第頁(yè)共頁(yè)物品租賃合同中英文翻譯物品租賃合同匯總物品租賃合同中英文翻譯物品租賃合同篇一出租人lessor:______________(以下簡(jiǎn)稱(chēng)甲方hereafterreferredtoas“partya”)tel:______________手機(jī)mobile:______________承租人lessee:(以下簡(jiǎn)稱(chēng)乙方hereafterreferredtoas“partyb”)通訊地址mailadd:tel:fax:住客姓名theoccupantsofthepremiseswillbe:甲、乙雙方經(jīng)協(xié)商一致,訂立本合同。合同內(nèi)容如下:thisleasehasbeenmutualagreedandsetupbypartyaandpartybasthefollowing:1出租物業(yè)thepremisestobeleasedaredescribedasfollows:地址location:面積area:tel:_____條idd直線,____iddlines2租金rental:2.1租金每月為元整,形式支付partybshallpayasrentthesumof;permonth.2.3租金應(yīng)在入住前及此后每月的號(hào)前支付。甲方應(yīng)在收到租金后向乙方開(kāi)具正式發(fā)票。甲方應(yīng)每月提早向乙方發(fā)出支付租金的書(shū)面通知。2.4租金以人民幣支票或轉(zhuǎn)賬形式支付.rentalispayableinrenminbibycheckorbybanktransfer.2.5在本租約有效期內(nèi),租金不予調(diào)整。rentwillnotbemodifiedduringthetermofthisleaseagreement.3押金deposit:3.1乙方須支付相當(dāng)于兩個(gè)月房租的押金(即rmb),以人民幣支票或轉(zhuǎn)帳形式支付)。甲方應(yīng)在收到押金后向乙方開(kāi)具統(tǒng)一收據(jù)。adepositoftwo(2)months’equivalentrental(rmb)shallbepaidbypartybinrmbbycheckorbybanktransfer.partyashallissuetopartybofficialreceiptuponreceivingthedeposit.3.2押金在合同終止后10天內(nèi)由甲方以一樣幣種全額退還給乙方(不計(jì)利息)。假如延期返還,那么每延期一日,按每日萬(wàn)分之四支付給乙方利息。thedepositshallberefundableinfullamountin10daysafterthecontractexpiration,insamecurrencyandexcludinginterestthereupon.incasepartyadelaystherefundofthedeposit,partyashallpayinteresttopartybattherateof0.04%perdayofdelay.3.3甲方應(yīng)按時(shí)付清各種帳單。假設(shè)以上出租房屋及其家具、設(shè)備等因乙方原因出現(xiàn)遺失或非正常的損壞,乙方應(yīng)負(fù)責(zé)賠償。partyashallpayoffontimeallthebillsdue.incasethereisanylossorunusualdamagetothefurnishings,contentsortherentalpremisesduetopartyb’sreason,partybshallpensateforit.4租期leaseterm:乙方租用出租房屋期限為1年,即自年月日至年月日。from16july2023to15july2023forone(1)year.5出租人的責(zé)任partya’sobligation:5.13甲方聲明及保證甲方為該出租房屋的合法擁有人,有合法地位出租此房屋,并就出租事宜已獲得有關(guān)方面的批準(zhǔn)。partyaassurestobethelegalowneroftheleasedpremises,tohavethenecessarylegalcapacitytoleaseit,andpartya’actionhasbeenratifiedbytheauthoritiesconcerned.5.2租賃期內(nèi),假設(shè)甲方出售該出租房屋導(dǎo)致該出租房屋所有權(quán)發(fā)生轉(zhuǎn)移,甲方須保證本合同能繼續(xù)執(zhí)行。incasepartyasellsthepremisesduringtheleasewhichleadstothepremisesownershipbetransferred,partyashallensurethatthesaidcontractwillbeimplementedcontinuously.5.3甲方須按時(shí)將清潔狀況良好的出租房屋交付乙方使用,保證在租賃期內(nèi)出租房屋內(nèi)的各項(xiàng)設(shè)施能正常使用。partyashallhandoverthesaidpremisestopartybontimeandassurethesaidpremiseswillbecleanedandingoodstatusduringtheleaseterm.5.4甲方有義務(wù)負(fù)責(zé)出租房屋及設(shè)施的正常維護(hù)和保養(yǎng),如房屋或設(shè)施非因甲方原因出現(xiàn)故障,甲方應(yīng)在收到乙方通知后二十四(24)小時(shí)內(nèi)自行或通過(guò)其他方式解決故障,否那么,乙方有權(quán)雇傭第三方進(jìn)展維修,由甲方承當(dāng)所有費(fèi)用并承當(dāng)相關(guān)責(zé)任。由于不可抗力(如地震、臺(tái)風(fēng)、洪水、非人為的火災(zāi)等)、自然損耗或乙方以外的原因造成的損壞,亦由甲方承當(dāng)有關(guān)費(fèi)用。partyashallbeartheresponsibilityofthesaidpremises’normalrepairsandmaintenance,andpaythecostrelated.incasethepremisesorfacilitiesareinbadconditionsnotduetothereasonofpartyb,partyashallpletetherepairworkwithin24hoursuponreceiptofthenoticefrompartyb.otherwise,partybshallhavetherighttohireanythirdpartiesfortherepairworkatthecostofpartya.thecostofrepairstothesaidpremises,ifdamagedbyforcemajeure(suchasearthquake,typhoon,floodnon-manmadefire,etc)reasonablewearandtearorbyaccidentsbeyondpartyb’scontrol,shouldalsobebornebypartya.5.5租賃期內(nèi),在乙方遵守合同及支付租金的前提下,未經(jīng)乙方允許,甲方不得進(jìn)入該出租房屋。