2、hall be in accordance to the law, regulations and articles specified in the “Labor Law of the Peoples Republic of China ".與本合同相關(guān)的事宜及合同雙方的其它權(quán)利和義務(wù)都必須符合法律,法規(guī)和?中華人民共和國(guó)勞動(dòng)合同法?中所規(guī)定的條款.This contract is subject to changes as to comply with local labor laws. If local labor laws do not address the specifi
3、c terms of this contract, this contractwill prevail.本合同的制定以當(dāng)?shù)氐膭趧?dòng)法規(guī)為前提.當(dāng)?shù)貏趧?dòng)法規(guī)未涉及到的條款,將依據(jù)本合同中的規(guī)定執(zhí)行.This Employment Contract (hereinafter referred to as the “ Contract " ) is signed on the basis of equality , under the principles of willingness and agreement.本合同(以下簡(jiǎn)稱為“合同)在平等的根底上,以雙方自愿,協(xié)商為原那么簽訂的.Ti
4、tle of Position/職位名稱:The Title of the Employee is “ ESL Foreign Teacher外籍教師 ( 中文)Employment Contract Period:合同期限The contract is for a full-time employment, commencing fromuntil, including the probation period from until,本合同自年 月日生效,至年 月 日終止,其中試用期自年 月 日至年 月 日.Duties/工作責(zé)任:1. The duties to be performed
5、by the Employee include/雇員應(yīng)盡以下工作責(zé)任2. Teaching up to 5 EFL classes per day;每天上課不超過(guò)5節(jié);3. Doing/participating monthly orientation and on-job training;進(jìn)行或參與每月崗前培訓(xùn)和在職培訓(xùn);4. Doing student level placement , supervising exams and giving end-of-level tests;為學(xué)員做級(jí)別鑒定,進(jìn)行監(jiān)考并做學(xué)員的級(jí)末測(cè)試;5. English language learning c
6、ounseling;為學(xué)員的英文學(xué)習(xí)進(jìn)行咨詢;6. Participating in and organizing the school' s social programs and eventsincluding Extra Curricular Activities (ECA) for the Academic Department;參加并組織學(xué)校舉辦的各種社會(huì)活動(dòng),包括教學(xué)部的各項(xiàng)課外活動(dòng);7. Giving democlasses to potential customers to help with student recruiting;為潛在學(xué)員做演示課并幫助學(xué)校進(jìn)行招生活
7、動(dòng);8. Participating in promotional and marketing activities organized by thecenter or the Head Office;參加中央或總部組織的各種市場(chǎng)活動(dòng);9. Attending all meetings scheduled in his/her working hours, where his/herpresence is required;參加在工作時(shí)間內(nèi)召開的各種會(huì)議;10. Delivering CLT(Corp. Language Training) courses assigned by the ce
8、nter.需配合中央教授團(tuán)訓(xùn)課程.11. Other tasks assigned upon mutual agreement either by the center or byAcademic Department from the Head Office;完成其他由中央或總部組織的各種其他任務(wù).Employee' s Obligation/ 雇員的義務(wù)1. Statements madein the Employee' s curriculum vitae , resume and references together with any other informatio
9、n submitted to the Employer in support of the Employee' s application for employment are true and not misleading in any way;雇員交給校方的個(gè)人簡(jiǎn)歷及其他個(gè)人信息都必須屬實(shí),2. The Employee is entitled to apply for a working visa through our school;雇員有權(quán)利通過(guò)校方申請(qǐng)工作簽證;3. The Employee is of sound mind and in a good physical c
10、ondition;雇員必須體格健全,身心健康;4. The Employee will devote his full working time and attention to the dutiesof his employment;雇員應(yīng)該在工作時(shí)間內(nèi)將全部精力投諸工作;5. The Employee will perform the duties of his employment in a professionaland diligent manner;雇員應(yīng)該對(duì)工作盡職并敬業(yè);6. The Employee will obey the written and/or verbal or
11、ders and directions ofthe company ' s management;雇員應(yīng)該遵守校方治理的各種書面及口頭規(guī)定;7. The Employee will at all times comply with the rules and regulations of the employer and the provisions outlined in the“Foreign Employee Handbook "雇員應(yīng)該遵守校方的各項(xiàng)規(guī)章和制度及“外籍員工手冊(cè)中的條款;8. The Employee must , at all times , comp
12、ly with the laws of the P.R.C.;雇員必須遵守中華人民共和國(guó)的各項(xiàng)法律法規(guī);9. The Employee must not harm the image of the Employer or fellow workers by his/her conduct;雇員的行為不得損害校方或其他員工的形象;10. On the basis of the agreement between the two parties, the Employer mayappoint the Employee to work in his franchisee schools.在雙方協(xié)商
