安全生產(chǎn)法(中英文)

1、第六十七條 新聞、出版、廣播、電影、電視等單位有進行安全生產(chǎn)宣傳教育的義務(wù)，有對違反安全生產(chǎn)法律、法規(guī)的行為進行輿論監(jiān)督的權(quán)利。Article 67 The entities such as news agency, publication, broadcasting, movie and television, etc. shall be under the obligation of the publicity and education of production safety, and shall have the right to conduct supervision by pub

2、lic opinions over the acts violating the statutory provisions concerning production safety.第五章 生產(chǎn)安全事故的應急救援與調(diào)查處理Chapter V Emergency Rescue, Investigation and Handling of Production Safety Accidents第六十八條 縣級以上地方各級人民政府應當組織有關(guān)部門制定本行政區(qū)域內(nèi)特大生產(chǎn)安全事故應急救援預案，建立應急救援體系。Article 68 The people's governments on the

3、 county level and above shall organize relevant departments to formulate emergency rescue plans for the especially serious production safety accidents within their respective administrative jurisdictions, and establish their own systems of emergency rescue.第六十九條 危險物品的生產(chǎn)、經(jīng)營、儲存單位以及礦山、建筑施工單位應當建立應急救援組織；

4、Article 69 The entities that produce, manage or store hazardous substances as well as the mining and construction building entities shall establish emergency rescue organizations. 生產(chǎn)經(jīng)營規(guī)模較小，可以不建立應急救援組織的，應當指定兼職的應急救援人員。If a production and business operation is small in scale, it may designate part-time

5、 emergency rescue persons instead of establishing emergency rescue organizations.危險物品的生產(chǎn)、經(jīng)營、儲存單位以及礦山、建筑施工單位應當配備必要的應急救援器材、設(shè)備，并進行經(jīng)常性維護、保養(yǎng)，保證正常運轉(zhuǎn)。The entities that produce, manage or store hazardous substances as well as the mining and construction building entities shall be equipped with necessary res

6、cue apparatuses and equipments which shall be serviced and maintained regularly so as to ensure their normal operation.第七十條 生產(chǎn)經(jīng)營單位發(fā)生生產(chǎn)安全事故后，事故現(xiàn)場有關(guān)人員應當立即報告本單位負責人。Article 70 When a production safety accident occurs to a production and business operation entity, the relevant persons at the spot of the

7、accident shall report to the persons-in-charge of the entity immediately.單位負責人接到事故報告后，應當迅速采取有效措施，組織搶救，防止事故擴大，減少人員傷亡和財產(chǎn)損失，并按照國家有關(guān)規(guī)定立即如實報告當?shù)刎撚邪踩a(chǎn)監(jiān)督管理職責的部門，不得隱瞞不報、謊報或者拖延不報，不得故意破壞事故現(xiàn)場、毀滅有關(guān)證據(jù)。The persons-in-charge of the entity shall, after receiving the report of accident, take effective measures immed

8、iately, organize rescues, and prevent the accident from deteriorating so as to reduce the casualty of personnel and property losses. They shall, according to the relevant provisions of the state, report truthfully to the departments responsible for the supervision and administration of production sa

9、fety of the local place, and may not conceal anything or report deceitfully or delay the reports or ruin the spot of the accident on purpose or destroy relevant evidences.第七十一條 負有安全生產(chǎn)監(jiān)督管理職責的部門接到事故報告后，應當立即按照國家有關(guān)規(guī)定上報事故情況。Article 71 The departments responsible for the supervision and administration of

10、production safety shall, after receiving a report of accident, report the accident to the relevant authorities on higher levels according to the relevant provisions of the state. 負有安全生產(chǎn)監(jiān)督管理職責的部門和有關(guān)地方人民政府對事故情況不得隱瞞不報、謊報或者拖延不報。The departments responsible for the supervision and administration of produc

12、ponsible for the supervision and administration of production safety shall, after receiving a report of production safety accident, hurry to the spot of the accident immediately to organize rescues.任何單位和個人都應當支持、配合事故搶救，并提供一切便利條件。All entities and individual shall support and coordinate the rescue of a