duringthelease,partyashallnotgetinthesaidpremiseswithoutpartyb’spermissionifpartybhasbeencarryingoutthecontractnormally.5.6甲方應(yīng)催促管理公司向乙方提供足夠的效勞,如冷水、熱水、煤氣,電的供給及各種設(shè)備的正常工作。partyashalldirectpropertymanagementpanytoprovidesufficientandcontinuousservicestopartyb,includingprovisionofcoldwater,hotwater,gasandelectricityandensurepropermaintenanceofequipmenttherein.5.7房產(chǎn)稅及與租賃有關(guān)的所有稅費(fèi)由甲方承當(dāng)。premisestaxandotherleasingrelatedtaxesshallbepaidbypartya.6承租方的責(zé)任partyb’sobligations:6.1乙方申明及保證其在中國(guó)擁有合法居留權(quán),并按有關(guān)規(guī)定辦理必要的居住登記手續(xù)。partybassurestohavethelegalrightofresidenceinchina,andshallpletetheresidentialformalitiesplyingwiththelocalregulations.6.2住客應(yīng)按時(shí)支付費(fèi)含上網(wǎng)費(fèi)、水電煤氣費(fèi)。theoccupantshallpaythetelephonebillsandinterfee,extrawaterelectricitygasfeeontime.6.3乙方只能將出租房屋用做住宅,不得將之用作公司及代表處的注冊(cè)地址,亦不可作為公開(kāi)的辦公室。thepremisesarelimitedforresidentialuseonlybypartyb,andareprohibitedfromregisteringaslegaladdressforanypanyoragency,orusingaspublicoffice.6.4乙方不得在出租房屋內(nèi)進(jìn)展違背法律及政府對(duì)出租房屋用處有關(guān)規(guī)定的行為。partybshallnotcarryinthepremisesanyunlawfulorillegalactivitieswhicharenotallowedaccordingtotheleasingregulationsfromthegover____ent.6.5租賃期內(nèi),未經(jīng)甲方書(shū)面同意,乙方不得將出租房屋局部或全部轉(zhuǎn)租別人。partybshallnotpartlyortotallysubletthesaidpremiseswithoutthewrittenpermissionfrompartya.6.6假設(shè)因乙方使用不當(dāng)或不合理使用,出租房屋及其內(nèi)的設(shè)施出現(xiàn)損壞或發(fā)生故障,乙方應(yīng)及時(shí)聯(lián)絡(luò)管理機(jī)構(gòu)或甲方進(jìn)展維修,并負(fù)責(zé)有關(guān)維修費(fèi)用.thedamageofthepremisesorthefittingsthatarewithinthecontrolofpartybshallbebornebypartyb,andpartybshallcontactthemanagementofficeorpartyainstantly.6.7租賃期內(nèi),乙方對(duì)出租房屋進(jìn)展裝修或增加水、電、消防等設(shè)施,須經(jīng)甲方同意并經(jīng)有關(guān)部門(mén)批準(zhǔn),并由甲方執(zhí)行監(jiān)理,所需費(fèi)用由乙方承當(dāng)。雙方解約時(shí),乙方不能移走自行添加的構(gòu)造性設(shè)施,甲方亦不必對(duì)上述添加設(shè)施進(jìn)展補(bǔ)償。partyb,uponwrittenpermissionofpartya,maymakeadditionsoralterationsdealingwithwater,electricitysupplyorfireprotection,athisownexpense,subjecttonecessarypermitsorlicensesrequiredbytheauthoritiesconcernedandunderthesupervisionofpartya.nostructuralalterationsoradditionscanberemovedfromthepremisesupontheexpirationofthiscontract.noreimbursementforthesaidadditions.6.8乙方有權(quán)在墻壁上懸掛畫(huà)、圖片或其他裝飾性物品。合同履行期限屆滿或提早解約時(shí),甲方應(yīng)承當(dāng)費(fèi)用拔掉釘子、粉刷墻壁或使墻壁恢復(fù)原狀,并承諾不以此為由拘留乙方的押金。partybisentitledtohangpictures,paintingsorotherdecorativearticlesonthewalls.uponexpirationorearlyterminationofthecontract,partyashallbearthecosttoremovethenails,repaintthewallorrestorethewalltotheoriginalstate,andpartyashallnotretainpartyb’sdepositforthereasonofdoingthingsabove.6.9租賃合同期滿的前一個(gè)月內(nèi),經(jīng)合理事先書(shū)面通知,乙方應(yīng)允許甲方或其受權(quán)人引領(lǐng)潛在客人參觀在出租房屋。duringthelastmonthofthecontract,afterreasonablepriorwrittennoticetopartyb,partyaorhisnomineeshallbeallowedtoshowthesaidpremisestothepotentialclients.6.10租賃期滿,假設(shè)甲,乙雙方未達(dá)成續(xù)租協(xié)議,乙方應(yīng)于租期屆滿時(shí)或之前遷離出租房屋并將鑰匙及清理干凈的房屋歸還甲方.partybshallreturnthepremisesinacleanconditiontopartya(exceptwearandtear)attheexpirationofthecontractifthereisnorenewalthereupon.7提早解約earlytermination:7.1六(6)個(gè)月后,乙方如要退租,應(yīng)提早一(1)個(gè)月書(shū)面通知甲方終止本租約。