9、乙方保證，在租賃期內(nèi)未征得甲方書面同意以及按規(guī)定須經(jīng)有關(guān)部門審批而未核準(zhǔn)前，不擅自改變上述約定的使用用途.2-2 Party B promises that it shall not change the usage of the Premises without getting the written consent of Party A and the approval of the related department according to the terms herein during the Leasing term. 三、交付日期和租賃期限Three、Delivery date

18、ies on Repair of the Premises6-1租賃期間，乙方發(fā)現(xiàn)該房屋及其附屬設(shè)施有損壞時，應(yīng)及時通知甲方修復(fù)；甲方應(yīng)在接到乙方通知后 叁 日內(nèi)進(jìn)行維修。逾期不維修的，乙方可代為維修，費(fèi)用由甲方承擔(dān)。6-1 During the leasing term, Party B shall inform Party A to repair in the event that the damage to the Premises or facilities is occurred. Party A shall repair it within three(3) day after r

In Case Party A fails to repair the damage on time, Party B can repair it instead of Party A and the Party A shall be responsible for the fees. 6-2 租賃期間，乙方應(yīng)合理使用并愛護(hù)該房屋及其附屬設(shè)施。因乙方使用不當(dāng)或不合理使用，致使該房屋及其附屬設(shè)施損壞或發(fā)生故障的，乙方應(yīng)負(fù)責(zé)維修。乙方拒不維修，費(fèi)用由乙方承擔(dān)。6-2 Party B shall take good care of and reasonabl

20、y use the Premises and attached facilities during the leasing team. Party B shall be responsible for the immediate repair or compensation for the damage to the Premises or facilities due to Party Bs improper use.6-3租賃期間，甲方督促物業(yè)管理公司保證該房屋及附屬設(shè)施處于正常的使用和安全的狀態(tài)。甲方對該房屋進(jìn)行檢查、養(yǎng)護(hù)，應(yīng)提前 壹 日通知乙方。檢查養(yǎng)護(hù)時，乙方應(yīng)予以配合。甲方應(yīng)減少對

21、乙方使用該房屋的影響。6-3 Party A shall guarantee that the Premises shall be under the condition of usable and safety during the leasing term. Party A shall notice Party B one (1) day in advance while repairing maintenance Premises. Party B shall assist or cooperate with Party A . Party A shall reduce the infl

22、uence of Party Bs using of the Premises.6-4 除本合同附件(三)外，乙方另需裝修或者增設(shè)附屬設(shè)施和設(shè)備的，應(yīng)事先征得甲方的書面同意，按規(guī)定須向有關(guān)部門審批的，則還應(yīng)由 甲方委托乙方 報請有關(guān)部門批準(zhǔn)后，方可進(jìn)行。乙方增設(shè)的附屬設(shè)施和設(shè)備歸屬及其維修責(zé)任由甲、乙雙方另行書面約定. 6-4 If Party B intends to make renovations or changes to the original facilities apart from the appendix (3) of this contract, Party B shal

23、l do so only after obtaining the written consent of Party A. Party B shall be able to carry out the said project only after going through the application formalities to the related department in accordance with the relevant regulations. The ownership and responsibilities of repairing the accessory e

24、quipment shall be stipulated at some other time by Party A and Party B.七、房屋返還時的狀態(tài)Seven、The state of the returned Premises7-1 除甲方同意乙方續(xù)租外，乙方應(yīng)在本合同的租期滿后的 當(dāng) 日內(nèi)返還該房屋，未經(jīng)甲方同意逾期返還房屋的，每逾期一日，乙方應(yīng)按 / 元平方米（幣）向甲方支付該房屋占用費(fèi)。（詳見補(bǔ)充條款）7-1 Except that Party A agrees Party B extends this contract, Party B shall return the

While

26、returning, the Premises shall be checked for acceptance and the two parties shall pay up the charges ought to be borne by each other.八、轉(zhuǎn)租、轉(zhuǎn)讓和交換Eight、Subletting, transfer and exchange8-1除甲方已在本合同補(bǔ)充條款中同意乙方轉(zhuǎn)租外，乙方在租賃期內(nèi)，需事先征得甲方的書面同意，方可將該房屋部分或全部轉(zhuǎn)讓給他人。但同一間居住房屋，乙方不得部分或同時轉(zhuǎn)租給二個或二個以上的承租人。8-1 Party B shall be al

