5、if the employee is un able to con ti nue to work due to work conn ected orwork aggravated injury of illness;d. force of majeure; and e. in such othercases whe n con tract of employme nt is termi nated through no fault of the employee.8. 交通費用:被雇傭人從本國到工作地點,交通費用由雇傭方承擔;因下列情形,需返回被雇傭人本國的,交通費亦由雇傭方承擔,具體情形如下
6、:a.合同期滿;b.雇用人以非正當理由終止合同;c.被雇傭人因工傷而無法繼續(xù)履行工作義務的;d.不可抗力;e.非被雇傭人過錯,但雇傭合同終止的。9. Free food or compensatory allowanee of US$,free suitablehous ing.9. 免費工作餐或津貼$美元,免費住宿。10. 8、ided by the employer at no cost to the worker.11. 保險:根據(jù)雇傭國政府或菲律賓政府的相關法律,為被雇傭人辦理個人意外保 險,費用由雇傭者全權負責。此外,若工作地點是被菲律賓政府指定為有戰(zhàn)爭危險 的地區(qū),雇用單位需對為雇用人提供不低于100,000比索的戰(zhàn)爭險,該費用由雇傭單位全額支付。12. In the case the employee ' s next kin and/orby the PhilippineEmbassy/ Consulaten earest the jobsite.12. 若被雇傭人在合同期間不幸死亡,雇用人全權負責將被雇傭人的遺體和個人財產(chǎn)遣返回菲律賓。送至被雇傭人的親戚或者最近的菲律賓大使館/領事館。13. The employer shall assist the Employee in
10、remitt ing a perce ntage ofhis salary through the proper Banking channel or other means authorized by law.13. 雇用人應協(xié)助被雇傭人通過銀行或其它合法渠道匯一定比例的工資款。L11,/ 14. Term in ati on:,* I x 1 i'14.合同終止:a. Termin ati on by Employer: The employer may termi nate this Con tract onthe followi ng just cause: serious m
11、isc on duct. Willful disobedie nee ofiemployer' s lawful orders, habitualneglect of duties,absenteeism,-jI/in subord in ati onreveali ngsecrets of establishme nt , whe n employeeviolates customs, traditi ons, and lows ofan d/or terms of this Agreeme nt. The employee shall shoulder the repatriati
12、 on expe nses backto the Philipp in es.a.雇用人終止合同:雇傭方可以以如下正當理由終止合同: 嚴重過失。故意違反 雇用人的合法指令,習慣性的疏于職守,曠工,透露公司商業(yè)秘密,當被雇傭人違反風俗、傳統(tǒng)和穩(wěn)定,以及本合同的條款,被雇傭人自負遣返回菲律賓的費用Con tractb. Term in ati on by Employee: The employee may term in ate thiswithout serving any notice to the employer for any of the following justcauses:
13、serious insult by the employer or his representative,inhuman andunbearable treatmentaccorded the employee by the employer or hisreprese ntative,commissi on of a crime/offe nse by the employer or hisreprese ntative . Employer shall pay the repatriati on expe nses back to the Philippi nes.b.被雇傭人終止合同:被
14、雇傭人可以如以下正當理由在任何情況下直接終止合 同:被雇傭方及其相關人欺凌,雇用人或其相關代表人對被雇傭人的殘忍不公的 對待,雇用人或其相關代表人的犯罪行為,在以上情況下,雇用人應支付被雇傭 人返回菲律賓的費用。 I X 1 CX i'b.1The employee may termi nate this con tract without just cause by serv ing one (1) month in adva nee no tice to the employer.The employer upon whomno such notice was served may
15、 hold the employee liable for damages In any7 廠7i ,case, the employee shall shoulder all expenses relativeto his repatriation,-j I# fback to point of origi n.b. 無正當理由,被雇傭人需提前1個月通知雇用人,要求終止合同。雇用人若未 收到任何通知,被雇傭人有權要求雇用人承擔賠償責任。在此種情況下,被雇傭 人需承擔返回菲律賓的一切費用。c. Term in ati on due to Ill ness:Either party may te
16、rmi nate the con tract onthe ground of illness,disease or injury by the employee. The employer shallshoulder the cost of repatriati on.c. 因疾病終止:雙方皆可以被雇傭人的疾病、受傷而終止合同。雇用人需承擔遣返費15. Settleme nt of disputes: All claims and complai nts relative to theemployme nt con tract of the employee shall be settled
17、in accorda nee withthe Company policies, rules and regulations. In the case the employeecon tests the decisi on of the employer, the matter shall be settled amicably with the participati on of the Labor Attache or any authorized represe ntative of the Philippi ne Embassy/C on sulate n earest compete
18、 nt or appropriate government body in host country or in the Philippines if permissible by host country laws at the opti on of the compla ining party.15. 爭端解決:被雇傭人若對雇傭合同相關內(nèi)容有何異議,皆可按照公司政策、條 例和法規(guī)友好協(xié)商解決。如果被雇傭人對雇用人的決議由任何的爭議,申訴方可以 I X 1% y ' y'自主選擇可通過所在國的勞動部門或菲律賓大使館/領事館相關授權地點協(xié)調(diào)處理。廠一一_”丿16. The employee shall observe employer' s companyrelues and abide by the pert inent laws of the host country and respect its customs and traditi ons.16. 被雇傭人應遵從雇用公司的規(guī)定,遵守所在國的法律,尊重所在國的風俗習慣,-jI/和傳統(tǒng)。17.
