RECOGNISINGthatbordermanagementisexercisedbymultipleorgansofstatewiththepurposeofsecuringthebordersoftheRepublicandprotectingnationalinterest;

RECOGNISINGFURTHERthatthereisaneedforintegratedandco-ordinatedbordermanagementinaccordancewiththeConstitution,internationalanddomesticlaw,inorderto—

contributetothesocio-economicdevelopmentoftheRepublic;

ensureeffectiveandefficientborderlawenforcementfunctionsatportsofentryandtheborder;

contributetothefacilitationoflegitimatetradeandsecuretravel;

contributetothepreventionofsmugglingandtraffickingofhumanbeingsandgoods;

preventillegalcross-bordermovement;

contributetotheprotectionoftheRepublic’senvironmentalandnaturalresources;and

protecttheRepublicfromharmfulandinfectiousdiseases,pestsandsubstances;

Denitions

1.(1)InthisAct,unlessthecontextindicatesotherwise—

airspace"meanstheareaenclosedbytheouterlimitoftheinternationallyrecognisedairspaceoftheRepublic;

"Authority"meanstheBorderManagementAuthorityestablishedbysection4ofthisAct;

"borderguard"meanstheborderguardreferredtoinsection6(1)(c);"borderlawenforcementarea"means,inrespectof—

(a)thelandborder,adistanceof10kilometresoranyreasonabledistanceinsidetheinternationallyrecognisedbordersoftheRepublic;and

(b)themaritimeborders,adistanceof10kilometresoranyreasonabledistanceonthelandwardsideofthebaselinesextendingseawardtotheouterlimitoftheExclusiveEconomicZoneasde?nedintheMaritimeZonesAct,1994(ActNo.15of1994);

"borderlawenforcementfunctions"meansfunctionsconferredontheAuthority

bylawandintermsofthisAct;

"bordermanagement"meanstheexecutionofborderlawenforcementfunctionsandincludesco-operationwiththeDefenceForceontheimplementationofborderprotectionfunctions;

"borderprotectionfunctions"meansthefunctionsperformedexclusivelybytheDefenceForceintermsofsection200(2)oftheConstitution;

"BorderTechnicalcommittee"meanstheCommitteeestablishedbysection25;"commissionedofficer"meansapersonreferredtoinsection14(1);

"commissioner"meansthepersonappointedintermsofsection7(1)ofthisAct;"constitution"meanstheConstitutionoftheRepublicofSouthAfrica,1996;

"customsrelatedfunctions"meansthefunctionsperformedexclusivelybytheSouthAfricanRevenueServiceunder—

(a)customsandexciselegislation;and

(b)anytaxAct,

asde?nedintheTaxAdministrationAct,2011(ActNo.28of2011);

"DefenceForce"hasthemeaningascribedtoitinsection1oftheDefenceAct,2002(ActNo.42of2002);

2.(1)ThisActappliestotheexercisebytheAuthorityofitsborderlawenforcementfunctionswithintheborderlawenforcementareaandatportsofentry.

(2)ThisActappliesoutsidetheterritoryoftheRepublicinaccordancewithanybindinginternationalagreemententeredintointermsofsection231oftheConstitution.

(3)ExceptwheretheActotherwiseprovides,thisActdoesnotapplyto—

(a)theborderprotectionfunctionsperformedbytheDefenceForce,includingthoseperformedinrespectoftheairspaceoftheRepublic;

(b)postalservicesasde?nedinsection1ofthePostalServicesAct,1998(ActNo.124of1998);and

(c)thecustomsrelatedfunctionsperformedbytheSouthAfricanRevenueService.

BORDERMANAGEMENTAUTHORITY

EstablishmentofBorderManagementAuthority

4.(1)TheBorderManagementAuthorityisherebyestablishedasanationalpublicentity,ascontemplatedinPartAofSchedule3ofthePublicFinanceManagementAct,outsideofthepublicservice,andisanarmedserviceestablishedintermsofsection199(3)oftheConstitution.

(2)TheborderlawenforcementfunctionswithintheborderlawenforcementareaandatportsofentrymustbeperformedexclusivelybytheofficersoftheAuthority.

FunctionsofAuthorit

5ThefunctionsoftheAuthorityareto—

(a)facilitateandmanagethelegitimatemovementofpersonswithintheborderlawenforcementareaandatportsofentry;

(b)facilitateandmanagethelegitimatemovementofgoodswithintheborderlawenforcementareaandatportsofentry;and

(c)co-operateandco-ordinateitsborderlawenforcementfunctionswithotherorgansofstate,bordercommunitiesoranyotherpersons.

7.(1)ThePresidentmustappointaCommissionerwho—

(a)isa?tandproperperson;

(b)possessestertiaryquali?cationsappropriatetothepost;

(c)holdsaminimumof10years’appropriateseniormanagementexperience;(d)isaSouthAfricancitizen;

(e)hasnotbeenconvictedandimprisonedwithouttheoptionofa?ne,exceptforacriminaloffenceforwhichthepersonhasbeengrantedamnestyintermsofthePromotionofNationalUnityandReconciliationAct,1995(ActNo.34of1995);

(f)hasatrustworthyandexemplarycharacter;and

(g)isacommissionedofficerormust,subsequenttohisorherappointment—(i)successfullycompletetheappropriateprescribedtraining;

(ii)complywiththeprescribedsecuritygradingrequirements;and

(iii)successfullyundergoanappropriatesecurityclearanceprocess,tobeappointedasacommissionedofficer.
