16、限的勞動(dòng)合同,應(yīng)當(dāng)訂立無(wú)固定期限的勞動(dòng)合同。)二、工作內(nèi)容第二條 乙方同意甲方根據(jù)生產(chǎn)和工作需要,在 崗位工作。乙方應(yīng)當(dāng) 完成甲方規(guī)定在生產(chǎn)上應(yīng)當(dāng)達(dá)到的數(shù)量指標(biāo)、質(zhì)量標(biāo)準(zhǔn)或工作任務(wù)。甲方如因生產(chǎn)(工作) 需要,經(jīng)甲乙雙方協(xié)商一致,可以調(diào)換乙方的工作;如果雙方協(xié)商不一致,甲方可以解除 乙方的勞動(dòng)合同,但必須按國(guó)家規(guī)定支付經(jīng)濟(jì)補(bǔ)償金。三、勞動(dòng)保護(hù)和勞動(dòng)條件第三條甲方必須執(zhí)行國(guó)家關(guān)于加強(qiáng)企業(yè)生產(chǎn)中勞動(dòng)安全衛(wèi)生的規(guī)定,改善勞動(dòng)條件,保障乙方的安全、健康,甲方按國(guó)家有關(guān)規(guī)定對(duì)女工和未成年工實(shí)行特殊勞動(dòng)保護(hù)。第四條甲方安排乙方執(zhí)行 制度。執(zhí)行標(biāo)準(zhǔn)工時(shí)制的,乙方每日工作時(shí)間 8小時(shí),每周工作40小時(shí)。執(zhí)行綜
17、合計(jì)算工作時(shí)工作制的,乙方平均每天工作時(shí)間不超過(guò)8小時(shí),平均每周工作不超過(guò)40小時(shí)。執(zhí)行不定時(shí)工作制,在保證完成甲方工作任務(wù)的情況下,乙方自行安排工作和休息時(shí)問(wèn)。第五條甲方安排乙方加班,應(yīng)符合法律、法規(guī)的規(guī)定,甲方安排乙方延長(zhǎng)工作時(shí)問(wèn),應(yīng)支付不低于工資的150%工資報(bào)酬;甲方安排乙方休息日工作又不能安排補(bǔ)休的,應(yīng)支付不低于200%的工資報(bào)酬;甲方安排乙方法定休假日工作的,應(yīng)支付不低于工資的300% 的工資報(bào)酬。四、勞動(dòng)紀(jì)律第六條甲方對(duì)乙方進(jìn)行勞動(dòng)紀(jì)律、業(yè)務(wù)技術(shù)、安全生產(chǎn)等方面基本知識(shí)的教育和訓(xùn)練,乙方必須服從甲方領(lǐng)導(dǎo),自覺(jué)遵守勞動(dòng)紀(jì)律,遵守國(guó)家政策、法規(guī),遵守 甲方各項(xiàng)規(guī)章制度。乙方違反勞動(dòng)紀(jì)

26、 scil and e c'ial civlizai on cnstruCio -erfrms ad t直至解除本合同。甲方的規(guī)章制度應(yīng)當(dāng)通過(guò)職工代表大會(huì)或職工大會(huì)討論通過(guò)。五、勞動(dòng)報(bào)酬第七條 甲方每月按時(shí)以貨幣形式支付乙方工資,月工資為 元, 或 執(zhí)行。乙方在試用期的工資 元,甲方支付乙方工資不得低于當(dāng)?shù)卣?guī)定的最低工資標(biāo)準(zhǔn)。六、保險(xiǎn)福利待遇第八條 甲方按國(guó)家和自治區(qū)有關(guān)規(guī)定為乙方向社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)繳納社會(huì)保險(xiǎn) 費(fèi),包括失業(yè)、養(yǎng)老、工傷、醫(yī)療、生育等項(xiàng)保險(xiǎn)費(fèi)。乙方按規(guī)定繳納個(gè)人應(yīng)負(fù)擔(dān)的社會(huì) 保險(xiǎn)費(fèi)。第九條乙方在合同期內(nèi),患病或非因工負(fù)傷,需要停止工作醫(yī)療時(shí),根據(jù)本人實(shí)際參加工作年限
27、和在甲方工作年限,按有關(guān)規(guī)定給予三個(gè)月至二十四個(gè)月的醫(yī)療期。第十條乙方在合同期內(nèi),其病假工資、疾病救濟(jì)費(fèi)和醫(yī)療待遇按照有關(guān)規(guī)定執(zhí)行。第十一條乙方在合同期內(nèi)因工傷殘、因工死亡、因病死亡和患職業(yè)病,其待遇按國(guó)家有關(guān)規(guī)定執(zhí)行。七、勞動(dòng)合同的變更、解除第十二條有下列情形之一的,甲乙雙方應(yīng)變更勞動(dòng)合同并及時(shí)辦理變更合同手續(xù):(一)甲乙雙方協(xié)商一致的;(二)訂立本合同所依據(jù)的客觀情況發(fā)生重大變化,致使本合同無(wú)法履行的;(三)訂立本合同所依據(jù)的法律、法規(guī)、規(guī)章發(fā)生變化的。第十三條當(dāng)事人依據(jù)第十二條第(二)項(xiàng)的約定,一方要求變更合同的,應(yīng)將變更要求書(shū)面通知另一方,另一方應(yīng)在 15日內(nèi)(含15日)書(shū)面答復(fù)對(duì)方;

40、合同:(一)患職業(yè)病或者因工負(fù)傷并被確認(rèn)達(dá)到傷殘等級(jí)的;(二)患病或非因工負(fù)傷、在規(guī)定的醫(yī)療期內(nèi)的;(三)女職工在孕期、產(chǎn)期、哺乳期內(nèi)的。第十九條勞動(dòng)者解除勞動(dòng)合同,應(yīng)當(dāng)提前30 日以書(shū)面形式通知用人單位,并辦理有關(guān)工作移交手續(xù)。第二十條有下列情形之一的,乙方可以隨時(shí)通知甲方解除本合同:(一)在試用期內(nèi)的;(二)甲方以暴力、威脅或者非法限制人身自由的手段強(qiáng)迫勞動(dòng)的;(三)甲方未按照本合同約定支付勞動(dòng)報(bào)酬或者提供勞動(dòng)條件的;(四)甲方未依法為乙方繳納社會(huì)保險(xiǎn)費(fèi)的。8、 經(jīng)濟(jì)補(bǔ)償與賠償?shù)诙粭l發(fā)生下列情形之一的,甲方按下列標(biāo)準(zhǔn)向乙方支付經(jīng)濟(jì)補(bǔ)償金:(一)甲方克扣或者無(wú)故拖欠乙方工資的,以及拒不支
