36、(edge) on crime. 外國人犯罪案件情況分析與對策我國改革開放不斷深入，國際交往日益加深，來上海外國人愈來愈多，這是對外開放的發(fā)展趨勢。其中也不乏一些來中國進行犯罪的不法之徒，我們切不可掉以輕心。我對近兩年來上海的外國人犯罪情況進行梳理，對外國人犯罪的原因、特點及對策作了一些分析與思考。一、基本情況根據(jù)我國刑事訴訟法及高檢院刑事訴訟規(guī)則第 94 條規(guī)定，外國人犯罪逮捕案件由檢察分院審查，省、市檢察院決定。據(jù)統(tǒng)計，2001 年至 2003 年 10 月本市檢察機關(guān)共辦理審查批捕外國人刑事犯罪案件 60 件 80 人，其中批準(zhǔn)逮捕 72 人，不批準(zhǔn)逮捕 8 人。共涉及韓國、日本、美國、

37、俄羅斯、馬來西亞、印度尼西亞、新加坡、泰國、菲律賓、柬埔寨、巴基斯坦、法國、新西蘭、澳大利亞、加拿大等 21個國家和地區(qū)。主要案由有：（1）組織、運送他人偷越國（邊）境 23 件 26 人；（2）信用卡詐騙 7 件 15人；（3）走私、運輸毒品 4 件 9 人；（4）故意殺人 2 件 3 人；（5）強奸 2 件 2 人、強制狠褻婦女 l 件 1 人；（6）故意傷害 l 件 1 人；（7）非法拘禁 l 件 1 人；（8）盜竊 7 件 10 人；（9）票據(jù)詐騙 2 件 2 人、詐騙 2件 2 人；（10）走私普通貨物 l 件 1 人；（11）出售、持有假幣 2 件 2 人，以及非法持有、私藏槍支彈

38、藥 l件 1 人、賭博 l 件 1 人、非法經(jīng)營 l 件 1 人、窩藏 1 件 1 人、重婚 1 件 1 人等 l6 種罪名。二、主要特點（一）妨害國（邊）境管理犯罪案件多兩年來本市檢察機關(guān)共辦理外國人組織、運送他人偷越國（邊）境、出售出入境證件等妨害國（邊）境管理案件 23 件 26 人，占受理案件數(shù)的 38，且犯罪嫌疑人多數(shù)是外籍華人，他們對我國大陸的情況比較熟悉，為非法牟利，通過國內(nèi)“蛇頭”組織偷渡人員，在機場由他們以外籍華人的身份帶領(lǐng)偷渡人員用偽造的護照從機場偷渡出境，從中收取好處費。如新西蘭籍華人龍啟華（英文名 LONG QI HUA）于 2002年 1 月在香港搭識臺灣人梁姓“蛇頭

39、”，然后根據(jù)梁的安排于同年 2 月 6 日在上海浦東國際機場侯機廳和偷渡人陳鵬飛見面并與其調(diào)換登機牌，同時將一本署名“龍啟驊”的偽造的中國護照交給陳，自己則登上飛往日本的班機，陳欲登機偷渡到美國時，被邊檢當(dāng)場查獲。為此，龍從中收取 500 美元的好處費。這類偷渡案件近幾年的發(fā)案率有所上升，難以查處，主要原因有：一是“蛇頭”行蹤詭詐難以查獲。在上述 23 件組織、運送他人偷越國（邊）境案件中抓獲“蛇頭”的很少，以組織他人偷越國（邊）境罪被判處徒刑的只有 2 人，這些“蛇頭”平時行蹤詭詐，在組織偷渡人員的過程中不留真名，有的只留姓不留名，有的只知道綽號，通訊地址也是多變的手機號碼，如要送交假護照以

40、及簽證材料也多在賓館內(nèi)進行，無固定場所，難以抓獲。二是利益驅(qū)動，孤注一擲。在上述 23 件偷渡案件中，被抓獲的偷渡人員以浙江溫州、樂清，福建長樂、福州人為多數(shù)，其中福建長樂偷渡者居首共 l7 件，占 73，這些偷渡者多是為到境外打工圓淘金夢的，因此在偷渡前已花了巨款，少則幾萬，多則十幾萬人民幣，但最終都是竹籃打水一場空。（二）信用卡詐騙犯罪猖獗一是結(jié)伙犯罪多。兩年來本市檢察機關(guān)共辦理外國人信用卡詐騙犯罪案件 7 件 l7 人，其中兩人以上結(jié)伙犯罪的有 5 件 15 人，占 882，參加人數(shù)最多有 7 人的團伙犯罪。如韓國籍人崔英燮等 7 人信用卡團伙詐騙一案。犯罪嫌疑人崔英燮為非法牟利，勾結(jié)權(quán)

41、炳瑾等韓國人在韓國收集那些已嚴(yán)重透支的國際信用卡，然后由犯罪嫌疑人崔洪日負(fù)責(zé)在上海尋找有 POS 機的特約商戶，以虛構(gòu)交易的手法，套取現(xiàn)金。同年 5 月，犯罪嫌疑人崔英燮伙同崔洪日、申三浩、樸潤鎮(zhèn)、林洛仁等人，先后用從韓國收集來的已嚴(yán)重透支的 l40 張國際信用卡，通過上海馨原貿(mào)易有限公司提供的 POS 機，虛構(gòu)機票交易 6l 0 次，共套取現(xiàn)金人民幣 l39 萬余元。二是犯罪案值高。在上述 7 件信用卡詐騙犯罪案件中，案值最高的為人民幣 l39 萬元，最低的也要達到數(shù)萬元，犯罪嫌疑人的犯罪手段都是用偽造的信用卡在商店瘋狂購物消費或套取現(xiàn)金，每次犯罪數(shù)額均在萬元以上。如馬來西亞籍犯罪嫌疑人翁燦

