After months of stay, Party B mayterminate this Agreement by giving months prior notice in written without being liable therefore.32.2 在租期開(kāi)始前,出租房屋及附件二所列設(shè)備應(yīng)已裝修或安裝布置完畢,電話、寬帶、電視均已開(kāi)通,處于可供租賃的良好狀態(tài)。甲方應(yīng)按時(shí)交付出租房屋及附件二所列設(shè)備,如有逾期,乙方有權(quán)解除本租約,甲方應(yīng)應(yīng)返還乙方已付押金及剩余租金,并向乙方支付相當(dāng)于兩個(gè)月租金的違約金。The Leasing Premises and the f

6、me , iffails ,Party B has the right to terminate this Agreement, and PartyA shallreturn the depositand prepaid rentto PartyB and shallpay Party B the compensation of amount which equals to twomonths rent.2.3 租期屆滿(mǎn),甲方有權(quán)收回出租房屋及附件二所列全部設(shè)備,乙方亦應(yīng)如期交還;乙方如要求續(xù)租,則享有優(yōu)先續(xù)租權(quán),但必須在本租約期滿(mǎn)前2 個(gè)月向甲方提出書(shū)面申請(qǐng),租金雙方另行協(xié)商。4租賃終止或解
7、除時(shí),如甲方不及時(shí)接收房屋,乙方有權(quán)將房屋鑰匙按通訊地址寄給甲方,以此視為乙方交還完畢以及甲方驗(yàn)收合格。On expiryof this lease term , PartyA has the right totake back the leased property(including all the furnituresdetailed in Appendix II)in full, and Party B shall take backthe leased propertyon time. IfParty B wishes to renew the LeasedPremise, Part
8、y B shallhave the priorityto renew the leasewitha written notice 2 months in advance to Party A. The renewalrental shall be negotiated between the two parties uponextension.On expirationor terminationof thelease , ifPartyA fails to take over the property in a timely manner, Party Bmay deliver the ke
9、ys to the property to Party A, which shallconstitute a completion of return by Party B and satisfactoryacceptance by Party A.2.4 除本合同另有約定外,租賃期內(nèi)乙方如需提前退租,應(yīng)提前 30 日通知甲方,并向甲方支付相當(dāng)于兩個(gè)月租金的違約金。Unless other agreed in thisAgreement, duringthe termof Agreement , If party B terminates the Tenancy Agreement,Party
10、 B shall inform Party A 30 days in advance and shall pay5Party A the compensation which equals to two monthss rent.第3條租金:Rent:3.1 租金每月為人民幣元整,包括家具、電器(見(jiàn)附件二)物業(yè)管理費(fèi)、房租完稅發(fā)票、衛(wèi)星電視的開(kāi)通費(fèi)、電話和寬帶M 開(kāi)通費(fèi)以及 .The rent shallbe RMBper month,including:furnitures,electricalappliances(See appendix II ), management fee , ta
11、xinvoice , SatelliteTV installationfee , M speed internetandtelephone installation fee and . .3.2 租金每個(gè)月支付一次,每次支付金額為元。甲方應(yīng)于每個(gè)支付周期開(kāi)始日前10 日內(nèi)向乙方開(kāi)具相應(yīng)金額的租賃發(fā)票, 乙方應(yīng)在收到甲方正式完稅發(fā)票后個(gè)工作日內(nèi)向甲方指定賬戶(hù)支付月租金。如若甲方未按時(shí)提供有關(guān)發(fā)票,乙方有權(quán)延付租金。若乙方收到發(fā)票后未按上述期限付款,則每逾期一日,應(yīng)按未付租金的千分之三向甲方支付滯納金。Party B shallpay each months rent which equals t

In case Party B fails to pay therent after receiving the invoice as agreed in the Tenancy,penalty of 3 for each overdue payment should be charged.3.4 租金以人民幣支付。在本租約有效期內(nèi),租金不予調(diào)整。The rent shall be paid in RMB. The rent cannot be adjusted during the term of this