在此情況下,甲方應(yīng)在本租約終止后十(10)日內(nèi)將押金全額退還乙方。aftersix(6)months,partybmay,uponone(1)monthadvancewrittennoticetopartya,terminatethistenancyagreementwithoutanyliabilities.underthiscircumstance,partyashallreturnthedepositinfulltopartybwithinten(10)daysafterthetermination.7.2假設(shè)因自然界的不可抗力,如火災(zāi)、洪水、臺(tái)風(fēng)、地震、戰(zhàn)爭(zhēng)等意外損害導(dǎo)致出租房屋無(wú)法居住,合同即自動(dòng)終止,甲、乙雙方互不承當(dāng)責(zé)任。ifthesaidpremisesaresodamagedbyforcemajeure(fire,flood,typhoon,earthquake,war,andetc)thatit’snolongerhabitable,thecontractshallbeterminatedautomatically.neitherpartyanorpartybshallbearanyresponsibilitytoeachother.8續(xù)租renewal:租賃期滿,乙方有優(yōu)先續(xù)租權(quán),但須提早一個(gè)月通知甲方,并安排簽訂續(xù)租合同。partybretainstheprioritytorenewthisleaseuponexpiration,whileone-monthpriornoticetopartyaisnecessary,andpartyashallarrangethesignaturefortherenewalcontract.9爭(zhēng)議的解決disputeresolution:9.1本合同適用法律為中華人民共和國(guó)相關(guān)法律。thecontractisgovernedbythelawsofthepeople’srepublicofchina.9.2在履行本合同過(guò)程中產(chǎn)生的任何爭(zhēng)議由雙方協(xié)商解決,協(xié)商不成,可向中國(guó)國(guó)際經(jīng)濟(jì)貿(mào)易仲裁委員會(huì)(北京)申請(qǐng)仲裁。incaseofanydisputearisingoutoftheperformanceofthiscontract,partyaandpartybshallconsulttogethertoreachunanimity,otherwisebothpartiescansubmitthedisputetothechinainternationaleconomicandtradearbitrationmission(beijing)forarbitration.10其他others:10.1本合同以中英文兩種文字?jǐn)M成,兩種文本同等有效。thecontractisdrawninbothchineseandenglishversions.bothtextshaveequaleffect.10.2本合同一式二份,甲、乙雙方各執(zhí)一份。twocopiesofthecontractwillbedrawnandremainedinthepossessionofpartya-partyb.10.3本合同自簽定之日起生效。thecontractshalleintoforceonthedateofsignature.10.4本合同的附件是本合同必不可少的組成局部。附件一列明的物品在甲、乙雙方核實(shí)簽字后生效。11簽章signaturesandofficialmarks:甲方乙方partya:partyb:受權(quán)代表:受權(quán)代表人:authorizedrepresentative:authorizedrepresentative:蓋章:蓋章:seal:seal:日期日期date:date:出租方:(以下簡(jiǎn)稱(chēng)“甲方”)landlord:(hereaftercalled“partya”)承租方:(以下簡(jiǎn)稱(chēng)“乙方”)tenant:(hereaftercalled“partyb”)甲、乙雙方就甲方愿意出租,乙方自愿承租房屋之事宜,經(jīng)雙方協(xié)商一致,同意簽訂該房屋正式租賃協(xié)議。thisagreementismadebetweenpartyaandpartybinconnectionwithrentalofpropertywherebythefollowingisagreed:1房屋property1.1租賃房屋地址:(以下簡(jiǎn)稱(chēng)“該房屋”)leasedpropertyaddress:(hereaftercalledthe“property“)1.2用處:該房屋只供住宅使用。usage:forresidentialuseonly.1.3面積:該房屋建筑面積為平方米。area:grossareaissquaremeters.2租賃期限lengthoftenancy2.1租賃期限為壹年,自起至止。thepropertyisherebyleasedforoneyear,mencingonandexpiringon.2.2為防止歧義,雙方同意,本協(xié)議下甲方向乙方交付該房屋的交房日為,起租日為,退房日為協(xié)議終止日后一天下午2:00前。toavoidanyambiguity,bothpartiesagreethatthehandoverdateofthepropertybypartyatopartybis,therentmencementdatehereunderisandtheduedayforcheck-outis2:00pm,thenextdayoftheleaseexpiringday.3租金rental3.1租金:租賃期租金為每月人民幣元(大寫(xiě):元整),其中包含括物業(yè)每月管理費(fèi)人民幣元(大寫(xiě):)。房屋租賃稅金,小區(qū)會(huì)所家庭會(huì)員卡(2成人+2小孩),有線及正版衛(wèi)星安裝和使用費(fèi),和寬帶安裝費(fèi)。theagreedmonthlyrentalisrmb(inwords:),includingthemonthlymanagementfeermb(inwords:twothousandstwenty-oneandthirty-eightcents).leasinginvoice,clubhousemembershipfor2adultsand2kids,localcabletvandsatelliteinstallationfeeandusagefee,interandtelephoneinstallationfee.3.2付租方法:首月租金需于雙方簽好合同后15個(gè)工作日內(nèi)支付。