BythetimeRhodesdiedin1902,DeBeerscontrolled90%oftheworld5sdiamond
production.Rhodes'simmensefortunestillpaysforpeoplelikeBillClintontostudy
atOxford.
Since1929,whenSirErnest(knightedforwarservicesin1921)tookoveraschairman,
theOppenheimershaveledDeBeersalmostwithoutinterruption,massagingtheprice
ofdiamondsbyhoardingthemandoccasionallysellingpartofthefirm'sstockpile.
Thefamilyhaswieldedpoliticalinfluence,too,mostlybankrollingliberalcauses.
BothErnestandhissonHarryservedinSouthAfrica'sparliament:Ernestfor14
yearsintherun-uptothesecondworldwar,andHarryfornineyearsasamember
oftheanti-apartheidopposition.
Oflate,however,thefamily,sinfluencehaswaned.SomewonderwhetherNickyand
hissonJonathanhavethesamedriveandacumenastheirswashbucklingforebears.
AndAngloAmerican,thefirmtheirfamilyfounded(andinwhichitnowhasastake
of2%),moveditsheadquarterstoLondonin1999.NickyOppenheimerinsiststhat
thefamilywillstayconnectedwithSouthAfrica:theyarestillbasedin
Johannesburg.
Whatwi11theOppenheimersdowiththeirnewpileofcash?Thedealwilltakemonths
tocomplete,sotheyhavetimetoponder.Underitsterms,theyarebarredfrom
dabblingindiamondsfortwoyears.Butotherpossibilitiesabound.
Thefamilyhastwoinvestmentarms.One,calledStockdaleStreetCapital,invests
largelyinmedium-sizedfirmsinSouthAfrica.Theother,TanaAfricaCapital,is
ajoint,venturewithSingapore,ssovereign-wealthfund,Temasek,andinvestsinthe
restofAfrica.Amongotherthings,itholdsastakeinaNigerianfirmthatsells
powderedmilk,anditplanstobuildupfivetotensubstantialfirmsoverthenext
decade.
Atthemoment,Tanaisfocusedonfast-movingconsumergoodsandagriculture,and
toalesserextentonbuildingmaterials,healthandeducation.Thenewmoneycould
gointoanyoralloftheseareas,saysJamesTeeger,afamilyspokesman.Andthe
Oppenheimersmayalsolookatinfrastructureandenergy,twoofthehottest

byAndreasSchmittnerofOregonStateUniversity,suggestsitisnot.InDr
Schmittnerysanalysis,theclimateislesssensitivetocarbondioxidethanwas
feared.
Existingstudiesofclimatesensitivitymostlyrelyondatagatheredfromweather
stations,whichgobacktoroughly1850.DrSchmittnertakesadifferentapproach.
Hisdatacomefromthepeakofthemostrecenticeage,between19,000and23,000
yearsago.Hisgroupisnotthefirsttousesuchdata(icecores,fossils,marine
sedimentsandthelike)toprobetheclimate'ssensitivitytocarbondioxide.But
theirpaperisthemostthorough.Previousattemptshadconsideredonlysmal1regions
oftheglobe.Hehascompiledenoughinformationtomakeacrediblestabatrecreating
theclimateoftheentireplanet.
Theresultoffersthatrarestofthingsinclimatescience—abitofgoodnews.The
groupJsmost1ikelyfigureforclimatesensitivityis2.3°C,whichismorethan
halfadegreelowerthantheconsensusfigure,witha66%probabilitythatit1ies
between1.7°and2.6°C.Moreimportantly,theseresultssuggestanupperlimit
forclimatesensitivityofaround3.2°C.
BeforeyoutaketheSUVoutforacelebratoryspin,though,itisworthbearingin
mindthatthisisonlyonestudy,and,likeallsuch,ithasitsflaws.Thecomputer
modelusedisofonlymiddlingsophistication,DrSchmittneradmits.Thatmaybe
onereasonforthenarrowrangeofhisteam,sresults.Andalthoughthestudy's
geographicalcoverageisthemostcomprehensivesofarforworkofthistype,there
arestillblankareas—notablyinAustralia,CentralAsia,SouthAmericaandthe
northernPacificOcean.Moreover,someskepticscomplainaboutthewayancientdata
ofthistypewereusedtoconstructadifferentbutrelatedpieceofclimatescience:
theso-calledhockey-stickmodel,whichsuggeststhattemperatureshaverisen
suddenlysincethebeginningoftheindustrialrevolution.Itwillbeinteresting

