1、房屋租賃合同出租方(甲方):XXX有限公司Lessor (Party A):XXXMa nageme nt Co.,ltd承租方(乙方):Lessee (Party B): 根據(jù)中華人民共和國(guó)合同法、上海市房屋租賃條例等相關(guān)法律法規(guī) 的規(guī)定,甲、乙雙方經(jīng)丙方居間介紹,在平等、自愿、公平和誠(chéng)信的基礎(chǔ)上,經(jīng)協(xié) 商一致,就乙方承租甲方的房屋事宜,簽訂本合同,以資共同遵守:This Con tract is made by Party C and betwee n both parties after n egotiati on on an equal, volun tary, fair and go

2、od-faith basis in accorda nee with“on tract Law ofthe People 'Republic of China ”,Shanghai Municipality Regulations on the Leas ing of Build ing Premises ” and other releva nt laws and regulati ons, with regard to the issue that Party B will rent the house of Party A:一、出租房屋基本情況:(下稱“該房屋”,實(shí)際情況以權(quán)屬證

3、明或相關(guān)法律文書 的記載內(nèi)容為準(zhǔn))I. Usage of the ren ted premises乙方向甲方承諾,租賃該房屋作為 使用,并遵守國(guó)家和本市有關(guān)于房 地產(chǎn)使用和物業(yè)管理的規(guī)定。Party B shall make commitment to Party A that the premises shall be used as and shall abide

5、 by the regulati ons of real estate use and property man ageme nt in China and Shan ghai Muni cipality.三、交付日期和租賃期限III. Date of delivery and term of leasing3.1甲乙雙方約定,甲方應(yīng)于年月日之前向乙方交付該房屋。交付時(shí)甲、乙雙方在丙方見證下簽訂本合同之附件二房屋交接書。3.1 Both parties have agreed that Party A shall hand over the premises to PartyB before

7、e rent of the premises per month is(RMB) .4.2 租金以個(gè)月為一期支付。乙方應(yīng)于每期提前日前向甲方支付租金。逾期支付的,每逾期一日,則乙方需按月租金的支付逾期違約金。4.2 The rent shall be paid with mon ths as a payme nt period. Party B shallpay the rent before the day in the first month of every payment period. Incase of payme nt delay, the pen alty shall be c

8、ollected at the daily rate of %.4.3乙方支付租金的方式如下:甲方收取租金的賬戶如下:戶名: XX有限公司開戶行:XXX銀行賬號(hào):4.3 Party B shall pay the rent by the follow ing means: bank tran sfer. Theacco unt of Party A to receive the rent:Acco unt n ame: Opening Bank: Acco unt No.: s4.4以上租金包含甲方出具租賃發(fā)票的費(fèi)用、物業(yè)費(fèi)等。4.4 The above rent in cludes 五、保證

9、金(押金)和其他費(fèi)用V. Guara ntee deposit (security deposit) and other fees5.1甲乙雙方約定,在簽訂本合同時(shí),乙方應(yīng)向甲方支付房屋租賃保證金(押金),保證金(押金)為人民幣 元(大寫_元整)。甲方收取該保證金(押金)后應(yīng)向乙方出具收款憑證。租賃關(guān)系終止時(shí),甲方收取的房屋租賃保證金(押金) 除用于抵充本合同約定由乙方承擔(dān)的費(fèi)用外,剩余部分無息歸還乙方。5.1 Both parties have agreed that at the time of (Man dover of the premises sig ning this Con tr

10、act), Party B shall pay Party A the guara ntee deposit (security deposit) of the premises, which is equivale nt to the rent of mon th(s), that is,(RMB USD )(Say Only). Upon receiving theguara ntee deposit (security deposit), Party A shall issue the receipt voucher to Party B. At the time of the term

11、 in ati on of leas ing relati on, the guara ntee deposit (security deposit) collected by Party A shall be used to offset the fees un dertake n by Party B as agreed in this Con tract and the remai ning porti on shall be returned to Party B without in terest.5.2租賃期間內(nèi)發(fā)生的電費(fèi)、電話(通訊)費(fèi)等房屋使用費(fèi)用由乙方承擔(dān);物 業(yè)管理費(fèi)由甲方

12、承擔(dān)。5.2 The cost aris ing from water, electricity, gas, teleph one call(com muni catio n) and TV and so on( etc.) duri ng the leas ing period shall beun dertake n by Party B; property man ageme nt fee shall be un dertake n by (dPartyA OParty B).六、房屋使用要求和維修責(zé)任VI. House use requireme nts and maintenance