13、一致的根底上,校方可以將雇員派送到校方的加盟學(xué)校工作.Remuneration/ 報(bào)酬The Employee ' s remuneration includes the following items:雇員的報(bào)酬包括以下局部:1. The monthly salary of "" before tax will be paid together tothe employee on the 10th of each month. However the employee is required to cover all relevant utility expens
14、es. All the new employee should go through two months'probation. The monthly salary during the probation isbefore tax.每月稅前工資為人民幣元.工資發(fā)放日期為每月10號(hào).2個(gè)月試用期期間薪資為元.雇員自行支付房屋使用的水電等費(fèi)用.2. There will be a payment toward airfare cost of RMB at the end of this employment contract.雇員履行完本合同期后,校方將給予元的機(jī)票補(bǔ)貼.3. Afte
15、r fulfilling a one year contract, if the employee passes aTeaching/Working Performance Evaluation and wishes to continue his/her employment with World Educational Group at their original centre or other World branches , the employee can request a reevaluation of their salary and package. 雇員完本合同期后,假設(shè)
16、通過(guò)教學(xué)評(píng)估并有意在校方或校方關(guān)聯(lián)的其它中央工作,可向校方提出申請(qǐng),重新評(píng)估其薪資和各項(xiàng)待遇.Working Hours/ 工作時(shí)間1. The total working hours is 40 hours per week , including 25 teaching hours and 15 hours of class preparation , curriculum design , orientation , on-job training , academic work and activity participation. Teaching hours beyond 110
17、per month will be considered as overtime hours which will be paid monthly by 100RMB/hour. If the teacher is absent from work without permission, his/herdaily pay will be deducted and he/she will also receive a warning letter fromthe employer. The teacher will be fired if he/she receives a warning le
18、tter more than three times. During the working hours , the Employee is expected to dress in a professional manner, pants and a collared shirt for men slacks/ a skirt and a blouse for women with proper shoes in the office/classroom.2.雇員每周累計(jì)工作時(shí)間 40小時(shí),包括25個(gè)小時(shí)上課時(shí)間和15個(gè)小時(shí)的備課、培訓(xùn)、或是各種課外活動(dòng)的組織或參與.每月上課時(shí)間超過(guò)110小
19、時(shí)的算做額外的加班課時(shí),加班課時(shí)費(fèi)為100元/小時(shí).如果雇員未能通過(guò)校方批準(zhǔn)而無(wú)故缺勤,該行為屬無(wú)故礦工,除扣除當(dāng)天全部工資,必須接受警告.累計(jì) 3次以上校方有權(quán)開除該雇員 雇員在工作時(shí)間應(yīng)以正裝出席.男士著有領(lǐng)襯衫和長(zhǎng)褲;女士著裙子、襯衣、適宜的鞋子.3. The Employee will be given a daily schedule upon mutual agreement; howeverthe Employer reserves the right to change the schedule as required.校方每日會(huì)在雙方同意的根底上提供給雇員當(dāng)日工作的課程安排,
20、但是校方保存更改的權(quán)利.Taxes付稅The basic salary as referred to in section titled“ remuneration “ is beforetax , the Employee is therefore responsible for the payment of local taxes inChina and in his/her country if applicable. However , according to the laws inP.R.C. , the employer deducts the income tax from t
21、he salary for the employee every month.在“報(bào)酬 一欄所指的工資為稅前工資,雇員有義務(wù)根據(jù)國(guó)家法律法規(guī)繳納各種稅務(wù).根據(jù)中華人民共和國(guó)法律規(guī)定,校方有權(quán)每月從雇主的工資中代扣代繳個(gè)人調(diào)節(jié)稅.Other parts of the Employee ' s remuneration may be subject to the relevant regulations of tax in P.R.C.雇員的其它報(bào)酬稅金依據(jù)中華人民共和國(guó)稅務(wù)法規(guī)的相關(guān)條例執(zhí)行.Insurance/ 保險(xiǎn)The Employer shall buy the commerci
22、al insurance for the employee, which covers medical insurance and accident insurance in accordance with the localregulation.校方根據(jù)當(dāng)?shù)卣咭?guī)定應(yīng)該給予雇員購(gòu)置商業(yè)保險(xiǎn),包括醫(yī)療保險(xiǎn)和意外傷害保險(xiǎn).Visa/簽證teaching certificatesBased on the presence of legal documents (passport , educational certificateshealth report , overseas people te