首月租金計(jì)自至,金額為人民幣元。甲方收到該租金后的5個(gè)工作日內(nèi)提供乙方正式租賃發(fā)票。自第二租賃月起租金按自然月結(jié)算,甲方需在前一個(gè)月的15號(hào)或之前給到乙方當(dāng)月發(fā)票原件,乙方應(yīng)在當(dāng)月1號(hào)前支付當(dāng)月租金,匯至甲方指定的銀行帳號(hào)(附件三所示),支付租金日期以乙方匯出日期為準(zhǔn)。末月租金計(jì)自至,金額為人民幣元整。rentalpayment:therentalforthefirstmonthoftheleaseshallbepaidwithin15workingdaysafterbothpartiessigntheleasecontract.thefirstmonth’srentalperiodisfromtoandtherentalamountisrmb.partyashallprovideanofficialtaxinvoicewithin5workingdaysfromthedatepaymentisreceived.therentalforthelastmonthperiodisfromto,andtherentalamountisrmb.3.3所有費(fèi)用,包括保證金,租金等均以人民幣方式支付。allpaymentsofsecuritydeposit,rentalandmanagementfeeandetc.hereundershallbemadeinrmb.3.4乙方同意按上述規(guī)定每月按時(shí)支付租金給甲方,如乙方逾期支付超過(guò)5個(gè)工作日(除國(guó)定長(zhǎng)假外),那么須繳納滯納金給甲方,滯納金每日按月租金百分之0.5(0.5%)計(jì)收直到所拖欠租金和滯納金一起付清為止。乙方逾期超過(guò)30天的,仍未支付當(dāng)月租金那么被視為違約,那么甲方有權(quán)提早終止本協(xié)議并收回該物業(yè)沒(méi)收乙方保證金,乙方仍須支付遲付房租,相應(yīng)滯納金及未付的公用事業(yè)費(fèi)。如由于出現(xiàn)不可抗力的情況包括但不限于,如遇銀行方面問(wèn)題或地震、風(fēng)暴、洪水和火災(zāi)等自然災(zāi)害襲擊,而使乙方不能及時(shí)付款,乙方不須支付其逾期付款所產(chǎn)生的滯納金并不被視為違約行為。partybagreestopaytherentaltopartyaontimeaccordingtotheconditionsstatedabove.wherefullpaymentoftherentalisdelayedformorethan5workingdays(exceptnationalholiday),partybagreestopaytopartyaafinefordelayedpaymentequalto0.5percentofthemonthlyrentalperdayuntilanyoutstandingrental,includinglatefees,hasbeenpaidinfull.shoulddelayoftheaboverentalpaymentbemorethanthirty(30)daysinarrearsandpartybhasstillnotpaidtherental,thenpartybshallbedeemedtohavebreachedtheagreement.partyareservestherighttocancelthisagreementearlywithoutfurtherprejudice.partyahastherighttokeeppartyb’ssecuritydeposit,andpartybisstillresponsibleforpayingthelaterentalpayment,relevantlatefeesandanyoutstandingutilitiesincurredbypartyb.theabove-mentionedfinesshallnotbeimposedtopartybincasethatanydelayofpaymentisduetoreasonofforcemajeureincludingbutnotrestrictedtobankstrikes,storm,earthquake,flood,andfirethatrestrictpaymenttransfersdirectly,andinthiscasepartybshallnotbedeemedtohavebreachedtheagreement.3.5月租金包括所有有關(guān)于該房屋的稅金及物業(yè)管理費(fèi)用,甲方應(yīng)及時(shí)支付上述費(fèi)用。如因甲方不支付或延期支付上述任何款項(xiàng)而導(dǎo)致乙方任何損失、責(zé)任或義務(wù)的,甲方應(yīng)當(dāng)向乙方承當(dāng)相應(yīng)的補(bǔ)償責(zé)任,并使乙方免受損害。themonthlyrentalincludesalltherelevanttaxesandmanagementfeesconcerningtheproperty.partyashallmaketimelypaymentsoftheaboveexpenses.partyashallpensatepartybforandholdpartybharmlessfromanydamages,obligationsorliabilitiesincurredbynon-paymentorlatepaymentofanyoftheabovesaidexpensesbypartya.4公用事業(yè)費(fèi)feesandutilities4.1租期內(nèi),房屋內(nèi)所有除3.1條款及附件一中租金所包含的費(fèi)用外,由乙方使用產(chǎn)生的公用事業(yè)費(fèi)及其它使用費(fèi)等均由乙方承當(dāng)。partybagreestomakefullpaymentofanyutilityandpersonalusagefees,exceptthefeesinclusiveintherentalinclause3.1andattachment1,incurredbythematthepropertyduringtheleaseperiodasoutlinedinthisagreement.4.2乙方應(yīng)及時(shí)支付由乙方產(chǎn)生的公用事業(yè)費(fèi)及其它使用費(fèi),如因乙方不支付或延期支付上述任何款項(xiàng)而導(dǎo)致甲方任何損失、責(zé)任或義務(wù)的,乙方應(yīng)當(dāng)向甲方承當(dāng)相應(yīng)的補(bǔ)償責(zé)任,使甲方免受損失。