13、 resp on sibility6.1租賃期間,乙方發(fā)現(xiàn)該房屋及其附屬設(shè)施有損壞或故障時(shí), 應(yīng)及時(shí)通知甲方修 復(fù);甲方應(yīng)在接到乙方通知后的日內(nèi)進(jìn)行維修。逾期不維修的,乙方可代為維修, 費(fèi)用由甲方承擔(dān)。6.1 During the leasing period, if Party B discovers any damage or trouble withthe premises and the accessory facilities, Party B shall timely notify Party A for repair; Party A shall carry out the re

14、pair within day(s) after receiving thenotification. In case of delay of repair, Party B may make the repair in place of Party A at the cost of Party A.6.2租賃期間,乙方應(yīng)合理使用并愛護(hù)該房屋及其附屬設(shè)施。因乙方使用不當(dāng)或不 合理使用,致使該房屋及其附屬設(shè)施損壞或發(fā)生故障的,乙方應(yīng)負(fù)責(zé)維修。乙方拒 不維修的,甲方可代為維修,費(fèi)用由乙方承擔(dān)。6.2 During the leas ing period, Party B shall make re

15、as on able use of the premises and the accessory facilities. Any damage or trouble aris ing from improper use or un reas on able use of the premises and accessory facilities shall be repaired by Party B. In the eve nt that Party B refuses the repair, Party A may carry out the repair in place of Part

16、y B at the cost of Party B.6.3租賃期間,甲方應(yīng)保證該房屋及其附屬設(shè)施處于正常的可使用和安全的狀態(tài)。 甲方對(duì)該房屋進(jìn)行檢查、養(yǎng)護(hù),應(yīng)提前 日通知乙方。檢查養(yǎng)護(hù)時(shí),乙方應(yīng)予以 配合。甲方應(yīng)減少對(duì)乙方使用該房屋的影響。6.3 During the leasing period, Party A shall ensure normal availability and safe status of the premises and accessory facilities. If Party A intends to carry outin spect ion and m

17、aintenance on the premises, Party A shall no tify Party B days in adva nee. During the in specti on and maintenan ce, Party B shall provide coord in ati on. Party A shall mini mize the in flue nee on the use of the premises.6.4乙方需裝修或者增設(shè)附屬設(shè)施和設(shè)備的,應(yīng)事先征得甲方的書面同意,按規(guī)定 須向有關(guān)部門報(bào)批的,則應(yīng)由甲方報(bào)請(qǐng)有關(guān)部門批準(zhǔn)后,方可進(jìn)行。乙方增設(shè)的附 屬

18、設(shè)施和設(shè)備的歸屬及其維修責(zé)任由甲、乙雙方另行書面約定。6.4 In case that Party B intends to decorate the premises or add accessoryfacilities and equipments, Party B shall obtain written permission from Party A in advanee; if it is required so,(OParty A OParty B entrusted by Party A) shallsubmit such behavior to the compete nt d

19、epartme nt for approval before the impleme ntatio n. The own ership and maintenance of the accessory facilities and equipme nts added by Party B shall be additi on ally agreed by both parties in written form.七、房屋返還與續(xù)租VII. House retur n and renting ren ewal7.1乙方應(yīng)在本合同的租賃期限屆滿之后的 日內(nèi)返還該房屋,未經(jīng)甲方同意逾 期返還該房屋的

20、,每逾期一日,乙方應(yīng)以日租金向甲方支付該房屋占用期間的 使用費(fèi)。7.1 Party B shall return the premises within days after the term in ati on ofthe leas ing period, and in case of any delay for the retur n of the premises without permissi on of Party A, Party B shall pay Party A the use fee of the premises at the daily rate equivale

21、nt to % of daily rent duri ng the occupati on of thepremises.7.2乙方如果需要續(xù)租的,應(yīng)在租賃期限屆滿兩個(gè)月之前向甲方提出,甲方同意的, 雙方另行簽訂相關(guān)續(xù)租文書。乙方在同等條件下享有優(yōu)先承租權(quán)。7.2 In case that Party B wan ts to renew the Con tract, Party B shall raise the ren ewal inten ti on to Party A two mon ths before the term in ati on of the leas ing perio

22、d, and with the approval of Party A, the ren ewal con tract will be additi on ally sig ned betwee n both parties. Un der the equivale nt con diti on, Party B shall have the priority for obta ining the lease.7.3租賃期限屆滿,甲乙雙方未續(xù)簽租賃合同,乙方繼續(xù)支付租金,甲方未表示拒 絕的,則按法律相關(guān)規(guī)定,雙方之間成立不定期租賃關(guān)系。在不定期租賃關(guān)系中, 甲方有權(quán)提前一個(gè)月通知乙方租賃關(guān)系終

