ytimeduringofcancellingthisCharter.ateofHire從本船交付之時(格林威治時間)起至還給船東之時(格林威治時間)止，租船人按本船夏季干舷載TheChartererstopayashireattherateofpertonof2240ontheVesselstotaldeadweightonsummerfreeboardperM.T.)ofthevessel'sdeliveryuntilthetime(G.M.T.)ofherre-deliverytoOwners.租金應(yīng)在交船后七個銀行營業(yè)日內(nèi)，以后各期租金應(yīng)在到期后七個銀行營業(yè)日內(nèi)，以現(xiàn)款在給預(yù)付半月(但最后一期，租金預(yù)付到經(jīng)租船人合理估算足以完成最后一個航次所需的時間)，該項租金除了扣除本租約已具體規(guī)定的項目外，還扣除租船人及其理人應(yīng)得的回扣和傭金、有關(guān)實際停租或估計停租期間的任何款項或費用，還扣除租船人合理估算，在述期間內(nèi)所發(fā)生的費用以及根據(jù)本租約，租船人對船東的索賠款項，如付款到期之日，本船停租，則租余額應(yīng)在本船起租后七個銀行營業(yè)日內(nèi)支付，租船人還有權(quán)在最后整月租金中扣除預(yù)計代船東墊付的港費和開支以及還船時船上存油的估計金額，以上付款，還船后多退少補。PaymentofHire:FirstpaymentofhiretobemadewithinsevenbankingdaysoftheVessel'sdeliveryandsubsequentpaymentsofhirewithinsevenbankingdaysoftheduedate，inlyinadvanceexceptfortheorChartererswhichmayreasonablybeestimatedbythemtorelatetosuchoff-hireperiodsandanyamountofclaimsCharterersmayhaveonOwnersunderthisCharterIfonduedatethedaysaftertheVesselisagainon-hire.TheCharterersalsotohaverighttodeductfromthelastfullmonthshirethedisbursementsexpectedtobemadeonOwners'behalfofexpensesexpectedtobeincurredbycharterersforOwners'accountandestimatedcostofbunkersberefundedbyOwnersorunder-paymentpaidbyCharterers.如未履行支付租金，船東有權(quán)撤船，不給租船人使用，但這并不損害船東根據(jù)本租約在其他方面對租船人IndefaultofpaymenttheOwnersmaywithdrawtheVesselfromtheserviceofCharterers，withoutprejudicetoanyclaimOwnersmayotherwisehaveonCharterersunderthisCharter.elivery本船應(yīng)于租約期滿時，按交付給租船人時大體相同的良好狀態(tài)(自然損耗和由于第21條列舉的原因所造成的船舶過失除外)，在租船人選擇的安全、沒有冰凍的港口退還。TheVesseltobere-deliveredontheexpirationoftheCharterinthelikegoodorderaswhendeliveredtotheCharterers(fairwearandtearandlossofordamagetotheVesselby租船人有卸畢還船的選擇權(quán)，給船東或水手支付包干費最多以代替清艙，清除墊TheChartererstohavetheoptionofre-deliveringtheVesseluponcompletionofsalumpsumofmaximuminlieuofholdingcleaningincludingdunnageremoval.NoticeofRe-deliveryLastVoyage:TheChartererstogiveOwnersnotlessthantendays'noticeofVessel'sexpectedportanddateofre-delivery.次:如本船被擋令的航次超過租期時，租船人可使用本船完成該航次，但如市價高于租約規(guī)定的租ShouldtheVesselbeorderedonavoyagebywhichtheCharterperiodwillbeexceededtheChartererstohavetheuseoftheVesseltoenablethemtocompletethevoyageandpaythemarketrateforanytimeexceedingtheterminationdateifmarketrateishigherthantheratestipulatedherein.goSpace除保留適當(dāng)足夠的部位供船長、船員、水手使用及存放船具、屬具、家具、食品與船用品外，本船所有空s部位裝滿貨物，費用自理，并承擔(dān)風(fēng)險，裝載DeckCargo:TheChartererstohavetheprivilegeofloadingafullcargoondeckand/oronhatchesinaccordancewithnormalmarinepracticeattheirexpenseandriskanddeckloadwillbecontrolledbyVessel'sstabilityandseaworthiness.WhilstinnavigationtheMastertotakegoodcarefordeckcargoandtightenuplashingsondeckcargowiththeVessel'sCrew.14.Charterers'Representatives租船人有權(quán)派代表一至二人。