14、 TenancyAgreement.第4條押金:Deposit :4.1 本租約簽訂之日起個(gè)工作日內(nèi)且起租日前,乙方應(yīng)向甲方繳付相當(dāng)于個(gè)月租金額的租賃押金計(jì)人民幣元。甲方應(yīng)于乙方將水、電、煤、電話費(fèi)、寬帶等費(fèi)用及其他損壞賠償費(fèi)用(如有)結(jié)清后 7 個(gè)工作日內(nèi)將押金退還。Within working days after signing of this LeaseAgreement and before the lease start date, Party B shall payto Party A months rent as deposit, and the amount of depos
15、it7is RMBin total.Party A shallB within7 working days afterare cleared.returnthe depositin fullto Partyallthe utilityfee and damagefees4.3 甲方因乙方違反本合同的規(guī)定而受的損失,可在押金中扣抵合理數(shù)目,在甲方做出該種扣抵前,需書(shū)面通知乙方將被扣抵的金額和理由,乙方有權(quán)拒絕不合理或不公正的抵扣,不足部分乙方必須在接到甲方付款通知后15 個(gè)工作日內(nèi)補(bǔ)足。Party A maydeduct a reasonable amount from the security
16、 deposit towards payment of any actual damages Party A may have incurred or suffered as a result of Party Bs breach of thisAgreement. Before making such deductions , PartyA shall informParty B with written notice of the amount which it intends todeductand thereason formaking such deductions.PartyB s
17、hallbe entitled toobject to such deductions ifPartyB believes thatsuch deductionsare unreasonable or unjustified.If thesecuritydeposit is not sufficient, Party B must pay the deficiencywithin15 working days ofthe receipt ofa demandfromParty A.4.4 押金以人民幣支付,甲方收到押金時(shí)應(yīng)向乙方開(kāi)具收據(jù)。The deposit shall be paid in

Party A shall issue an official receipt to Party B upon the receipt of deposit.8第 5 條 其它費(fèi)用:Other Charges :5.1 乙方在租賃期內(nèi)所用的水、 電、煤氣(天然氣),物業(yè)管理公司或公共事業(yè)部門(mén)將每月按房屋實(shí)際耗用量結(jié)算,由乙方按單繳付。During the period of Lease term, Party B shall paymonthly charges for usage of water , electricity, gas based onthe actual con
19、sumption amount billed by the management office or relating government utility bureaus.5.2 乙方所用電話,按電信部門(mén)相關(guān)標(biāo)準(zhǔn)收費(fèi), 每月根據(jù)實(shí)際用量結(jié)算,由乙方按單繳付。Telephone bills shall be paid by Party B and based on the actual usage according to the relevant standard of the the telecommunication bureau.第 6 條 甲方的權(quán)利和義務(wù):Landlords Rig
20、hts and Obligations:6.1 本租約簽訂后,甲方不得無(wú)故收回房屋,如甲方中途要求收回房屋或擅自解除合同,乙方有權(quán)拒絕。在征得乙方書(shū)面同意解9除租約后,甲方應(yīng)返還乙方已付押金及剩余租金,并向乙方支付相當(dāng)于兩個(gè)月租金的違約金。Party A is not permittedto take back the leased propertyor terminatethisAgreement during the term of Agreement withoutany reason. If Party A wishes to do so, Party B has the rightt
21、o refuse.Upon the writtenconsent of PartyB to terminatetheLease Agreement, PartyA shallreturnthe depositand prepaidrentto Party B and shallpay PartyB the compensation of amountwhich equals to two months rent.6.2 甲方應(yīng)確保房屋的各項(xiàng)附屬設(shè)施以及家具家電均處于完好、可租賃狀態(tài)。如上述各項(xiàng)出現(xiàn)損壞或不能正常工作,甲方在收到乙方發(fā)出的通知后24 小時(shí)內(nèi)迅速修理或修繕該損壞處。 若 3 個(gè)日歷