氣候科學(xué)的復(fù)雜程度眾所周知,但把一個(gè)指標(biāo)記在腦中非常好用,那就是“氣候敏感性”。
該指標(biāo)表示預(yù)計(jì)大氣中二氧化碳濃度翻倍所能引致的升溫量。政府間氣候變化專門委員會(huì)
(IPCC)在其最近一次關(guān)于其預(yù)測(cè)背后的科學(xué)性的概要中(發(fā)布于2007年)估計(jì),在如今的

complained,asever,aboutpoliceinfiltration,butasthesevideosmakeclear,
protestersandothercitizensarekeepingtheireyesonpolice,too.
Morethantwo-thirdsofAmericansowndigitalcameras.Aroundone-thirdofadults
ownasmartphone.Mostofthesedevicescanrecordandeasilytransmitaudioand
video.Recordingpolicehasneverbeeneasier,andthankstosocial-mediaand
activistnetworkssuchasCopwatch,whichmonitorspoliceactivityandpostsvideos
totheweb,neitherhaspublicizingtheserecordings.
Thatdoesnotalwaysgooverwell.Peoplepeaceablyfilmingpolicehavebeen
handcuffed,beaten,hadtheircamerasseized,andbeenarrestedforobstructing
governmentaladministration,obstructinganinvestigation,interference,
disturbingthepeace,orforillegalwiretapping.Intakingsuchactionthepolice
areonshakylegalground.Therighttophotographpeople,includingpoliceofficers,
inpublicplaces,isrelativelyclear.
Addingaudio,however,raisesanewsetoflegalissues.Moststateshave
single-partyconsentlawsconcerningaudiorecording,meaningthataslongasone
partyconsentstobeingrecorded,thetapingislegal.Inmostofthe12statesin
whichallpartiesmustconsenttoberecorded,aviolationoccursonlyifthesubjects
beingrecordedhaveareasonableexpectationofprivacy.Arguingthatpolice
officerscarryingouttheirdutiesinpublichavesucharightisachallenge.The
attorney-generalinMaryland,anal1-party-consentstate,wrotein2010thatfew
interactionswithpolicecouldbeconsideredprivate.
Andchallengesaremountingintwoofthestates-Illinoisand
Massachusetts-withoutexpectation-of-privacyclauses.InMassachusettslast
August,afederalappealscourtupheldalowercourtJsrulingthatacitizen's
righttofilmpoliceinpublicisprotectedbythefirstandfourthamendments.
Duringoralarguments,oneofthejudgeshearingthechailengestotheIllinois
EavesdroppingActworriedthatallowingrecordingmighthindertheabilityofthe
policetodotheirjobs.Hegavetheexampleofapolicemantalkingtoaconfidential
informant.Policehavealsoexpressedconcernaboutrecording,andhenceexposing,
undercoverofficers.Butofcoursepolicecanstillspeakinprivate.Giventhe
actionsofsomepoliceofficerswhenconfrontedwithacamera,filmingcopsmaynot
beprudent.Butneithershoulditbei1legal.

位手無(wú)寸鐵、被關(guān)著的女士?或許是在只有抗議者和一排戴著黑色頭盔的防暴警察的奧克蘭
街頭,其中一個(gè)警察向一位拍攝他的抗議者射出的一枚橡膠子彈將沉默瞬間打破。一如往常,
抗議者抱怨他們時(shí)刻處在警察的監(jiān)視之下,但這些視頻清楚地表明,抗議者與其他市民同樣

