/房屋租賃合同出租方(甲方):XXX有限公司Lessor(PartyA):XXXManagementCo.,ltd承租方(乙方):Lessee(PartyB):依據(jù)《中華人民共和國合同法》、《上海市房屋租賃條例》等相關法律法規(guī)的規(guī)定,甲、乙雙方經(jīng)丙方居間介紹,在同等、自愿、公允和誠信的基礎上,經(jīng)協(xié)商一樣,就乙方承租甲方的房屋事宜,簽訂本合同,以資共同遵守:ThisContractismadebyPartyCandbetweenbothpartiesafternegotiationonanequal,voluntary,fairandgood-faithbasisinaccordancewith“ContractLawofthePeople’sRepublicofChina”,“ShanghaiMunicipalityRegulationsontheLeasingofBuildingPremises”andotherrelevantlawsandregulations,withregardtotheissuethatPartyBwillrentthehouseofPartyA:一、出租房屋基本狀況:(下稱“該房屋”,實際狀況以權屬證明或相關法律文書的記載內(nèi)容為準)I.Basicinformationoftheleasedhouse:(hereinafterreferredtoas“thepremises”,andtheactualsituationshallbebasedontheownershipcertificationortherecordsofrelevantlegaldocuments)1.1房屋類型:1.1Typeofthepremises:1.2房屋座落:區(qū)路號室。1.2 ThepremisesaresituatedatRoom,Lane,Road,No.,District1.3房屋用途:1.3Useofthepremises:1.4建筑面積:平方米;1.4Buildingarea:m2;1.5裝修狀況:1.5Decoration:二、租賃用途II.Usageoftherentedpremises乙方向甲方承諾,租賃該房屋作為運用,并遵守國家和本市有關于房地產(chǎn)運用和物業(yè)管理的規(guī)定。 PartyBshallmakecommitmenttoPartyAthatthepremisesshallbeusedasandshallabidebytheregulationsofrealestateuseandpropertymanagementinChinaandShanghaiMunicipality.三、交付日期和租賃期限III.Dateofdeliveryandtermofleasing3.1甲乙雙方約定,甲方應于年月日之前向乙方交付該房屋。交付時甲、乙雙方在丙方見證下簽訂本合同之附件二《房屋交接書》。3.1 BothpartieshaveagreedthatPartyAshallhandoverthepremisestoPartyBbefore,.UnderthewitnessofPartyC,bothpartiesshallsignAppendixII:LetterofHouseHandoveratthetimeofdelivery.3.2該房屋租賃期限自年月日起至年月日止。3.2Thepremisesareleasedfrom,to,.四、租金、支付方式和支付日期IV.Rent,methodandtimeofpayment4.1甲乙雙方約定,該房屋每月租金為(人民幣)元(大寫元整)4.1Bothpartieshaveagreedthattherentofthepremisespermonthis(RMB).4.2租金以個月為一期支付。乙方應于每期提前日前向甲方支付租金。逾期支付的,每逾期一日,則乙方需按月租金的%支付逾期違約金。4.2Therentshallbepaidwithmonthsasapaymentperiod.PartyBshallpaytherentbeforethedayinthefirstmonthofeverypaymentperiod.Incaseofpaymentdelay,thepenaltyshallbecollectedatthedailyrateof%.4.3乙方支付租金的方式如下:甲方收取租金的賬戶如下:戶名:XX有限公司開戶行:XXX銀行賬號:4.3PartyBshallpaytherentbythefollowingmeans:banktransfer.TheaccountofPartyAtoreceivetherent:Accountname:OpeningBank:AccountNo.:.4.4以上租金包含甲方出具租賃發(fā)票的費用、物業(yè)費等。4.4 Theaboverentincludes五、保證金(押金)和其他費用V.Guaranteedeposit(securitydeposit)andotherfees5.1甲乙雙方約定,在簽訂本合同時,乙方應向甲方支付房屋租賃保證金(押金),保證金(押金)為人民幣元(大寫元整)。甲方收取該保證金(押金)后應向乙方出具收款憑證。租賃關系終止時,甲方收取的房屋租賃保證金(押金)除用于抵充本合同約定由乙方擔當?shù)馁M用外,剩余部分無息歸還乙方。5.1Bothpartieshaveagreedthatatthetimeof(□handoverofthepremises□signingthisContract),PartyBshallpayPartyAtheguaranteedeposit(securitydeposit)ofthepremises,whichisequivalenttotherentofmonth(s),thatis,(□RMB□USD□)(SayOnly).Uponreceivingtheguaranteedeposit(securitydeposit),PartyAshallissuethereceiptvouchertoPartyB.Atthetimeoftheterminationofleasingrelation,theguaranteedeposit(securitydeposit)collectedbyPartyAshallbeusedtooffsetthefeesundertakenbyPartyBasagreedinthisContractandtheremainingportionshallbereturnedtoPartyBwithoutinterest.5.2租賃期間內(nèi)發(fā)生的電費、電話(通訊)費等房屋運用費用由乙方擔當;物業(yè)管理費由甲方擔當。