FamilyAgreement

ThisFamilyAgreement(the"Agreement")ismadeandenteredintoasofthe_____dayof________,20______(the"EffectiveDate"),byandamongtheundersignedparties(collectivelyreferredtoasthe"Parties").

WHEREAS,thePartiesdesiretosetforthcertaintermsandconditionsgoverningtheirrespectiverightsandresponsibilitieswithinthefamilyunit,andtoprovideaframeworkforresolvingdisputesandmisunderstandingsinafairandequitablemanner.

NOW,THEREFORE,inconsiderationofthemutualpromisesandcovenantscontainedherein,andforothergoodandvaluableconsideration,thereceiptandsufficiencyofwhichareherebyacknowledged,thePartiesagreeasfollows:

Article1:Definitions

1.1"Family"shallmeanthecollectivegroupofindividualscomprisingtheimmediatefamilymembersoftheParties,includingbutnotlimitedtospouses,children,andanyotherrelativesasmaybedesignatedbymutualagreement.

1.2"DisputeResolution"shallmeantheprocessbywhichthePartiesagreetoresolveanydisagreementsorconflictsthatmayarisebetweenthem,assetforthinArticle6.

Article2:Purpose

2.1ThepurposeofthisAgreementistoestablishaclearunderstandingamongthePartiesregardingtheirrespectiveroles,responsibilities,andexpectationswithinthefamily,andtoprovideamechanismforthepeacefulresolutionofanydisputesthatmayarise.

Article3:FamilyRolesandResponsibilities

3.1EachPartyacknowledgesandagreestofulfillthefollowingrolesandresponsibilitieswithinthefamily:

3.1.1Tomaintainopenandhonestcommunicationwithallfamilymembers.

3.1.2TocontributetothefinancialsupportofthefamilyasagreeduponbytheParties.

3.1.3Toparticipateinfamilydecision-makingprocessesinafairandequitablemanner.

3.1.4Toprovideemotionalsupportandencouragementtoallfamilymembers.

3.2ThespecificrolesandresponsibilitiesofeachPartyaresetforthinExhibitAattachedheretoandmadeapartofthisAgreement.

Article4:FinancialArrangements

4.1ThePartiesagreetothefollowingfinancialarrangements:

4.1.1EachPartyshallcontributetothefamily'sfinancialneedsassetforthinExhibitBattachedhereto.

4.1.2AllmajorfinancialdecisionsshallbemadejointlybytheParties,witheachPartyhavinganequalvoiceinsuchdecisions.

Article5:PropertyandAssets

5.1ThePartiesagreethatallpropertyandassetsacquiredduringthetermofthisAgreementshallbeconsideredmaritalpropertyandshallbedividedequallyintheeventofadissolutionofthefamilyunit.

5.2ThePartiesacknowledgeandagreethatallpropertyandassetsownedpriortotheEffectiveDateshallremaintheseparatepropertyoftheowningParty.

Article6:DisputeResolution

6.1ThePartiesagreetoattempttoresolveanydisputesordisagreementsarisingoutoforrelatedtothisAgreementthroughmediationorothernon-bindingdisputeresolutionmethodsbeforeresortingtolitigation.

6.2IfthePartiesareunabletoresolveadisputethroughmediation,eitherPartymayinitiatelegalproceedingsinacourtofcompetentjurisdiction.

Article7:AmendmentsandWaivers

7.1ThisAgreementmaybeamendedonlybyawritteninstrumentsignedbyallParties.

7.2NowaiverofanybreachofanyprovisionofthisAgreementshallconstituteawaiverofanyprior,concurrent,orsubsequentbreachofthesameoranyotherprovisionshereof,andnowaivershallbeeffectiveunlessmadeinwritingandsignedbythePartywaivingthebreach.

Article8:GoverningLaw

8.1ThisAgreementshallbegovernedbyandconstruedinaccordancewiththelawsoftheStateof________.

Article9:EntireAgreement

9.1ThisAgreementconstitutestheentireagreementbetweenthePartiesandsupersedesallpriorandcontemporaneousagreements,understandings,andnegotiations,whetherwrittenororal,withrespecttothesubjectmatterhereof.

Article10:Severability

10.1IfanyprovisionofthisAgreementisheldtobeinvalidorunenforceableforanyreason,theremainingprovisionswillcontinueinfullforceandeffect.

Article11:Counterparts

11.1ThisAgreementmaybeexecutedincounterparts,eachofwhichshallbedeemedanoriginal,andallofwhichtogethershallconstituteoneandthesameinstrument.

Article12:Notices

12.1AnynoticerequiredorpermittedtobegivenunderthisAgreementshallbeinwritinganddeliveredpersonallyorsentbycertifiedmail,returnreceiptrequested,totheaddresssetforthbeloworsuchotheraddressaseitherPartymaydesignateinwriting.

INWITNESSWHEREOF,thePartieshaveexecutedthisAgreementasoftheEffectiveDate.