23、mporary residencewith the employee on his/her, either party terminates thisrecord , photos etc.) , the HumanResource Department will assist and take care of the residence permit application process along day off.No matter under what kind of circumstances contract during the contract period , the Emp
24、loyee will be responsible for all of the cost including visa , residence permit , health check and transportation fees. The Employer will make a fee checklist for visa application. The employee needs to sign and confirm it.In addition the Employee will pay for all the cost by him/herself at firstif
25、the Employee fulfills the contract the Employer will reimburse the relevant cost during the contract period including Z-visa application residence permit and health check but not the transportation and living fees to transfer to a Z visa.雇員向校方提供辦理簽證所需的各種材料,人力資源部將協(xié)助雇員辦理簽證的申請(qǐng),但外教辦證須安排在自己的本休期間.如果雇員在合同期
26、內(nèi)以何種原因離職或在合同期內(nèi),或無(wú)論何種原因校方與雇員解除勞動(dòng)關(guān)系,雇員將自行支付所有的費(fèi)用簽證,居住證實(shí),健康證和交通費(fèi)和居留許可辦 理費(fèi)).校方將列出相關(guān)辦理簽證各項(xiàng)費(fèi)用的清單,雇員需簽字確認(rèn).另外,雇員的所有費(fèi)用先由雇員自己支付,假設(shè)雇員履行完本合同期限,校方將報(bào)銷雇員 在本合同期限內(nèi)產(chǎn)生的相關(guān)費(fèi)用.包括工作簽證,居住證實(shí),健康證、和居留許可辦理 費(fèi)但不報(bào)銷轉(zhuǎn)工作簽證的路費(fèi)和住宿費(fèi).Holidays and Vacation/假期和節(jié)日1. The Employee will be given all statutory holidays as paid holiday. Thoseho
27、lidays are one(1) day for New Years Day , three(3) days for the Chinese NewYear, one(1)day for Tomb-sweeping Day , one(1)day for the Chinese Labor Day , one(1)day for Dragon Boat Festival , one(1)day for Mid-autumn Day and three(3) days for the Chinese National Day.雇員將享有所有國(guó)家法定休息日,包括:元旦 1天,春節(jié)3天,清明節(jié)1天
28、,勞動(dòng)節(jié)1 天,端午節(jié)1天,中秋節(jié)1天,國(guó)慶節(jié)3天.2. In addition , the Employee will be granted a 1-day paid holiday for Christmas. 除此之外,雇員可享受1天帶薪的圣誕節(jié)假期.3. The Employee will be entitled to take an annual paid vacation which will be5 days according to the employer ' s regulation , after he/she fulf川s a one- year contrac
29、t , and it will be up to 6 days after fulfilling a second year contract.If any extra leave (no more than 15days continuously) need to be taken, theemployee needs to submit a leave application form for unpaid private leave,30 days in advance for review , if the calculated total no. After receiving pe
30、rmission for private leave , the request form must be sent to the HRDepartment for reference. The leave application must be written application and must beapproved and signed by the CD.滿一年后雇員將按校方規(guī)定享有5天帶薪年假,滿兩年后雇員將按校方規(guī)定享有6天帶薪年假.如果雇員需要額外請(qǐng)假不超過(guò)15天,那么需要提前30天提交請(qǐng)假申請(qǐng)表,此 額外假期不帶薪.如果請(qǐng)假被允許,請(qǐng)假表格需要提交給人事部門備案.請(qǐng)假必須向
31、中 心校長(zhǎng)提出書面申請(qǐng)并得到校長(zhǎng)同意簽字方可.Sick leave/ 病假1. The Employee is only allowed to take any unpaid sick leave with an official permission from the Employer and the Employer reserves the right to deduct anamount from the Employee' s salary for each day that the Employee is absent from work, which will be in
32、 accordance with relevant law or regulation. This amount should be deducted in proportion to the total number of teaching hours the Employee has not worked.合同期內(nèi)雇員必須經(jīng)校方正式許可后可申請(qǐng)無(wú)薪病假.校方將有權(quán)從雇員工資中按國(guó)家相關(guān)規(guī)定扣除相應(yīng)的薪資.2. In the case of the employee being unable to work due to illness, he/shemust get the verific
33、ation from the doctor afterwards. If the employee fails to do so , it is regarded as private affair leave. If the employee cannot make it due to illness , he/she has to inform the HR or his/her direct manager before 12:00pm that day. The employee shall report to HR and complete the sick-leaveform as