13、ccident and provide all conveniences.第七十三條 事故調(diào)查處理應當按照實事求是、尊重科學的原則，及時、準確地查清事故原因，查明事故性質(zhì)和責任，總結(jié)事故教訓，提出整改措施，并對事故責任者提出處理意見。Article 73 The principle of being practical and realistic and the principle of respecting science shall be observed in the investigation and handling of accidents. The relevant people

14、 shall find out the accurate causes of the accidents in good time sum up the lessons of the accidents, suggest measures for rectification and mending up, and give their opinions about how to deal with those who are responsible for the accidents. 事故調(diào)查和處理的具體辦法由國務(wù)院制定。The detailed measures for the inves

15、tigation and handling of accidents shall be formulated by the State Council.第七十四條 生產(chǎn)經(jīng)營單位發(fā)生生產(chǎn)安全事故，經(jīng)調(diào)查確定為責任事故的，除了應當查明事故單位的責任并依法予以追究外，還應當查明對安全生產(chǎn)的有關(guān)事項負有審查批準和監(jiān)督職責的行政部門的責任。Article 74 If any production safety accident happened to a production and business operation entity is found, on the basis of investig

16、ations, to be an accident due to negligence, the relevant people shall not only find out the liabilities of and fix penalties to the entity where the accident has happened, they shall also find out the liabilities of the administrative departments that are responsible for the examination and approva

17、l of the relevant matters concerning production safety. 對有失職、瀆職行為的，依照本法第七十七條的規(guī)定追究法律責任。Any person who is found to be guilty of dereliction in duties or malfeasance shall be subject to undertaking legal liabilities according to Article 77 of the present law.第七十五條 任何單位和個人不得阻撓和干涉對事故的依法調(diào)查處理。Article 75 No

18、 entity or individual may obstruct or interfere with the lawful investigation and handling of accidents.第七十六條 縣級以上地方各級人民政府負責安全生產(chǎn)監(jiān)督管理的部門應當定期統(tǒng)計分析本行政區(qū)域內(nèi)發(fā)生生產(chǎn)安全事故的情況，并定期向社會公布。Article 76 The department of the local people's government on the county level and above who are responsible for the supervisi

19、on and administration of production safety shall make statistical analyses regularly of the production safety accidents happened within their respective administrative regions, and publicize them to the general public.第六章 法律責任Chapter VI Legal Liabilities第七十七條 負有安全生產(chǎn)監(jiān)督管理職責的部門的工作人員，有下列行為之一的，給予降級或者撤職的行

20、政處分；Article 77 Any staff member of the departments responsible for the supervision and administration of production safety who commits any of the following acts shall be given an administrative punishment of being demoted or removed from his position. 構(gòu)成犯罪的，依照刑法有關(guān)規(guī)定追究刑事責任：If his act constitutes a cr

21、ime, he shall be subject to assume criminal liabilities:（一）對不符合法定安全生產(chǎn)條件的涉及安全生產(chǎn)的事項予以批準或者驗收通過的；a. Granting approval or accepting on the basis of examination any matter relating to production safety which does not meet the statutory conditions for production safety;（二）發(fā)現(xiàn)未依法取得批準、驗收的單位擅自從事有關(guān)活動或者接到舉報后不予取締

22、或者不依法予以處理的；b. Failing to clamp down or handle according to law after finding or receiving reports that any entity which has not obtained approval or has not passed the examinations for acceptance according to law is engaged in relevant activities;（三）對已經(jīng)依法取得批準的單位不履行監(jiān)督管理職責，發(fā)現(xiàn)其不再具備安全生產(chǎn)條件而不撤銷原批準或者發(fā)現(xiàn)安全生產(chǎn)

23、違法行為不予查處的。c. Finding that an entity which has obtained approval or passed the examinations for acceptance according to law but fails exercise its duties of supervision and administration and failing to withdraw the original approval or failing to investigate and handle any act violating the statutor

