1、貨物保險附加險(2011 版)條款擴展類:1、郵包險條款一、責任范圍本保險負責賠償:(一)直接由于、類似行為和行為、沖突或海盜行為所致的損失。(二)由于上述第(一)款引起的捕獲、拘留、制、扣押所造成的損失。、禁(三)各種常規(guī),包括水雷、所致的損失。(四)本條款責任范圍引起的共同海損的犧牲、分攤和救助費用。二、除外責任本保險對下列各項,不負賠償責任:(一)由于失和費用。行為使用原子或熱核制造的所致的損(二)根據(jù)執(zhí)政者、當權者或其他引起的承保航程的喪失和挫折而三、責任起訖的扣押、拘留任何索賠。本保險責任自被保險郵包經(jīng)郵局收訖后自處所開始運送時生效,直至該項郵包運達本保險單所載目的地郵局送交收件人為
2、止。本條款系郵包保險條款(2009 版)的(以下簡稱“主險條款”)的附加條款,本條款與主險條款有抵觸時,均以本條款為準;本條款未盡事宜,以主險條款為準。2、條款(郵包)INSTITUTE WAR CLAUSESRISKS COVERED(sendings byt)1/1/82This insurance covers, except as provided in Clauses 3 and 4 below, loss of or damage to the subject-matter insured caused bywar civil war revolution rebellion in

4、 This insurance covers general average and salvage charges, adjusted or determined according to the contract of affreightmentand/or theerning law and practice, incurred to avoid or inconnection with the avoidance of loss from a risk covered under these clauses.EXCLUSIn no case shall this insurance c
5、overloss damage or expense attributable to willful misconduct of theAredordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear of the subject-matter insuredloss damage or expense caused by insufficiency or unsuitability of packing or preparation of the subject-matter insured

15、和上述行動或行為所引起的共同海損的犧牲、分攤和救助費用。二、除外責任本保險對下列各項,不負賠償責任:在期間由于勞動力短缺或不能履行正常職責所致的保險貨物的損失,包括因此而引起的動力或藏機停止工作所致的冷藏貨物的損失。缺乏使冷本條款系各種貨物保險條款(以下簡稱“主險條款”)的附加條款,本條款與主險條款有抵觸時,均以本條款為準;本條款未盡事宜,以主險條款為準。4、偷竊、提貨不著險條款本保險對被保險貨物償:下列損失,按保險價值負責賠1、偷竊行為所致的損失;2、整件提貨不著;3、根據(jù)分。契約規(guī)定船東和其他責任方免除賠償?shù)牟勘槐kU人必須及時提貨,遇有第 1的損失,必須在提貨后十日內(nèi)申請檢驗;遇有第 2
16、項損失,必須向責任方取得整件提貨不著的證明,否則,保險人不負賠償責任。保險人收回被保險人向船東或其他有關責任方面追償?shù)降娜魏钨r款,但其金額以保險人支付的賠款為限。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的一般附加險條款。保險責任的成立需受保險單約定的貨運險條款的除外責任部分所制約;本條款未盡事宜,以主險條款為準。5、淡水、雨淋險條款本保險對被保險貨物因直接雨淋或淡水所致的損失負責賠償,但包裝外部應有雨水或淡水痕跡或有其他適當?shù)淖C明。被保險人必須及時提貨,并在提貨后十天內(nèi)申請檢驗,否則,保險人不負賠償責任。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的一般附加險條款。保險
17、責任的成立需受保險單約定的貨運險條款的除外責任部分所制約;本條款未盡事宜,以主險條款為準。6、短量險條款本保險對被保險貨物在過程中,因外包裝破裂或散裝貨物發(fā)生數(shù)量散失和實際重量短缺的損失負責賠償,但正常的途耗除外。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的一般附加險條款。保險責任的成立需受保險單約定的貨運險條款的除外責任部分所制約;本條款未盡事宜,以主險條款為準。7、混雜、沾污險條款本保險對被保險貨物在的損失,負責賠償。過程中,因混雜、沾污所致本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的一般附加險條款。保險責任的成立需受保險單約定的貨運險條款的除外責任部分所制約;本條