代表上船并押運并考察航次盡快運行情況，對他們將免費提供房間并供應(yīng)與負擔(dān)。TheChartererstohavetheprivilegeofputtingone/twooftheirRepresentativesonboardutmostdespatch.TheyaretobefurnishedwithfreeaccommodationsandsamefareasprovidedfortheMaster'stable，victuallingexpensestobeforCharterers'account.TheOwnerswarranttohavesecuredandcarryonboardthenecessarycertificatestocomplywithSafetyandHealthRegulationsandallcurrentrequirementsinallportsofcall.其他一切設(shè)備符合本船靠掛港口的規(guī)定，還保證本船隨時持有現(xiàn)行有效證件，在東未能照辦使其符合上述規(guī)定或未持有上述證件以致岸上人員不能作業(yè)，則由。TheOwnersguaranteethatVessel'scargogearandallotherequipmenttocomplywiththepossessionofvalidandup-to-datecertificatestocomplywithsuchregulationsineveryrespect.IfshorepersonnelisnotpermittedtoworkduetofailureoftheOwnersnyOwners'account.租船人有權(quán)免費使用船上的絞車吊桿包括重吊及／或轉(zhuǎn)盤吊至其最大起重能力，起貨機應(yīng)保持完好工作狀給予足夠時間的通知。gearand/orcranestotheirfullcapacityandgeartobekeptinfullworkingorderforuseheavyliftgear.熏艙:在租期內(nèi)，船東提供有效的熏蒸滅鼠證書或免疫證書，由于載貨或根據(jù)租船人指示而掛港需要熏F(xiàn)umigations:TheOwnerstoprovidevalidfumigationandderatizationorexemptioncertificatesthroughouttheCharterperiod.AllfumigationsrequiredbecauseofcargoescarriedorportsvisitedunderCharterers'instructionstobeforCharterers'(A)如時間損失是由于(1)人員或船用品不足；(2)船殼、機器或設(shè)備損壞；(3)船舶或貨物遇到海損事故包括碰撞和擱淺而造成延誤；(4)修船、進行干船塢或保持本船效能所采取的其他必要措施； (5)未持有或未隨船攜帶貨運需要的有效證件及或其他船舶文件，包括有效的巴拿馬和蘇伊士運河丈量證件；(6)船長、船員或水手的罷工、拒航、違抗命令或失職；(7)任何當(dāng)局因船東、船長、船員或水手受到控告或違章對本船實行拘留或干預(yù)(但租船人的疏忽行為或不行為所引起者除外)；(8)船東違反租約而停工；(9)由于本條所提到的任何原因或任何目的(惡劣天氣除外)或由于傷病船員上岸治療而使本船繞航，折返或靠掛非租船人所指示的其他港口；(10)本租約另有規(guī)定的停租項目或其他任何原態(tài)，在不使租船人比時間損失開始之時的船位吃虧的地點恢復(fù)服務(wù)止，租金停止。(A)Intheeventoflossoftimedueto(1)deficiencyofmenorstores;(2)breakdownornbyaverageaccidentstoshiporcargoincludingcollisionandstranding;(4)repairs，drydockingorothernecessarymeasurestomaintaintheefficiencyoftheVessels(5)failuretopossessorcarryonew (7)detentionoforinterferencewiththeVesselbyanyauthoritiesinconsequenceof unlessbroughtaboutbythenegligentactoromissionofCharterers);(8)stoppagesrtotherthanthattowhichsheisboundundertheinstructionsofCharterersforanyreasonorforanypurpose(exceptforstressofweather)mentionedinthisClauseorforthepurposeofobtainingmedicaladviceortreatmentfororagreedasoffhireaselsewhereworkingofetoceasefromcommencementofsuchlossoftimeuntiltheVesselisagaininanefficientstatetoresumeherservicefromapositionnotlessfavourabletoCharterersthanthatatwhichsuchlossoftimecommenced.