5.2Thecostarisingfromwater,electricity,gas,telephonecall(communication)andTVandsoon(etc.)duringtheleasingperiodshallbeundertakenbyPartyB;propertymanagementfeeshallbeundertakenby(□PartyA□PartyB).六、房屋運用要求和修理責任VI.Houseuserequirementsandmaintenanceresponsibility6.1租賃期間,乙方發(fā)覺該房屋及其附屬設施有損壞或故障時,應剛好通知甲方修復;甲方應在接到乙方通知后的日內(nèi)進行修理。逾期不修理的,乙方可代為修理,費用由甲方擔當。6.1Duringtheleasingperiod,ifPartyBdiscoversanydamageortroublewiththepremisesandtheaccessoryfacilities,PartyBshalltimelynotifyPartyAforrepair;PartyAshallcarryouttherepairwithinday(s)afterreceivingthenotification.Incaseofdelayofrepair,PartyBmaymaketherepairinplaceofPartyAatthecostofPartyA.6.2租賃期間,乙方應合理運用并疼惜該房屋及其附屬設施。因乙方運用不當或不合理運用,致使該房屋及其附屬設施損壞或發(fā)生故障的,乙方應負責修理。乙方拒不修理的,甲方可代為修理,費用由乙方擔當。6.2Duringtheleasingperiod,PartyBshallmakereasonableuseofthepremisesandtheaccessoryfacilities.AnydamageortroublearisingfromimproperuseorunreasonableuseofthepremisesandaccessoryfacilitiesshallberepairedbyPartyB.IntheeventthatPartyBrefusestherepair,PartyAmaycarryouttherepairinplaceofPartyBatthecostofPartyB.6.3租賃期間,甲方應保證該房屋及其附屬設施處于正常的可運用和平安的狀態(tài)。甲方對該房屋進行檢查、養(yǎng)護,應提前日通知乙方。檢查養(yǎng)護時,乙方應予以協(xié)作。甲方應削減對乙方運用該房屋的影響。6.3Duringtheleasingperiod,PartyAshallensurenormalavailabilityandsafestatusofthepremisesandaccessoryfacilities.IfPartyAintendstocarryoutinspectionandmaintenanceonthepremises,PartyAshallnotifyPartyBdaysinadvance.Duringtheinspectionandmaintenance,PartyBshallprovidecoordination.PartyAshallminimizetheinfluenceontheuseofthepremises.6.4乙方需裝修或者增設附屬設施和設備的,應事先征得甲方的書面同意,按規(guī)定須向有關部門報批的,則應由甲方報請有關部門批準后,方可進行。乙方增設的附屬設施和設備的歸屬及其修理責任由甲、乙雙方另行書面約定。6.4IncasethatPartyBintendstodecoratethepremisesoraddaccessoryfacilitiesandequipments,PartyBshallobtainwrittenpermissionfromPartyAinadvance;ifitisrequiredso,(□PartyA□PartyBentrustedbyPartyA)shallsubmitsuchbehaviortothecompetentdepartmentforapprovalbeforetheimplementation.TheownershipandmaintenanceoftheaccessoryfacilitiesandequipmentsaddedbyPartyBshallbeadditionallyagreedbybothpartiesinwrittenform.七、房屋返還和續(xù)租VII.Housereturnandrentingrenewal7.1乙方應在本合同的租賃期限屆滿之后的日內(nèi)返還該房屋,未經(jīng)甲方同意逾期返還該房屋的,每逾期一日,乙方應以日租金%向甲方支付該房屋占用期間的運用費。7.1PartyBshallreturnthepremiseswithindaysaftertheterminationoftheleasingperiod,andincaseofanydelayforthereturnofthepremiseswithoutpermissionofPartyA,PartyBshallpayPartyAtheusefeeofthepremisesatthedailyrateequivalentto%ofdailyrentduringtheoccupationofthepremises.7.2乙方假如須要續(xù)租的,應在租賃期限屆滿兩個月之前向甲方提出,甲方同意的,雙方另行簽訂相關續(xù)租文書。乙方在同等條件下享有優(yōu)先承租權。7.2 IncasethatPartyBwantstorenewtheContract,PartyBshallraisetherenewalintentiontoPartyAtwomonthsbeforetheterminationoftheleasingperiod,andwiththeapprovalofPartyA,therenewalcontractwillbeadditionallysignedbetweenbothparties.Undertheequivalentcondition,PartyBshallhavethepriorityforobtainingthelease.7.3租賃期限屆滿,甲乙雙方未續(xù)簽租賃合同,乙方接著支付租金,甲方未表示拒絕的,則按法律相關規(guī)定,雙方之間成立不定期租賃關系。