出入境合作協(xié)議書-中英文對照版

3、wing agreement.一、工作戈U分 /Work management:甲方將自行組織的出境旅游客人交由乙方接待，甲方負(fù)責(zé)本地區(qū)內(nèi)出境旅游線路推銷、招攬客人、辦理護(hù)照、收取旅游費(fèi)用事宜，乙方負(fù)責(zé)出境團(tuán)隊(duì)的安排游客境外段接待事宜。甲乙雙方各對職內(nèi)工作承擔(dān)相關(guān)的責(zé)任與義 務(wù)，享受相關(guān)的權(quán)利.country responsibly beyond the border teamThe party of the first part will organize to leave country voluntarily the traveling visitor to hand over by t

5、on matters concerned.Armor secondgrade both sides work respectively to the duty in undertake the correlation responsibility and the duty , enjoys the correlation the right.二、質(zhì)量保證 /Quality management :雙方必須認(rèn)真操作。 保證質(zhì)量，做好前后環(huán)節(jié)的銜接，避免出錯(cuò)，以優(yōu)質(zhì)的服務(wù)做好每一個(gè)出境團(tuán)隊(duì)（或散客）的接待工作.雙方應(yīng)當(dāng)就出境旅游的行程、標(biāo)準(zhǔn)、購物等情況向客人做如實(shí)陳述，不做虛假、誤導(dǎo)性的書面或口頭

6、宣傳。乙方應(yīng)當(dāng)本著謹(jǐn)慎、周到的原則，按照甲乙雙方協(xié)商后確認(rèn)的行程標(biāo)準(zhǔn)為客人提供旅游服務(wù)。Both sides must operate earnestly.Guarantees the quality around , completes the link engagement , avoids making a mistake, completes each leaves country the team (or individual tourist) the reception work by the high quality service.The second party must i

8、armor second grade both sides which confirmed for the visitor to provide the traveling service 。三、團(tuán)隊(duì)出境前雙方義務(wù)/Group leaves country the bilateral duty:雙方應(yīng)隨時(shí)保持信息交流，及時(shí)勾通情況，雙方必須最遲于出境前十天做出團(tuán)隊(duì)最后確認(rèn)（“黃金周”、圣誕 節(jié)等旺季期間計(jì)劃要提前預(yù)報(bào)，具體要求按實(shí)際作業(yè)情況商定）Both sides should maintain the communication as necessary , colludes with t

10、費(fèi)用的確認(rèn)均以傳真為依據(jù)，雙方按約定的接待標(biāo)準(zhǔn)和日程安排為游客提供服務(wù)，如甲方操作失誤造成游客行程延誤、更改、取消所產(chǎn)生的經(jīng)濟(jì)損失由甲方承擔(dān)，除人力不可抗拒因素外，如乙方未 按約定的標(biāo)準(zhǔn)和日程向游客提供服務(wù)，應(yīng)當(dāng)為游客提供補(bǔ)償服務(wù)或?qū)⒌陀诜?wù)標(biāo)準(zhǔn)的費(fèi)用差額退還甲方（或在甲 方許可的情況下直接退還給游客）The mutual consent to leaves country the team traveling schedule expense confirmation take the facsimile as the basis , both sides provides the serv

13、part （or returns directly in situation which the party of the first part permitted for tourist ）.五、第三方責(zé)任 /Third party :如果甲方客人因特殊原因在簽證簽出的情況下要求退團(tuán)，則所產(chǎn)生的簽證費(fèi)用及機(jī)票損失費(fèi)用，應(yīng)由甲方或其客人自彳f承擔(dān).Because if the party of the first part visitor special reason signs in the visa in the situation the request withdraws from t

14、he Chinese communist youth league, then produces the visa expense and the airplane ticket loss expense , should undertakes voluntarily by the party of the first part or its visitor 。在境外參團(tuán)期間，如甲方客人由于自身過錯(cuò)、自由活動(dòng)等行為或自身疾病引起的人身、財(cái)產(chǎn)損失由客人自行 承擔(dān)，乙方有義務(wù)協(xié)助處理。在境外參團(tuán)期間，如甲方客人違反有關(guān)國家或地區(qū)法律、法規(guī)而被懲罰、拘留、遣返及追究其他法律責(zé)任的，相關(guān)責(zé)任和費(fèi)用由甲

