1、xx年X月X日精品范文-聘(雇)用契約書 契約 _(以下簡稱甲方)為應業(yè)務需要,聘(雇)用_先生(女士)(以下簡稱乙方)為約聘(雇)人員,雙方訂立契約條款如下:一、聘(雇)用期間:自_年_月_日起至_年_月_日止。二、聘(雇)用報酬:甲方按月支給乙方報酬_薪點(_元)。三、工作內(nèi)容(具體敘明):_。四、受聘(雇)責任:乙方受聘(雇)后須確保甲方公務機密,有保密期限者從其規(guī)定,無保密期限者自離職日起_年為限(解聘(雇)者亦同)。乙方不得有不法行為或違背約定義務,如有違背者,除涉及民、刑事責任,由甲方依法追究外,并得隨時解聘(雇)。在聘(雇)用期間,乙方愿接受與甲方約定之工作上的指派調(diào)遣,并遵守此
2、工作上之相關規(guī)定。若乙方違背上述相關規(guī)定確屬情節(jié)重大,甲方得隨時終止契約;甲、乙雙方如因特別事故須提前終止契約時,應于一個月前提出預告,經(jīng)甲、乙雙方協(xié)議后乙方始得離職。乙方離職時,應先依照規(guī)定辦妥離職手續(xù)。如有損害公物,或侵權情事(或違反甲方智能財產(chǎn)權規(guī)定),應負責賠償。五、乙方在受聘(雇)用期間,除應遵守甲方一切行政法規(guī)之規(guī)定外,其假期、離職儲金給與、勞工保險及全民健保等,依左列約定:假期核給:依_辦理。離職儲金之扣繳及給與依_規(guī)定辦理,按月扣繳儲存生息,并于離職時依規(guī)定發(fā)給。按乙方每月支報酬之百分之_提存儲金,其中百分之_由乙方于每月報酬中扣繳作為自提儲金,另百分之_由甲方提撥作為公提儲金
3、,并由甲方在金融機構開立專戶儲存孳息,列帳管理。乙方因契約期滿離職、或經(jīng)甲方同意于契約期限屆滿前離職、或在職因公、因病或意外死亡者,發(fā)給公、自提儲金本息。乙方因違反契約所定義務而經(jīng)甲方予以解聘,或未經(jīng)甲方同意而于契約期限屆滿前離職者,僅發(fā)給自提儲金之本息。其余未盡事宜請參考_有關規(guī)定。乙方受聘(雇)用期間,甲方應善盡投保勞工保險及全民健康保險之義務。六、乙方于受聘(雇)期間之著作或工作成果,如系于甲方企劃下,或法定工作期間完成者,其所有權歸屬甲方。因前開著作或工作成果所生之智能財產(chǎn)權,應依本院之相關規(guī)定辦理。七、本契約期間屆滿當然失效,如因業(yè)務需要須續(xù)聘時,另行簽訂新契約。八、本契約未訂定事項
4、,悉依聘用人員聘用條例及_相關規(guī)定辦理。九、本契約以中文本為準。如中、英文二本互相歧異或抵觸時,以中文本為準。十、本契約法律糾紛以_法院為第一審管轄法院。十一、本契約乙式參份,除一份由甲方報院備查外,另由雙方各執(zhí)乙份。甲方(簽章):_乙方(簽章):_年_月_日_年_月_日附件This Agreement is made and entered into on the _day of _ , _by and between _( xxtitute or Preparatory Office ), Academia Sinica ( hereinafter referred to as A ) a
5、nd_( hereinafter B ).Whereas, A is willing to offer B employment, and B is willing to accept such employment subject to the following terms and conditions:(1)、Term of EmploymentThe parties agree that the term of this agreement shall be mencing from this _ day of _ , _ to the_day of _ , _.(2)、Remuner

In the event that B violates any law or regulation, or breaches this Agreement or working rules concerned, A
8、may in its discretion reprimand B or terminate this Agreement. A also reserves the right to xxtitute suit agaxxt B for civil pensation or to impose criminal liability.(4)、2During the term of this Agreement, B shall ply with the directions and xxtructions of his/her supervisors, perform his/her dutie
9、s in accordance with all regulations and relevant working rules. Where B violates any obligation specified in this paragraph and the case is considered to be serious in nature, A may in its discretion terminate this Agreement. If at any time the parties intend to terminate this Agreement due to caus
10、es beyond the reasonable control of such party, either shall give thirty(30) days notice of cancellation to the other party prior to the intended termination date. B shall vacate his/her office under and pursuant to the stipulations agreed upon by both parties. B shall submit to the proceedings in p
11、rescribed manner as to be vacated of his/her office.In case of any one of the following conditions which is due to Bs fault,B shall be responsible for pensation:(1) Where B inflicts damage to or excessively abuses machinery, equipment, tools, raw materials, products or other article belonging to Aca
12、demia Sinica;(2) Where B mits torts;(3) Where B violates As ownership of intellectual property rights.(5)、B shall ply with any administrative regulations and rules provided by A. In regard to the matters of absence on leave, pay-as-you-go contribution benefit, labor xxurance and national health xxur