18、款未盡事宜,以主險條款為準。8、滲漏險條款本保險對被保險貨物在過程中,因容器損壞而引起的滲漏損失,或用液體儲藏的貨物因液體的滲漏而引起的貨物等損失,負責賠償。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的一般附加險條款。保險責任的成立需受保險單約定的貨運險條款的除外責任部分所制約;本條款未盡事宜,以主險條款為準。9、碰損、破碎險條款本保險對被保險貨物在過程中因、碰撞、受壓造成的破碎和碰撞損失,負責賠償。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的一般附加險條款。保險責任的成立需受保險單約定的貨運險條款的除外責任部分所制約;本條款未盡事宜,以主險條款為準。10、串味險條款本
19、保險對被保險食物、中藥材、化妝品原料等貨物在運輸過程中,因受其他物品的影響而引起的串味損失,負責賠償。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的一般附加險條款。保險責任的成立需受保險單約定的貨運險條款的除外責任部分所制約;本條款未盡事宜,以主險條款為準。11、受潮受熱險條款本保險對被保險貨物在過程中因氣溫突然變化或由于船上通風設備失靈致使船艙內(nèi)水氣凝結、發(fā)潮或發(fā)熱所造成的損失,負責賠償。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的一般附加險條款。保險責任的成立需受保險單約定的貨運險條款的除外責任部分所制約;本條款未盡事宜,以主險條款為準。12、鉤損險條款本保險對被保險
20、貨物在裝卸過程中因鉤損而引起的損失,以及對包裝進行修補或調(diào)換所支付的費用,均負責賠償。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的一般附加險條款。保險責任的成立需受保險單約定的貨運險條款的除外責任部分所制約;本條款未盡事宜,以主險條款為準。13、包裝破裂險條款本保險對被保險貨物在過程中因搬運或裝卸不慎,包裝破裂所造成的損失,以及為繼續(xù)安全所需要對包裝進行修補或調(diào)換所支付的費用,均負責賠償。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的一般附加險條款。保險責任的成立需受保險單約定的貨運險條款的除外責任部分所制約;本條款未盡事宜,以主險條款為準。14、銹損險條款本保險對被保險
21、貨物在償。過程中發(fā)生的銹損負責賠本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的一般附加險條款。保險責任的成立需受保險單約定的貨運險條款的除外責任部分所制約;本條款未盡事宜,以主險條款為準。15、交貨不到條款本保險自貨物裝上船舶時開始,不論由于任何原因,如貨物不能在預定抵達目的地的日期起六個月以內(nèi)交訖,保險人同意按全損予以賠付,但該貨物之全部權益應轉(zhuǎn)移給保險人。被保險人保證已獲得一切證。所有險及險項下應予負責的損失,概不包括在本條款責任范圍之內(nèi)。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的特別附加險條款。本條款與主險條款有抵觸時,以本條款為準;本條款未盡事宜,以主險條款為準
22、。16、拒收險條款一、保險人對被保險貨物由于在進口港被進口國的或有關進口或沒收予以負責,并按照被進口或被沒收貨物的保險價值賠償。二、在被保險貨物起運后,進口國宣布實行任何禁運或,保險人僅負責賠償運回到出口國或轉(zhuǎn)口到其他目的地而增加的運費。但最多不得超過該批貨物的保險價值。三、本保險的終止,自被保險貨物卸離海輪存入卸貨港的倉庫時為止,或者(一)自被保險貨物在目的港卸離海輪滿二十天時終止;(二)自被保險貨物已被進口國的口時為止;以首先發(fā)生者為準。四、被保險人保證:或有關允許進(一)被保險貨物的生產(chǎn)、質(zhì)量、包裝和商品檢驗必須符合產(chǎn)地國和進口國的有關規(guī)定;(二)被保險貨物備有一切必需的有效的進口特許證
23、或許可證。五、保險人對下列原因引起的任何損失不負賠償責任:(一)上述第四條中的任何一款;(二)市價跌落;(三)被保險貨物記載的錯誤、商標或標記的錯誤、貿(mào)易契約或其他文件發(fā)生的錯誤或遺漏;(四)定;產(chǎn)地國或有關關于出口貨物的有關規(guī)(五)被保險貨物在起運前,進口國已經(jīng)宣布實行禁運或。六、在發(fā)生本保險承保的損失時,被保險人應立即通知保險人,并按照保險人的要求采取一切可能的措施。保險人與被保險人對被進口或沒收貨物采取的一切措施都不應視為接受賠償或放棄索賠的表示。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的特別附加險條款。本條款與主險條款文有抵觸時,以本條款為準;本條款未盡事宜,以主險條款為
24、準。17、素險條款本保險對被保險貨物,在保險責任有效期內(nèi),在進口港或進口地經(jīng)當?shù)匦l(wèi)生檢驗證明,因含有毒素,并進口、沒收且超過了進口國對該毒素的限制標準,必須或強制改變用途時,保險人按照被進口或被沒收部分貨物的保險價值或改變用途所造成的損失,負責賠償。如發(fā)生本條款項下的損失,被保險人同意,在保險人需要時應盡力處理裁。進口或強制改變用途的貨物,或申請仲本條款不負責由于其他原因所致的被有關口或沒收或強制改變用途的貨物的損失。進本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的特別附加險條款。本條款與主險條款有抵觸時,以本條款為準;本條款未盡事宜,以主險條款為準。18、二1、二器設備重置條款器設