在不定期租賃關系中,甲方有權提前一個月通知乙方租賃關系終止。7.3 Aftertheterminationoftheleasingperiod,ifnorenewalcontractissignedbybothpartiesandPartyBcontinuespayingtherent,whichisnotrefusedbyPartyA,thenon-fixed-termleasingrelationsareestablishedbetweenbothpartiesaccordingtorelevantlawsandregulations.Duringsuchnon-fixed-termleasingrelations,PartyAshallhavetherighttoterminatetheleasingrelationsbynotifyingPartyBone(1)monthinadvance.7.4乙方返還該房屋應符合正常運用后的狀態(tài)。返還時,應經(jīng)甲方驗收認可,并相互結(jié)清各自應當擔當?shù)馁M用。7.4 ThepremisesreturnedbyPartyBshallbeconsistentwiththestatusafternormaluseofthepremises.Uponreturnofthepremises,PartyBshallinspectthepremisesbeforeitsacceptanceandtherelevantfeesforrespectivepartiesshallbesettled.八、轉(zhuǎn)租和轉(zhuǎn)讓VIII.Subleaseandtransfer8.1除甲方已經(jīng)在本合同中同意乙方轉(zhuǎn)租外,乙方在租賃期限內(nèi),不行將該房屋部分或全部轉(zhuǎn)租給他人。8.1 ExceptthatPartyAagreesinthisContractthatthepremisesmaybesubleasedbyPartyB,PartyBshallnotsubleasepartorallofthepremisestoanyotherpersonwithintheleasingperiod,withoutwrittenpermissionofPartyA.Anyhowonelivingroomintheoriginalhouseholdtypeshallnotbeseparatedforsubleasing.九、解除合同的條件IX.Conditionsforcontractcancelation9.1甲乙雙方同意在租賃期限內(nèi),有下列情形之一的,本合同終止,雙方互不擔當責任:9.1Bothpartiesagreethatduringtheleasingperiod,thisContractshallbeterminatedneitherpartyneedingtoassuminganyresponsibilityincaseofanyofthefollowingsituations;(一)該房地產(chǎn)占用范圍內(nèi)的土地運用權依法提前收回的;(1)Theuserightofthelandoccupiedbytherealestatehasbeenlegallyretrieved;(二)該房地產(chǎn)因社會公共利益被依法征用的;(2)Thepremisesareoccupiedbymeansoflegalrequisitionduetosocialandpublicinterests;(三)該房地產(chǎn)因城市建設須要被依法列入房屋拆遷許可范圍內(nèi)的;(3)Thisrealestatehastobelegallyputintothedismantlingrangeduetourbanconstruction;(四)該房屋毀損、滅失或者被鑒定為緊急房屋的;(4)Thepremisesaredamaged,destroyedorverifiedasdangeroushouse;(五)甲方已告知乙方該房屋出租前已設定抵押,現(xiàn)被處分的;(5)PartyAhasnotifiedPartyBthatthepremiseshavebeenpledgedbeforeleasingandnowhasbeendisposed;9.2甲乙雙方同意,有下列情形之一的,一方可書面通知另一方解除本合同。違反合同的一方,應向另一方按月租金的倍支付違約金,給對方造成損失的,支付的違約金不足以抵付損失的,還應賠償造成的損失和違約金的差額部分:9.2 BothpartiesagreethateitherpartymaynotifytheotherpartytocancelthisContractinwrittenformincaseofanyofthefollowingsituation,andthepartythatbreachesthisContractshallpaytheotherpartytheliquidateddamagesequivalenttotime(s)ofthemonthlyrent,andincasethatthelossesincurredtobothpartiescannotbeoffsetbytheliquidateddamagespaidbythebreachingparty,thebreachingpartyshallpaythedifferencebetweentheincurredlossesandtheliquidateddamages;(一)甲方未按時交付該房屋,經(jīng)乙方催告后日仍未交付的;(I)PartyAfailstohandoverthepremisesontime,andevendaysafterexigentnoticeofPartyB;(二)甲方交付的該房屋不符合本合同的約定,致使不能實現(xiàn)租賃目的的;或甲方交付的房屋存在缺陷,危及乙方平安的;(II)ThepremiseshandedoverbyPartyAdonotcomplywiththeagreementinthisContract,whichthereforemakesitimpossibletorealizetheleasingpurpose;orthepremiseshandedoverbyPartyAhavethedefectsendangeringthesafetyofPartyB;(三)