22、日內(nèi)甲方仍不能修繕或修繕無(wú)效,乙方有權(quán)停止并免于支付租金直到上述情況改進(jìn)至乙方合理滿(mǎn)意為止,直至上述影響居住的情況改進(jìn)至乙方合理滿(mǎn)意為止。情況嚴(yán)重影響乙方正常居住的,乙方有權(quán)以書(shū)面形式通知甲方解除本租賃合同,租金付至合同解除日,甲方應(yīng)返還乙方已付押金及剩余租金,并向乙方支付相當(dāng)于兩個(gè)月租金的違約金。Party A will maintain and keep all the equipments and fixtures in good leasing condition.If any of them was damagedor cannot work in good manner, Part
23、yA should repairor remedyany defectswithin24 hours afterbeing notifiedof such defect10by Party B, IfParty A failsto improve the bad situationwithinthree (3)calender days, PartyB shallbe entitledto withholdand exempt from Rent untilrectificationof the situationto bethe reasonable satisfaction of Part

If the events affectedthe normal livingof the occupant of the Premises designatedbyParty B badly, Party B shall issue a written notice to PartyA to terminate this Lease Agreement, Party A shall return thedeposit and prepaid rent to Party B and shall pay Party B the compensation which equals to
25、two monthss rent.6.3 甲方謹(jǐn)在此聲明及保證甲方為出租房屋的合法擁有人并有合法地位出租此房屋于乙方。就本合同及出租此出租房屋予乙方之事,甲方已取得所有有關(guān)機(jī)構(gòu)的批準(zhǔn),包括政府批準(zhǔn)及 / 或抵押權(quán)人的同意(如適用)甲方于本合同所做出的聲明及保證,如有錯(cuò)誤或違反者,甲方須就乙方因此而引致的任何損失、損害、支出及費(fèi)用做出全部補(bǔ)償。Party A hereby represents and warrants that Party A isthe legal owner of the leasing Premises and has the necessarylegalcapacity
26、to lease the propertyto Party B. Party A has alsoobtained all the necessary authorizations from all relevantauthoritiesin the PeoplesRepublic of China in respectof thisLease Agreement and the leasingof the leasingPremises to Party11B, including any necessary government approvals orregistrationsand/o
27、r mortgagee consent(ifapplicable) PartyA shall continue to be liable to keep Party B fully indemnified against any costs , expenses , losses and damages suffered by Party B due to any breach of Party A to its above-mentioned guarantee.6.4 如在租賃期內(nèi),出租房屋發(fā)生所有權(quán)全部或部分的轉(zhuǎn)移、或其他影響乙方權(quán)益的事情時(shí)(甲方出售房屋或者抵押房屋),甲方應(yīng)保證所有權(quán)
28、人或其他影響乙方權(quán)益的第三者,能繼續(xù)遵守本合同所有條款。縱使出租房屋已被轉(zhuǎn)移,如乙方于本合同下的權(quán)益受此等所有權(quán)人或第三所影響或損害,甲方須負(fù)責(zé)補(bǔ)償乙方的所有損失。If during the lease term, all or part of the leasingPremises is transferred or mortgaged to a third party by PartyA, or Party Bs right to use the leased property is otherwise affected , Party A shall ensure that such t
29、ransferee or third party having an effect on Party Bs right to use the leasing Premises will continue to abide by the terms of this Lease Agreement. Even if the leased Premises is transferred where a transferee or a third party affects Party Bs interests underthis Lease Agreement, Party A shall cont
30、inue to be liable to12keep Party B fully indemnified against all damages suffered byParty B.6.5 甲方應(yīng)提供無(wú)毒無(wú)害的居住環(huán)境。如果該房屋中存在有害氣體、噪音或者其他危害健康的情形,經(jīng)執(zhí)證機(jī)關(guān)通過(guò)專(zhuān)業(yè)檢測(cè)后證明房屋內(nèi)的有害氣體、噪音或者其他情形確實(shí)超過(guò)國(guó)家規(guī)定的健康標(biāo)準(zhǔn)的,乙方有權(quán)憑檢測(cè)報(bào)告解除本協(xié)議,甲方應(yīng)返還乙方全額押金和剩余租金。Party A shall provide harmless circumstance. If thereis poisonous gas, and other cas