23、止。7.3 After the term in atio n of the leas ing period, if no ren ewal con tract is sig ned by both parties and Party B con ti nues pay ing the rent, which is not refused by Party A, the non-fixed-term leas ing relati ons are established betwee n both parties accordi ng to releva nt laws and regulati

24、 ons. During such non- fixed-term leas ing relations, Party A shall have the right to terminate the leasing relations bynotifying Party B one (1) month in advanee.7.4乙方返還該房屋應(yīng)符合正常使用后的狀態(tài)。返還時(shí),應(yīng)經(jīng)甲方驗(yàn)收認(rèn)可,并相 互結(jié)清各自應(yīng)當(dāng)承擔(dān)的費(fèi)用。7.4 The premises returned by Party B shall be con siste nt with the status after norma

25、l use of the premises. Upon return of the premises, Party B shall inspect the premises before its accepta nee and the releva nt fees for respective parties shall be settled.八、轉(zhuǎn)租與轉(zhuǎn)讓VIII. Sublease and tran sfer8.1除甲方已經(jīng)在本合同中同意乙方轉(zhuǎn)租外,乙方在租賃期限內(nèi),不可將該房屋部分或全部轉(zhuǎn)租給他人。8.1 Except that Party A agrees in this Con tr

26、act that the premises may be subleased by Party B, Party B shall not sublease part or all of the premises to any other person within the leasing period, without written permission of Party A.An yhow one liv ing room in the orig inal household type shall not be separated for subleas ing.九、解除合同的條件IX.

27、Con diti ons for con tract can celati on9.1甲乙雙方同意在租賃期限內(nèi),有下列情形之一的,本合同終止,雙方互不承擔(dān) 責(zé)任:9.1 Both parties agree that duri ng the leas ing period, this Con tract shall be terminated neither party needing to assuming any responsibility in case of any of the follow ing situati ons;(一) 該房地產(chǎn)占用范圍內(nèi)的土地使用權(quán)依法提前收回的;(1

28、) The use right of the land occupied by the real estate has bee n legally retrieved;(二) 該房地產(chǎn)因社會(huì)公共利益被依法征用的;(2) The premises are occupied by means of legal requisiti on due to social and public in terests;(三) 該房地產(chǎn)因城市建設(shè)需要被依法列入房屋拆遷許可范圍內(nèi)的;(3) This real estate has to be legally put into the disma ntl ing

29、range due to urba n con struct ion;(四) 該房屋毀損、滅失或者被鑒定為危險(xiǎn)房屋的;(4) The premises are damaged, destroyed or verified as dan gerous house;(五) 甲方已告知乙方該房屋出租前已設(shè)定抵押,現(xiàn)被處分的;(5) Party A has notified Party B that the premises have been pledged before leas ing and now has bee n disposed;9.2甲乙雙方同意,有下列情形之一的,一方可書面通知另一

30、方解除本合同。違反 合同的一方,應(yīng)向另一方按月租金的 倍支付違約金,給對(duì)方造成損失的,支付的違約金不足以抵付損失的,還應(yīng)賠償造成的損失與違約金的差額部分:9.2 Both parties agree that either party may no tify the other party to can cel thisCon tract in writte n form in case of any of the followi ng situati on, and the party that breaches this Con tract shall pay the other part

31、y the liquidated damages equivale nt to time(s) of the mon thly rent, and in case that the losses in curredto both parties cannot be offset by the liquidated damages paid by the breachi ng party, the breach ing party shall pay the differe nee betwee n the in curred losses and the liquidated damages;

32、(一) 甲方未按時(shí)交付該房屋,經(jīng)乙方催告后 日仍未交付的;(I) Party A fails to hand over the premises on time, and even days afterexige nt no tice of Party B;(二) 甲方交付的該房屋不符合本合同的約定,致使不能實(shí)現(xiàn)租賃目的的;或甲方 交付的房屋存在缺陷,危及乙方安全的;(II) The premises han ded over by Party A do not comply with the agreeme nt in this Con tract, which therefore make

33、s it impossible to realize the leas ing purpose; or the premises han ded over by Party A have the defects endan geri ng the safety of Party B;(三) 乙方在甲方按時(shí)交付該房屋的情形下,未能配合辦理交房手續(xù),經(jīng)甲方催告后日仍未配合辦理交房手續(xù)的;(III) In spite of the timely han dover of the premises by Party A, Party B fails tocooperate to go through

