1、深圳市行政事業(yè)性收費(fèi)管理若干規(guī)定深圳市人民政府令(第116號(hào))深圳市行政事業(yè)性收費(fèi)管理若干規(guī)定已經(jīng)2002年6月26日市政府三屆第60次常務(wù)會(huì)議審議通過,現(xiàn)予發(fā)布。自2002年8月1日起施行。市長于幼軍二00二年七月一日深圳市行政事業(yè)性收費(fèi)管理若干規(guī)定第一條為加強(qiáng)行政事業(yè)性收費(fèi)管理,建立規(guī)范、透明、合理的收費(fèi)制度,維護(hù)公民、法人和其他組織的合法權(quán)益,根據(jù)有關(guān)法律、法規(guī),結(jié)合深圳市實(shí)際,制定本規(guī)定。第二條行政事業(yè)性收費(fèi)應(yīng)依法設(shè)立和征收。第三條行政事業(yè)性收費(fèi)項(xiàng)目的設(shè)立,應(yīng)具備下列之一的法律依據(jù):(一)法律、行政法規(guī);(二)國務(wù)院制定或批準(zhǔn)制定的規(guī)范性文件;(三)國家行政事業(yè)性收費(fèi)主管部門根據(jù)法律或
2、行政法規(guī)制定的規(guī)章;(四)廣東省人民代表大會(huì)及其常務(wù)委員會(huì)制定的地方性法規(guī);(五)廣東省人民政府根據(jù)法律、法規(guī)制定的規(guī)章;(六)深圳市人民代表大會(huì)及其常務(wù)委員會(huì)制定的特區(qū)法規(guī)和地方性法規(guī);(七)深圳市人民政府制定的規(guī)章.前款法律、法規(guī)、規(guī)章或規(guī)范性文件未規(guī)定實(shí)施行政管理行為可以收費(fèi)的,不得設(shè)立行政事業(yè)性收費(fèi)項(xiàng)目.第四條申請(qǐng)征收行政事業(yè)性收費(fèi),申請(qǐng)單位應(yīng)提供依據(jù)、說明理由并提交相應(yīng)的文件、資料。市物價(jià)部門對(duì)征收申請(qǐng)進(jìn)行審查提出初步意見后,提交深圳市行政事業(yè)性收費(fèi)審查委員會(huì)(以下簡稱審查委員會(huì))對(duì)收費(fèi)的必要性、合理性與合法性進(jìn)行審查;審查委員會(huì)認(rèn)為有必要的,可以決定舉行聽證。聽證會(huì)由市物價(jià)部門負(fù)責(zé)
3、組織,應(yīng)保證有一定比例的企業(yè)、市民和專業(yè)人士參加。審查委員會(huì)應(yīng)將聽證情況、審查意見報(bào)市政府常務(wù)會(huì)議審議。未經(jīng)深圳市人民政府批準(zhǔn),不得征收任何行政事業(yè)性收費(fèi),市物價(jià)部門不得為其辦理廣東省行政事業(yè)性收費(fèi)許可證。審查委員會(huì)由市財(cái)政、物價(jià)、計(jì)劃、法制、審計(jì)、監(jiān)察等部門組成,日常工作由市物價(jià)部門負(fù)責(zé);審查委員會(huì)會(huì)議各組成部門必須參加,所形成的報(bào)告、意見由各組成部門的代表委員簽署后報(bào)市政府.第五條市物價(jià)部門應(yīng)會(huì)同市財(cái)政部門按實(shí)際征收的行政事業(yè)性收費(fèi)項(xiàng)目編制深圳市行政事業(yè)性收費(fèi)征收項(xiàng)目目錄(以下簡稱征收項(xiàng)目目錄);征收項(xiàng)目目錄包括項(xiàng)目名稱、征收單位、許可證編號(hào)、征收標(biāo)準(zhǔn)、辦法及開征時(shí)間等,應(yīng)于每年的三月份在
4、市政府公報(bào)及政府信息網(wǎng)上公布.未列入征收項(xiàng)目目錄的,不得征收,任何單位和個(gè)人有權(quán)拒絕繳交。第六條經(jīng)批準(zhǔn)征收的行政事業(yè)性收費(fèi),應(yīng)于開始征收30日前在市政府公報(bào)及政府信息網(wǎng)上公布,并列入征收項(xiàng)目目錄。第七條停止征收或降低征收標(biāo)準(zhǔn)的,市物價(jià)部門應(yīng)將停止征收或降低征收標(biāo)準(zhǔn)的項(xiàng)目名稱、征收單位、許可證編號(hào)、停止征收的時(shí)間,或降低的征收標(biāo)準(zhǔn)及其開始執(zhí)行的時(shí)間在市政府公報(bào)及政府信息網(wǎng)上公布.第八條市財(cái)政、物價(jià)部門應(yīng)編制每一年度的行政事業(yè)性收費(fèi)情況報(bào)告,經(jīng)審查委員會(huì)審議后報(bào)市政府。第九條行政事業(yè)性收費(fèi)應(yīng)納入財(cái)政預(yù)算,實(shí)行收支兩條線管理。征收單位應(yīng)使用市財(cái)政部門統(tǒng)一印制的行政事業(yè)性收費(fèi)收據(jù),如實(shí)登記收費(fèi)事項(xiàng),采
5、用委托銀行代收的辦法,所有行政事業(yè)性收費(fèi)均應(yīng)進(jìn)入市財(cái)政部門認(rèn)可的銀行帳戶,并接受財(cái)政、物價(jià)、審計(jì)等部門的監(jiān)督檢查.第十條根據(jù)法律、法規(guī)和規(guī)章的規(guī)定制發(fā)證照的,可以申請(qǐng)收取證照工本費(fèi);法律、法規(guī)或規(guī)章未規(guī)定對(duì)證照年審可以收取年審費(fèi)的,不得收費(fèi)。對(duì)同一行政管理行為已收取管理費(fèi)的,不得再收取工本費(fèi),法律、法規(guī)規(guī)定可以收取的除外。第十一條利用政府所有或管理的文件、資料、信息、技術(shù)或其他類似資源的,資源管理部門可按法律、法規(guī)或規(guī)章的規(guī)定收取復(fù)制成本費(fèi),但法律、法規(guī)、規(guī)章規(guī)定行政管理部門應(yīng)履行職責(zé)或應(yīng)提供服務(wù)的,不得因履行職責(zé)或提供服務(wù)收取任何費(fèi)用,不得指定或委托事業(yè)單位或中介機(jī)構(gòu)履行職責(zé)、提供服務(wù),不得
6、因此獲得任何經(jīng)濟(jì)上的利益.第十二條實(shí)施行政管理行為要求行政管理相對(duì)人提供相應(yīng)的文件、資料的,不得強(qiáng)制購買標(biāo)準(zhǔn)或示范文本,不得指定辦理文件、資料的單位,不得規(guī)定辦理文件、資料的費(fèi)用標(biāo)準(zhǔn),實(shí)施行政管理行為的單位不得因此獲得任何經(jīng)濟(jì)上的利益。第十三條代征收行政事業(yè)性收費(fèi)的,應(yīng)提交代征收的授權(quán)委托書,并按本若干規(guī)定第四條、第六條的規(guī)定進(jìn)行審查、公告。第十四條征收行政事業(yè)性收費(fèi)不得附帶收取任何費(fèi)用或因此獲得任何經(jīng)濟(jì)上的利益。制作證照需使用鏡框或其它承載物、外飾物的,不得提供鏡框或承載物、外飾物,不得規(guī)定鏡框或承載物、外飾物的規(guī)格或式樣,不得指定制作的單位、規(guī)定制作的費(fèi)用標(biāo)準(zhǔn)。第十五條實(shí)行檢驗(yàn)、檢疫、檢測
7、管理,本規(guī)定第三條所列法律、法規(guī)、規(guī)章或規(guī)范性文件未規(guī)定可以收費(fèi)的,不得收取任何費(fèi)用,但送檢單位主動(dòng)送檢的除外。第十六條對(duì)同一行政管理行為不得重復(fù)設(shè)立收費(fèi)項(xiàng)目,設(shè)立的收費(fèi)標(biāo)準(zhǔn)應(yīng)一致,不得因管理對(duì)象不同收取不同標(biāo)準(zhǔn)的費(fèi)用。第十七條任何單位和個(gè)人有權(quán)對(duì)行政事業(yè)性收費(fèi)的必要性、合理性與合法性向市監(jiān)察部門進(jìn)行投訴和提出意見或建議。市監(jiān)察部門應(yīng)及時(shí)對(duì)違法收費(fèi)行為進(jìn)行查處,并公告查處結(jié)果。對(duì)收費(fèi)的必要性與合理性提出意見或建議的,市監(jiān)察部門應(yīng)將接到的意見或建議于5日內(nèi)提交審查委員會(huì),審查委員會(huì)認(rèn)為有必要的,可舉行聽證會(huì),并將討論意見或聽證情況報(bào)市政府常務(wù)會(huì)議審議。審查委員會(huì)任何組成部門可自行動(dòng)議對(duì)各項(xiàng)行政事
