BillofLadingB/LNo.:XXXX(ToBeUsedWithCharter-Parties) Portof PortofdischargeShipper’sdescriptionof Gross (ofwhichXXXXondeckatShipper’srisk;theCarriernotbeingresponsibleforlossordamagehowsoeverarising)FreightpayableasperFEIGHTReceivedonaccountof SHIPPEDatthePortofloadinginapparentgoodorderandconditiononboardtheVesselforcarriagetothePortofDischargeorsoneartheretoasshemaysafelygetthegoodsspecifiedWeight,measure,quality,ty,condition,contentsandvalueunknown.INWITNESSwhereoftheMasterorAgentofthesaidVesselhassignedthenumberofBillsofLadingindicatedbelowallofhistenoranddate,anyoneofwhichbeing plishedtheothersshallbeFORCONDITIONSOFCARRIAGEFreightpayableceanddateofNumberoforiginalFORANDONBEHALFOFMASTEROFTheVESSEL背面BILLOFTOBEUSEDWITHCHARTER-PARTIESCODENAME:"CONGENBILL"EDITION1994ADOPTEDTHEBALTICANDINTERNATIONALMARITIMECOUNCILConditionsofAlltermsandconditions,libertiesandexceptionsoftheCharterParty,datedasoverleaf,includingtheLawandArbitrationClause,areherewithincorporated.)GeneralParamountTheHagueRulescontainedintheInternationalConventionfortheUnificationofcertainrulesrelatingtoBillsofLading,datedBrusselsthe25thAugust1924asenactedinthecountryofshipment,shallapplytothisBillofLading.Whennosuchenactmentisininthecountryofshipment,thecorrespondinglegislationofthecountryofdestinationshallapply,butinrespectofshipmentstowhichnosuchenactmentsarecompulsorilyapplicable,thetermsofthesaidConventionshallapply.TradeswhereHague-VisbyRulesIntradeswheretheInternationalBrusselsConvention1924asamendedbytheProtocolsignedatBrusselsonFebruary23rd1968-theHague-VisbyRules-applycompulsorily,theprovisionsoftherespectivelegislationshallapplytothisBillofLading.TheCarriershallinnocaseberesponsibleforlossofordamagetothecargo,howsoeverarisingpriortoloadingintoandafterdischargefromtheVesselorwhilethecargoisinthechargeofanotherCarrier,norinrespectofdeckcargoorliveanimals.GeneralGeneralAverageshallbeadjusted,statedandsettledaccordingtoYork-AntwerpRules1994,oranysubsequentmodificationthereof,inLondonunlessanotherceisagreedintheCharterParty.Cargo\'scontributiontoGeneralAverageshallbepaidtotheCarrierevenwhensuchaverageistheresultofafault,neglectorerroroftheMaster,PilotorCrew.TheCharterers,ShippersandConsigneesexpresslyrenouncetheBelgianCommercialCode,PartII,Art.148.NewJasonIntheeventofaccident,danger,damageordisasterbeforeorafterthecommencementofthevoyage,resultingfromanycausewhatsoever,whetherduetonegligenceornot,forwhich,orfortheconsequenceofwhich,theCarrierisnotresponsible,bystatute,contractorotherwise,thecargo,shippers,consigneesortheownersofthecargoshallcontributewiththeCarrierinGeneralAveragetothepaymentofanysacrifices,lossesorexpensesofaGeneralAveragenaturethatmaybemadeorincurredandshallpaysalvageandspecialchargesincurredinrespectofthecargo.IfasalvingvesselisownedoroperatedbytheCarrier,salvageshallbepaidforasfullyasifthesaidsalvingvesselorvesselsbelongedtostrangers.SuchdepositastheCarrier,orhisagents,maydeemsufficienttocovertheestimatedcontributionofthegoodsandanysalvageandspecialchargesthereonshall,ifrequired,bemadebythecargo,shippers,consigneesorownersofthegoodstotheCarrierbeforedelivery.Both-to-BlameCollisionIftheVesselcomesintocollisionwithanothervesselasaresultofthenegligenceoftheothervesselandanyact,neglectordefaultoftheMaster,Mariner,PilotortheservantsoftheCarrierinthenavigationorinthemanagementoftheVessel,theownersofthecargocarriedhereunderwillindemnifytheCarrieragainstalllossorliabilitytotheotherornon-carryingvesselorherownersinsofarassuchlossorliabilityrepresentslossof,ordamageto,oranyclaimwhatsoeveroftheownersofsaidcargo,paidorpayablebytheotherornon-carryingvesselorherownerstotheownersofsaidcargoandset-off,recoupedorrecoveredbytheotherornon-carryingvesselorherownersaspartoftheirclaimagainstthecarryingVesselortheCarrier.Theforegoingprovisionsshallalsoapplywheretheowners,operatorsorthoseinchargeofanyvesselorvesselsorobjectsotherthan,orinadditionto,thecollidingvesselsorobjectsareatfaultinrespectofacollisionorcontact.
