2022年跟單員考試輔導跟單信用證適用范圍《跟單信用證統一慣例(UCP600)》Article1ApplicationofUCP第一條統一慣例的適用范圍TheUniformCustomsandPracticeforDocumentaryCredits,2022Revision,ICCPublicationno.600(“UCP”)arerulesthatapplytoanydocumentarycredit(“credit”)(including,totheextenttowhichtheymaybeapplicable,anystandbyletterofcredit)whenthetextofthecreditexpresslyindicatesthatitissubjecttotheserules.Theyarebindingonallpartiestheretounlessexpresslymodifiedorexcludedbythecredit.跟單信用證統一慣例，2022年修訂本，國際商會第600號出版物，適用于所有在正文中標明按本慣例辦理的跟單信用證(包括本慣例適用范圍內的備用信用證)。除非信用證中另有規(guī)定，本慣例對一切有關當事人均具有約束力。

Article2Definitions其次條定義Forthepurposeoftheserules:就本慣例而言：

Advisingbankmeansthebankthatadvisesthecreditattherequestoftheissuingbank.通知行意指應開證行要求通知信用證的銀行。

Applicantmeansthepartyonwhoserequestthecreditisissued.申請人意指發(fā)出開立信用證申請的一方。

Bankingdaymeansadayonwhichabankisregularlyopenattheplaceatwhichanactsubjecttotheserulesistobeperformed.銀行日意指銀行在其營業(yè)地正常營業(yè)，按照本慣例行事的行為得以在銀行履行的日子。

Beneficiarymeansthepartyinwhosefavouracreditisissued.受益人意指信用證中受益的一方。

Complyingpresentationmeansapresentationthatisinaccordancewiththetermsandconditionsofthecredit,theapplicableprovisionsoftheserulesandinternationalstandardbankingpractice.相符提示意指與信用證中的條款及條件、本慣例中所適用的規(guī)定及國際標準銀行實務相一致的提示。

Confirmationmeansadefiniteundertakingoftheconfirmingbank,inadditiontothatoftheissuingbank,tohonourornegotiateacomplyingpresentation.保兌意指保兌行在開證行之外對于相符提示做出兌付或議付確實定承諾。

Confirmingbankmeansthebankthataddsitsconfirmationtoacreditupontheissuingbank’sauthorizationorrequest.保兌行意指應開證行的授權或苦求對信用證加具保兌的銀行。

Creditmeansanyarrangement,howevernamedordescribed,thatisirrevocableandtherebyconstitutesadefiniteundertakingoftheissuingbanktohonouracomplyingpresentation.信用證意指一項商定，無論其如何命名或描述，該商定不成撤銷并因此構成開證行對于相符提示予以兌付確實定承諾。

Honourmeans:a.topayatsightifthecreditisavailablebysightpayment.b.toincuradeferredpaymentundertakingandpayatmaturityifthecreditisavailablebydeferredpayment.c.toacceptabillofexchange(“draft”)drawnbythebeneficiaryandpayatmaturityifthecreditisavailablebyacceptance.兌付意指：

a.對于即期付款信用證即期付款。

b.對于延期付款信用證發(fā)出延期付款承諾并到期付款。

c.對于承兌信用證承兌由受益人出具的匯票并到期付款。

Issuingbankmeansthebankthatissuesacreditattherequestofanapplicantoronitsownbehalf.開證行意指應申請人要求或代表其自身開立信用證的銀行。

Negotiationmeansthepurchasebythenominatedbankofdrafts(drawnonabankotherthanthenominatedbank)and/ordocumentsunderacomplyingpresentation,byadvancingoragreeingtoadvancefundstothebeneficiaryonorbeforethebankingdayonwhichreimbursementisdueto(tobepaidthenominatedbank.議付意指被指定銀行在其應獲得償付的銀行日或在此之前，通過向受益人預付或者同意向受益人預付款項的方式添置相符提示項下的匯票(匯票付款人為被指定銀行以外的銀行)及/或單據。

Nominatedbankmeansthebankwithwhichthecreditisavailableoranybankinthecaseofacreditavailablewithanybank.被指定銀行意指有權使用信用證的銀行，對于可供任何銀行使用的信用證而言，任何銀行均為被指定銀行。

Presentationmeanseitherthedeliveryofdocumentsunderacredittotheissuingbankornominatedbankorthedocumentssodelivered.提示意指信用證項下單據被提交至開證行或被指定銀行，抑或按此方式提交的單據。

Presentermeansabeneficiary,bankorotherpartythatmakesapresentation.提示人意指做出提示的受益人、銀行或其他一方。

Article3Interpretations第三條釋義Forthepurposeoftheserules:就本慣例而言：

Whereapplicable,wordsinthesingularincludethepluralandinthepluralincludethesingular.在適用的條款中，詞匯的單復數同義。

Acreditisirrevocableevenifthereisnoindicationtothateffect.信用證是不成撤銷的，即使信用證中對此未作指示也是如此。

Adocumentmaybesignedbyhandwriting,facsimilesignature,perforatedsignature,stamp,symboloranyothermechanicalorelectronicmethodofauthentication.單據可以通過手簽、簽樣印制、穿孔簽字、蓋章、符號表示的方式簽署，也可以通過其它任何機械或電子表明的方法簽署。

Arequirementforadocumenttobelegalized,visaed,certifiedorsimilarwillbesatisfiedbyanysignature,mark,stamporlabelonthedocumentwhichappearstosatisfythatrequirement.當信用證含有要求使單據合法、簽證、表明或對單據有類似要求的條件時，這些條件可由在單據上簽字、標注、蓋章或標簽來得志，只要單據外觀已得志上述條件即可。

Branchesofabankindifferentcountriesareconsideredtobeseparatebanks.一家銀行在不同國家設立的分支機構均視為另一家銀行。

Termssuchas"firstclass","wellknown","qualified","independent","official","competent"or"local"usedtodescribetheissuerofadocumentallowanyissuerexceptthebeneficiarytoissuethatdocument.諸如"第一流"、"出名"、"合格"、"獨立"、"正式"、"有資格"、"當地"等用語用于描述單據出單人的身份時，單據的出單人可以是除受益人以外的任何人。

Unlessrequiredtobeusedinadocument,wordssuchas"prompt","immediately"or"assoonaspossible"willbedisregarded.除非確需在單據中使用，銀行對諸如"急速"、"立刻"、"盡快"之類詞語將不予置理。

Theexpression"onorabout"orsimilarwillbeinterpretedasastipulationthataneventistooccurduringaperiodoffivecalendardaysbeforeuntilfivecalendardaysafterthespecifieddate,bothstartandenddatesincluded."于或約于"或類似措辭將被理解為一項商定，按此商定，某項事情將在所述日期前后各五天內發(fā)生，起迄日均包括在內。

Thewords"to","until","till",“from”and“between”whenusedtodetermineaperiodofshipmentincludethedateordatesmentioned,andthewords“before”and"after"excludethedatementioned.詞語"×月×日止"(to)、"至×月×日"(until)、"直至×月×日"(till)、"從×月×日"(from)及“在X月X日至X月X日之間”(between)用于確定裝運期限時，包括所述日期。詞語“X月X日之前”(before)及“X月X日之后”(after)不包括所述日期。