31、es which are hazardous to healthin the apartment , which exceed the standard regulated by government, Party B has the right to terminate this Agreement immediately. Party A shall refund the whole amount of deposit and the prepaid rent to Party B.6.6 除本合同另有約定外,若甲方違反此租約的任何條款并在乙方發(fā)出書(shū)面通知15 天后仍未改正,乙方有權(quán)解除此
32、租約,收回押金,且有權(quán)要求甲方支付相當(dāng)于兩個(gè)月租金的違約金,同時(shí)租金付至合同解除日。Unless other agreed in this Agreement, Party B shall13have the right to terminate the Lease Agreement when Party A breaches the Lease Agreement and fails to remedy the breach afterfifteen (15) days of giving written notification of Party B. Party B shall be
33、entitled to withdraw the deposit and request Party A to undertake the compensation which equals to two monthss rent. The rental should be paid till the termination of Agreement.第 7 條 乙方權(quán)利和義務(wù):Tenants Rights and Obligations:7.1 乙方應(yīng)按期交納押金、租金及其他費(fèi)用。若超過(guò)限定期限 30 個(gè)工作日,乙方無(wú)正當(dāng)理由仍未支付的, 則甲方有權(quán)解除本租約,并要求乙方承擔(dān)相當(dāng)于兩個(gè)月租金
34、的違約金。Party B should pay the deposit , rentand otherchargesaccordingto the Agreement term. IfParty B failsto pay the abovementioned fee forover 30 working days withoutjustfulreason ,Party A has the rightto terminatethisagreement, PartyB shallpay Party A the compensation of amount which equals to two
35、months rent.7.2 租賃期內(nèi)未經(jīng)甲方同意,乙方不能轉(zhuǎn)租其所租房屋,私自轉(zhuǎn)租無(wú)效。14During the lease term, unless with the agreement ofParty A , Party B cannot sub-let or let in part or in full theleasing Premises.7.3 乙方應(yīng)愛(ài)護(hù)房屋及其設(shè)備,如因使用不當(dāng)而導(dǎo)致?lián)p壞,乙方應(yīng)負(fù)責(zé)賠償。Party B must take good care of the property ; otherwise Party B should pay compensatio
36、n to Party A for his improper use of the property.7.4 除房?jī)?nèi)已有的裝飾和設(shè)施外,乙方如要增加設(shè)備或其他裝修須征得甲方同意。租賃期滿(mǎn),乙方向甲方交還房產(chǎn)時(shí),除雙方另有約定外,應(yīng)恢復(fù)其原狀(正常磨損除外)未經(jīng)甲方書(shū)面同意,乙方不得擅自設(shè)立、安裝或移動(dòng)設(shè)施及設(shè)備,不能擅自設(shè)立隔斷,不得擅自對(duì)房屋的結(jié)構(gòu)改動(dòng)或增加。In additionto thedecorationand equipment alreadyinthe property, if Party B wishes to make any alterations ordecorationt
37、o such property , PartyB should get the consent ofParty A. On completionof the Lease term , PartyB must hand overthe property to Party A in its original condition(except fornormal wear ) Party B shall not erect, install or remove anyfixturesor partitioning, orto make any structuraladditions15and alt
38、erations without the prior written consent of Party A.7.5 由于乙方或乙方關(guān)聯(lián)人員的粗心、疏忽或故意而造成房屋的損害或損失的,乙方應(yīng)當(dāng)承擔(dān)賠償責(zé)任,并允許甲方或其授權(quán)人在事先通知后進(jìn)入房屋,對(duì)房屋的損失或損害進(jìn)行彌補(bǔ)及修復(fù),由此所發(fā)生的費(fèi)用由乙方負(fù)擔(dān)。Party B shallindemnifyParty A from any loss or damagesto the leased property from negligent act or omission of PartyB or its connecter and shall p