partybshallmaketimelypaymentsoftheutilityandpersonalusagefees.partybshallpensatepartyaforandholdpartyaharmlessfromanydamages,obligationsorliabilitiesincurredbynon-paymentorlatepaymentofanyoftheabovesaidexpensesbypartyb.5保證金securitydeposit5.1本協(xié)議下租賃保證金為人民幣(大寫(xiě):元整),乙方需于雙方簽好合同后15個(gè)工作日內(nèi)以銀行轉(zhuǎn)賬向甲方支付該保證金。甲方收款后的10個(gè)工作日內(nèi)提供乙方收據(jù)。itisalsoagreedthatpartybshallpaytopartya,arefundablerentalsecuritydepositofrmb(inwords:).thisamountshallbepaidviabanktransferwithin15workingdaysafterbothpartiessigntheleaseagreement,forwhichpartyashallissueaseparatereceiptwithin10workingdaysafterpartyareceivessuchrentalsecuritydepositpayment.5.2如乙方在協(xié)議期滿時(shí)不再續(xù)租,乙方同意不會(huì)使用保證金抵扣租金。upontheexpirationoftheagreement,thedepositshallnotbeusedtosetofftherental.5.3除本協(xié)議另有約定之外,甲方應(yīng)于租賃期限滿或提早終止本協(xié)議之日起且乙方己清空、點(diǎn)清、并付清所有應(yīng)付費(fèi)用的10個(gè)日內(nèi)將剩余租賃保證金無(wú)息退還乙方。unlessotherwiseprovidedintheagreement,partyashallreturntopartybtheremainingsecuritydepositwithoutinterestwithin10daysafterexpirationorsoonerterminationoftheagreementprovidedthatpartybhasvacatedthepropertyandsettledallrelatedcharges.5.4如以下情況發(fā)生,甲方有權(quán)合理地從保證金中扣除以下費(fèi)用,如保證金缺乏抵付時(shí),那么乙方應(yīng)負(fù)擔(dān)差額局部。partyaisentitledtowithholdreasonableamountfromthissecuritydepositrequiredtocovercostsinthefollowingsituations.shouldthesecuritydepositnotbeenoughtocoverthedamageoftheproperty,partybshallcovertherestofthecost.i.租期內(nèi),房屋之一切設(shè)備如有因乙方非正常使用而導(dǎo)致的損壞的,且該損壞的物品已于退房日經(jīng)甲乙雙方簽字認(rèn)可的但乙方未支付該修復(fù)費(fèi)。甲方扣除該修復(fù)費(fèi)必需合理并在抵扣后的三天內(nèi)向乙方提供正規(guī)維修發(fā)票原件。repairsordamagescausedbypartybduringthetenancyforwhichconfirmedbybothpartyaandpartybonthecheck-outdatewhilepartybhasnotalreadypaidtherepairfee,otherthannormalwearandtear.thecorrespondingofficialinvoiceshallbeprovidedbypartyatopartybwithinthreedaysafterthedeductionofthereasonablerepairfees.ii.乙方在租賃期內(nèi)所使用(未支付)的費(fèi)或其它使用費(fèi)等,并在扣除后的'三天內(nèi)給到乙方正規(guī)的費(fèi)用發(fā)票。anyremainingoroutstandingutilitiesandpersonalusagefeesincludingbutnotlimitedtotelephonefeesorunpaidliabilities.thecorrespondingofficialinvoiceshallbeprovidedbypartyatopartybwithinthreedaysaftersuchdeduction.5.5假設(shè)根據(jù)本協(xié)議規(guī)定,甲方有權(quán)在乙方違約的情形下沒(méi)收該保證金的,那么甲方應(yīng)向乙方提供沒(méi)收保證金的書(shū)面收據(jù)。intheeventthatpartyaisentitledtoconfiscatethesecuritydepositduetothebreachofpartybaccordingtothestipulationhereunder,partyashallprovidepartybawrittenconfirmationregardingsuchconfiscationofthesecuritydeposit.6甲方同意遵守以下條款和條件,否那么視為甲方違背本協(xié)議:partyaagreestoabidebythefollowingtermsandconditions,otherwisepartyaisinbreachofthisagreement:6.1甲方須負(fù)責(zé)該房屋各種構(gòu)造之維修費(fèi)用,如屋頂、天花板、以及主干構(gòu)造包括墻壁等,并確保該房屋的主干構(gòu)造處于良好狀態(tài)。toberesponsibleforanyrepairsrequiredtotheroof,ceilingandmainstructureofthepropertyincludingwalls,andtomaintainthesestructuresingoodrepairandconditionatitsownexpense.6.2待本協(xié)議簽署后,甲方需在交房日前按照本協(xié)議之附件四(該房屋內(nèi)家具與設(shè)備電器清單)提供裝備家具與電器設(shè)備。tofurnishthepropertyaccordingtotheattachment4(furniture,furnishingsandapplianceslists)beforethehandoverdate,afterthisagreementhasbeensignedbybothparties.6.3租賃期內(nèi),除乙方發(fā)生違約或不可抗力因素(包括自然災(zāi)害襲擊或政府政策變動(dòng))外,甲方不得無(wú)故提早終止本協(xié)議,否那么甲方除返還乙方支付的保證金(除第5.4.1條和5.4.2條所涉及內(nèi)容以外),還需以銀行電匯方式支付乙方人民幣元(大寫(xiě):元)作為提早終止本協(xié)議的賠償金。