34、the procedures for the han dover of the premises days after the exige nt no tice of Party A;(四) 乙方未征得甲方書面同意改變?cè)摲课萦猛荆率乖摲课輷p壞的;(IV) Party B cha nged the use of the premises without writte n permissi on of Party A and therefore in curred the damage of the premises;(五) 因乙方原因造成該房屋主體結(jié)構(gòu)損壞的;(V) The mai n str

35、ucture of the premises is damaged due to the reas ons of Party B;(六) 乙方擅自轉(zhuǎn)租該房屋或轉(zhuǎn)讓該房屋承租權(quán)的;(VI) Party B subleases the premises or tran sfers the leas ing right of the premises without permissi on of Party A;(七) 乙方逾期不支付租金累計(jì)超過 _天的;(VII) Party fails to pay the rent up to more than days;十、違約責(zé)任X. Breaching

36、 liability10.1該房屋交付時(shí)存在缺陷的,甲方應(yīng)自交付日起 日內(nèi)進(jìn)行修復(fù),逾期不修復(fù)的,甲方同意減少租金并變更有關(guān)租金條款。10.1 In case of any defect with the premises at the time of handover, Party Ashall make the repair with in days after the han dover, and if no repair ismade eve n after the stipulated period, Party A agrees to reduce the rent and cha

37、 nge the clause related to the rent.10.2租賃期間,甲方不及時(shí)履行本合同約定的維修與養(yǎng)護(hù)責(zé)任,致使該房屋損壞,造成乙方財(cái)產(chǎn)損失或人身傷害的,甲方應(yīng)承擔(dān)賠償責(zé)任。10.2 During the leas ing period, Party A fails to timely perform the maintenance resp on sibility of the premises as agreed in the Con tract, which therefore hasincurred the damage of the premises, the

38、n any property loss or personal injury in curred upon Party B shall be compe nsated by Party A.10.3租賃期間,非本合同規(guī)定的情況,甲方擅自解除本合同,提前收回該房屋的, 甲方應(yīng)按月租金的倍向乙方支付違約金。若違約金不足以抵付乙方損失的,甲 方還應(yīng)負(fù)責(zé)賠償。10.3 During the leas ing period, Party A un laterally can celled this Con tract andtook back the premises in adva nee in ca

39、se of the situati ons other tha n those stipulated in the Con tract, Party A shall pay Party B the liquidated damages equivale nt to times of mon thly ren t. If the liquidated damages cannotcompe nsate for the loss in curred upon Party B, Party A shall provide further compe nsati on.10.4乙方未征得甲方書面同意或

40、者超出甲方書面同意的范圍和要求裝修房屋或者 增設(shè)附屬設(shè)施和設(shè)備的,甲方可以要求乙方恢復(fù)房屋原狀或賠償損失。10.4 If Party B decorates the premises or adds the accessory facilities or equipme nts without writte n permissi on of Party A or bey ond the scope and requireme nts agreed in writte n permissi on of Party A, Party A may require Party B to recover

41、 the premises to the original state, or compensate for the loss.10.5租賃期間,非本合同規(guī)定的情況,乙方中途擅自退租的,乙方應(yīng)按月租金的倍向甲方支付違約金。若違約金不足以抵付甲方損失的,乙方還應(yīng)負(fù)責(zé)賠償。10.5 During the leasing period, in case of the situation other than those stipulated in the Con tract, Party B stops the ren ti ng, Party B shall pay Party A the liq

42、uidated damages equivale nt to time(s) of mon thly ren t. If the rent is noteno ugh to offset the loss in curred upon Party A, Party B shall provide further compe nsati on.十一、其他條款XI. Others11.1本合同及附件一自甲、乙雙方于本合同簽章處簽字或簽章后立即生效。11.1 This Con tract and its Appe ndix I shall come into effect upon the sig natures or seal stamp ing of Parties A and B .11.2本合同空格處填寫文字與鉛印文字具有同等法律效力,若填寫文字與鉛印文 字相沖突,以填寫文字為準(zhǔn)。若有未盡事宜,可簽訂補(bǔ)充協(xié)議進(jìn)行約定,若補(bǔ)充協(xié) 議與本協(xié)議相沖突,以補(bǔ)充協(xié)議為準(zhǔn)。11.2 The words filled and prin ted in the bla nk part of this Con tract shall have