8、業(yè)性收費(fèi)的必要性、合理性與合法性進(jìn)行討論或舉行聽證會(huì),審查委員會(huì)應(yīng)將討論意見或聽證情況報(bào)市政府。第十八條違反有關(guān)法律、法規(guī)、規(guī)章或本規(guī)定收取費(fèi)用的,由市物價(jià)部門責(zé)令立即糾正,并責(zé)令收取單位在規(guī)定時(shí)間內(nèi)將違法收取的費(fèi)用退還原交費(fèi)人,規(guī)定時(shí)間內(nèi)無法退還的,上繳國庫。退還單位應(yīng)將退還事項(xiàng)、退還辦法、退還時(shí)間等在市政府公報(bào)、政府信息網(wǎng)及有關(guān)新聞媒體上公布.市物價(jià)部門應(yīng)將處理情況在市政府公報(bào)及政府信息網(wǎng)上公布。第十九條違法收費(fèi)的直接責(zé)任人和單位負(fù)責(zé)人,由市監(jiān)察部門按規(guī)定予以行政降級(jí)、撤銷行政職務(wù)直至開除公職的處分,并將處分情況于市政府公報(bào)及政府信息網(wǎng)上公布.市監(jiān)察部門應(yīng)于每一年度將違法收費(fèi)予以行政處分的
9、情況向市政府報(bào)告。第二十條本若干規(guī)定于2002年8月1日起實(shí)施,1996年3月28日市政府第51號(hào)令發(fā)布實(shí)施的深圳經(jīng)濟(jì)特區(qū)行政事業(yè)性收費(fèi)管理若干規(guī)定同時(shí)廢止.Several Rules of The Shenzhen Municipality for The Control of Collection of Administrative Institutional FeesOrder of the Shenzhen Municipal Peoples Government (No. 116)Several Rules of the Shenzhen Municipality for the C

11、Shenzhen Municipality for the Control of Collection of Administrative Institutional FeesArticle 1 In order to strengthen the control of collection of administrative institutional fees, establish a normative, open, and reasonable system for collection of fees, and maintain the legal rights and intere
12、sts of citizens, legal persons and other organizations, these rules are hereby formulated in accordance with the related law, regulations and in the light of specific conditions of the Shenzhen City。Article 2 Administrative institutional fees shall be set and collected according to law。Article 3 To
13、set an administrative institutional fee, it shall be required to have one of the following as a legal basis:(1) the law, administrative regulations(2) the normative documents formulated or approved to be formulated by the State Council;(3) the rules formulated by the state department responsible for
14、 administrative institutional collection of fees according to law, administrative regulations;(4) the local law and regulations formulated by the Guangdong Provincial People's Congress and its standing committee;(5) the rules formulated by the Guangdong Provincial Peoples Government according to
15、 law, regulations;(6) the Special Zones law, regulations, and local law, regulations formulated by the Shenzhen Municipal People's Congress and its standing committee;(7) the rules formulated by the Shenzhen Municipal People's Government。If the law, regulations, rules or normative documents
16、have no rules on collection of fees for an administrative management act, no item of administrative institutional fee shall be set up for such an act.Article 4 To apply for collection of an administrative institutional fee, an applying unit shall provide a basis, explain the reason, and submit the r
17、elated documents, materials。The municipal department of prices shall put forward a preliminary opinion after examining the application for collection, and then submit it to the Shenzhen Municipal Examination Committee on Collection of Administrative Institutional Fees (hereinafter referred to as the
18、 examination committee) to inquire into the necessity, reasonability, and legitimacy of the fee collection; if the examination committee thinks it is necessary, a decision may be made to have a hearing. The municipal department of prices shall be responsible for organizing the hearing, and ensure th
19、e attendance of a certain proportion of enterprises, city residents, and professionals. The examination committee shall report to the executive meeting of the municipal government about the hearing and its opinion for examination。Without approval from the Shenzhen Municipal People's Government,