nottoprematurelyterminatethisagreementduringtheleaseterm,unlessabreachoreventofforcemajeure(includingactsofgodorofgover____ent)hasoccurred.shouldpartyaterminatetheleaseprematurelywithoutgoodcausetheninadditiontorepaymentofthesecuritydepositpaidbypartyb(exceptasprovidedinsec.5.4.i.and),partyaagreestowiretransferrmbtopartybasthepenaltyforsuchearlyterminationoftheagreement.6.4在租賃期內(nèi),甲方所提供的家具或是家電由于質(zhì)量原因或是老損而導(dǎo)致其不能正常運(yùn)作,甲方同意自擔(dān)費(fèi)用為乙方進(jìn)展維修或更換同等級(jí)別或以上的產(chǎn)品.ifanyappliancesprovidedbypartyabeebrokenormalfunctionduetonormalwearandtearduringtheleaseterm,partyawillberesponsibleforrepairorreplacementtothesamestandardofapplianceorbetteratitsownexpense.6.5租賃期內(nèi),甲方定期對(duì)房屋設(shè)備進(jìn)展維修保養(yǎng)。甲方應(yīng)保證租賃房屋及附件四所列之所有家具、設(shè)備和電器的使用平安,且應(yīng)負(fù)責(zé)修理和維護(hù)租賃房屋和所有上述家具、設(shè)備和電器,并保證所提供的家具、設(shè)備和電器符合平安性能標(biāo)準(zhǔn)和具備正常使用功能。如需緊急修理,甲方在收到乙方通知后十二小時(shí)內(nèi)需安排人員進(jìn)場(chǎng)查看和檢修,如遇等待專(zhuān)門(mén)的第三方維修工作或等待專(zhuān)用的設(shè)備零部件的情況,那么維修的截止日期為維修工作或零部件到達(dá)日,費(fèi)用由甲方負(fù)責(zé)(除乙方使用不當(dāng)造成的維修)。6.6租賃期內(nèi),甲方和/或甲方所指定的代理人如需進(jìn)入該房屋進(jìn)展修理或維護(hù)、甲方需給予乙方居住人不少于24小時(shí)的預(yù)約通知,且不得影響乙方居住人的正常生活。除非任何一方認(rèn)為情況緊急,應(yīng)該安排甲方和居住人雙方都方便的時(shí)間進(jìn)展修理。duringtheleasetermpartybandtheoccupantagreetogivepartyaand/orhisappointedagent(s)accesstothepropertyforrepairsandmaintenanceasneededbutwithoutaffectingtheoccupant’snormallife.intentiontoundertakesuchmaintenancewillbeprecededwithnolessthan__24__hourspriornoticefrompartyatotheoccupant(unlessdeemedmoreurgentbyeitherparty)andshallbearrangedatatimeconvenientforbothpartyaandtheoccupant.6.7如因該房屋內(nèi)的設(shè)備、設(shè)施發(fā)生故障,無(wú)法保證乙方正常居住,(因水、電、煤供給公司停頓其效勞及小區(qū)設(shè)備設(shè)施維護(hù)情形除外),且甲方收到乙方通知后三日內(nèi)仍無(wú)法完成修復(fù)的,在該等房屋修復(fù)或糾正期間,甲方應(yīng)提供乙方(a)可替代的具有類(lèi)似標(biāo)準(zhǔn)的全裝修并配置齊全的房屋,(b)效勞式公寓或酒店(最高價(jià)值人民幣元/天)用于臨時(shí)居住。如在甲方收到乙方通知后14日內(nèi),所涉問(wèn)題仍無(wú)法修復(fù),乙方有權(quán)書(shū)面通知終止本協(xié)議且不承當(dāng)違約責(zé)任,甲方應(yīng)自收到乙方發(fā)出的該等書(shū)面終止通知之日后5日內(nèi),不計(jì)利息全額返還乙方保證金。becauseoftheproblemsofthepropertyfurnitureandequipment,thepropertybeesuninhabitable,(exclusivetheproblemsofwater,electric,gaspaniesstopserviceandplexequipmentstopservice),andpartyacan’tfixtheproblemsin3daysaftergetnoticefromtenant,duringtheaforesaidproblemfixingperiod,partyashouldprovideeither(a)alternativefullyfittedandfurnishedacmodationofaparablestandard,orpayfor(b)serviced/hotelacmodationvaluedatmaximumrmbperdaywhilethepropertyisbeingrepaired.ifthepropertyisnotrepairedwithin14daysafterreceivingthenoticefrompartyb,partybhastherighttoterminatetheleasebyservingawrittennoticewithoutbeingheldofandliabilitiesofbreachofthisagreementandpartyashallreturnthesecuritydepositinfullamounttopartybwithin5daysuponreceivingtheterminationnoticeofthisagreement.6.8甲方保存在本租賃期限內(nèi)出售本出租房屋的權(quán)利,但需提早60日向乙方發(fā)出書(shū)面通知,在此情況下乙方放棄對(duì)該物業(yè)的優(yōu)先購(gòu)置權(quán),此時(shí)乙方有權(quán)選擇(1)終止本協(xié)議,甲方應(yīng)把保證金全款退還(5.4條款涉及的情況除外)以及退還乙方已向甲方支付但尚未使用的租金;或者(2)選擇要求繼續(xù)履行本協(xié)議,甲方應(yīng)確保新業(yè)主同意概括承受本協(xié)議項(xiàng)下剩余租賃期限內(nèi)甲方的所有權(quán)利及義務(wù),且甲方、乙方及新業(yè)主應(yīng)當(dāng)簽署三方轉(zhuǎn)讓協(xié)議,明確本協(xié)議項(xiàng)下乙方已向甲方支付但尚未使用的租金以及其他任何乙方已付未用費(fèi)用,以及租賃保證金應(yīng)當(dāng)由甲方直接轉(zhuǎn)交至新業(yè)主,并由新業(yè)主向乙方開(kāi)具新的租賃保證金收據(jù)。