5、 to Chin ese citize ns as follows:第一條甲方同意將組織成行的旅游團交由乙方接待，乙方同意按照雙方確認的接待標(biāo)準(zhǔn)，安排旅游團的旅行游覽活動。第二條 Party A agreed to employ Party B to provide tourism services to tourism groups orga ni zed by Party A. Party B agreed to provide such services according to the arrangements confirmed by both parties.第三條第四條 甲方應(yīng)在

6、旅游團進入目的地國境之日 20 天前向乙方預(yù)報團隊信息；乙 方應(yīng)當(dāng)在接到甲方預(yù)報后 2 個工作日內(nèi)予以回復(fù)。甲方應(yīng)當(dāng)在旅游團進 入目的地國境之日前 5 個工作日內(nèi)，以書面形式向乙方提供下列資料： 第五條 Party A shall notify Party B preliminarygroup information 20 daysprior to the planed arrival date; Party B shall respond to Party A within 2 working days after receipt of the notice. Party A shall p

7、rovide following detailed information in writing to Party B 5 days prior to the planed arrival date:1接待標(biāo)準(zhǔn)； Accommodation Standard;2游程安排； Itinerary;3 旅游者名單（含姓名、性別、出生年月、職業(yè)、國籍、證件名稱、號碼）;Tourist Details4 所需房間數(shù)； Rooms Needed5 入境航班或車次。 Flight Information6乙方應(yīng)按上述要求向甲方做出報價。 上述信息和乙方的報價經(jīng)雙方確認 后作為執(zhí)行該次旅行的標(biāo)準(zhǔn)。 如果甲方取

8、消該旅行團， 應(yīng)在旅行團發(fā)團 14 天前通知乙方，以便乙方進行相應(yīng)安排。如果在 14 天內(nèi)通知，甲方 應(yīng)支付團費的 50%作為補償。Party B shall provide fee quotation to Party A based on the above information. Both parties, upon confirmation of the aforesaid, shall perform relevant trips accordingly. Party A shall notify Party B 14 days prior to departure date in

Otherwise, 50% of the group fees shall be paid to Party B as compensation.甲方應(yīng)保證旅行團成員持有前往目的地國家/ 地區(qū)的有效護照和簽證。Party A shall be responsible for validity of tourists passportand visa.第三條 除非雙方另有約定，甲方應(yīng)當(dāng)在旅游團進入目的地國境之日前，用電匯 方式把旅游團的全部旅行費用匯入乙方帳戶。Unless otherwise agreed, Party A shall remit

10、 group fees to the followingbank account of Party B by T/T prior to arrival date of the group: 開戶銀行如果甲方未能按本合同規(guī)定支付相關(guān)款項，每逾期一日，應(yīng)向乙方支付 未付款項的千分之一作為違約金，并賠償乙方的其他損失。In case of any delay in the above payment, Party A shall pay 0.1% of outstanding amount as liquidated damagefor each day delayed, and compensat

11、e for any loss of Party B.第四條 如因甲方操作失誤或甲方的其他原因造成旅游團行程延誤、 更改、 取消 所產(chǎn)生的經(jīng)濟損失(包括但不限于乙方的損失)由甲方承擔(dān)。Party A shall be responsible for any loss (includingbut notlimited to loss of Party B) causedby delay, modification orcancellation of the groups due to reasons attributable to Party A.第五條 乙方應(yīng)當(dāng)按照本合同和合同附件約定及雙方確認

12、的標(biāo)準(zhǔn)和日程安排為 旅游團提供服務(wù)。除人力不可抗拒或乙方不能控制的因素外，如乙方未 按約定的接待標(biāo)準(zhǔn)和日程安排向旅游團提供服務(wù)，應(yīng)當(dāng)提供補償服務(wù)或 將低于服務(wù)標(biāo)準(zhǔn)的費用差額退還甲方。除人力不可抗拒或乙方不能控制 的因素外，如因乙方的原因變更旅行日程、交通工具、食宿標(biāo)準(zhǔn)等所增 加的費用由乙方承擔(dān)。Party B shall provide services according to the agreed schedule and standards. Otherwise, Party B shall compensate price difference to Party A and bear