24、y provisions concerning production safety.第七十八條 負有安全生產(chǎn)監(jiān)督管理職責的部門，要求被審查、驗收的單位購買其指定的安全設(shè)備、器材或者其他產(chǎn)品的，在對安全生產(chǎn)事項的審查、驗收中收取費用的，由其上級機關(guān)或者監(jiān)察機關(guān)責令改正，責令退還收取的費用；Article 78 Any department responsible for the supervision and administration of production safety who demand the entities subject to examination and approva

25、l or examinations for acceptance to buy any safety equipment, facility or other product as designated thereby or charge any fees in the examination and approval or examination for acceptance concerning the matters of production safety shall be ordered to mend up by the competent authorities or the g

26、overnment supervision organs on a higher level and be ordered to refund the fees charged. 情節(jié)嚴重的，對直接負責的主管人員和其他直接責任人員依法給予行政處分。If the circumstances are serious, the person-in-charge and other personnel who are held to be directly responsible shall be given administrative punishments according to law.第七

27、十九條 承擔安全評價、認證、檢測、檢驗工作的機構(gòu)，出具虛假證明，構(gòu)成犯罪的，依照刑法有關(guān)規(guī)定追究刑事責任；Article 79 Any institution that undertakes the work of safety appraisal, certification, detection and test issues false certificates and thus constituting a crime shall assume criminal liabilities according to the relevant provisions of the Crimin

28、al Law. 尚不夠刑事處罰的，沒收違法所得，違法所得在五千元以上的，并處違法所得二倍以上五倍以下的罰款，沒有違法所得或者違法所得不足五千元的，單處或者并處五千元以上二萬元以下的罰款，對其直接負責的主管人員和其他直接責任人員處五千元以上五萬元以下的罰款；If the acts thereof are not enough for criminal punishments, the illegal proceeds shall be confiscated and at the same time, it shall be imposed upon a fine of not less tha

29、n two times but not more than five times the illegal proceeds if the illegal proceeds are more than 5,000 yuan; or, if the illegal proceeds are less than 5,000 yuan, be simply imposed upon a fine of not less than 5,000 yuan but not more than 20,000 yuan, and the person-in-charge and other persons wh

30、o are held to be directly responsible shall be imposed a fine of not less than 5,000 yuan but not more than 50,000 yuan. 給他人造成損害的，與生產(chǎn)經(jīng)營單位承擔連帶賠償責任。If injuries have been caused to other people, it shall take several and joint liabilities with the production and business operation entity.對有前款違法行為的機構(gòu)，撤銷

31、其相應資格。Any institution that has committed any of the illegal acts as mentioned in the preceding paragraph shall be disqualified accordingly.第八十條 生產(chǎn)經(jīng)營單位的決策機構(gòu)、主要負責人、個人經(jīng)營的投資人不依照本法規(guī)定保證安全生產(chǎn)所必需的資金投入，致使生產(chǎn)經(jīng)營單位不具備安全生產(chǎn)條件的，責令限期改正，提供必需的資金；Article 80 If the decision-making organ or major person-in-charge of any p

32、roduction and business operation entity or the investor of any individually run business fails to ensure the capital investment necessary for guaranteeing the production safety as provided in the present law so that the production and business operation entity no longer meets the requirements for sa

33、fety production, the entity shall be ordered to mend up within a prescribed time period and provide the necessary capital investment. 逾期未改正的，責令生產(chǎn)經(jīng)營單位停產(chǎn)停業(yè)整頓。If it fails to mend up within the prescribed time period, the production and business operation entity shall be ordered to suspend business for

34、rectifications.有前款違法行為，導致發(fā)生生產(chǎn)安全事故，構(gòu)成犯罪的，依照刑法有關(guān)規(guī)定追究刑事責任；If any of the illegal acts as mentioned in the preceding paragraph has resulted in any production safety accident and a crime is constituted, the offenders concerned shall assume criminal liabilities according to the relevant provisions of the C

35、riminal Law. 尚不夠刑事處罰的，對生產(chǎn)經(jīng)營單位的主要負責人給予撤職處分，對個人經(jīng)營的投資人處二萬元以上二十萬元以下的罰款。If the act is not serious enough for assuming criminal liabilities, the major persons-in-charge of the production and business operation entity shall be given a punishment of demotion, and the investor of the individually run busines