假設(shè)前述三方轉(zhuǎn)讓協(xié)議未能簽署導(dǎo)致乙方無(wú)法繼續(xù)承租該房屋的,那么甲方應(yīng)賠償乙方由此遭受的全部損失,并雙倍返還保證金和所有已付未用的租金及其他費(fèi)用給乙方。duringtheleaseterm,partyareservestherighttoselltheproperty,providedaprior60dayswrittennoticeisgiventopartyb.undertheaboveconditions,partybforgoesprioritytopurchasethesaidproperty.underthisthesituation,partybshallhavetherighttochoosetoi)terminatetheleaseandpartyashallreturnpartyb’ssecuritydepositinfull(exceptasprovidedinsection.5.4)andreturnanyrentalwhichhaspaidbypartybtopartyabutnotyetused;orii)keepexecutingthisleaseagreement,thenpartybshallensurethenewpropertyowneragreetobearallrightsandobligationsofpartyaduringtheremainingleasetermunderthisleaseagreement,andpartya,partybandthenewlandlordshallenterintoatri-partytransferagreement,whichshallclearlystatingthatallthesecuritydepositinfullandanyrentalandotherfeeswhichhaspaidbypartybtopartyabutnotyetusedshallbeendirectlytransferredfrompartyatothenewlandlord,andthenewlandlordshallissuethenewreceipttopartybforthesecuritydeposit.iftheaforesaidtri-partytransferagreementisnotsignedandpartybcouldnotfurtherleasethepremises,thenpartyashallbearallthelossesforpartybwhichincurred,andshalldoublereturnpartybthesecuritydepositandreturnanyrentalandotherfeeswhichhaspaidbypartybtopartyabutnotyetused.6.9如甲方自交房日起延遲交付乙方房產(chǎn)壹個(gè)月,那么視甲方違約,甲方需歸還乙方租賃保證金和已支付的租金并另外再支付乙方與該保證金同等金額的賠償金。ifpartyadelaysthepropertyhandovertopartybformorethanonemonthfromtheduehandoverdate,thenpartyashallbedeemedtohavebreachedthecontract,partyashouldrefundtherentalsecuritydeposit,therentalalreadypaidbypartyb,andpayanamountequivalenttothesecuritydeposittopartybasthepenalty.7乙方同意遵守以下條款和條件,否那么視為乙方違背此協(xié)議:partybagreestoabidebythefollowingtermsandconditionsotherwisepartybisinbreachofthisagreement:7.1乙方承租房屋須按規(guī)定用處使用,不可用于規(guī)定以外不道德或不合法用處。tousethenamedpropertyaspertheusagestipulatedaboveonlyandnottousethepropertyforanyimmoralorillegalpurpose.7.2乙方須全面遵守有關(guān)房屋管理公約,履行公約所規(guī)定的各項(xiàng)義務(wù),承當(dāng)違背公約所產(chǎn)生的責(zé)任,但前提是甲方應(yīng)事先向乙方提供該房屋管理公約。partybshouldabidebyanyrulesand/orregulationsofthebuilding’smanagement,andberesponsibleforbreakingtherules/regulations,providedthatsuchrulesand/orregulationsshallbemadeavailabletopartybbypartyainadvance.7.3租賃期內(nèi),除乙方在給予甲方書(shū)面通知后,甲方?jīng)]有在前述6.7條約定的三天內(nèi)履行其應(yīng)盡的修復(fù)義務(wù)之情況外,乙方在第2.1條規(guī)定的固定期內(nèi)不得無(wú)故提早終止本協(xié)議,否那么甲方將有權(quán)保存乙方兩個(gè)月租金之保證金以作賠償,乙方仍須支付直到實(shí)際搬離日的未付租金,滯納金和公用事業(yè)費(fèi)用及因乙方或居住人或乙方指定進(jìn)入該房屋的人忽略而導(dǎo)致的損壞所產(chǎn)生的費(fèi)用(除正常損耗外)。nottoprematurelyterminatethisagreement,unlessabreachhasoccurredbypartyaandhasnotconductedthereparationobligationwithin3daysofwrittennoticehavingbeendeliveredtopartyastipulatedinarticle6.7.shouldpartybterminatetheleaseprematurelywithoutgoodcauseduringthefixedleasetermasspecifiedinclause2.1hereunder,thenpartybshallforfeitthesecuritydepositinfullandwillstillbeheldaccountablefortherentuntilthephysicalcheckoutdate,latefees,utilitiesandcostsforrepairinganydamages(exceptfornormalwearandtear)accruedand/orcausedbypartyb,theoccupantorpersonsauthorizedbypartybortheoccupanttoentertheproperty.7.4乙方不得擅自將房屋轉(zhuǎn)租給第三方,或與第三方合租、分租。