1、房屋買賣合約Sale&PurchaseAgreementofHouseThedateofsignatureon本合約訂于Thisagreementismadeonthedayof合約之第一方(以下簡(jiǎn)稱賣方)PartyA(hereinafterreferredtoasTheVendor):姓名Name:身份證號(hào)碼IdentityCardNumber:地址Address:合約之第二方(以下簡(jiǎn)稱買方)PartyB(hereinafterreferredtoasThePurchaser):姓名Name:身份證號(hào)碼IdentityCardNumber:地址Address:合約之第三方(以下簡(jiǎn)稱經(jīng)紀(jì)人):

2、PartyC(hereinafterreferredtoastheAgent):注冊(cè)地址:RegisteredAddress合約三方茲同意買賣條款如下:Allthreepartesagreeonthetermsandconditionsasfollow1、買賣雙方經(jīng)協(xié)商須以下列條款通過經(jīng)紀(jì)出售及購入位于業(yè)。(以下簡(jiǎn)稱該物業(yè))之物BothTheVendorandThePurchasershallsellorbuythehouselocatedat(hereinafterreferstoastheproperty)throughTheAgentaccordingtothefollowingterm

3、sandconditions。該物業(yè)建筑面積為平方米(以房產(chǎn)證面積為準(zhǔn))。Thegrossfloorareaofthepropertyissquaremeter.2、該物業(yè)之樓價(jià)為_幣,買方須按下述選擇的方式付款(AC只可選擇其中1種)。PurchasepriceofthepropertyisRMB_andThePurchasershallpayinthefollowingmanner(chooseonefromAtoC).A一次性付款CASHPAYMENT(a) _幣須在簽本合約之同時(shí)付清作為定金;RMB_shallbepaidasinitialdeposituponsigningthisa

4、greement(b) _幣須在簽正式買賣合約時(shí)付清作為部分樓款,正式買賣合約須于_或之前簽妥;RMBshallbepaidaspartialdeposituponsigningformalsale&purchaseagreementwhichshallbesignedonorbefore;(c) _幣須于買賣完成時(shí)由買方付清作為樓價(jià)余款,而買賣須在或之前完成;RMBshallbepaidasremainingbalaneeofthepurchasepricewhenclosingthetransactionwhichshallbesingedonorbefore;B、按揭付款MORTGAGE

5、PAYMENT(a) _幣須在簽本合約之同時(shí)付清作為定金;RMBshallbepaidasinitialdeposituponsigningthisagreement(b) 幣須在簽正式貸款合同時(shí)付清作為首期余款,正式貸款合同須于_簽妥;RMBshallbepaidaspartialdeposituponsigningformalmortgageloanagreementwhichshallbesignedonorbefore;(c) _幣須于買賣完成并辦妥他項(xiàng)權(quán)利登記后由貸款銀行直接撥入賣方銀行帳號(hào)作為樓價(jià)余款,銀行實(shí)際貸款額與原貸款額之間差額由買方以現(xiàn)金支付,而買賣須在完成;RMBshal

6、lbepaidasremainingbalaneeofthepurchasepricebythemortgagebankwhenthetransactioniscompletedandallotherformalitiesofmortgageloanregistrationsettledThedifferencesbetweentheactualandtheoriginalmortgageloanifany,shallbepaidincashbyThePurchaser;C、轉(zhuǎn)按付款Submortgage(a) _幣須在簽本合約之同時(shí)付清作為定金,賣方收款_天內(nèi)向抵押銀行申請(qǐng)轉(zhuǎn)按手續(xù),并協(xié)助買

7、方申請(qǐng)銀行貸款手續(xù);RMBshallbepaidasinitialdeposituponsigningofthisagreementwithinDaysafteracceptingthesaiddepositTheVendorshallapplyforsubmortgagetothemortgagebankandshallassistThePurchasertoapplyforthemortgageloan(b) _幣須在簽正式買賣合約時(shí)付清作為首期余款,正式買賣合約須于簽妥;RMBshallbepaidaspartialdeposituponsigningformalsale&purchas

8、eagreementwhichshallbesignedonorbefore;(c) _幣須于買賣完成并辦妥他項(xiàng)權(quán)利登記后由貸款銀行扣除賣方所欠款項(xiàng)后將余款直接拔入賣方銀行帳號(hào)作為樓價(jià)余款,銀行實(shí)際貸款額與原貸款額之間差額由買方以現(xiàn)金支付,而買賣須在完成;RMBshallbepaidasremainingbalaneeofthepurchasepricebythemortgagebankwhenthetransactioniscompleteandhouseencumbranee,deductingvenddrsarrearage.Thedifferencesbetweentheactuala

9、ndtheoriginalmortgageloanifany,shallbepaidincashbyThePurchase;D、涂銷抵押Revocationofmortgage_幣須在簽妥本合約_天內(nèi)付清作為定金余款,賣方收款當(dāng)日須即時(shí)向抵押銀行申請(qǐng)贖契手續(xù),賣方須在完成贖契、涂銷抵押登記及歸檔等手續(xù)_天內(nèi)簽署廣州市房地產(chǎn)交易所正式買賣合約,協(xié)助買方申請(qǐng)銀行貸款手續(xù),賣方完成以上手續(xù)不得遲于-;RMBshallbepaidaspartialdepositwithindaysaftersigningthisagreementandTheVendorshallimmediatelyapplyfor

10、RevocationofmortgageofthePropertystitlefromthemortgagebankonthesamedayofacceptingthesaiddeposit.TheVendorshallsigningformalsale&purchaseagreementwiththePurchaserassistThePurchasertoapplyforthemortgageloanwithin_Daysafterfinishingallformalitiesofredeemingtitle,dischargingmortgageregistrationandfiling

