INSURANCEREQUIREMENTSFORCONTRACTOR對工程承包商保險責任的要求（工程合同附件）InsurancetobetakenoutbytheContractor.承包商擔當保險：Inaccordancewiththeprovisionsofcontract,theContractorshallatitsexpensetakeoutandmaintainineffect,orcausetobetakenoutandmaintainedineffect,duringtheperformanceoftheContract,theinsurancesetforthbelowinthesumsandwiththedeductiblesandotherconditionsasspecified.TheidentityoftheinsurersandtheformofthepoliciesshallbesubjecttotheapprovalofEMPLOYER.ThecostsforinsurancetobeincludedinBidprice依照合同條約，承包商應在合同履行期間投保且保持保險有效，或促成投保且保持保險有效，保險數(shù)額、免賠額和其他條件已在下方列明。保險公司的身份和保單形式應得到雇主同意。投標價格包含保險成本。依照合同之規(guī)定，在合同履行期間，承包商負責投保或促成投保以保持該保險有效，保險金額、扣除條款與其他條件規(guī)定如下。保險公司和保險單形式均須獲得業(yè)主正式批準。標價含保險費。1.ConstructionandErectionInsurance施工和安裝保險ThefollowinginsuranceshallbetakenoutandmaintainedbytheContractorduringtheperiodofdelivery/installation/construction/fieldtesting/commissioning/trialoperationattheSiteoftheWorkscoveredundertheContract:在工地交付、安裝、施工、場地檢測、調(diào)試、試運營期間，承包商須投保以保持合同中以下保險有效：依照合同規(guī)定，承包商須在現(xiàn)場工程交付/安裝/施工/現(xiàn)場測試/調(diào)試/試運行期間投保和保持以下保險：(a)ErectionAllRisksInsurancetocovertheentireWorks(permanentand/ortemporary)fromanyandallkindsofdamageswhichitisstandardinternationalpracticeforacontractortoinsureundersuchapolicy;安裝一切風險險，即覆蓋整個工程（永久或短期）的全部損害的險種。是承包商標準國際慣例“安裝一切險”：范圍含全部工程保險（永久和/或臨時性工程保險），即承包商依照保險單規(guī)定按標準國際慣例投保的全部損害保險；(b)"Third-PartyLiabilityInsurance"tocoverinjuryordeathtopersonsordamagestopropertycausedbytheWorksorbytheContractor'svehicles,toolsand/orequipmentorperEmployerpersonnel;第三方責任險：工程或承包商車輛、工具和/或設備或業(yè)主造成的人員傷亡或財產(chǎn)損壞“第三方責任險”：范圍包括由于工程施工或承包商的車輛、工具和/或設備或工作人員造成的人員傷亡或財產(chǎn)損害；(c)"Workman'sCompensationInsurance".ThistypeofinsuranceisrequiredunderLawtobesecuredbytheContractorforhisemployees.TheContractorshall,therefore,faithfullycomplywiththerequirementsofsaidlaw.工人賠償險：依照法律，此類保險由承包商為員工投保。因此，承包商須完全遵守上述法律要求。依照法律規(guī)定，承包商須保證為其雇員供應“職工賠償保險”。因此，承包商應照實遵照上述法律要求為其雇員投保職工賠償保險。(d)AutomobileLiabilityInsurance“機動車責任保險”：CoveringuseofallvehiclesusedbytheContractororitsSubcontractors(whetherornotownedbythem)inconnectionwiththeexecutionoftheWorks.范圍含工程執(zhí)行相關(guān)的承包商或分包商運用的全部車輛（不管是否屬于前兩者）?！皺C動車責任保險”：范圍包括承包商或其分包商為執(zhí)行施工運用的全部機動車輛(無論所述機動車輛是否屬于承包商或其分包商全部)的責任保險。TheContractorhastheresponsibilitytoensuretheinsurancesasmentionedabovebythewaytoemployatrustyInsuranceCompanywhichisacceptabletoEMPLOYER.TheseinsuranceswillbeeffectivetoFinalAcceptanceCertificateissuedbyOwnerspecifiedinContractAgreement.承包商負責確保供應上述全部保險，并投保守信牢靠的、業(yè)主接受的保險公司。上述保險的有效期至業(yè)主發(fā)出合同協(xié)議規(guī)定的最終驗收證書之日。Beforecommencingthesoilinvestigationworksatsite,theContractorshallsubmittheaboveInsurancePoliciestogetherwiththeofficialreceiptsevidencingpremiumpayments.在現(xiàn)場進行土地勘察工作之前，承包商應連同正式收據(jù)一起提交上述保險單，以證明其已經(jīng)支付保險金。BeneficiaryforErectionAllRisksshallbetheContractorwithinthePlantfence,andEMPLOYERoutofthePlantfence;BeneficiaryforThirdPartyLiabilityRiskshallbeEMPLOYER.安裝一切險受益人為電廠圍墻內(nèi)的承包商，以與電廠圍墻外的業(yè)主；第三者責任險受益人為業(yè)主。DeductibleslimitforErectionAllRisks:安裝一切險的免賠額限制如下：USD200,000.00A.O.AforLossorDamageduetoActsofGod由于自然災難造成的任何一次事故的損失或損害扣除金額為200,000.00美元；USD200,000.00A.O.AforLossorDamageduetoCommissioning/TestingandMaintenancecausedbyTurbine由于汽輪機的調(diào)試/測試和修理期間發(fā)生造成的任何一次事故的損失或損害扣除金額為200,000.00美元；DeductiblelimitforThirdPartyLiabilitiesapplicablef適用于財產(chǎn)損害的第三方責任險的免賠額限制為：一次事故5000.00美元。DeductiblelimitforThirdPartyLiabilitiesapplicableforpersonalinjury:Nil適用于人員損害險的第三方責任險的免賠額限制為：零美元。