假設(shè)乙方需將該房屋轉(zhuǎn)租給nike的關(guān)聯(lián)公司或其員工,需提早書(shū)面通知甲方并與甲方和新的承租方簽訂轉(zhuǎn)租協(xié)議。partybshallnottosub-letorpartwiththepossessionofthenamedpropertytoanotherthirdparty.however,partybcanassignthepropertytoanassociatedpartyaffiliatedtonikeoritsstaff.inthiscase,partybshouldprovidepartyaapriorwrittennotice,andsignatransferagreementwithpartyaandthenewtenant.7.5乙方不得在該房屋內(nèi),政府違禁之物品,舉凡軍械、火藥、硫磺、汽油,及揮發(fā)性之化工原料,或有爆炸之危險(xiǎn)物品,均不得陳放該房屋內(nèi)外任何地方,否那么違背中國(guó)法律或地方律令,一切后果由乙方負(fù)責(zé)。nottostorearms,ammunitionorunlawfulgoods,gun-powder,keroseneoranyexplosiveorbustiblesubstanceatthenamedproperty,andtobeanswerableandresponsibleforanyconsequenceofanybreachoflocalordinancesorchineselaws.8房屋的使用要求propertyuseguidelines8.1乙方須正確使用該房屋內(nèi)甲方所提供之家具,裝置及設(shè)備,確保退還時(shí)仍處于良好狀態(tài),正常損耗除外。maintaintheinteriorofthenamedproperty,includingallfurniture,fixturesandfittingsprovidedbypartya,suchthatthepropertycanbereturnedtopartyaingoodcondition(butconsideringnormalwearandtear)andstateofrepairasatmencementofthelease.8.2乙方應(yīng)采取所有合理預(yù)防措施來(lái)保護(hù)出租房屋的內(nèi)部設(shè)施以防其受到暴風(fēng)雨(雪)和其它惡劣氣候條件的損害,且一有此種惡劣氣候條件下,乙方即應(yīng)采取適當(dāng)行動(dòng),例如,包括但不限于所有的外部門(mén)窗鎖牢或關(guān)牢等。partybshalltakeallreasonableprecautionstoprotecttheinteriorofthepropertyagainstdamagesfromstormsandotheradverseweatherconditionsandshall,uponthreatofsuchweathercondition,takeappropriateaction,suchas,butnotrestrictedto,ensurethatallexteriordoorsandwindowsaresecurelylockedorclosed.8.3乙方應(yīng)保護(hù)并適當(dāng)使用租賃房屋。假如由于乙方或乙方的任何雇員、代理、訪客或被邀請(qǐng)人對(duì)租賃房屋的不適當(dāng)使用造成租賃房屋的任何損害或損失,乙方應(yīng)及時(shí)通知甲方,甲方將安排修復(fù)該等受損財(cái)產(chǎn)。由此發(fā)生的合理費(fèi)用由乙方承當(dāng)。partybshalltakecareandmakeproperuseoftheproperty.ifpartyboranyemployee,agent,visitororinviteeofpartybhascausedanydamageorlosstothepropertyduetoitsimproperuseofthesame,partybshallimmediatelyinformpartya,whowillthenarrangeforrepairofsuchdamagedproperties.thereasonableexpensesincurredtherefromshallbebornebypartyb.8.4乙方居住人需通知甲方并在其協(xié)助下在房屋墻上掛畫(huà)或藝術(shù)品以保護(hù)墻面和藝術(shù)品并防止墻壁內(nèi)部電線和管道被破壞。partyb’soccupantshouldnotifyandallowpartyatoassistinhangingpictures/artworkonthewallsoastominimizedamageto(a)avoiddamagetointernalwiringandplumbing,andto(b)minimizedamagetowallsandpaintwork.8.5遺棄物品abandoneditems當(dāng)本協(xié)議到期時(shí),乙方應(yīng)將該物業(yè)連同本協(xié)議所有的附件中所列清單中的家具及設(shè)備歸還給甲方。除非甲方同意,任何該物業(yè)內(nèi)乙方遺留的物件,甲方可通知乙方將其清理,如通知后的五個(gè)工作日內(nèi)乙方仍未清理,甲方有權(quán)將其視為乙方遺棄之物品,可自行處理并有權(quán)從乙方所付之保證金中扣除因此而產(chǎn)生的合理費(fèi)用。partybshallreturntheproperty,fixturesandfittingstogetherwithallitemsasdetailedontheattachmentsofthisagreementtopartyawhentheleasetermexpires.unlessotherwiseagreedbypartya,partyashallnotifypartybofanyitemsleftinthepropertybypartyb.ifafter5workingdayspartybhasnotremovedtheseitemsthentheyshallbedeemedtohavebeenabandonedandpartyashallhavetherighttodisposeoftheitemsanddeductanyreasonablecostsfordoingsofrompartyb’ssecuritydeposit.9不可抗力forcema
