鼎和財產(chǎn)保險股份有限公司2.1歸因于被保險人之故意不當行為所致2.2保險標的物之正常漏損、重量或容量之正常指之「包裝」包括貨柜或貨箱內(nèi)之堆放，但此項堆放以完成于本保險生效前或由被保險人2.5由于飛機裝運的集裝箱或貨箱不適合安全裝運被保貨物且被保險人在裝運時知道4.1由于罷工工人、停工工人或參與勞工騷擾、4.2因罷工、停工、勞工騷擾、暴動或內(nèi)亂所產(chǎn)5.1.2交付與本保險單所載目的地或其他由被保險人選擇使用的任何之最終之倉庫或5.1.2.3被保險貨物自飛機最終卸貨據(jù)運送契約授權(quán)飛機承運人或飛機租用人自由載量而產(chǎn)生之任何危險變更之期間內(nèi)繼續(xù)有契約或因其他緣故在貨物未能如前述第5條之約定交貨前該運送即告終止時，則本終止條9、由于本保險所承保危險之發(fā)生，致使被保險航程在本保單所載明以外之機場或地點轉(zhuǎn)條款之適當而合理之一切額外費用，保險人同意予以補償。本條款不適用于共同海損或救經(jīng)認可的貨物價值將被表示成等于最初保險項下的總的投保金額加上被保險人要求承15、被保險人在其所能控制之一切情況下應(yīng)作合INSTITUTECARGOCLAUSE1.Thisinsurancecoversallrisksoflossofordamagetothesubject-matterinsurprovidedinClauses2,3anGeneralExclusions2.1lossdamageorexpenseattributabletowilfulmisconductoftheAssured2.2ordinaryleakage,ordinarylossinweightorvolume,orordinarywearandtearofthe2.3lossdamageorexpensecausedbyinsufficiencyorunsuitabilityofpackingorpreparationofthesubject-matterinsured(forthepurposeofthisClause2.3"packing"shallbedeemedtoincludestowageinacontainerattachmentofthisinsuranceorbytheAssuredortheirservants)2.4lossdamageorexpensecausedbyinherentviceornatureofthesubject-matterinsured2.5lossdamageorexpensearisingfromunfitnessofaircraftconveyancecontainforthesafecarriageofthesubject-matterinsured,wheretheAssuredortheirservantsuchunfitnessatthetimethesubject-matterinsuredisloaded2.6lossdamageorexpenseproximatelycausedbydelay,eventhoughthedelaybecausedby2.7lossdamageorexpensearisingfrominsolvencyorfinancialdefaultoftmanagerscharterersoroperatorsoftheaircraft2.8lossdamageorexpensearisingfromtheuseofanyweaponofwaremployingatomicornuclearfissionand/orfusionorotherlikereactionorraWarExclusionClause3.Innocaseshallthisinsurancec3.1warcivilwarrevolutionrebellioninsurrection,orcivilstrifehostileactbyoragainstabelloigerentpower3.2captureseizurearrestrestraintordetainment(piracthereoforanyattemptthereat3.3derelictminestorpedoesbombsorotherderelictweaponsofwar.4.Innocaseshallthisinsuranc4.1causedbystrikers,locked-outworkmen,orpersonstakingpartinlabourdisturbance4.2resultingfromstrikes,lock-outs,labourdisturbances,riotsorcivilc4.3causedbyanyterroristoranypersonactingfromapoliticalmDURATION55.1Thisinsuranceattachesfromthetimethesubject-matterinsuredpremisesorplaceofstorageattheplacenamedhereinforthecommencementofthetransit,continuesduringtheordinarycourseoftransitandterminateseither5.1.1ondeliverytotheConsignees'orotherfinalwarehouse,premisesorplaceofthedestinationnamedherei5.1.2ondeliverytoanyotherwarehouse,premisesorplaceofstorage,whetherpriortooratthedestinationnamedherein,whichtheAssuredelecttouseeither5.1.2.1forstorageotherthanintheordinarycourseoftransitor5.1.2.2forallocation5.1.3ontheexpiryof30daysafterunloadingthesubject-matterinsurthefinalplaceofdischarge,whichevershallfirstoccur.5.2If,afterunloadingfromtheaircraftatthefinalplaceofdischarge,butpriortoterminationofthisinsurance,thesubject-matterinsuredisforwardedtoadestinationothitisinsuredhereunder,thisinsurance,whilstremainingsubjecttoterminationasprovidabove,shallnotextendbeyondthecommencementoftransittosuchotherdestination.5.3ThisinsuranceshallremainintheprovisionsofClause6below)duringdelaybeyondthecontroloftheAssured,anydeviation,forceddischarge,reshipmentortransshipmentandduringanyvariationoftheadventfromtheexerciseofalibertygrantedtotheaircarriersunderthecontractofcarriage.TerminationofContractofCarriage6.IfowingtocircumstancesbeyondthecontroloftheAssuredeitherthecontractofcarriageisterminatedataplaceotherthanthedestinationnamedthereinortheterminatedbeforedeliveryofthesubject-matterinsuredasprovidedforinClause5abothisinsuranceshallalsoterminateunlesspromptnoticeisgiventotheUnderwrcontinuationofcoverisrequestedwhentheinsuranceshallremaininforce,subadditionalpremiumifrequiredbytheUnderwriters,either6.1untilthesubject-matterissoldanddeagreed,untiltheexpiryof30daysafterarrivalofthesubject-matterherebyinsuredatsuchplace,6.2ifthesubject-matterisforwardedwithinthesaidperiodof30daysforanyagreedextensionthereof)tothedestinationnamedhereinortoanyotherdestination,untilterminatedinaccordancewiththeprovisionsofClause5above.HangeofTransitClau7.Where,afterattachmentofthisinsurance,thedestinationischangedbytheAssured,coveredatapremiumandonconditionstobearrangedsubjecttopromptnUnderwriters.InsurableInterestClau88.1InordertorecoverunderthisinsurancetheAssuredmuthesubject-matterinsuredatthetimeoftheloss8.2Subjectto8.1above,theAssuredsduringtheperiodcoveredbythisinsurance,notwithstandingthatthelossoccurredbefocontractofinsurancewasconcluded,unlesstheAssuredwereawareofthelossandtheUnderwriterswerenot.ForwardingChargesCl9.Where,asaresultoftheoperationofariskcoveredbythisinsurance,theinsuredtransitisterminatedataplaceotherthanthattowhichthesubject-matteriscoveredunderttheUnderwriterswillreimbursetheAssuredforanyextrachargesproperlyandreasonablyincurredinunloadingstoringandforwardingthesubject-matterThisClause9,whichdoesnotapplytotheexclusionscontainedinCthefaultnegligenceinsolvencyorfinancialdefaultoftheAssuredortheirservants.ConstructiveTotalLoss10.NoclaimforConstructiveTotalLossshallberecoverablsubject-matterinsuredisreasonablyabandonedeitheronaccountofitsactualtotallossappeartobeunavoidableorbecausethecostofrecovering,reconditioningandforwardingthesubject-mattertothedestinationtowhichitisinsuredwoul1111.1IfanyIncreasedValueinsuranceiseffectedbyhereintheagreedvalueofthecargoshallbedeemedtobeincreasedtothetotalamountinsuredunderthisinsuranceandallIncreasedValueinsurancescoveringtheloss,andlibiliinsuranceshallbeinsuchproportionasthesuminsuredhereiIntheeventofclaimtheAssuredshallprovidetheUnderwriterswithevidenceoftheamountsinsuredunderallotherinsur11.2WherethisinsuranceisoTheagreedvalueofthecargoshallbedeemedtotheequaltothetotalamountinsutheprimaryinsuranceandallIncreasedValueinsurancescoveringthcargobytheAssured,andliabilityunderthisinsuranceshallbeiinsuredhereinbearstosuchtotalamountinIntheeventofclaimtheAssuredshallprovidetheUnderwriterswithevidenceoftheamountsinsureunderallotherinsu12.ThisinsuranceshallnotinuretothebenefitofthecarrieDutyofAssuredClause13.ItisthedutyoftheAssuredandtheirservantsandagentsinrespectoflhereunder13.1totakesuchmeasuresasmaybereasonableforthepurposeofavertingorminimising13.2toensurethatallrightsagainstcarriers,baileesorpreservedandexercisedandtheUnderwriterswill,inadditiontoanylossrecoverablehereunreimbursetheAssuredforanychargesproperlyandreasonablyincurredinpursuanceoftheseWaiverClause14.MeasurestakenbytheAssuredortheUnderwriterswiththeobjectofsaving,orrecoveringthesubject-matterinsuredshallnotbeconsideredasawaiveroraccabandonmentorotherwiseprejudicetherightsofeitherparty.Reasonable