27、lowed to sublet the premises in part or in whole to third Party only after getting Party As written consent during the leasing term unless Party A authorizes Party B to sublet the Premises in the Supplementary Agreement made by Party A and Party B. Party B shall not sublet the same Premises in part

28、or sublet the Premises to more than two other Persons.8-2乙方轉(zhuǎn)租該房屋，應(yīng)按規(guī)定與受租方訂立書面合同的轉(zhuǎn)租合同并按規(guī)定向該房屋所在區(qū)、縣房地產(chǎn)交易中心或農(nóng)場系統(tǒng)受理處辦理，登記備案。8-2 When Party B sublets the Premises, Party B shall conclude written subleasing Contract with the sub lessee and register in the premises transaction center of district/country or

29、 acceptance bureau of farm system where the premises locate in accordance with regulations.8-3在租賃期內(nèi)，乙方將該房屋轉(zhuǎn)讓給他人承租或與他人承擔(dān)的房屋進(jìn)行交換，必須事先征得甲方書面同意。轉(zhuǎn)讓或交換后，該房屋承租權(quán)的受讓人或交換人應(yīng)與甲方簽定租賃主體變更合同并繼續(xù)履行本合同。8-3 During leasing term, Party B shall not sublease the premises to third Party or exchange it with third Party unle

30、ss a written consent from Party A has be granted. After subletting, the successor of the lease right of the Premises shall execute a principal part alteration contract with Party A and continue to fulfill this contract.8-4在租賃期內(nèi)，甲方如需出售該房屋，應(yīng)提前三個月通知乙方。乙方放棄優(yōu)先購買權(quán)。轉(zhuǎn)讓后，甲方應(yīng)保證受讓人與乙方簽定租賃主體變更合同并繼續(xù)履行本合同。8-4 Dur

31、ing leasing term, Party A shall inform Party B three(3) months in advance , Party B gives up the right of preemption. After property transaction, Party A shall guarantee the successor of the property shall execute a principal part alternation contract with Party B and continue to fulfill this contra

32、ct九、解除本合同的條件Nine、 conditions to terminate the Contract9-1甲、乙雙方同意在租賃期內(nèi)，有下列之一的，本合同終止，雙方互不承擔(dān)責(zé)任。9-1 During the leasing term, the contract shall be terminated when any of the following condition occurs and two parties shall not be responsible for each other.（一）該房屋占用范圍內(nèi)的土地使用權(quán)依法提前收回的；(a) The right to the u

33、se of land on which the Premises locate be legally taken back in advance;（二）該房屋因社會公共利益或城市建設(shè)需要被依法征用的；(b) The Premises be taken back for the need of public interest or the citys construction;(三) 該房屋毀損、滅失或者被鑒定為危險房屋的；(c) The Premises be damaged, missing or be authenticated as dangerous Premises;9-2甲、乙雙方

34、同意，有下列情形之一的，一方可書面通知另一方解除本合同。違反本合同的一方，應(yīng)向另一方按月租金的 兩 倍支付違約金；給對方造成損失的，支付的違約金不足抵付一方損失的，還應(yīng)賠償造成的損失與違約金的差額部分：9-2The both sides agree that One Party shall inform the other Party in written to terminate the Contract under the following conditions. The defaulting Party shall pay to the other Party the liquidat

35、ed damages equivalent to two(2) times of the monthly rent. If the financial losses incurred to the other Party exceed the amount of the liquidated damages, the defaulting Party shall compensate the deficiency.（一）甲方未按時交付該房屋，經(jīng)乙方催告后 拾伍 日內(nèi)仍未交付的；(a) Party A fails to deliver the Premises on schedule and f

36、ails to do so within fifteen(15) days after reception of Party Bs summon exhortation. （二）甲方交付的該房屋不符合本合同的約定，致使不能實(shí)現(xiàn)租賃目的的；或甲方交付的房屋存在缺陷，危及乙方安全的。(b) The Premises Party A delivered be not in accordance with the agreement of Contract which leads to fail to fulfill the aim of the rent. Or the Premises be de

37、fective to endanger the safety of Party B.（三）乙方未征得甲方書面同意改變房屋用途，致使房屋損壞的；(c) Party B transforms the usage of the Premises without the written agreement of Party A which damaged the Premises;（四）因乙方原因造成房屋主體結(jié)構(gòu)損壞的；(d) The damage of main structure of the Property caused by Party B;（五）乙方擅自轉(zhuǎn)租該房屋、轉(zhuǎn)讓該房屋承租權(quán)或與他人