20、no administrative institutional fee shall be collected, the municipal department of prices shall not issue Permit of Collection of Administrative Institutional Fees in Guangdong Province to the applier.The examination committee shall be composed of the municipal departments of finance, prices, plann
21、ing, justice, auditing, supervision, etc., and the department of prices shall be responsible for daily work; the member departments shall attend the meetings of the examination committee, the resultant reports, opinions shall be signed by the representatives of the member departments and then submit
22、ted to the municipal government。Article 5 The municipal department of prices shall join hands with the municipal department of finance to work out Catalogue of the Items of Administrative Institutional Fees to be Collected in the Shenzhen City (hereinafter referred to as Catalogue of Collection Item
23、s); Catalogue of Collection Items shall include the names of items, collecting units, permit number, rates and methods of collection, and time to start collection, etc。, which shall be published in the municipal government's bulletin and government information website every March。If a fee is not
24、 listed in Catalogue of Collection Items, it shall not be collected, and any unit and individual shall have the right to refuse to pay it。Article 6 If an administrative institutional fee has been approved to be collected, it shall be made public in the municipal government's bulletin and governm
25、ent information website 30 days ahead of the date to start collection, and also listed in Catalogue of Collection Items。Article 7 When stopping collection of an administrative institutional fee or reduce the rate of collection, the municipal department of prices shall publish the name of item, colle
26、cting unit, permit number, rate and method of collection, and time to start collection or the reduced rate and starting time of the item to be stopped or to have a reduction of rate in the municipal government's bulletin and government information website。Article 8 The municipal departments of f
27、inance, prices shall draw up an annual report on collection of administrative institutional fees, and submit to the municipal government after the examination committee's deliberation.Article 9 Administrative institutional fees shall be entered into the fiscal budget, and handled separately in t
28、erms of income and expenses。A collecting unit shall use the receipt for collection of administrative institutional fee uniformly printed by the municipal department of finance, accurately record the collection items, and entrust a bank with collection on its behalf, all the administrative institutio
29、nal fees shall be credited into a bank account endorsed by the municipal department of finance, and open for supervision and examination conducted by the departments of finance, prices, auditing, etc。Article 10 In case of issuing a certificate or license according to law, it shall be allowed to char
30、ge for the cost of production of a certificate or license; in case of no stipulation in law, regulations or rules that an annual examination fee may be collected, there shall be no such charge.If a management fee has already been charged for the same administrative management act, there shall be no
31、charge for the cost of production of a certificate or license except those allowed by law, regulations.Article 11 In case of using the documents, materials, information, technique, or other similar resources which are owned or administered by the government, the department of resources management ma