36、s be imposed a fine of not less than 20,000 yuan but not more than 200,000 yuan.第八十一條 生產(chǎn)經(jīng)營單位的主要負責人未履行本法規(guī)定的安全生產(chǎn)管理職責的，責令限期改正；Article 81 If the major person-in-charge of a production and business operation fails to perform his duty of administering production safety according to the provisions of the p

37、resent law, he shall be ordered to mend up within a prescribed time period. 逾期未改正的，責令生產(chǎn)經(jīng)營單位停產(chǎn)停業(yè)整頓。If he fails to mend up within the prescribed time period, the production and business operation entity shall be ordered to suspend production or business for rectifications.生產(chǎn)經(jīng)營單位的主要負責人有前款違法行為，導致發(fā)生生產(chǎn)安全事

38、故，構(gòu)成犯罪的，依照刑法有關(guān)規(guī)定追究刑事責任；If the major person-in-charge of a production and business operation entity commits any of the acts as mentioned in the preceding paragraph so that a production safety accident has resulted, and thus a crime has been constituted, the major person-in-charge shall assume crimina

39、l liabilities according to the relevant provisions of the Criminal Law. 尚不夠刑事處罰的，給予撤職處分或者處二萬元以上二十萬元以下的罰款。If the acts are not serious enough for assuming criminal liabilities, he shall be given a punishment of demotion or be fined of not less than 20,000 yuan but not more than 200,000 yuan.生產(chǎn)經(jīng)營單位的主要負

40、責人依照前款規(guī)定受刑事處罰或者撤職處分的，自刑罰執(zhí)行完畢或者受處分之日起，五年內(nèi)不得擔任任何生產(chǎn)經(jīng)營單位的主要負責人。If the major person-in-charge of a production and business operation entity assumes criminal liabilities or is punished by being removed from his positions according to the provisions of the preceding paragraph, he may not be the major perso

41、n-in-charge of any production and business operation entity within five years starting from the day when the criminal penalty is executed or from the day when he is given the punishment.第八十二條 生產(chǎn)經(jīng)營單位有下列行為之一的，責令限期改正；Article 82 In any of the following circumstances, the production and business operatio

42、n entity shall be ordered to mend up within a prescribed time periond. 逾期未改正的，責令停產(chǎn)停業(yè)整頓，可以并處二萬元以下的罰款：If it fails to mend up within the prescribed time period, it shall be ordered to suspend production or business for rectifications, and may be fined not more than 20,000 yuan:（一）未按照規(guī)定設(shè)立安全生產(chǎn)管理機構(gòu)或者配備安全生

43、產(chǎn)管理人員的；a. Failing to establish an organ for the administration of production safety or to arrange for persons to take charge of the administration of production safety;（二）危險物品的生產(chǎn)、經(jīng)營、儲存單位以及礦山、建筑施工單位的主要負責人和安全生產(chǎn)管理人員未按照規(guī)定經(jīng)考核合格的；b. The major persons-in-charge or the person in charge of production safety

44、of an entity that produces, manages or stores hazardous substances or the mining or construction building entity fails to passed the examinations according to relevant provisions;（三）未按照本法第二十一條、第二十二條的規(guī)定對從業(yè)人員進行安全生產(chǎn)教育和培訓，或者未按照本法第三十六條的規(guī)定如實告知從業(yè)人員有關(guān)的安全生產(chǎn)事項的；c. Failing to educate or train the workers accor

45、ding to the provisions of Articles 21 and 22 of the present law or failing to inform truthfully the workers of the production safety matters according to the provisions of Article 36 of the present law;（四）特種作業(yè)人員未按照規(guī)定經(jīng)專門的安全作業(yè)培訓并取得特種作業(yè)操作資格證書，上崗作業(yè)的。d. The special operation staff members failing to rece

