tothecontractorthroughthesupervisor.2.10保障Guarantee在監(jiān)理人不違反有關(guān)法律、法規(guī)的前提下，委托人應(yīng)保障監(jiān)理人免受因履行本監(jiān)理合同而引起的外界索賠或干擾。Subjecttothepremisethatthesupervisordoesnotviolatetherelevantlawsandregulations,theclientshallindemnifythesupervisoragainstexternalclaimsorinterferencecausedbytheperformanceofthissupervisioncontract.3.委托人管理Client’smanagement3.3決定或答復(fù)Decisionorreply第3.3.2項(xiàng)細(xì)化為：Item3.3.2isdetailedas:委托人對(duì)監(jiān)理人關(guān)于本工程的工期、質(zhì)量、投資、合約和安全等問題提出的請(qǐng)示應(yīng)及時(shí)作出書面答復(fù)。對(duì)上述請(qǐng)示給予書面答復(fù)的期限，自收到書面請(qǐng)示之日起最長(zhǎng)不超過7日，重大問題不得超過28日。逾期沒有作出答復(fù)的，視為己獲得委托人的批準(zhǔn)。Theclientshouldmakepromptlythewrittenreplytotherequestsissuedbythesupervisorontheconstructionperiod,quality,investment,contract,andsafetyoftheproject.Thetimelimitforthewrittenreplytotheaboverequestshallnotexceed7daysfromthedateofreceivingthewrittenrequest,andshallnotexceed28daysformajorissues.If,failuretorespondwithinthetimelimitshallbedeemedtohavebeenobtainedfromtheclient.4.監(jiān)理人義務(wù)Supervisor’sObligations第4.2款細(xì)化為：Section4.2isdetailedas:4.2履約保證金Performancebond4.2.1履約保證金自合同生效之日起生效。在簽發(fā)合同工程交工證書后，監(jiān)理人應(yīng)按委托人要求的格式，以項(xiàng)目專用合同條款規(guī)定的額度向委托人提交缺陷責(zé)任期保函。委托人在收到監(jiān)理人提交的缺陷責(zé)任期保函后7日內(nèi)向監(jiān)理人返還履約保證金。在簽發(fā)工程缺陷責(zé)任終止證書后14日內(nèi)，委托人向監(jiān)理人返還缺陷貢任期保函。Theperformancebondiseffectivefromthedateofthecontractbecomingeffective.Aftertheissuanceofthecontractworkdeliverycertificate,thesupervisorshallsubmitaguaranteeletterforthedefectliabilityperiodtotheclientintheamountspecifiedintheparticularconditionsofcontractintheformatrequiredbytheclient.Theclientshallreturntheperformancebondtothesupervisorwithin7daysafterreceivingtheguaranteeforthedefectliabilityperiodsubmittedbythesupervisor.Within14daysaftertheissuanceofthecertificateofterminationoftheliabilityforengineeringdefects,theclientshallreturntheguaranteeforthetermofdefecttothesupervisor.4.2.2如果監(jiān)理人不履行合同約定的義務(wù)或其履行不符合合同的約定，委托人有權(quán)扣劃相應(yīng)金額的履約保證金或缺陷責(zé)任期保函，但不影響監(jiān)理人根據(jù)監(jiān)理合同應(yīng)當(dāng)?shù)玫降钠渌铐?xiàng)的支付。Ifthesupervisorfailstoperformtheobligationsstipulatedinthecontractoritsperformancedoesnotcomplywiththecontract,theclienthastherighttodeductacorrespondingamountofperformancebondordefectliabilityperiodguarantee,howeveritcannotaffectotheramountsthatthesupervisorshouldreceiveunderthesupervisioncontractpayment.5.1監(jiān)理范圍Scopeofsupervision第5.1.3項(xiàng)細(xì)化為：Item5.1.3isdetailedas:階段范圍指公路工程建設(shè)程序中的施工準(zhǔn)備階段、施工階段、驗(yàn)收與缺陷責(zé)任期階段中的一個(gè)或者多個(gè)階段，具體范圍在項(xiàng)目專用合同條款中約定。Phasescopereferstooneormoreoftheconstructionpreparationphase,constructionphase,acceptanceanddefectliabilityphasephasesinthehighwayengineeringconstructionprocess,andthespecificscopeisstipulatedintheparticularconditionsofcontract.第5.2款細(xì)化為：Article5.2isdetailedas:5.2監(jiān)理依據(jù)Supervisionbasis除項(xiàng)目專用合同條款另有約定外，本工程的監(jiān)理依據(jù)如下：Unlessotherwisespecifiedintheparticularconditionsofcontract,thesupervisionbasisforthisprojectisasfollows:(1）適用的法律、行政法規(guī)及部門規(guī)章：Applicablelaws,administrativeregulationsandregulations:(2)與工程有關(guān)的規(guī)范、標(biāo)準(zhǔn)、規(guī)程；Engineering-relatedspecifications,standards,andprocedures;(3）工程前期有關(guān)文件：Relevantdocumentsintheearlystageoftheproject:(4）工程勘察文件、設(shè)計(jì)文件及其他文件；Engineeringsurveydocuments,designdocumentsandotherdocuments;(5）本工程監(jiān)理的委托合同及補(bǔ)充合同：Theentrustmentcontractandsupplementarycontractoftheprojectsupervision:(6）委托人簽訂的施工承包合同；Constructioncontractsignedbytheclient;(7）合同履行中與監(jiān)理服務(wù)有關(guān)的來往函件：Correspondencesrelatedtosupervisionservicesduringcontractperformance:(8）其他監(jiān)理依據(jù)。Othersupervisionbasis.第5.3款細(xì)化為：Article5.3isdetailedas:5.3監(jiān)理內(nèi)容Supervisioncontent監(jiān)理人應(yīng)按照《公路工程施工監(jiān)理規(guī)范》及相關(guān)法律、法規(guī)開展監(jiān)理服務(wù)。委托人須依據(jù)《公路工程施工監(jiān)理規(guī)范》要求對(duì)監(jiān)理機(jī)構(gòu)的設(shè)置方式進(jìn)行選擇，并在項(xiàng)目專用合同條款中予以約定。各階段監(jiān)理服務(wù)包括但不限于以下內(nèi)容，委托人可根據(jù)工程實(shí)際情況在項(xiàng)目專用合同條款中對(duì)其進(jìn)行調(diào)整。SupervisorsshallcarryoutsupervisionservicesinaccordancewiththeCodeforConstructionSupervisionofHighwayEngineeringandrelatedlawsandregulations.TheclientshouldchoosethemethodofsettingupthesupervisioninstitutioninaccordancewiththerequirementsoftheCodeforConstructionSupervisionofHighwayEngineering,andagreeontheparticularconditionsofcontract.Supervisionservicesateachstageincludehoweverarenotlimitedtothefollowing,andtheclientcanadjusttheasmeintheparticularconditionsofcontractinaccordancewiththeactualconditionsoftheproject.5.3.1在工程同時(shí)設(shè)置總監(jiān)辦和駐地辦時(shí)，總監(jiān)辦的監(jiān)理服務(wù)內(nèi)容為；Whenchiefengineerofficeandaresidentofficeestablishedatthesametime,thesupervisionservicecontentofthechiefofficeare:(1)總監(jiān)辦工地試驗(yàn)室按監(jiān)理