(B)如裝卸貨物所需的絞車／轉(zhuǎn)盤吊或其他設(shè)備損壞或不堪使用，或絞車／轉(zhuǎn)盤吊動力不足，則開工不足的時間應(yīng)按所需作業(yè)的絞車及或轉(zhuǎn)盤吊的數(shù)目比例計算時間損失，如上述原因使裝完或卸完整船的時間推遲，則開工不足的時間應(yīng)相應(yīng)地全部停租，如租船人要求繼續(xù)作業(yè)，則船東支付岸上設(shè)備費用以代替絞車／轉(zhuǎn)盤吊，租船人仍應(yīng)支付全部租金，但如岸上轉(zhuǎn)盤吊數(shù)目不夠，則租金應(yīng)按岸上可供使用的轉(zhuǎn)盤吊數(shù)(B)Intheeventofbreakdownordisablementofoneormorewinchesand/orcranesorotherequipmentnecessaryforloadingordischargingcargoofinsufficientpowertooperateawinch(s)and/orcrane(s)，thelossoftimetobecalculatedpro-rataforthesitionasfulloffhirecorrespondinglyifitisthecauseofcompletionofloadingordischargingpayfullhire.Howeverintheeventthatsufficientshorecranesarenotavailablethenhiretobepaidpro-ratatothenumberofcranesavailable.(C)由于上述原因引起的額外費用，包括裝卸工人待時費，如有罰款也包括在內(nèi)，均由船東負責(zé)，并從(C)Anyextraexpensesresultingfromanyoftheabovementionedcausesincludinghire.(D)租船人有將任何停租時間加在租期內(nèi)的選擇權(quán)。(D)TheChartershavetheoptionofaddinganyoff-hiretimetotheCharterperiodunder(E)如本租約所說的原因使本船延誤達六周以上，租船人有解除租約的選擇權(quán)。(E)IfanycausementionedhereindelaystheVesselmorethansixweekstheChartererstohavetheoptionofcancellingthisCharter.edClaimfitisunderstoodthatiftheservicespeedoftheVesselbereducedand/ortheoil-fuelconsumptionbeincreasedthetimelostandcostofanyextrafuelconsumedshallbedeductedfromthehire.籍國政府征用，則租金應(yīng)從征用之時停止，凡預(yù)付而不應(yīng)得的租金以及征用時船上requisitionshallberefundedtoCharterers.Iftheperiodofrequisitionexceeds19．從上次油漆船底算起，不超過十個月，本船應(yīng)在船東和租船人雙方同意的方便地點和時間，至少進干塢一次(清洗油漆船底)19.TheVesseltobedrydocked(bottomcleanedandpainted)atleastonceatintervalsofmaximumtenmonthsreckoningfromthetimeoflastpaintingataconvenientplaceandtimetobemutuallyagreeduponbetweenOwnersandCharterers.20.DutiesofMasterBillsofLading船長和水手應(yīng)盡快完成所有航次并提供慣常的協(xié)助。在航次、代理或其他安排方面，船長應(yīng)聽從租船人的指示，船長本人或經(jīng)租船人要求授權(quán)租船人或其代理人按照大副或理貨收據(jù)簽發(fā)提供的任何提單。TheMastertoprosecuteallvoyageswiththeutmostdespatchandtorendercustomaryassistancewiththeVessel'sCrew.TheMastertobeundertheordersoftheCharterersasregardsemployment，agencyorotherarrangements.TheMastertosighorifrequiredbyChartererstoauthoriseCharterersortheirAgentstosignBillsofLading，forcargoaspresentedinconformitywithMate'sorTallyClerks'receipts.