2024版離婚協(xié)議書的違約責(zé)任條款2024DivorceAgreement-ClauseonBreachofContractLiabilityPartiesInvolved:Husband(PartyA):__________,IdentificationNumber:__________,Address:__________.Wife(PartyB):__________,IdentificationNumber:__________,Address:__________.Preamble:Recognizingthevoluntarydissolutionofthemaritalrelationship,PartyAandPartyBhavereachedanagreementonthedivisionofproperty,childcustody,andotherrelatedmatters.Toensurethefulfillmentofobligations,thefollowingclausesregardingbreachofcontractliabilityareherebyestablished.Article1:BreachofContractLiabilityBothpartiesshalladheretothetermsofthisAgreementandshallnotbreachthem.Intheeventofabreachbyeitherparty,thebreachingpartyshallbearthecorrespondingliabilityforbreachofcontract.Article2:SpecificBreachActionsBreachofcontractactionsinclude,butarenotlimitedto,thefollowing:FailuretotransferpropertyasstipulatedintheAgreement;Non-paymentorlatepaymentofchildsupport;Failuretocomplywiththeagreedvisitationrightsschedule;Anyactionthatunderminestheinterestsoftheotherpartyorchild(ren).Article3:LiabilityforBreachofPropertyTransferIfeitherpartyfailstotransferpropertywithinthetimeframespecifiedintheAgreement,thebreachingpartyshallcompensatetheotherpartyforlosses,includingbutnotlimitedtopropertyvaluefluctuationsandrelatedadministrativecosts.Thecompensationamountshallbedeterminedbasedontheactuallosssufferedbythenon-breachingparty.Article4:LiabilityforNon-PaymentorLatePaymentofChildSupportThepartyresponsibleforpayingchildsupportmustmakepaymentsontime.Failuretodosowillresultintheobligationtopayalatefee,theamountofwhichshallbe__________(specifythecalculationmethodorrate).Ifchildsupportpaymentsaredelayedformorethan__________(specifythenumberofdays),thebreachingpartyshallalsopayapenaltyof__________(specifytheamountorcalculationmethod).Article5:LiabilityforBreachofVisitationRightsIfthecustodialpartyunreasonablydeniesthenon-custodialparty'svisitationrights,thecustodialpartyshallcompensatethenon-custodialpartyforanylossesincurred,includingemotionaldistressandlossoftime.Thenon-custodialparty,intheeventofabreachofvisitationrights,hastherighttorequestthecourttoenforcethevisitationschedule.Article6:RemediesforBreachofContractIntheeventofabreach,thenon-breachingpartymaytakethefollowingmeasures:DemandperformanceoftheobligationsundertheAgreement;Requestcompensationforlosses;TerminatetheAgreement;Seeklegalremediesthrougharbitrationorlitigation.Thenon-breachingparty'schoiceofremediesshallnotaffecttheirrighttorequestcompensationforlosses.Article7:CalculationofCompensationforLossesThecompensationforlossesshallbebasedontheactualdamagesincurredbythenon-breachingparty.Thecalculationofdamagesmayincludedirecteconomiclosses,emotionaldistress,andanyotherlossesasdeterminedbythecourtorarbitralinstitution.Article8:NoticeofBreachUpondiscoveringabreach,thenon-breachingpartyshallnotifythebreachingpartyinwriting,specifyingthenatureofthebreachandthedemandforremedy.Thebreachingpartyshallrespondtothenoticewithin__________(specifythenumberofdays)andtakenecessarymeasurestoremedythebreach.Article9:MediationandDisputeResolutionBothpartiesagreetofirstattempttoresolveanydisputesarisingfromabreachofcontractthroughmediation.Ifmediationfails,eitherpartymaysubmitthedisputeto__________(specifythearbitrationinstitutionorcourt)forresolution.Article10:GoverningLawThisAgreementshallbegovernedbyandconstruedinaccordancewiththelawsof__________(specifythejurisdiction).Article11:SignaturesHusband(PartyA)Signature:__________Date:__________Wife(PartyB)Signature:__________Date:__________(Note:Theabovecontentisatemplateforthebreachofcontractliabilityclauseinadivorceagreement.Specifictermsmustbefilledinaccordingtotheactualsituation.)(Thetextendshere)Article12:LiquidatedDamagesInadditiontocompensationforlosses,thebreachingpartyshallalsopayliquidateddamagestothenon-breachingparty.TheamountofliquidateddamagesshallbedeterminedbasedontheseverityofthebreachandmaybeaspecifiedsumorapercentageofthetotalvalueoftheAgreement.Article13:InterestonLatePaymentsIfanypaymentunderthisAgreementislate,thebreachingpartyshallpayinterestonthelatepaymentatarateof__________(specifytherate)perannumorpartthereof.Theinterestshallaccruedailyfromtheduedateuntilthedateofactualpayment.Article14:RighttoSetoffThenon-breachingpartyshallhavetherighttosetoffanyamountsowedbythebreachingpartyagainstanyamountspayablebythenon-breachingpartytothebreachingparty.Theexerciseoftherightofsetoffshallnotaffectanyotherrightsorremediesavailabletothenon-breachingparty.Article15:SuspensionofPerformanceIntheeventofabreachbyPartyA,PartyBmaysuspendperformanceofitsobligationsunderthisAgreementuntilthebreachisremedied.ThesuspensionofperformanceshallnotconstituteabreachofcontractbyPartyB.Article16:RighttoSpecificPerformanceThenon-breachingpartyshallhavetherighttoseekspecificperformanceofanyobligationsunderthisAgreement.ThecourtorarbitralinstitutionmayorderthebreachingpartytoperformitsobligationsasspecifiedinthisAgreement.I.AnnexList:AnnexI:Listofallpropertiessubjecttodivision.AnnexII:Childsupportpaymentschedule.AnnexIII:Visitationrightsschedule.AnnexIV:Acknowledgmentofreceiptofnoticeofbreach.AnnexV:Documentationofliquidateddamagesandinterestcalculations.II.BreachofContractandDetermination:AbreachoccurswhenapartyfailstofulfillanyofitsobligationsunderthisAgreementorperformsinamannerthatsubstantiallydeviatesfromthetermsofthisAgreement.Thenon-breachingpartyshalldeterminethebreachbasedontheevidenceofnon-performanceorimproperperformance.III.LegalTermsandDefinitions:Liquidateddamages:AsumofmoneystipulatedbythepartiesintheAgreementascompensationforbreachofcontract.Interestonlatepayments:AdditionalchargesimposedonoverduepaymentsasperthetermsoftheAgreement.Righttosetoff:Thelegalrightofapartytooffsetadebtitoweswithadebtowedtoitbythecounterparty.IV.ProblemsEncounteredinExecutionandSolutions:IfapartybreachestheAgreement,thenon-breachingpartymayseeklegaladviceandinitiatelegalproceedingstoenforceitsrights.Partiesmayencounterdifficultiesinenforcingvisitationrights;insuchcases,theymayseekcourtordersorarbitralawardsforspecificperformance.Disputesoverpropertydivisionmayarise;thesecanberesolvedthroughnegotiation,mediation,orbyinvokingthedisputeresolutionmechanismsspecifiedintheAg