46、ive specialized trainings in production safety and failing to obtain a qualifications certificate for the special operations according to the provisions yet still works at his position.第八十三條 生產(chǎn)經(jīng)營單位有下列行為之一的，責令限期改正；Article 83 In any of the following circumstances, the production and business operation

47、 entity shall be ordered to mend up within a prescribed time period. 逾期未改正的，責令停止建設(shè)或者停產(chǎn)停業(yè)整頓，可以并處五萬元以下的罰款；If it fails to mend up within the prescribed time period, it shall be ordered to suspend construction or suspend production or business for rectifications, and may be fined not more than 50,000 yu

48、an. 造成嚴重后果，構(gòu)成犯罪的，依照刑法有關(guān)規(guī)定追究刑事責任：If serious consequences have resulted and thus a crime has been constituted, the offenders shall be subject to criminal liabilities according to the relevant provisions of the Criminal Law.（一）礦山建設(shè)項目或者用于生產(chǎn)、儲存危險物品的建設(shè)項目沒有安全設(shè)施設(shè)計或者安全設(shè)施設(shè)計未按照規(guī)定報經(jīng)有關(guān)部門審查同意的；a. There is no desi

49、gn of safety facilities for a mining construction project or a construction project for the production or storage of hazardous substances, or the design of safety facilities has failed to be submitted to relevant departments according to relevant provisions for examination and approval;（二）礦山建設(shè)項目或者用于

50、生產(chǎn)、儲存危險物品的建設(shè)項目的施工單位未按照批準的安全設(shè)施設(shè)計施工的；b. The construction entity of a mining project or a construction for the production or storage of hazardous substances fails to execute the construction according to the approved design of safety facilities;（三）礦山建設(shè)項目或者用于生產(chǎn)、儲存危險物品的建設(shè)項目竣工投入生產(chǎn)或者使用前，安全設(shè)施未經(jīng)驗收合格的；c. The

51、safety facilities fail to pass the examinations for acceptance before a mining construction project or a construction project for the production or storage of hazardous substances is put into production or use;（四）未在有較大危險因素的生產(chǎn)經(jīng)營場所和有關(guān)設(shè)施、設(shè)備上設(shè)置明顯的安全警示標志的；d. Failing to place eye-catching safety warning m

52、arks on the sites of production and business operation or relevant facilities and equipments which are considerably dangerous;（五）安全設(shè)備的安裝、使用、檢測、改造和報廢不符合國家標準或者行業(yè)標準的；e. The installation, use, test, transformation or discarding safety facilities as useless is not in conformity with national standards or

53、 industrial standards;（六）未對安全設(shè)備進行經(jīng)常性維護、保養(yǎng)和定期檢測的；f. Failing to carry out regular maintenance or service or regular tests to the safety facilities;（七）未為從業(yè)人員提供符合國家標準或者行業(yè)標準的勞動防護用品的；g. Failing to provide labor protection products to the workers according to the national or industrial standards;（八）特種設(shè)備以及危

54、險物品的容器、運輸工具未經(jīng)取得專業(yè)資質(zhì)的機構(gòu)檢測、檢驗合格，取得安全使用證或者安全標志，投入使用的；h. A special equipment or a container or transportation for hazardous substances is put into use before passing the detection and test of the eligible institutions and obtaining a certificate for safety use or a safety label;（九）使用國家明令淘汰、禁止使用的危及生產(chǎn)安全的工

55、藝、設(shè)備的。i. Using any of the techniques or equipments that endanger production safety and that have been explicitly announced to be eliminated or to be prohibited from use.第八十四條 未經(jīng)依法批準，擅自生產(chǎn)、經(jīng)營、儲存危險物品的，責令停止違法行為或者予以關(guān)閉，沒收違法所得，違法所得十萬元以上的，并處違法所得一倍以上五倍以下的罰款，沒有違法所得或者違法所得不足十萬元的，單處或者并處二萬元以上十萬元以下的罰款；Article 84 A

56、ny one who unlawfully produces, manages or stores any hazardous product without approval shall be ordered to terminate the illegal act or to close down with its illegal proceeds be confiscated and imposed upon a fine of not less than one time but not more than five times the illegal proceeds if such
