Chapter1GeneralProvisions

Article1TheseRulesarerormulatedinaccordancewiththeprovisionsoftherelevantlawsanddecreesforthepurposeofstrengtheningtheadministrationofemploymentofforeignersinChina.

Article2Theterm〃foreigners“intheseRulesreferstothepersons,whoundertheNationalityLawofthePeople'sRepublicofChina,donothaveChinesenationality.

Theterm^employmentofforeignersinChina"intheseRulesreferstoactsofforeignerswithoutpermanentresidencestatustoengageinremunerativeworkwithinChineseterritoryinaccordancewithitlaws.Article3TheseRulesshallapplytoemployedforeignerswithinChineseterritoryandtheiremployers.

TheseRulesshallnotapplytoforeignerswhoenjoydiplomaticprivilegesandimmuniLiesemployedbyforeignembassiesorconsulates,ortheofficesoftheUnitedNationsandotherinternationalorganizationsinChina.

Article4Thelabouradministrativeauthoritiesofthepeople'sgovernmentoftheprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentandthoseattheprefectureandcitylevelwiththeirauthorizationareresponsiblefortheadministrationofemploymentofforeignersinChina.

ChapterIIEmploymentLicense

Article5TheemployershallapplyCortheemploymentpermissionifitintendstoemployforeignersandmaydosoafterobtainingapprovalandThePeople'sRepublicofChinaEmploymentLicenseforForeigners(hereinafterreferredtoastheEmploymentLicense").

Article6Theposttobefilledbytheforeignerrecruitedbytheemployershallbethepostofspecialneed,apostthat,cannotbefilledbyanydomesticcandidatesforthetimebeingbutviolatesnogovernmentregulations.

Noemployershallemployforeignerstoengageincommercializedentertainingperformance,exceptforthepersonsqualifiedunderArticle9(3)oftheseRules.

Article7AnyforeignersseekingemploymentinChinashallmeetthefollowingconditions:

18yearsofageorolderandingoodhealth;

withprofessionalskillsandjobexperiencerequiredfortheworkofintendedemployment;

withnocriminalrecord;

aclearly-definedemployer;

withvalidpassportotherinternationaltraveldocumentinlieuofthepassport(hereinafterreferredtoasthe“TravelDocument").

Article8ForeignersseekingemploymentinChinashallholdtheEmploymentVisasfortheirentry(Incaseofagreementformutualexemptionofvisas,theagreementshallprevail.),andmayworkwithinChineseterritoryonlyaftertheyobtaintheEmploymentPermitforForeigner(hereinafterreferredtoasthe^EmploymentPermit")andtheforeignerresidencecertificate.

Foreignerswhohavenotbeenissuedresidencecertificate(i.e.holdersofF,L,CorG-typesvisas),andthosewhoareunderstudyorinterimprogramsinChinaandthefamiliesofholdersofEmploymentVisasshal1notworkinChina.Inspecialcases,employmentmaybeallowedwhentheforeignerchangeshisstatusatthepublicsecurityorganswiththeEmploymentLicensesecuredbyhisemployerinaccordancewiththeclearanceprocedures,undertheseRulesforeignerschangeshisstatusatthepublicsecurityorganswiththeEmploymentLicenseandreceiveshisEmploymentpermitandresidencecertificate.

TheemploymentinChinaofthespousesofthepersonnelofforeignembassies,consulates,representativeofficesoftheUnitedNationsSystemandotherinternationalorganizationinChinashallfollowtheProvisionsofMinistryofForeignAffairsofthePeople'sRepublicofChinaConcerningtheEmploymentoftheSpousesofthePersonnelofForeignEmbassies,ConsulatesandtheRepresentativeOfficesoftheUnitedNationsSysteminChinaandbehandledinaccordancewiththeclearanceproceduresprovidedforinthesecondparagraphofthisarticle.