25、備損壞的賠償責任以該損壞部分的重置或修理費用按新機器設備價值的比例分攤加費用為限,但不包括關稅。費及安裝2、若全部關稅已包含在保險金額內(nèi),則保險人對于額外支付的關稅給予賠償。3、保險人的賠償責任以全部機器設備的保險價值為限。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的附加險條款。本條款與主險條款有抵觸時,以本條款為準;本條款未盡事宜,以主險條款為準。19、品牌和商標條款若受損險人對于該是具有品牌或商標的承諾保證或負責,該受損,或制造商及被保的殘值應該在保險人按慣例剔除此類品牌、商標或其他標識后再確定。被保險人對于受損擁有全部所,并且對所有受損保留控制權。被保險人對受損進行適當判斷,
26、并將獨立判定該受損是否適于消費。所有不適于消費的受損均不應該銷售或處理,而保險人可對被保險人取得的受損財產(chǎn)殘值進行銷售和處理,但是應事先取得被保險人的同意。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的附加險條款。本條款與主險條款有抵觸時,以本條款為準;本條款未盡事宜,以主險條款為準。20、賣方利益保險條款本保險系賣方利益保險,負責賠償貨物在本保險單載明承保險別的條款責任范圍內(nèi)的賣方損失。但本保險僅在買方不支付該項受損貨物部分的貨款損失時才予賠償。被保險人應將其向買方或第三者的權利轉(zhuǎn)移給保險人。如對本保險單項下的任何利益或賠款轉(zhuǎn)讓,保險人即解除其全部責任。本條款系本保單約定的貨運險條
27、款(以下簡稱“主險條款”)的附加險條款。本條款與主險條款有抵觸時,以本條款為準;本條款未盡事宜,以主險條款為準。21、臨時倉儲條款(以天為限)茲經(jīng)保險合同雙方同意,本條款擴展承保被保險貨物在公共倉儲地點或者其他被指定的倉庫進行臨時倉儲期間的風險。本條款所約定的臨時倉儲期限自貨物抵達倉儲地點起開始,并不得超過本保單中所約定的天的期限;同時,倉儲時間應當連續(xù)計算,不得中斷。但是在倉儲過程中因下列原因造成的標的損失,屬于本條款的除外責任:征收、稱重、數(shù)量與質(zhì)量檢驗、包裝、抽樣、裝卸、堆垛、分銷。被保險人須保證用于臨時倉儲的倉庫需符合一類建筑物的標準,即其屋頂、外墻和內(nèi)墻需以磚、石料、鋼筋混泥土、空心
28、磚、實心磚或者石板所建,其的樓板、樓梯、作業(yè)需完全以非易燃物質(zhì)所建造,且需配備有 24 小時的安全措施和裝置。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的附加險條款。本條款與主險條款有抵觸時,以本條款為準;本條款未盡事宜,以主險條款為準。22、放棄代位追償權利條款茲經(jīng)保險合同雙方同意,若本保險單項下負責的損失涉及其他責任方時,保險人在此同意放棄向被保險人相關利益方,包括各下屬雇員、股東、任何子公司、關聯(lián)公司、控股公司、董事等進行追償?shù)臋嗬?。本保險單所載其他條件不變。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的附加險條款。本條款與主險條款有抵觸時,以本條款為準;本條款未盡
29、事宜,以主險條款為準。23、擴展承保裝載、卸載條款茲經(jīng)保險合同雙方同意,本保險單擴展承保保險標的在裝載、卸載過程中因自然或意外事故導致的直接物質(zhì)損失風險。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的附加險條款。本條款與主險條款有抵觸時,以本條款為準;本條款未盡事宜,以主險條款為準。24、活動條款茲經(jīng)保險合同雙方同意,鑒于被保險人已繳付了附加的保險費,本保險協(xié)議擴展承保本協(xié)議明細表的區(qū)域所出現(xiàn)任何分子或組織進行活動直接造成的被保險貨物的滅失或損壞。本保險協(xié)議所載其他條件不變。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的附加險條款。本條款與主險條款有抵觸時,以本條款為準;本
30、條款未盡事宜,以主險條款為準。25、索賠準備費用條款茲經(jīng)保險合同雙方同意并約定,本保單擴展承保被保險人按照保單條款的要求,應保險人或其代表或其要求提供給保險人所需索賠其他證明材料(而這些、文件、定因定損檢測檢驗或、文件和等不是被保險人正常營運中本來就具有的)所發(fā)生的必要的和合理的費用。該費用包括但不限于檢驗費、集裝箱占有使用費、碼頭占有使用費、倉庫/場地租賃費、為檢測檢驗產(chǎn)生的運費和裝卸費等。本條款同樣適用賠案處理初期保單責任不明確的情況。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的附加險條款。本條款與主險條款有抵觸時,以本條款為準;本條款未盡事宜,以主險條款為準。26、及民眾條款