13、ance, the following terms and conditions shall be applicable.(5)、1Absence on leave shall be operated pursuant to Regulation of Absence on leave for Personnel served in all Executive Yuan organizations under Civil Contractual Relationship.(5)、2The deduction and grant of pay-as-you-go contribution ben
14、efit shall be operated pursuant to Regulation of pay-as-you-go contribution benefit for Personnel served in all organizations and schools under Civil Contractual Relationship. Certain amount of salary shall be deducted per month and accrue on the financial xxtitute over the term of this employment.(
15、5)、(2)、1An amount equal to seven percent ( 7) of the monthly salary shall be contributed. Fifty percent ( 50) of the contribution shall be drawn from Bs monthly salary. ( hereinafter called personal contribution benefit) A shall provide the other fifty percent ( 50) of the contribution ( hereinafter
16、 called public contribution benefit), and shall open a special account on financial xxtitute as to accumulate and manage this contribution (personal plus public) .(5)、(2)、2The total amount of the contribution benefits (personal plus public) shall be granted to B, if at any time (a) B leaves the offi
17、ce on the expiry of this Agreement, (b) B vacates the office prior to the expiration date with the consent of A, and (c) B deceases due to undertaking of duty, illness or accident.(5)、(2)、3The amount of personal contribution benefits accumulated shall be granted to B, if at any time (a) A terminates
18、 this Agreement inasmuch as B breaches any obligation, and (b) B resigns from the office prior to the expiration date without the consent of A.(5)、(2)、4Any matter or event not provided in the context of this Article shall be operated pursuant to Regulation of pay-as-you-go contribution benefit for P
19、ersonnel served in all organizations and schools under Civil Contractual Relationship and relevant regulations.(5)、3During the term of this Agreement, A shall xxure B subject to the terms and conditions pursuant to labor xxurance regulations and national health xxurance regulations.(6)、Both parties
20、agree that A shall own proprietary right pertaining to the literary works or achievements pleted by B under the projects initiated or coordinated by A during the term of this Agreement. The ownership of intellectual property rights ( including but not limited to certain patents, trademarks, copyrigh
21、ts, technical information and know-how ) accrued from the literary works or achievements herein contained is subject to the relevant regulations and rules provided by A.(7)、ExpirationAt the expiration of the term of this agreement, the employment relationship shall automatically terminate without an
22、y condition. A new employment agreement shall be signed for the renewal and continuance of such relationship, if agreed to any by both parties.(8)、)Any matter or event not provided in the context of this Agreement shall be governed by and interpreted in accordance with Employment Regulation for Pers
23、onnel under Civil Contractual Relationship (stipulated by Academia Sinica ) &; Employment Regulation for Personnel served in all Executive Yuan organizations under Civil Contractual Relationship.(9)、Governing LanguageThe Chinese text of this Agreement shall be deemed the original. In the event of any dispute or misunderstanding as to the interp retation of the language or terms of this Agree