TheEmploymentLicenseandtheEmploymentPermitshallbedesignedandpreparedexclusivelybytheMinistryofLabour.夕卜Article9ForeignersmaybeexemptedfromtheEmploymentLicenseandEmploymentpermitwhentheymeetanyofthefollowingconditions:

foreignprofessionaltechnicalandmanagerialpersonnelemployeddirectlybytheChinesegovernmentorthosewithseniortechnicaltitlesorcredentialsofspecialskillsrecognizedbytheirhomeorinternationaltechnicalauthoritiesorprofessionalassociationstobeemployedbyChinesegovernmentorgansandinstitutionsandforeignersholdingForeignExpertCertificateissuedbyChina'sBureauofForeignExpertAffairs;

foreignworkerswithspecialskillswhowokinoffshorepetroleumoperationswithouttheneedtogoashoreforemploymentandhold“WorkPermitforForeignPersonnelEngagedintheOffshorepetroleumOperationsinthepeople'sRepublicofChina”;

foreignerswhoconductcommercializedentertainingperformancewiththeapprovaloftheMinistryofCultureandhold/zpermitforTemporaryCommercializedPerformance”.

Article10ForeignersmaybeexemptedfromtheEmploymentLicenseandmayapplydirectlyfortheEmploymentPermitbypresentingtheirEmploymentVisasandrelevantpapersaftertheirentrywhentheymeetanyofthefollowingconditions:

foreignersemployedinChinaunderagreementsoraccordsenteredintobytheChinesegovernmentwithforeigngovernmentsorinternationalorganizationsfortheimplementationofSino-foreignprojectsofcooperationandexchange;

chiefrepresentativesandrepresentativesofthepermanentofficesofforeignenterprisesinChina.

ChapterIIIApplicationandApproval

Article11TheemployerWhenintendingtoemployaforeigner,stallfillouttheApplicationFormfortheEmploymentofForeigners(hereinafterreferredtoasthe,'ApplicationForm")andsubmitittoitscompetenttradeauthoritiesatthesamelevelasthelabouradministrativeauthoritiestogetherwiththefollowingdocumentations:

thecurriculumviLaeoftheforeignertobeemployed;

theletterofintentionforemployment;

thereportofreasonsforemployment;

thecredentialsoftheforeignerrequiredfortheperformanceofthejob;

thehealthcertificateoftheforeignertobeemployed;

otherdocumentsrequiredbyregulations.

ThecompetenttradeauthoritiesshallexamineandapprovetheapplicationinaccordancewithArticles6and7oftheseRulesandrelevantlawsanddecrees.

Article12Aftertheapprovalbythecompetenttradeauthorities,theemployershalltaketheApplicationFormtothelabouradminisIllativeauthoritiesofiheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentorthelabouradministrativeauthoritiesattheprefectureandcitylevelwherethesaidemployerislocatedforexaminationandclearance.Thelabouradministrationauthoritiesdescribedaboveshalldesignateaspecialbody(hereinafterreferredtoasthe''CertificateOffice")totakeuptheresponsibilityofissuingtheEmploymentLicense.TheCertificateOfficeshouldtakeintoconsiderationoftheopinionsofthecompetenttradeauthoritiesandthedemandandsupplyoflabourmarket,andissuetheEmploymentLicensetotheemployerafterexaminationandclearance.

Article13EmployersattheCentrallevelorthosewithoutthecompetenttradeauthoritiesmaysubmittheirapplicationdirectlytotheCertificateOfficeofthelabouradministrativeauthoritiesfortheEmploymentPermit.

TheexaminationandapprovalbythecompetenttradeauthoritiesisnoLrequiredforforeign-fundedenterprisestoemployforeigners,andsuchenterprisesmaysubmittheirapplicationsdirectlytotheCertificateOfficeofthelabouradministrativeauthoritiesfortheEmploymentLicense,bringingwiththemthecontract,articlesofassociation,certificateofapproval,businesslicenseandthedocumentationreferredtoinArticle11oftheseRules.