31、茲經(jīng)保險合同雙方同意,本保險擴展承保本保險單承保的在保險單的途中由于、或公共或民眾造成的損失。但本擴展條款對由于令、沒收、征用或拆毀造成的損失不負責賠償。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的附加險條款。本條款與主險條款有抵觸時,以本條款為準;本條款未盡事宜,以主險條款為準。27、隱藏條款盡管另有相反約定,茲同意當承保風險引起的損失于貨物到達被保險人的倉庫、地點之后的天內(nèi)被發(fā)現(xiàn),保險人應按貨物到達當時發(fā)現(xiàn)的損失同樣之處理方式進行理賠。但該損失必須可以歸因于保險合同載明之承保條件及范圍。當貨物到達時如發(fā)現(xiàn)有外部破損現(xiàn)象應及時開箱檢查。本保險協(xié)議所載其它條件不變。本條款系本保單約
32、定的貨運險條款(以下簡稱“主險條款”)的附加險條款。本條款與主險條款有抵觸時,以本條款為準;本條款未盡事宜,以主險條款為準。28、延遲開箱條款茲經(jīng)保險合同雙方同意,保險人擴展承擔自貨物抵達目的地后()天內(nèi),若開箱后發(fā)現(xiàn)貨物損失,如果保險人不能舉證該損失發(fā)生在保險責任終止前或終止后,則保險人承擔賠償責任。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的附加險條款。本條款與主險條款有抵觸時,以本條款為準;本條款未盡事宜,以主險條款為準。29、隱蔽性損失條款(天)茲經(jīng)保險合同雙方同意,1、本保單擴展承保保險標的物在正常途中,因保險事故造成但從外包裝無法察覺的隱藏性損失,但被保險人應在開箱后立
33、即通知保險檢驗人,且最晚不得超過抵達最后目的地之后()天。保險人不承擔保險單載明的保險期間終止日或運險條款載明的保險責任終止日后的賠償責任。貨2、當被保險人發(fā)現(xiàn)整件貨物損失或當貨物抵達倉庫發(fā)現(xiàn)包裝物破損,被保險人應按照保單上載明的被保險義務約定立即向承運人索賠,同時通知檢驗人對包裝破損貨物進行損驗。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的附加險條款。本條款與主險條款有抵觸時,以本條款為準;本條款未盡事宜,以主險條款為準。30、延長期限特別條款保險人理解并同意,從保單上的終止日期開始到()天之內(nèi),被保險貨物在最后達到保單上的最終目的地止,承擔保險貨物到達最終倉庫期間的保險責任。本
34、條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的附加險條款。本條款與主險條款有抵觸時,以本條款為準;本條款未盡事宜,以主險條款為準。31、再包裝費用特別條款茲經(jīng)保險合同雙方同意,如果保險貨物由于遭遇風險造成的外包裝損失,包裝內(nèi)的貨物必須重新再包裝后才能銷售,本保險負責承擔被保險人需要支付的新的包裝費用,特殊費用,勞動力等用于此次事故造成的再包裝費用。此條款項下規(guī)定每次事故最高賠償限額為。本條款系本保單約定的貨運險條款(以下簡稱“主險條款”)的附加險條款。本條款與主險條款有抵觸時,以本條款為準;本條款未盡事宜,以主險條款為準。32、特別空運費用條款茲經(jīng)保險合同雙方同意,經(jīng)發(fā)生保險責任范圍內(nèi)

If the subject matterinsured ibsequently reshipped to the original or any otherdestination, then, provided notice is given to the Underwriters before the commencement of such further transit and subject to an additional premium, such insurance reattaches5.3.
53、1he case of the subject-matter insured having beendischarged, as the subject-matter insured and as to any part astpart is loaded on the on-carrying vefor the voyage;5.3.2he case of the subject-matter noving been discharged,when the vesails from such deemed final port of discharge;thereafter such ins
54、urance terminates in accordance with 5.1.4.5.4 The insurance against the risks of mines and derelict torpedoes, floating or submerged, is extended whilst the subject-matter insuredor nay part thereof is on craft whilstransit to or from the overseave, but in no casethe expiry of 60 days after dischar