32、y charge for the cost of reproduction according to law, regulations or rules, but if an administrative department must perform a duty or provide a service according to law, regulations or rules, it shall not collect any fee for performing the duty or providing the service, assign or entrust an insti
33、tutional unit or an intermediary agency with performing the duty or providing the service, and make any economic gain for this。Article 12 In case of taking an administrative management act which requires the person under such management to provide the related documents, materials, it shall be forbid
34、den for the unit taking the administrative management act to force a purchase of a standard or model text, to designate a unit for processing the documents, materials, to set rates to charge for processing the documents, materials, and to have any economic gain.Article 13 In case of colleting admini
35、strative institutional fees on others' behalf, the power of attorney for such collection shall be presented, and the collection shall be examined and made public according to Articles 4, 6 of these rules。Article 14 Collection of administrative institutional fees shall not lead to any incidental
36、charge or economic gain。If production of certificates or licenses needs frames or other holders, exterior decorations, it shall be forbidden to provide frames or holders, exterior decorations, to set the specifications or patterns of frames or holders, decorations, to assign a production unit, and t
37、o fix the cost of production。Article 15 In case of administration of test, quarantine, and survey for which there is no stipulation on collecting fees in the law, regulations, rules referred to in Article 3 of these rules, it shall be forbidden to collect fees except a unit requests the test, quaran
38、tine, and survey on its own initiative.Article 16 It shall be forbidden to set more than one item to charge for the same administrative management act, the fixed rates shall be the same for everybody, and it shall not be allowed to charge different persons under the administrative management differe
39、nt fees.Article 17 Any unit and individual shall have the right to file complaints on the necessity, reasonability, and legitimacy of administrative institutional fees to the municipal department of supervision, and make comments or suggestions.The municipal department of supervision shall promptly
40、investigate into and punish illegal acts of collection of fees, and publish the outcome of investigation and punishment.In case of receiving a comment or suggestion on the necessity and reasonability of collection of fees, the municipal department of supervision shall report to the examination commi
41、ttee within 5 days from the date of receiving the comment or suggestion, a hearing may be held if the examination committee thinks it is necessary, and the opinion in discussion and the process of hearing shall be reported to the executive meeting of the municipal government for examination。Any memb
42、er department of the examination committee may initiate a motion by itself to discuss or to hold a hearing on the necessity, reasonability, and legitimacy of various administrative institutional fees, the examination committee shall report to the municipal government about the opinion in discussion or the process of hearing。Article 18 In case of collecting fees in violation of the related law, regulations, rules or these rules, the municipal department of prices shall order immediate correction, and also in