13、the cost of changes of itinerary, transportation and accommodation, unless such changes are caused by force majure and/or reasons not attributable to Party B 第六條 如果接待國法律有強制性要求， 乙方應(yīng)當(dāng)為旅游團委派持有導(dǎo)游證的導(dǎo) 游人員提供服務(wù)。乙方導(dǎo)游不得強迫或誘導(dǎo)旅游者購物；旅游者在乙方 指定的商店購物，經(jīng)鑒定，如屬偽劣假冒商品的，乙方有責(zé)任協(xié)助退換。 乙方導(dǎo)游不得誘導(dǎo)旅游者涉足色情場所和賭毒場所，不得強迫旅游者參 與自費項目。If

14、 required by local law compulsorily, Party B shall provide licensed tour guide for the groups. Tour guide shall not force tourist to shop or participate in program not included in the schedule or induce tourist to visit pornographic, gambling or drug places.第七條 甲方旅游團搭乘飛機、 輪船、汽車或在飯店、 餐廳等各項旅游設(shè)施 （區(qū)） 中受

15、到損害，或遇到戰(zhàn)爭、地震、海嘯、傳染性疫病等突發(fā)安全事件， 乙方必須立即向甲方反饋信息。如不屬乙方責(zé)任，乙方也應(yīng)盡人道主義 義務(wù)協(xié)助處理；如屬乙方責(zé)任，乙方應(yīng)當(dāng)負責(zé)處理。Party B shall notify Party A of any emergency of the groups or tourists and provide assistance in handling of such emergencies.第八條 甲方旅游團在進入目的地國境被阻時，除甲方或旅游者自身的原因外， 乙方應(yīng)當(dāng)積極協(xié)助處理；如屬乙方原因，乙方應(yīng)當(dāng)負責(zé)處理。 If the groups encounter

16、difficulties of entry into destination country due to reasons of Party A or tourists, Party B shall provide necessary assistance; Party B shall be responsible to resolve such difficulties in case they were caused by reasons of Party B.第九條 乙方未按雙方確認的接待標(biāo)準(zhǔn)為旅游團提供服務(wù)，造成旅游者經(jīng)濟損 失，乙方應(yīng)當(dāng)承擔(dān)賠償責(zé)任；甲方有權(quán)向乙方政府旅游管理機構(gòu)投訴

17、并 要求賠償。Party B shall compensate losses of tourist if Party B did not provide services according to agreed standards; Party A has the right to file complains against Party B with relevant tourism administrative authorities and claim compensation.第十條 乙方有責(zé)任使甲方知曉目的地國家的法律和有關(guān)規(guī)定的概況。 甲方應(yīng)當(dāng) 要求旅游者遵守目的地國家的法律和有關(guān)

18、規(guī)定。Party B shall introduce general legal and regulatory requirement of destination countries to Party A. Party A to request tourists to comply with local laws and regulations of destination countries.第十一條 乙方對旅游團的報價或雙方對本合同項下具體旅游團的安排文件， 經(jīng)雙方書面認可后，作為本合同的附件。本合同正文和合同附件為不可 分割的整體，具有同等的效力；兩者如有不符，應(yīng)以附件為準(zhǔn)。Quota

19、tion of Party B and other transaction documents in respect of specific trip or group should, upon confirmation of both parties, be deemed as appendixes of this contract. In case of any inconsistence between this contract and appendixes, the appendixes shall prevail.第十二條 甲方在此確認本合同及其項下交易將由其 /_ 分支機構(gòu)實 施

20、，甲方對該分支機構(gòu)的行為承擔(dān)連帶責(zé)任。Party A confirms this contract is to be performed by its branch/. Party A agreed to assume joint and several liabilities for its branch.第十三條 本協(xié)議項下的往來文件可以是復(fù)印件、傳真、電子郵件或其他非原 件形式。 該等非原件的往來文件經(jīng)適當(dāng)送達后應(yīng)被視為有效并具有約束 力。Transaction documents under this Contract can be madein fax, email, photoco

Such non-original documents shall be deemedvalid and binding if properly delivered. 第十四條 乙方在本合同項下的賠償責(zé)任限于其獲得的保險賠付。在此之外， 乙方的全部賠償責(zé)任的總額不超過其就相關(guān)旅游團從甲方收取的費用的 數(shù)額。任何一方均不對另一方的間接或結(jié)果性損失承擔(dān)責(zé)任，包括但不 限于收入、利潤、商業(yè)機會或商譽的損失。Compensation made by Party B under this contract shall be limited to the amount of its insurance recovery. In addition, total liabilities of Party B shall not exceed relevant group fees.