Article14EmployerswithpermissiontoemployforeignersshallnotsendtheEmploymentLicensenortheletterofvisanotificationdirectlytoheforeignerstobeemployedlandtheymustbesentbytheauthorizedunit.Article15ForeignerwithpermissiontoworkinChinashouldapplyforEmploymentVisasattheChineseembassies,consulatesandvisaoffices,bringingwiththemtheEmploymentLicenseissuedbytheMinistryofLabour,theletterortelexofvisanotificationsentbytheauthorizedunitandthevalidpassportorTravelDocument.

PersonnelreferredtoinArticle9(1)oftheseRulesshouldapplyfortheEmploymentVisasbypresentingtheirletterortelexofvisanotificationbyauthorizedunit;personnelreferredtoinArticle9(2)shouldapplyfortheEmploymentVisasbypresentingtheirletterortelexofvisanotificationissuedbytheChinaNationalOffshoreOilCorporation;personnelreferredtoinArticle9(3)shouldapplyfortheEmploymentVisasbypresentingtheirletteroftelexofvisanotificationissuedbytheforeignaffairsofficeunderthepeople,sgovernmentofprovinces,autonomousregionsormunicipalitiesdirectlyundertheCentralGovernmentandtherelevantdocumentsofapprovaloftheMinistryofCulture(addressedtoIheChineseemb社ssies,consulatesorvis社。[fices).

PersonnelreferredtoinArticle10(1)oftheseRulesshouldapplyfortheEmploymentVisasbypresentingtheirletterortelexofvisanotificationbyauthorizedunit,andthedocumentationonprojectsofcooperationandexchange;personnelreferredtoinArticle10(2)shouldapplyfortheEmploymentVisasbypresentingtheirletterortelexofvisanotificationbytheauthorizedunitandtheregistrationcertificationissuedbytheadministrativeauthoritiesofindustryandcommerce.Article16Theemployershould,withinfifteendaysaftertheentryoftheemployedforeignertaketotheoriginalCertificateOfficetheEmploymentLicensethelabourcontractwiththesaidforeignerandhispassportorTravelDocumenttoreceivehisEmploymentPermitwhilefillingouttheForeignerEmploymentRegistrationForm.

TheEmploymentPermitshallbeeffectiveonlywithintheareaspecifiedbytheCertificateOffice.

Article17ForeignerswhoreceivedtheirEmploymentPermitshould,withinthirtydaysaftertheirentry,applyfortheresidencecertificatewiththepublicsecurityorgansbringingwiththemtheirEmploymentPermit.ThetermofvalidityoftheresidencecertificatemaybedeterminedinaccordancewiththetermofvalidityoftheEmploymentPermit.

ChapterIVLabourAdnlinistration

Article18Theemployeranditsforeignemployeeshould,inaccordancewithlaw,concludealabourcontract,thetermofwhichshallnotexceedfiveyears.SuchcontractmaybereneweduponexpirationafterthecompletionofclearanceprocessinaccordancewithArticle19oftheseRules.

Article19TheEmployment.Permitoftheemployedforeignershallceasetobeeffectiveupontheexpirationofthetermofthelabourcontractbetweentheforeignerandhisemployer.Ifrenewalisrequired,theemployershould,withinthirtydayspriortotheexpirationofthecontract,submitanapplicationtothelabouradministrativeauthoritiesfortheextensionoftermofemployment,andafterapprovalisobtained,proceedtogothroughformalitiesfortheextensionoftheEmploymentPermit.

Article20I'heforeignemployeeshould,withintendaysafterobtainingtheapprovalforextensionofhistermofemploymentinchinaorthechangeofhisemploymentlocationorhisemployer,gothroughformalitiesfortheextensionorchangedhisresidencecertificateatthelocalpublicsecurityorgans.提供

Article21Aftertheterminationofthelabourcontractbetweentheforeignemployeeandhisemployer,theemployershouldprompt.lyreportittothelabourandpublicsecurityauthorities,returntheEmploymentPermitandtheresidencecertificateofthesaidforeigner,andgothroughformalitiesforhisexit,fromChina.公司b

Article22Thewagepaidtotheforeignemployeebytheemployershallnotbelowerthantheminimumwageinthelocality.