乙方在甲方按時交付該房屋的情形下,未能協(xié)作辦理交房手續(xù),經(jīng)甲方催告后日仍未協(xié)作辦理交房手續(xù)的;(III)InspiteofthetimelyhandoverofthepremisesbyPartyA,PartyBfailstocooperatetogothroughtheproceduresforthehandoverofthepremisesdaysaftertheexigentnoticeofPartyA;(四)乙方未征得甲方書面同意變更該房屋用途,致使該房屋損壞的;(IV)PartyBchangedtheuseofthepremiseswithoutwrittenpermissionofPartyAandthereforeincurredthedamageofthepremises;(五)因乙方緣由造成該房屋主體結(jié)構損壞的;(V)ThemainstructureofthepremisesisdamagedduetothereasonsofPartyB;(六)乙方擅自轉(zhuǎn)租該房屋或轉(zhuǎn)讓該房屋承租權的;(VI)PartyBsubleasesthepremisesortransferstheleasingrightofthepremiseswithoutpermissionofPartyA;(七)乙方逾期不支付租金累計超過天的;(VII)Partyfailstopaytherentuptomorethandays;十、違約責任X.Breachingliability10.1該房屋交付時存在缺陷的,甲方應自交付日起日內(nèi)進行修復,逾期不修復的,甲方同意削減租金并變更有關租金條款。10.1Incaseofanydefectwiththepremisesatthetimeofhandover,PartyAshallmaketherepairwithindaysafterthehandover,andifnorepairismadeevenafterthestipulatedperiod,PartyAagreestoreducetherentandchangetheclauserelatedtotherent.10.2租賃期間,甲方不剛好履行本合同約定的修理和養(yǎng)護責任,致使該房屋損壞,造成乙方財產(chǎn)損失或人身損害的,甲方應擔當賠償責任。10.2Duringtheleasingperiod,PartyAfailstotimelyperformthemaintenanceresponsibilityofthepremisesasagreedintheContract,whichthereforehasincurredthedamageofthepremises,thenanypropertylossorpersonalinjuryincurreduponPartyBshallbecompensatedbyPartyA.10.3租賃期間,非本合同規(guī)定的狀況,甲方擅自解除本合同,提前收回該房屋的,甲方應按月租金的倍向乙方支付違約金。若違約金不足以抵付乙方損失的,甲方還應負責賠償。10.3Duringtheleasingperiod,PartyAunilaterallycancelledthisContractandtookbackthepremisesinadvanceincaseofthesituationsotherthanthosestipulatedintheContract,PartyAshallpayPartyBtheliquidateddamagesequivalenttotimesofmonthlyrent.IftheliquidateddamagescannotcompensateforthelossincurreduponPartyB,PartyAshallprovidefurthercompensation.10.4乙方未征得甲方書面同意或者超出甲方書面同意的范圍和要求裝修房屋或者增設附屬設施和設備的,甲方可以要求乙方復原房屋原狀或賠償損失。10.4 IfPartyBdecoratesthepremisesoraddstheaccessoryfacilitiesorequipmentswithoutwrittenpermissionofPartyAorbeyondthescopeandrequirementsagreedinwrittenpermissionofPartyA,PartyAmayrequirePartyBtorecoverthepremisestotheoriginalstate,orcompensatefortheloss.10.5租賃期間,非本合同規(guī)定的狀況,乙方中途擅自退租的,乙方應按月租金的倍向甲方支付違約金。若違約金不足以抵付甲方損失的,乙方還應負責賠償。10.5Duringtheleasingperiod,incaseofthesituationotherthanthosestipulatedintheContract,PartyBstopstherenting,PartyBshallpayPartyAtheliquidateddamagesequivalenttotime(s)ofmonthlyrent.IftherentisnotenoughtooffsetthelossincurreduponPartyA,PartyBshallprovidefurthercompensation.十一、其他條款XI.Others11.1本合同及附件一自甲、乙雙方于本合同簽章處簽字或簽章后立刻生效。11.1ThisContractanditsAppendixIshallcomeintoeffectuponthesignaturesorsealstampingofPartiesAandB.11.2本合同空格處填寫文字和鉛印文字具有同等法律效力,若填寫文字和鉛印文字相沖突,以填寫文字為準。若有未盡事宜,可簽訂補充協(xié)議進行約定,若補充協(xié)議和本協(xié)議相沖突,以補充協(xié)議為準。11.2 ThewordsfilledandprintedintheblankpartofthisContractshallhavesamelegalforcewiththeContractitself,andincaseofanyconflictbetweenthefilledwordsandprintedwords,thefilledwordsshallprevail.Foranyuncoveredmatter,supp