17、e party of the first part's visitor。六、投訴處理 Dispose of complaint:雙方對出境團(tuán)隊(duì)（或散客 ）提出的投訴，應(yīng)相互配合 ，調(diào)查核實(shí)，如投訴屬實(shí)，根據(jù)投訴內(nèi)容的責(zé)任范圍，由責(zé) 任方承擔(dān)相應(yīng)的責(zé)任，做出解釋道歉，并根據(jù)相關(guān)法律規(guī)定合理賠償客人損失.如乙方在接待中出現(xiàn)嚴(yán)重服務(wù)質(zhì)量或信譽(yù)問題，甲方有權(quán)向乙方提出，責(zé)成乙方整改，直接取消與乙方的合作，并可根據(jù)實(shí)際受損情況，要求乙方賠償損失。Both sides to leave country the suit which the team (or individual tourist )

20、 according to the actual damage situation, requests the second party to pay indemnity for the damage.七、處理事故 /Adjudicate a dispute:甲方在出團(tuán)前需向客人清楚解釋出境旅游過程中的注意事項(xiàng)及安全問題，并建議客人自行購買保險(xiǎn)。在境外發(fā)生任何意外事故，雙方將協(xié)助處理問題.雙方都有責(zé)任和義務(wù)積極預(yù)防，杜絕事故隱患。The party of the first part in leaves in front of the group to have to the visitor

22、y and the voluntary positive prevention , ceases the accident hidden danger.八、結(jié)算團(tuán)款/Clearing form:雙方同意按 機(jī)票、簽證款全額以及地接款80%以(現(xiàn)金/公司成對支票/匯款)在出團(tuán)前支付.地接費(fèi)用20%以(現(xiàn)金/公司城對支票/匯款)作為尾款在團(tuán)隊(duì)返回之后支付方式結(jié)算團(tuán)款,乙方應(yīng)在團(tuán)隊(duì)出發(fā)前將團(tuán)隊(duì)賬單傳真給甲方，甲方應(yīng)在收到帳單后兩個(gè)工作日內(nèi)予以確認(rèn)(傳真/掃描件)，并在團(tuán)隊(duì)出發(fā)前按約定支付團(tuán)款。如甲方未能按期結(jié)算團(tuán)款，則乙方有權(quán)利拒絕接待甲方客人.尾款在團(tuán)隊(duì)返回后(15)個(gè)工作日之內(nèi)結(jié)清。超過時(shí)間沒有

23、結(jié)算將每天支付團(tuán)隊(duì)總費(fèi)用的1%作為違約罰金。The mutual agree to pay the full amount of tickets、visa and the 80% ground cost (in cash/company pairs check/remittance) before the departure of the team, and as the balance due, the 20% ground cost should be paid (in cash/company pairs check/remittance ) after the team returns

26、account 。The ultra another day settlement has not paid the team total expense 1 % to take the violation fine.九、結(jié)算違約條約 /Clearing form break a contract:甲方如果沒有按照合約規(guī)定的期限結(jié)算團(tuán)隊(duì)費(fèi)用，乙方有權(quán)終止合作關(guān)系，并要求甲方支付因?yàn)檫`約結(jié)款而產(chǎn)生的一切費(fèi)用。If the party of the first part according to the contract stipulation deadline settlement team e

28、中雙方往來文件均系能夠證明事實(shí)的法律文件，是本協(xié)議的組成部分，全部往來文件必須以原件或本協(xié)議指定傳真號(hào)碼送達(dá)對方，文件應(yīng)加蓋如本協(xié)議簽字欄樣式的簽章或有本協(xié)議簽約代表的簽字，傳真文件應(yīng)在傳真件上顯示發(fā)送方傳真號(hào)碼，以上條件具備時(shí)雙方均視為有效原件文件；以本協(xié)議指定電子郵箱發(fā)送文件的，對方收到后應(yīng)向發(fā)送方確認(rèn)回復(fù)，雙方即確認(rèn)該往來系有效法律文件。In this agreement implementation the bilateral intercourse document is can prove the fact the legal document, is this agreement