34、 soon as he/she resumes his/her work. If an employee fails to do so,he/she may be regarded as being absent without permission.如果雇員因病請(qǐng)假,那么事后應(yīng)提供醫(yī)院開具的有效病假單給人事部,反之那么視為事假處理.如果雇員因病無(wú)法及時(shí)請(qǐng)假,須在當(dāng)天中午12時(shí)之前 告知人事部門或直接主管,并在病后上班第一天到人事部補(bǔ)辦相應(yīng)請(qǐng)假手續(xù),如果雇員沒(méi)有做到以上所述,那么被視為無(wú)故曠工.3. Should the Employee be diagnosed as not capable
35、 of resuming work after the statutory sick leave , nor can he take up other positions arranged by the Employer , the Employer reserves the right to terminate the contract.雇員假設(shè)病假超過(guò)法定醫(yī)療期且仍不能從事原工作,也不能從事校方另行安排工作的,校方有權(quán)解除與雇員的勞動(dòng)關(guān)系.Termination/ 合同終止The Employer reserves the right to terminate the Employee
36、39; s employment without any severance benefits in any one of the following circumstances: 有以下情況之一的下,校方保存終止與雇員合同的權(quán)利而不給予賠償:1. The Employee brings the school into disrepute by his/her conduct.雇員由于個(gè)人緣故將校方卷入糾紛;2. The Employee breaches the confidentiality clause asreferred to in sectionaconfidentiality&q
37、uot;.雇員違反保密協(xié)議,詳見(jiàn)“保密條款;3. If the Employee is guilty of dereliction of duty, incompetence ,insubordination , dishonesty or other breaches of the Employee ' s obligations under this agreement or the rules and regulations of the company.如果雇員未能遵守或是觸犯了本合同的條款或是校方相關(guān)規(guī)定,或者未能履行本合同中所規(guī)定的責(zé)任;4. The students ha
38、ve complained about the employee ' s teaching quality or working attitude three times in two months.在2個(gè)月內(nèi)學(xué)員對(duì)雇員的教學(xué)質(zhì)量或教學(xué)態(tài)度投訴3次;5. The residence permit application is rejected due to other reasons except ones caused by the school.居留許可由于非校方緣故被拒簽.During the period of the contract , the employee shall
39、 notice the employer one month in advance if he/she intends to terminate the contract. Otherwise, theemployee shall pay one month salary as substitute.在合同期內(nèi),雇員提出離職必須提前一個(gè)月以書面形式通知校方;否那么,需以雇員一個(gè) 月的工資替代離職通知期.If the Employee is appointed to work in one of the Employer' s franchisee schools upon mutual
40、 agreement , this contract will be terminated as the Employee will sign another contract with the franchisee school when he/she begins to work with them.如雙方經(jīng)協(xié)商一致,雇員將派往甲方的子學(xué)校工作,此合同那么自動(dòng)終止;雇員將和加盟 學(xué)校重新簽訂勞動(dòng)合同.In the unlikely event of a disaster such as earthquake, fire , flood , civilunrest , etc. that w
41、ould makethe Employer unable to continue operating business , the contract will be considered nil and the Employee will be under no obligation to stay.在不可抗力導(dǎo)致的自然災(zāi)害,如地震,火災(zāi),戰(zhàn)爭(zhēng)等,導(dǎo)致校方無(wú)法繼續(xù)營(yíng)運(yùn)公司的情 況下,本合同視為無(wú)效,雇員無(wú)責(zé)任繼續(xù)為校方效勞.Confidentiality/ 保密性In the role as a teacher with the employer, the employee may have
42、access tosome confidential information. It is essential that such information shouldremain confidential and that any such material in the employee' s procession ,electronically or on hard copy , should be stored securely. By signing thea Non-disclosure Agreement “ the employee agrees not to disc
43、lose any confidential information , including the contents of the signed contract,unless authorized to do so.作為校方的老師,雇員有時(shí)機(jī)接觸機(jī)密信息.雇員必須對(duì)信息保密,校方所有的資料不 論電子形式或者書面形式,雇員必須平安保存.簽署保密協(xié)議后,除非經(jīng)校方允許,雇 員不得公布這些信息,包括合同內(nèi)容.The obligation of the Employee concerning the section titled aconfidentiality will survive the termination of this agreement.與“保密相關(guān)的條款將在合同結(jié)束后依然有效.Image Copyright/ 肖像權(quán)The employee grants to the employer his/her image copyright on a willingly basis for the advertising activities held by the company, including but notexcl