Onlyoneotherstate,Alaska,hasloser-pays,andonlyforaportionoffees.More
intriguingly,Floridaimposed“l(fā)oser-pays”in1980formedical-malpracticecases.
Thenumberofclaimsdropped,buttheaverageawardrose,suggestingthatmore
high-meritcasesgottheirdayincourtwhilelow-meritfilingsweredeterredor
settledforless.Butmanylosingplaintiffsweretoopoortopaythewinners?costs,
whileinonecasealosingdefendanthadtopaymillionsfortheplaintiff?slegal
fees.Evendoctorssupportedthelaw'srepealin1985.
MarieGryphonoftheManhattanInstitute,acentre-rightthink-tank,whoisauthor
ofaloser-paysproposal,saysthatTexasgot“muchlessthanhalfaloaf”,and
thatFloridawasspookedtooquickly.Shearguesthatloser-payscountriesneedlegal
insurance,whichcanbebought(forexample)inEnglandforjust£100-200($150-300)
afteranallegedloss,butbeforeasuitisfiled.Lawyerscanadvancethepremiums
andaddthemtotheirbills.Inothercountries,suchasGermany,manyhouseholds
carrystandinglegalinsurancewithasmal1monthlypremium.MsGryphonarguesthat
insuchamatureloser-paysmarketmoresmal1-valuebuthigh-meritcaseswouldbe
brought,whilebothsmal1"nuisance“suitsandbig“l(fā)ottery“suitswouldbeless
attractivetolawyers.
Loser-payshasyettobeproperlytriedinAmerica.Anotheridea,however,isin
placeinmanystates:cappingdamages.Inthepopularimaginationrunawayjuries
routinelyimposehugenon-economicdamages(topunishadefendantormakeupfor
aplaintiffJssuffering).Inpractice,head1ine-grabbingawardsareoftenreduced
byjudges:thenotorious$2.7minpunitivedamagesforawomanwhospilledscalding
McDonaldTscoffeeonherlapin1994endedupat$480,000.
侵權(quán)法改革
不能再靠碰運(yùn)氣
改革催生了大量索賠,但也帶來(lái)一些好觀念
里克?佩里的競(jìng)選之路舉步維艱,但他提出的“侵權(quán)法改革”卻引起熱議。今年六月,這位
德州州長(zhǎng)簽署了“敗訴賠付”的侵權(quán)法案,規(guī)定侵權(quán)案的敗訴方要補(bǔ)償勝訴方的法律成本,
希望以此減少一些瑣細(xì)無(wú)聊的侵權(quán)訴訟。該法案得到保守分子的大力支持。幾十年來(lái),右派
人士堅(jiān)持認(rèn)為,美國(guó)的法律文化窒息了小企業(yè)、醫(yī)生和創(chuàng)新者。
糟糕透頂?shù)氖?,德州的這項(xiàng)法律太過(guò)小心。在英格蘭、加拿大、德國(guó)等許多國(guó)家,“敗訴賠
付”已是處理侵權(quán)糾紛的常規(guī)標(biāo)準(zhǔn),不過(guò)在這些國(guó)家這一規(guī)定適用于多數(shù)侵權(quán)案的裁定,而
德州“敗訴賠償”法律只適用于那些“缺少法律或事實(shí)基礎(chǔ)”且在證據(jù)收集前就被撤案的
訴訟。大多數(shù)合格的律師能夠?qū)懗霰荛_這個(gè)障礙的訴狀。即便德克薩斯州辯護(hù)律師聯(lián)合會(huì)最
終也同意了佩里的這個(gè)法案。
還有另外唯一一個(gè)實(shí)行敗訴償付的州,那就是阿拉斯加,但這里敗訴方支付的僅是勝訴方法
律成本的一部分。更有趣的是,1980年佛羅里達(dá)州在處理醫(yī)療事故案例時(shí)就使用過(guò)“敗方賠
償”制度。這種制度的實(shí)施使訴訟的數(shù)量下降了,但平均裁決賠償額提高了,這表明,訴諸
法律的更多的是那些一方獲勝把握比較大的案子,而那些勝算不大的侵權(quán)糾紛,訴訟數(shù)量或
判決數(shù)量都減少了。但是,有很多敗訴的原告生活窮困,無(wú)力支付對(duì)方的法律成本,而在另

中右派智庫(kù)“曼哈頓研究會(huì)”的馬莉?格里芬,曾提交一項(xiàng)敗方賠付的提案,她說(shuō),德州推
行的政策“遠(yuǎn)遠(yuǎn)不達(dá)到應(yīng)有的水平”,而佛羅里達(dá)州在面對(duì)問(wèn)題時(shí)退縮得太快。馬莉認(rèn)為,
那些實(shí)行敗訴賠付制度的國(guó)家需要有法律保險(xiǎn),比如,在英格蘭,如果指控提出,當(dāng)事人可

Clubcardloyaltycard.Asitbulksupinfinancialservices,thatmaygiveBritain's
largestsupermarketchainanedgeovertraditionalinsurers.
Togiveanobviousexample,itwou1dbeworthofferingpetinsurancetosomeonewho
hasstartedbuyingkitty-litter.Buyinglotsofboozedoesnotmakeyoua
drunk-driver,butsomeonewhobuyslittleornoneseemslesslikelytobeone.Buyers
ofwindowlocksarelikelytobemoresecurity-conscious,andsoon.
TescodeclinedtodiscusshowitusesClubcarddataforthisarticle.Butagroup
ofstudentsattheLondonSchoolofEconomicscarriedoutaclassprojectinwhich
theymadeseveralapplicationsforTescocarinsurance.Whentheygavethenumber
ofanunusedClubcarditearneda1%discount.Whentheygavethesamepersonal
detailsbutquotedthenumbersofheavilyusedClubcards,thediscountsvaried
greatly,reaching18%.ToparaphraseTesco,sslogan,itseemsthateverylittle
scrapofinformationhelps.