Article23Theworkinghours,restandvacation,worksafetyandhygieneaswellasthesocialsecurityoftheforeignemployeesinChinashallfollowtherelevantprovisionsofthestate.

Article24TheemployeroftheforeignemployeeinChinashallbethesameasspecifiedinhisEmploymentLicense.

WhentheforeignerswitchesemployerswithintheareadesignatedbytheCertificateOfficebutslaysinajobofthesamenature,thechangemustbeapprovedbytheoriginalCertificateOfficeandrecordedinhisEmploymentPermit.

IftheforeigneristobeemployedoutsidetheareadesignatedbytheCertificateOfficeorswitchemployerwithinoriginaldesignatedareawhiletakingupjobsofadifferentnature,hemustgothroughformalitiesforanewEmploymentLicense.

Article25ForforeignerwhoseresidencestatusisrevokedbypublicsecurityorgansduetohisviolationofChineselaw,hislabourContractshouldbeterminatedbyhisemployerandhisEmploymentPermitbewithdrawnbythelabouradministrativeauthorities.

Article26ShouldthelabourdisputesarisebetweentheemployerandiIsforeignemployee,theyshouldbehandledinaccordanceWiththeLabourLawofthePeople'sRepublicofChinaandtheRegulationsofthepeople'sRepublicofChinaonSettlementofLabourDisputesinEnterprises.

Article27ThelabouradministrativeauthoritiesshallconductanannualinspectionoftheEmploymentPermit.Withinthirtydayspriortheenclofeveryyearofemploymentoftheforeigner.TheemployershouldgothroughformalitiesoftheannualinspectionattheCertificateOfficeofthelabouradministrativeauthorities.TheEmploymentPermitshallautomaticallyceasetobeeffectivewhenthedeadlineispassed.

IncaseoflossordamageoftheEmploymentPermitduringthetermofhisemploymentinChina,theforeignershouldpromptlyreportittotheoriginalCertificateOfficeandgothroughformalitiesforLheissuanceoftheEmploymentPermit.

ChapterVPenaltyProvisions

Article28ViolationoftheseRules,i.e.ForeignerswhoworkwithouttheEmploymentPermitoremployerswhichhireforeignerswithouttheEmploymentLicense,shallbehandledbythepublicsecurityorgansinaccordancewithArticle44oftheRulesGoverningtheImplementationoftheLawofthepeople5sRepublicofChinaontheEntryandExitofAliens.Article29ForforeignerswhorefusetohavetheirEmploymentPermitinspectedbythelabouradministrativeauthorities,changetheiremployersandprofessionsatwillorextendtheirtermofemploymentwithoutpermission,thelabouradministrativeauthoritiesshallwithdrawtheirEmploymentpermitandrecommendthattheirresidencestatusbecanceledbythepublicsecurityorgansincaseofdeportation,thecostsandexpensesshal1bebornebythesaidforeignertheiremployers.Article30Forforeignersandemployerswhoforge,alter,falselyuse,transfer,buyandselltheEmploymentPermitandtheEmploymentLicense,ThelabouradministrativeauthoritiesshalltakeovertheEmployment.PermitandtheEmploymentLicenseinquestion,confiscatetheillegalproceedsandimposeafinebetweententhousandandonehundredthousandRMBYuan.Inseriouscaseswhichconstituteacrime,theircriminalresponsibilityoftheperpetratorsshallbelookedintobythejudicialauthorities.

Article31Incaseofabuseofpower,illegalcollectionoffees,andfraudulentpracticesonthepartofofficialpersonneloftheCertificateOfficeorotherdepartment,
