù)甲方的一切設(shè)備、設(shè)施，如有損壞，乙方負(fù)責(zé)賠償。PartyBshouldduringexecution,liableforallaccidentofpersonalsafetyandprotectpartyA’sanyequipment/facility,incaseofanydamagethereto,forwhich,shallmakecompensation.5、 施工期間乙方應(yīng)遵守施工現(xiàn)場的安全生產(chǎn)責(zé)任制度。PartyBshouldduringexecution,abidebytheregulationofsafetyconstructiononthesite.乙方在竣工前十日向甲方提供完整的竣工資料肆套。ProvisionoffoursetsofcompletematerialsforfinalacceptancetopartyAonandbefore10dayspriortoprojectcompletion.第九條：進(jìn)度計(jì)劃ArticleNineProgressProgramme1、 在開工前乙方根據(jù)甲方要求擬訂本工程的進(jìn)度表。PartyBshouldpriortothecommencement,aspertherequirementofpartyA,drawoutthescheduleofproject.2、 乙方應(yīng)接受甲方代表對工程進(jìn)度、質(zhì)量的檢查和監(jiān)督。PartyBshouldaccepttheinspectionandsupervisionofpartyA’srepresentativeontheprogressandqualityofproject.3、施工中經(jīng)檢驗(yàn)質(zhì)量不合格，乙方按甲方代表，質(zhì)檢部門的要求進(jìn)行返工、修改，并承擔(dān)費(fèi)用。4、在日之前必須安裝完畢，并調(diào)試合格。第十條：工期ArticleTenWorkingTerm1、 乙方應(yīng)嚴(yán)格按照甲乙雙方認(rèn)定的工期進(jìn)行施工。PartyBshouldcarryouttheexecution,asper,onstrict,theworkingtermwhichisascertainedanddeterminedbypartieshereto.2、 除不可抗力及甲乙雙方責(zé)任之外的其他原因，導(dǎo)致工程停建，施工合同不能繼續(xù)履行，雙方可以協(xié)商解除合同。Providedthatanyotherreasonexceptforforcemajuereandtheliabilityofpartiesheretobringonprojectsuspensionorfailuretocontinueperformanceofcontract,partiesmaynegotiatetodischargecontract.第十一條：工程款支付ArticleElevenPaymentofProjectCost1、乙方進(jìn)場施工后，甲方按月進(jìn)度付款，次月15日前支付上月進(jìn)度款的70%。PartyAshall,onandafterpartyBenterthesiteforcommencementofproject,makemonthlyprogresspayment,70%oflastmonthprogresspaymentshallbepaidpriorto15thnextmonth.2、工程竣工付至進(jìn)度款的80%。80%ofprogresspaymentshallbemadeoncompletionofproject.3、水暖電安裝工程完工驗(yàn)收合格后，甲方付乙方工程結(jié)算款的97%。PartyAshall,onandafteracceptanceofcompetedinstallationofwaterandelectricity,make97%ofprojectpaymentstopartyB.4、水電費(fèi)以建設(shè)單位出具的水、電費(fèi)收據(jù)支付。Feesofwaterandelectricityusedinthesiteshallbepaidagainstreceiptissuedbyemployer.第十二條：違約責(zé)任ArticleTwelveBreachResponsibility1、 甲方未能履行合同，如果屬于以下情形之一，其經(jīng)濟(jì)損失由甲方承擔(dān)，工期順延。WhereandifpartyA’sfailureofperformanceisattributabletooneoffollowingmatters,theeconomiclossthereofwillbesufferedbypartyAandextensionofWorkingperiod.(1)因圖紙變更未能及時(shí)送達(dá)乙方；DrawingsfailtobeprovidedintimetopartyBduetoalterationthereof.(2)因應(yīng)由甲方提供的材料和設(shè)備未能及時(shí)到達(dá)現(xiàn)場或型號規(guī)格不符安裝圖紙規(guī)定的要求。MaterialsandequipmentswhichshouldbeprovidedbypartyAfailtoarriveintimeonthesiteorthemodel/specificationthereofareinconsistentwiththestipulationsofinstallationdrawings.2、 乙方未能履行合同，出現(xiàn)以下情形之一，造成工期延期。甲方有權(quán)要求乙方償付違約金，每延遲一天，罰款元并承擔(dān)相應(yīng)的經(jīng)濟(jì)損失;ProvidedthatifpartyAfailtoperformcontractduetooneofmattersasfollowsandresultinscheduledelay,partyAisentitletoliquidateddamages，frompartyB，ofUSDollarforeachdaydelayedandcorrespondingeconomiclosssuffered。.