38、交換各自承租的房屋的；(e) Party B sublets the Premises or the right of the tenancy or exchange the Premises with others without Party As consent;（六）乙方逾期不支付租金累計超過 壹 個月的； (f) Party B fails to pay the rent on schedule for longer than one(1) month; 十、違約責(zé)任Ten、Liabilities for Breach of contract10-1該房屋交付時存在缺陷的，甲方應(yīng)自交付

39、之日起的 拾 日內(nèi)進(jìn)行修復(fù)，逾期不修復(fù)的，甲方同意減少租金并變更有關(guān)租金條款。 10-1 if the Premises has defect when delivering, Party A shall repair the Premises within ten(10) days. If Party A fails to repair it, Party A agree to reduce the rent and change the related items of the rent clause.10-2因甲方未在本合同中告知乙方，該房屋出租前已抵押或產(chǎn)權(quán)轉(zhuǎn)移已受到限制，造成乙方損失

40、的，甲方應(yīng)負(fù)責(zé)賠償。10-2 Party A shall be fully responsible for any damages or losses to Party B if Party A has not informed Party B the Premises had been pledged or the transfer of the property right had been limited in the contract.10-3租賃期間，甲方不及時履行本合同約定的維修、養(yǎng)護(hù)責(zé)任，致使房屋損壞，造成乙方財產(chǎn)損失或人身傷害的，甲方應(yīng)承擔(dān)賠償責(zé)任。 10-3 during l

42、損失的，甲方還應(yīng)負(fù)責(zé)賠償。10-4 If Party A terminates the contract and takes back the Premises in advance for causes other than contract during leasing term, party A shall pay the liquidated damages equivalent to two(2) times of the daily rental left of the Premises to Party B. should the liquidated damages not t

43、o be enough to pay for Party Bs loss, Party A shall be responsible for the deficiency.10-5乙方未征得甲方書面同意或者超出甲方書面同意的范圍和要求裝修房屋增設(shè)附屬設(shè)施的，甲方可以要求乙方恢復(fù)房屋原狀。10-5 If Party B renovates and installs additional facilities in the leased Premises without the approval of Party A, Party A has the right to request Party

44、B to restore the Premises to its original state.10-6租賃期間，非本合同規(guī)定的情況，乙方中途擅自退租的,甲方可沒收乙方的保證金,不足抵付甲方損失的，乙方還負(fù)責(zé)賠償。10-6 If Party B terminates the contract and gives back the Premises in advance for causes other than Contract during leasing term, Party A shall seizure the security deposit and if the security

45、 deposit not to be enough to pay for Party As loss, Party B shall be responsible for the deficiency.十一、其他條款Eleven、Others terms11-1租賃期間，甲方需抵押該房屋，應(yīng)當(dāng)書面告知乙方。11-1 During leasing term, if Party A needs to mortgage the Premises, Part A shall inform Party B with written notice. 11-2本合同未盡事宜，經(jīng)甲、乙雙方協(xié)商一致，可訂立補(bǔ)充條

46、款。本合同補(bǔ)充條款及附件均為本合同不可分割的一部分，本合同及其補(bǔ)充條款和附件內(nèi)空格部分填寫的文字與鉛印文字具有同等效力。11-2 Party A and B shall make the supplementary agreements for the unaccounted term of this agreement through negotiation between Party A and B. all supplementary terms in the agreement and attachment shall be integral parts of the contract

47、 the written words filled in the blank of supplementary terms and attachments in the contract shall be of equally authentic with the printed words of the original lease contract.11-3甲、乙雙方在簽署本合同時，對各自的權(quán)利、義務(wù)、責(zé)任清楚明白，并愿按本合同規(guī)定索賠。如一方違反本合同,另一方有權(quán)按本合同規(guī)定索賠。11-3 Party A and B shall be totally aware of his right

If any party breaches the contract, the other party shall have the right to claim for damages in accordance with the terms of this contract.11-4甲、乙雙方就履行本合同發(fā)生糾紛，應(yīng)通過協(xié)商解決；協(xié)商解決不成的，雙方同意選擇下列第 (二) 種方式解決：11-4 Any dispute arising out during the perfo

49、rmance of the contract shall be resolved by friendly consultations, if an amicable agreement cannot be reached, Party A and Party B agree to solve the dispute by the way (b).（一）、提交 / 仲裁委員會仲裁；(a). Submit the dispute to / Arbitration Commission（二）、依法向人民法院起訴。（b）Submit the dispute to People s Court.11-6
