橄欖球選手轉(zhuǎn)會(huì)協(xié)議合同編號(hào):__________OliveballPlayerTransferAgreementThisOliveballPlayerTransferAgreement(hereinafterreferredtoasthe"Agreement")ismadeandenteredintoasof____________(the"EffectiveDate"),andbetween____________________________(the"Club")and____________________________(the"Player").WHEREAS,theClubisaprofessionaloliveballcluborganizedandexistingunderthelawsof_____________________,andisamemberingoodstandingofthe____________________________(the"League");WHEREAS,thePlayerisaprofessionaloliveballplayer,withpersonalskillsandabilitiesinplayingoliveball,andbothpartieswishtoenterintothisAgreementtosetforththetermsandconditionsofthePlayer'stransfertotheClub;NOW,THEREFORE,inconsiderationofthemutualpromisescontainedherein,thepartiesheretoagreeasfollows:Article1:TransferofPlayer1.1Transfer.TheClubagreestotransferthePlayerfromhiscurrentclub,____________________________(the"CurrentClub"),totheClub,andthePlayeragreestoacceptsuchtransferandjointheClub.1.2TransferFee.TheClubagreestopayatransferfeeof____________________(the"TransferFee")totheCurrentClub,asconsiderationforthetransferofthePlayer.TheTransferFeeshallbepaidtheClubtotheCurrentClubwithin____________(number)daysaftertheexecutionofthisAgreement.Article2:ContractTerms2.2Player'sObligations.DuringthetermofthisAgreement,thePlayeragreesto:(a)faithfullyperformalldutiesassignedtheClub,including,butnotlimitedto,participatingintrainingsessions,matches,andotheractivitiesorganizedtheClub;(b)遵守theClub'srulesandregulations,aswellastheLeague'srulesandregulations,andmaintainagoodimagefortheClubandtheLeague;(c)maintainahighlevelofphysicalfitnessandfollowtheClub'strainingplan;(d)usehisbesteffortstopromotetheClubandtheLeague,andparticipateinpublicrelationsactivitiesorganizedtheClubortheLeague.2.3Remuneration.ThePlayershallreceivethefollowingremunerationfromtheClubduringthetermofthisAgreement:(a)afixedmonthlysalaryof____________________(the"MonthlySalary");(b)aperformancebonusof____________________(the"PerformanceBonus")tobepaiduponthePlayerachievingcertainperformancetargetssettheClub;Article3:TransferofRights3.1TransferofPlayer'sRights.TheClubshallhavetheexclusiverightstotransferthePlayer'srightstoanyothercluborentity,withorwithoutthePlayer'sconsent,duringthetermofthisAgreement.3.2NoTransferPlayer.ThePlayeragreesnottotransferorassignhisrightsunderthisAgreementtoanyothercluborentitywithoutthepriorwrittenconsentoftheClub.Article4:DisputeResolution4.1GoverningLaw.ThisAgreementshallbegovernedandconstruedinaccordancewiththelawsof_____________________.4.2DisputeResolution.AnydisputesarisingoutoforinconnectionwiththisAgreementshallberesolvedthroughnegotiationsbetweentheParties.Ifthenegotiationsfailtoresolvethedisputes,eitherPartymaysubmitthedisputesto____________________________(the"DisputeResolutionInstitution")forresolution.ThedecisionoftheDisputeResolutionInstitutionshallbefinalandbindingupontheParties.Article5:Miscellaneous5.1EntireAgreement.ThisAgreementconstitutestheentireagreementbetweenthePartiesandsupersedesallprioragreementsandunderstandings,whetherwrittenororal,betweenthePartieswithrespecttothesubjectmatterhereof.5.2Amendments.ThisAgreementmaybeamendedormodifiedonlyawritteninstrumentexecutedbothParties.5.4SuccessorsandAssigns.ThisAgreementshallbebindinguponandinuretothebenefitofthePartiesandtheirrespectivesuccessorsandassigns.5.5Se一、附件列表:1.球員個(gè)人簡歷2.球員醫(yī)療報(bào)告3.轉(zhuǎn)會(huì)費(fèi)支付證明4.球員合同副本5.俱樂部規(guī)章制度6.聯(lián)賽規(guī)則與regulations7.球員績效目標(biāo)8.爭議解決機(jī)構(gòu)信息二、違約行為及認(rèn)定:1.球員未能按要求參加訓(xùn)練或比賽2.球員未經(jīng)俱樂部同意轉(zhuǎn)投其他俱樂部3.俱樂部未按時(shí)支付球員薪資或獎(jiǎng)金4.俱樂部未能履行合同約定的義務(wù)5.違反聯(lián)賽或俱樂部的規(guī)定6.任何一方違反保密義務(wù)7.任何一方未能履行合同約定的其他義務(wù)三、法律名詞及解釋:1.轉(zhuǎn)會(huì)費(fèi):指俱樂部為獲得球員轉(zhuǎn)會(huì)權(quán)而支付給原俱樂部的費(fèi)用。2.合同期限:指合同的有效期限,通常包括開始日期和結(jié)束日期。3.違約金:指一方違約時(shí)需支付給另一方的賠償金。4.績效獎(jiǎng)金:根據(jù)球員在合同期間的績效表現(xiàn)支付的獎(jiǎng)金。5.爭議解決機(jī)構(gòu):指雙方在發(fā)生爭議時(shí)選擇的用于解決爭議的機(jī)構(gòu)。四、執(zhí)行中遇到的問題及解決辦法:2.薪資支付延遲:俱樂部應(yīng)及時(shí)解決資金問題,確保球員薪資的按時(shí)支付。3.轉(zhuǎn)會(huì)糾紛:雙方應(yīng)遵守