（1）不能按期或按照要求完成施工任務(wù)；Failureofaccomplishmentofexecutionasperrequirementofcontract.（2）工程質(zhì)量不符合質(zhì)量要求，需要返工/返修或重做；Non-conformancetotherequirementofprojectqualityandneedtoreworkorrepairorredo.其他違反現(xiàn)場操作規(guī)定的事故發(fā)生。Occurrenceofaccidentduedisobeyingrulesofsiteoperation.第十三條：合同生效與終止ArticleThirteenEffectiveandTerminationofContract本合同自簽訂之日起生效。在竣工結(jié)算、甲方付款完畢后，除保修款仍生效外，其它條款即告終止。保修期滿后，有關(guān)保修條款終止。甲乙雙方另外簽訂維修合同。Thiscontractshallcomeintoforceandeffectiveonandfromthedateofsignature.Otherprovisionshereofexcepttothewarrantyarticle,onandafterfinalsettlementandcompletionofpaymentbypartyA,shallbecomenullandvoid.Thewarranteeprovisionwillafterexpirationofwarranteeperiod,beterminatedinadditiontoanothermaintenancecontractsignedbypartieshereto.第十四條：糾紛解決ArticleFourteenDisputeSettlement凡因執(zhí)行本合同或有關(guān)本合同所發(fā)生的一切爭執(zhí)，雙方應(yīng)以友好方式協(xié)商解決；如果協(xié)商不能解決，應(yīng)提交中國國際經(jīng)濟(jì)貿(mào)易仲裁委員會(huì)，根據(jù)該會(huì)的仲裁規(guī)則進(jìn)行仲裁。仲裁裁決是終局的，對雙方都有約束力。Arbitration：AlldisputesarisinginconnectionwiththisSalesContractortheexecutionthereofshallbesettledbywayofamicablenegotiation.Incasenosettlementcanbereached,thecaseatissueshallthenbesubmittedforarbitrationtotheChinaInternationalEconomicandTradeArbitrationCommissioninaccordancewiththeprovisionsofthesaidCommission.TheawardbythesaidCommissionshallbedeemedasfinalandbindinguponbothparties.第十五條其他ArticleFifteenMiscellaneous本合同一式二份，甲乙雙方各執(zhí)一份。本合同未盡事宜，雙方協(xié)商解決。Thiscontractismadetwooriginalcopiesforeachpartyholdonecopy.Anyoutstandingissueshereinshallbesettledbymutualnegotiation.發(fā)包方（甲方）：Employer(PartyA)承包方（乙方）：Contractor(PartyB)代表人：代表人：RepresentativeforRepresentativeforandonbehalfofPartyAandonbehalfofPartyB附件：AppendixGENERALREQUIREMENTS&DESIGNCRITERIA水暖電及空調(diào)通風(fēng)系統(tǒng)安裝技術(shù)要求及設(shè)計(jì)標(biāo)準(zhǔn)PART1:GENERAL第一節(jié)：概述1. SCOPE范圍Theworkscoveredunderthiscontractincludeallthesupply,installation,testinganddeliveringingoodoperatingconditionofcompleteairconditioningandventilationsystems,Plumbing,DrainageandFireProtectiondescribedinthesespecificationsandshownonthedrawings,exceptthefollowingequipment:本合同包括的工作包括這些規(guī)范中描述的和圖紙上顯示的，除下述設(shè)備外的全套空調(diào)和通風(fēng)系統(tǒng)，給排水系統(tǒng)及防火系統(tǒng)在良好操作狀態(tài)下的提供、安裝、檢驗(yàn)及供貨：1. Tocheckthedesignandtoundertaketheresponsibilityofachievingthedesignconditionsintheoccupiedareas.檢查設(shè)計(jì)，負(fù)責(zé)使已占用區(qū)域達(dá)到設(shè)計(jì)條件。1.2 Tosupply,installandcommissiontheairconditioningtothesatisfactionoftheClient.提供，安裝，調(diào)試空調(diào)裝置，使業(yè)主滿意。1.3 Toconnectductsplitunitsdrainstothenearestdrainpoint.將風(fēng)管分體單元的排水管連接到最近的排水點(diǎn)。