42、業(yè)、潘榮貴、李可新等犯罪團伙于 2001 年 1 月 7 日至 11 日，在本市緣友文化藝術(shù)品有限公司和 97 夜總會，用偽造的信用卡購買玉器及娛樂消費，在短短的 3 天內(nèi)先后消費人民幣 l8 萬元，詐騙數(shù)額巨大，犯罪氣焰囂張。三是犯罪手段狡猾。在信用卡詐騙犯罪案件中，犯罪嫌疑人的手段狡猾，有的利用上海人對西方國家的人較為好感、不易生疑的心理，實施詐騙犯罪。如香港籍犯罪嫌疑人白朗杰，為進行信用卡詐騙，在香港就勾結(jié)英國人德里克亨利凱德威爾，到上海的老廟黃金公司景容樓，由德里克亨利凱德威爾出面，用偽造的信用卡購買價值人民幣 l 8000 余元的黃金手飾，當(dāng)白朗杰再次指使德里克亨利凱德威爾在同一柜臺

43、繼續(xù)購買黃金手飾時，被查獲。（三）殺人、強奸等暴力案件時有發(fā)生兩年來本市檢察機關(guān)共辦理外國人故意殺人、故意傷害、強奸、強行侮辱婦女等暴力犯罪案件 6 件 7人。一般來說，外國人在我國境內(nèi)實施暴力犯罪的比較少見，但一旦發(fā)生社會影響廣、危害大。如日本籍犯罪嫌疑人佐藤登志惠、佐藤公彥故意殺人案，犯罪嫌疑人佐藤登志惠為了報復(fù)和騙取保險金，經(jīng)預(yù)謀，于 2001 年 4 月 29 日下午伙同其子佐藤公彥，在本市虹橋地區(qū)，將其父佐藤善治殺害。案件發(fā)生后，引起市公安局領(lǐng)導(dǎo)的高度重視。由于是外國人在本市殺人，比較罕見，因而在社會上也造成很大的影響。又如韓國籍犯罪嫌疑人梁丞摸故意殺人案，梁于 2003 年 2 月

44、 3 日從韓國來滬旅游，居住在由泰國籍女友盧麗霞租住的本市秀山路 4 弄 3 號 502 室內(nèi)。同年 3 月 1 日凌晨，兩人因故發(fā)生口角并被盧咬傷舌頭，梁惱羞成怒，用手掐住盧的頸部遭到反抗，梁又用電線勒其頸部，致其窒息死亡。梁殺人后向公安機關(guān)投案自首。案件發(fā)生后，根據(jù)市公安局領(lǐng)導(dǎo)的批示，有關(guān)部門積極做好被害人的善后事宜和安撫工作。（四）毒品犯罪手段隱蔽在本市檢察機關(guān)辦理的外國人毒品犯罪案件中，采用體內(nèi)藏毒方法運輸毒品比較少見，但犯罪手段隱蔽。如烏茲別克斯坦國籍犯罪嫌疑人阿圖爾阿比托夫等四人運輸毒品一案，犯罪嫌疑人阿圖爾阿比托夫等人為牟利，受人雇用，已多次采用體內(nèi)藏毒的方法為他人運輸毒品，不顧

45、身體傷害，仍繼續(xù)為他人運輸毒品。2003 年 5 月 22 日晚 l0 時許，犯罪嫌疑人阿圖爾阿比托夫和俄羅斯籍犯罪嫌疑人莉莉亞莎菲娜、瑪利亞路布楊斯卡婭、艾列諾拉托爾斯地赫以及舒赫拉特烏買爾諾夫等四人將毒品海洛因，用塑膠紙包成顆粒狀分別吞入體內(nèi)，從昆明搭乘 FM452 航班飛抵上海，次日凌晨在本市華茂大酒店 4008 房和40l 2 房被查獲并繳獲從犯罪嫌疑人排泄出體外的顆粒狀毒品海洛因 745 粒，重 2l55 余克。5 月 23 日至 5月 25 日又從上述犯罪嫌疑人的排泄物中繳獲顆粒狀毒品海洛因 337 粒，重 994 克，總計繳獲毒品海洛因3000 余克。（五）周邊國家和外籍華裔的犯

46、罪嫌疑人居多兩年來本市檢察機關(guān)共辦理的 60 件 80 人外國人犯罪案件中，在我國周邊地區(qū)國家的犯罪人員有 48人占 60，其中韓國 11 人、日本 7 人、馬來西亞 8 人、巴基斯坦 4 人、菲律賓 3 人、泰國 3 人、新加坡2 人、柬埔寨 2 人、印度尼西亞 2 人、伊朗 2 人、俄羅斯和烏茲別克斯坦 4 人。而美國、澳大利亞、加拿大、新西蘭等國家的犯罪嫌疑人，也是外籍華人為多數(shù)，共有 l8 人，其中美籍華人 11 人，居首位，且都是以非法牟利為目的，實施組織、運送他人偷越國（邊）境犯罪。 Nearly three years in Beijing foreigners who comm