BeforePAC,theOwnershallbearthedeductiblesforthelossand/ordamagewhichiscausedbyreasonoftheOwner(includinghisemployeeandconsultant);Ifthelossand/ordamageiscausedbyanythirdparty,theContractorshallbearthedeductiblesforthelossand/ordamagewhichcannotbeclaimedfromtheinsurer;TheContractorshallbearthedeductiblesforthelossand/ordamagewhichiscausedbyotherreason(excludingForceMajeure)；FromPACtoFAC,theContractorshallbearthedeductiblesforthelossand/ordamagewhichiscausedbytheContractor.EMPLOYERshallbearthedeductiblesforthelossand/ordamagewhichiscausedbyotherreasons.臨時驗收之前，業(yè)主須擔當由于其(包括業(yè)主雇員和顧問人員)造成的損失和/損害的免賠額；若上述損失和/損害由于任何第三方造成，承包商須擔當造成的損失和/損害的免賠額（該部分保險金不能由保險公司賠付）。承包商還須擔當由于任何其他緣由（不含不行抗力因素）造成的損失和/損害的免賠額；臨時驗收到最終驗收期間，承包商須擔當其自己造成的損失和/損害的免賠額。由于其他緣由造成的損失和/損害的免賠額則由業(yè)主擔當。TheContractorshallindemnifyEMPLOYERagainstallactions,suits,claims,demands,costorexpensesarisingfromorinconnectionwithanyaccident,illnessordeath(otherthansuchasmaybeattributabletoEMPLOYER,itsagentsorservEmployerants)topersonsemployedbytheContractororhisSubcontractoratSite.承包商應確保業(yè)主免于任何由于承包商或分包商的現(xiàn)場人員的全部事故、疾病或死亡引起或與事故、疾病或死亡有關(guān)的（不是由于業(yè)主、其代理商或雇員引起）全部訴訟、訟案、索賠、要求、成本或費用。TheContractorshallindemnifyEMPLOYERagainstalllossand/ordamagearisingfromitsimproperdesignfortheWorks.承包商須向由于其工程設計不當對業(yè)主造成的全部損失和/損害供應賠償。TheContractorshallinitiateandsuccessfullyobtainsecuritypaymentscoveringlossesand/ordamagesarisingoutoftheContract.FailuretoinitiateEmployerorsettletheclaimwithinareasonableperiodoftimeshallconstitutesufficientgroundsforEMPLOYERtoexerciseitsrightsundertheContract.ShouldtheContractorfailorrefusetomaintainitsinsuranceabove,EMPLOYERwillsecure,renewormaintainsaidinsurance,andanyandallexpensesincurredtherebyshallbedeductedfromanyandallsumsdueormaybecomeduetotheContractor.ThePerformanceBondsubmittedbytheContractorshallalsobeusedwherenecessarytocoversuchexpenses.承包商應發(fā)起和獲得全部損失和/損害的賠償金。若承包商未能在合理的期限內(nèi)起先或解決該索賠，則業(yè)主有足夠理由履行其合同給予的權(quán)利。若承包商未能或拒絕進行上述投保，則業(yè)主將供應、續(xù)?；虮３稚鲜霰ｋU有效，但由此招致的全部費用從任何或全部到期付款中扣除。依據(jù)須要，可以從承包商提交的履行保函中扣除上述費用。2.AllRiskInsuranceforTransportationofEquipmentandMaterials.設備和材料運輸一切險保險WithoutprejudicetotheContractor'sobligationsandresponsebilitiesundertheContract,theContractorshallinsuretheequipmentandmaterialstobesuppliedanddeliveredwithareputableinsurancecompanyacceptabletoEMPLOYER.TheinsuranceshallbetakenoutinthejointnamesoftheContractorandEMPLOYERfortheirrespectiverightsandinterests,andshallcoverallRisksincludingseaandlandtransport,andwarrisk,fromplaceoforigintotheSite.在與合同項下規(guī)定的承包商義務和責任不相沖突的狀況下，承包商應為將供應和交付的設備和材料投保一切險保險，承包商應投保信用牢靠的、業(yè)主接受的保險公司。由承包商和業(yè)主依照各自的合同權(quán)利和利益聯(lián)名共同投保，一切險范圍為從原產(chǎn)地到工程現(xiàn)場之間的全部運輸保險，包括海運險、陸運險、斗爭險。Theinsurancecoverageshallbeonehundredandtenpercent(110%)ofthedeliveredcostandinsurancepremiumsshallbepaidbytheContractor.Undersuchinsurance,theindemnitymustbepayableinUSdollars,freelyusabletoreplaceorrepairsuchgoods.TheContractor,actingasagentforEMPLOYER,shallinitiateproperactionandpursuesettlementregardinginsuranceclaimswheneverdamagesand/orlossesareinflictedonthegoods.TheContractorshallbeauthorizedtoreceivetheindemnitydirectlyfromtheinsurancecompaniesunlessotherwisedirectedbyEMPLOYER.保額為交付的材料或貨物的價值的百分之一十（110%），保費由承包商支付。依照本保險單之規(guī)定，保險賠付必需采納美元支付，其應能夠自由運用，以更換或修復保險賠付部分的貨物。作為業(yè)主的代理人，當貨物出現(xiàn)任何損害和/或損失時，承包商應實行適當?shù)男袆雍头椒ㄌ幚砣魏斡嘘P(guān)保險索賠。除業(yè)主指示外，承包商應獲得授權(quán)，以便干脆接受保險公司的賠付。EMPLOYERshallbenamedasco-insuredunderallinsurancepoliciestakenoutbytheContractorpursuanttoGC34.1,exceptforWorkman’sCompensation，andtheContract