指示和：租船人應(yīng)給船長各項指示和航行航海日志，指導(dǎo)，船長應(yīng)保存完整正確的航海日志供租船人或其他代理人查閱，甲板、機房日志應(yīng)用英文填寫，最遲應(yīng)于每航次完畢時交給租船人或其代理人，如未照租船人提出的數(shù)據(jù)為準，對此船東無權(quán)申訴。DirectionsandLogs：TheChartererstofurnishtheMasterwithallinstructionsandsailingbeopentoinspectionbyCharterersortheirAgents.Thedeck/enginelogabstractstobecompletedinEnglishlanguageanddeliveredtoCharterersortheirAgentsoncompletionofanyclaiminthisrespect.機長的行為不滿，船東在接到不滿的情節(jié)后，應(yīng)立即調(diào)查，如情節(jié)屬IftheChartereshavereasontobedissatisfiedwiththeconductoftheMaster，21．裝卸工人和理貨及租船人安排并作為船東的雇員，接受船長的指示和指導(dǎo)，租船人對雇用的裝配工人的疏忽，過失行為或判斷錯誤不負責(zé)任對引水員，拖船或裝卸工人的疏忽或裝載不合理或裝載不良造成的21.StevedoresandtallymentobearrangedbytheCharterersinloadinganddischarging，whoshallbeconsideredastheOwners'servantsandsubjecttotheordersanddirectionsof22．墊款22.Advances租船人或其代理人可墊支船長必要的款項，供船方在港的日常開支，收取2．5％供款手續(xù)費，forordinarydisbursementsfortheVessel'saccountatanyportcharging2--1/2percentCharterersortheirAgentstohaverighttorefusesuchadvancesiftheyconsideritnecessarytodoso.3．冰封23.Ice浮標的地點，本船也不得派往或進入因冰情，有危險使本船不能順利到達或在裝卸完畢后不能駛出的地點，本船沒有破冰航行的義務(wù)，但如需要，可尾隨破冰船航行。TheVesselnottobeorderedtonorboundtoenteranyice-boundplaceorplacewheretheVessel'sarrivalorwherethereisriskthatordinarilytheVesselwillnotbeableonaccountoficetoreachtheplaceortogetoutafterhavingcompletedloadingrequired.24.LossofVessel如本船滅失，租金在滅失之日停止，如本船失蹤，租金在本船最后一次報告之日的正午停止，凡預(yù)付而不andanyhirepaidinadvanceandnotearnedtoberefundedto'Charters.5．加班25.Overtime如需要，本船晝夜作業(yè)(周六星期日和假日包括在內(nèi))除非停租，租船按每日歷月定為了索回本租約屬下的賠償，船東有權(quán)留置屬于定期租船人的貨物和轉(zhuǎn)租運費以及提單運費，為了索回預(yù)人有權(quán)留置船舶。TheOwnerstohavealienuponallcargoesandsubfreightsbelongingtotheTime-CharterertohavealienontheVesselforallmoneypaidinadvanceandnotearnedandforallclaimsfordamagesarisingfromanybreachofthisCharterbyOwners.27．救助救助其他船舶所得的報酬，扣除船長與水手應(yīng)得的部分與各項法定費用和其他開支，包括按約對救助損失時間所付的租金，還有損壞的修復(fù)和燃料的消耗等項后，由船東與租船人均等分享，救助人命和救助財產(chǎn)無效所遭受的時間損失和費用(不包括本船的滅失)，由船東和租船人均等分擔(dān)。AllsalvageandassistancetoothervesselstobefortheOwners'andtheCharterers'equalbenefitafterdeductingtheMaster'sandCrew'sproportionandalllegalandotherofdamageandoilfuelconsumed.Alllossortimeandexpenses(excludinganydamagetoorlossoftheVessel)incurredinsavingorattemptingtosavelifeandinunsuccessfulattemptsatsalvageshallbeborneequallybyOwnersandCharterers.28．轉(zhuǎn)租28.Sublet租船人有轉(zhuǎn)租本船的選擇權(quán)，但原租船人對船東仍負有履行本租約的全部責(zé)任。TheChartererstohavetheopti