39、ermit Party A or his authorizedrepresentativeswith advance noticeto enter the leased propertyto repair any such loss or damage at the expense of Party B.7.6 租賃期間,乙方必須嚴(yán)格遵守中華人民共和國(guó)的有關(guān)法律、細(xì)則、規(guī)章及法令的規(guī)定,不得利用房屋進(jìn)行違犯法律及不道德的行為。Strictlyto comply and adhere in the usage of the leasedpropertyaccordingto alllaws ,
40、regulationsand decrees of thePeoplesRepublic of China , and specificallynot to permit theleased property to be used for any purpose that is unlawful or immoral.第8條違約責(zé)任16Breach of Agreement任何一方違反本協(xié)議的規(guī)定, 或其他在本協(xié)議內(nèi)所作的陳述、保證或承諾,造成另一方經(jīng)濟(jì)損失的,違反方應(yīng)依照合同約定承擔(dān)相應(yīng)的違約責(zé)任和賠償責(zé)任。Any Party who breaches the provisionsof th
41、isAgreement,or itsrepresentations,warrantiesor convents madehereunder ,causing the other Party loss, shall bear responsibility forcompensation according to the Agreement term.第9條不可抗力Force Majeure房屋由于火災(zāi)、 惡劣天氣、戰(zhàn)爭(zhēng)或其它不可抗力因素,而不是因?yàn)橐曳街苯踊蜷g接的疏忽及故意行為造成房屋毀壞而不能被正常使用及居住時(shí),乙方從該日起停止支付租金,直至房屋可再被使用及居住時(shí)為止。若甲方根據(jù)自己的意愿及經(jīng)
42、濟(jì)、實(shí)際意義等原因認(rèn)為沒(méi)有必要修繕復(fù)原房屋時(shí),應(yīng)書(shū)面通知乙方,并在做出上述通知后三日內(nèi)將押金及預(yù)付租金全部退還乙方。If the leased property are substantially destroyed ordamagedby fire , bad weather , war , and other factorsof ForceMajeure , and not attributable directly or indirectly to the17negligenceor maliceofPartyB or areotherwiserendered unfitforuse o
43、roccupation, therent shallcease tobe payablefromthedate the leased propertybecome unfit for use or occupationuntiltheleased propertyshallagain be renderedaccessibleandfit for use, however , that the Party A shall be under noobligation to repair the leased property, when in Party Asopinion , it is no
44、t reasonably or economically or practicallyto do so. Ifsuch an event occurs , PartyA shallgive a writtennotice to Party B, and the deposit and the rest of rent paidby Party B shallbe returnedin fullwithin3 days of said notice.第 10 條 適用法律及爭(zhēng)議的解決:Legislation & Arbitration of the Dispute:本租約受中華人民共和國(guó)法律的約
45、束,如發(fā)生與本租約有關(guān)的爭(zhēng)議,由雙方友好協(xié)商解決, 協(xié)商不成,按下列第 _種方式解決:( 1)提交 _仲裁委員會(huì)仲裁;( 2)依法向租賃房屋所在地人民法院起訴。This Lease Agreement shall be governed by the laws ofthe PRC. In case any dispute arises over this agreement, the18two Parties shall negotiate friendly, if failed, each partymay dispose accordingto the _ meansas stipulatedas below ,1) submititto ArbitrationCommittee for arbitration.2) appeal to the Peoples Court at the place where the Leasing Premises locates.第11條通知Notice甲方和乙方特此約定,所有關(guān)于對(duì)方的權(quán)利或義務(wù)的交給對(duì)方的通知應(yīng)書(shū)面做出,并由通信員、郵件、傳真或急件信使送至扉頁(yè)地址。任何一方名稱(chēng)或地址發(fā)生任何變更應(yīng)立即書(shū)面告知對(duì)方,否則應(yīng)自行承擔(dān)由于不能送達(dá)導(dǎo)致的法律后果。PartyA