11、whereastheseformalitiesshallbefinishednotlaterthan3、稅費(fèi)繳付方式Taxpaynetmethod:4、賣方收到買方首期樓款當(dāng)日/買賣完成時(shí),賣方須負(fù)責(zé)將該物業(yè)交付/買方同意連同該物業(yè)現(xiàn)有之租約一起購入該物業(yè),賣方須負(fù)責(zé)將該物業(yè)連租約一起交付給買方,并協(xié)助買方與租戶簽訂新的租約。Whenthetransactioniscompleted,TheVendorshalldeliverthepossessionrightofthepropertytoThePurchaser/ThePurchaseragreeonpurchasingthepropert

12、ywiththeexistedtenancyagreement.5、該物業(yè)是以現(xiàn)狀售予買方,而買方已檢查該物業(yè),故買方不得借此拒絕交易。ThepropertyissoldtoThePurchaserinstatusquo,andThePurchaserhasalreadyinspectedthepropertyanddeemedacceptableThePurchasershallnotrefusetocompletethetransactiononthisexcuxe.6、在該物業(yè)交易完成日期前,賣方須付清一切有關(guān)該物業(yè)之雜費(fèi)(如水電、煤氣、管理、電話費(fèi)及有線電視費(fèi)等)。TheVendors

13、hallsettlealloutgoingutilitychargesinrespectofwater;electricity,gas,managementandtelephonefeerelatedtothepropertybeforethetransactionofthepropertyiscompleted.7、賣方須保證對(duì)上述該物業(yè)享有完整所有權(quán),能完全支配及處理。有關(guān)該物業(yè)的產(chǎn)權(quán)瓜葛、債務(wù)、稅項(xiàng)及租賃清還抵押等,賣方應(yīng)在交易完成前清理完畢,并保證交易后買方無須負(fù)責(zé),否則賣方應(yīng)賠償買方由此引起的一切損失。TheVendorshallensurethatheenjoysthefullti

14、tlerightofthepropertywithabsolutecontrolandislawfultodisposeoftheproperty.AndTheVendorshallsettleanyencumbrancesrelatedtothepossessionrightsdebts,taxationandtenancymortgageandsoforthbeforethetransactioniscompleted,otherwiseanylosshereaftercausedshallbebornebyTheVendor.8、經(jīng)紀(jì)代賣方所收之臨時(shí)定金,由賣方收妥及簽署本合約作實(shí),如賣

15、方拒絕收取該臨時(shí)定金及簽署本合約,則該筆定金在沒有任何補(bǔ)償情況下原銀交回買方,買方將不得要求任何賠償。TheinitialdepositpaidbythePurchasershallbeconfirmedafterTheVendoracceptingthesaiddepositandsignthisagreement.IfTheVendorrefusetoacceptthesaildepositandsigntheagreemen,thesaiddepositwillberefundedtoThePurchaserwithoutanycompensationandThePurchasersha

16、llnotclaimforanycompensation.9、如買方未能履行本合約之條款以至本合約不能順利完成,則已付之定金將由賣方?jīng)]收,而賣方有權(quán)再將該物業(yè)售予任何人,唯賣方不可再為此而向買方進(jìn)一步追究責(zé)任或要求賠償損失。ProvidedthatThePurchaserfailstoperformanytermsofthisagreementandthereforethisagreementcannotbeexecutedproperlythepaiddepositbyThePurchasercanbeforfeitedbyTheVendorandTheVendorshallhavether

17、ighttoresellthepropertytootherparties.ButTheVendorshallnotrunfurtherobligationorclaimforcompensanontoThePurchaser.10、賣方在收取定金后不依合約條款將該物業(yè)售予買方,則賣方除須退還所有買方已付定金外,并須以同等數(shù)目之金額賠償買方以彌補(bǔ)買方之損失,唯買方不可要求進(jìn)一步賠償或逼使賣方履行此合約。IfTheVendorfailstosellthepropertytoThePruchaserafteracceptingthedepositaccordingtothetermsofthisa

18、greementshallrefundallpaiddeposittoThePruchaserandpaythesameamountofmoneytoThePurchasertocompensatehislosses.ButThePurchasershallnotaskforfurthercompensationorforceTheVendortofurtherexecutethisagreement.11、基于經(jīng)紀(jì)已提供之服務(wù),經(jīng)紀(jì)有權(quán)簽訂此合約時(shí)向賣方收取_幣及向買方收取幣作為傭金,該筆傭金之繳交日期為.TheAgentisentitledtocollectasumofRMB/HKDfro

19、mTheVendorandasumofRMB/HKDfromThePurchaserasthecommissionaftersigningthisagreementowingtohisservicesprovidedrelatedtothistransactionfortwoparties.Andthiscommissionshallbepaidnotlaterthanthedateof.12、無論在任何情況下,若賣方或買方任何一方未能依本合約之條款賣出或買方物業(yè),則毀約之一方須即時(shí)付予經(jīng)紀(jì)_幣作為賠償經(jīng)紀(jì)之損失。EitherTheVendororThePurchaserwhofailstos

20、ellorbuythepropertyaccordingtothetermsofthisagreementshallimmediatelypayasumofRMB/HKDasthecompensationtoTheAgent.13、簽署本合約后,如買賣雙方在未得經(jīng)紀(jì)同意下協(xié)議取消本合約,則買賣雙方將同時(shí)及分別成為本合約之毀約者,并仍須各自負(fù)責(zé)付予經(jīng)紀(jì)應(yīng)得之上述傭金。IfTheVenlorandThePurchaserrescindthisagreementwithouttheendorsementofTheAgentaftersigningthisagreementbothpartieswillberegardedasbreachingofrepudiationofagree