1.4 INTERPRETATIONOFDOCUMENTSANDDRAWINGS對文件和圖紙的解釋TheEngineer'sspecificationanddrawingshallbeinterpretedinaccordancewithgoodinstallationpracticerelevanttothecircumstances.TheguidelinesofCodesofPracticeoftheBritishstandardsinstitutionandASHRAEstandardswheresuchcodesarerelevantshalltakeprecedenceoverallothersunlessstatedinthisdocument.WheretheEngineer'sdrawingsaretoasmallscaleand/orareexpressedinsymbolictermsorareintheformofanexplanatorydiagram,thenoftheexactlocationordetailofpipes,ducts,cables,valvesorothercomponentsshallnotbeinferred.Anydetailsnotshownorspecifiedbutnecessaryfortheproperinstallationandoperationshallbeincludedinthework,atnoextracostonthecontractprice.對監(jiān)理工程師的規(guī)范和圖紙的解釋，應(yīng)根據(jù)相關(guān)環(huán)境下良好的安裝慣例進(jìn)行。除非本文件另有說明，英國標(biāo)準(zhǔn)協(xié)會(huì)操作規(guī)程指南以及美國采暖,制冷與空調(diào)工程師學(xué)會(huì)ASHRAE標(biāo)準(zhǔn)中相關(guān)規(guī)定應(yīng)優(yōu)先于所有其他規(guī)范。如果監(jiān)理工程師的圖紙的比例較小和/或以象征性條件或以解釋性圖表的格式表示，那么水管、風(fēng)管、電纜、水閥或其他部件的具體位置或詳細(xì)情況不應(yīng)據(jù)此推斷。任何沒有圖示的或規(guī)定的，但對正確安裝及操作所必需的細(xì)節(jié)應(yīng)該包含在工作中，但不應(yīng)增加合同總價(jià)的費(fèi)用。2.2 CO-ORDINATIONOFWORKDONEBYOTHERS與其他承包商完成的工作協(xié)調(diào)Accordingtothetypeofinstallation,afixedsequenceofoperationisrequiredtoproperlyinstallthecompletesystem.ItshallbetheresponsibilityoftheContractortocloselyschedulehisworksothatthisworkwillbeinstalledatthepropertimeandwithoutdelayingthecompletionoftheentireprojectortheworkofothertrades.AndtheContractorshall,withoutextrachargeortime,makeanymodificationinthelayoutasneededtopreventconflictwithothertradesforproperexecution.根據(jù)安裝類型，需需要有一個(gè)固固定的操作順順序來正確安安裝整個(gè)系統(tǒng)統(tǒng)。承包商應(yīng)應(yīng)負(fù)責(zé)緊密安安排自己的工工作，在適當(dāng)當(dāng)時(shí)間進(jìn)行安安裝工作，而而不至于耽誤誤整個(gè)工程的的竣工或其他他專業(yè)的工作作。同時(shí)，承承包商應(yīng)對總總平面圖進(jìn)行行必要的修改改，避免與其其他專業(yè)正常常施工發(fā)生矛矛盾，并不追追加費(fèi)用或工工期。2.3 CEIILINGHEIGHHTS天花板標(biāo)高高Architeccturalldrawwingsshalllbeccheckeedforrceillinghheighttrequuiremeents.RequeestsffordeeviatiionsffromtthesemustbeappproveedbytheEEngineeer.對天花板標(biāo)高的要要求需查閱建建筑圖。要改改變這些要求求必須請求工工程師的批準(zhǔn)準(zhǔn)。2.4 CUTTTINGANDPPATCHIING切割及修補(bǔ)TheConttractoorshaallennsurethatthennecesssaryppipeaandduuctoppeninggsforrthissworkkarebuilttintoothefloorrsanddwalllsintime..承包商需確保這項(xiàng)項(xiàng)工作所必需需的水管和風(fēng)風(fēng)管的開口及及時(shí)修筑在地地板和墻壁內(nèi)內(nèi)。TheConttractoor,shhallssetslleevessforpipessandductssaccuuratellybefforetthecooncretteflooorsaarepooured..Detaailsoofsleeevesareggivenhereiinafteer.ShhouldtheCContraactornegleecttooperfformtthispprelimminaryyworkk,anddshouuldcuuttinggrequuiredinorrderttoinsstallhisppipingg,ducctworkkoreequipmment,theeexpensseofthiscuttiinganndresstorinngofsurfaacetootheiiroriiginallcondditionnshalllbeborneebyttheCoontracctor.承包商應(yīng)在混凝土土地板澆筑前前準(zhǔn)確安裝風(fēng)風(fēng)管和水管的的套管。套管管詳圖在下文文中給出。如如果承包商忘忘記執(zhí)行這一一準(zhǔn)備工作，并并且為了安裝裝水管和風(fēng)管管或設(shè)備需要要進(jìn)行切割，切切割及將表面面恢復(fù)到原先先狀態(tài)的費(fèi)用用應(yīng)當(dāng)由承包包商承擔(dān)。.3.0 GENEERALSSPECIFFICATIIONS一般規(guī)范3.1
