1、.：.；英文合同本卷須知：1、本合同用英文和中文兩種文字寫成，一式四份。雙方執(zhí)英文本和中文本各一式兩份，兩種文字具有同等效能。The contract is made out in English and Chinese languages in quadruplicate, both texts being equally authentic, and each Party shall hold two copies of each text.2、本合同由雙方代表于1999年12月9日簽署。合同簽署后，由各方分別向本國政府當(dāng)局懇求同意，以最后一方的同意日期為本合同的生效日期，雙方應(yīng)力爭在60

After signing the contract, both parties shall apply to their respective Government Authorities for ratification. The date of ratification last obtained sha

15、簽署實(shí)際證明，英譯合同中容易出現(xiàn)過失的地方通常不是大的陳說性條款，而是一些關(guān)鍵的細(xì)目，比如：金錢、時(shí)間、數(shù)量等。為了防止出過失，在英譯合同時(shí)，經(jīng)常運(yùn)用一些有限定作用的構(gòu)造來界定細(xì)目所指定確實(shí)切范圍。1. 限定責(zé)任眾所周知，合同中要明確規(guī)定雙方的責(zé)任。為翻譯好雙方責(zé)任的權(quán)限與范圍，經(jīng)常運(yùn)用連詞和介詞的固定構(gòu)造?，F(xiàn)把最常用的此類構(gòu)造舉例闡明如下。1and/or常用 and/or英譯合同中“甲和乙+甲或乙的內(nèi)容，這樣就可防止漏譯其中的一部分。Eg. 假設(shè)上述貨物對船舶和或船上其它貨物呵斥任何損害，托運(yùn)人應(yīng)負(fù)全責(zé)。The shipper shall be liable for all damage c

17、ty subject to the terms and conditions stipulated below.2. 限定時(shí)間英譯與時(shí)間有關(guān)的文字，都該當(dāng)非常嚴(yán)厲慎重地處置，由于合同對時(shí)間的要求是必需準(zhǔn)確無誤的。英譯起止時(shí)間時(shí)，常用以下構(gòu)造來限定準(zhǔn)確的時(shí)間。1雙介詞用雙介詞英譯含當(dāng)天日期在內(nèi)的起止時(shí)間。Eg. 自 9月 20日起，甲方已無權(quán)接受任何定單或收據(jù)。Party A shall be unauthorized to accept any orders or to collect any account on and after September 20.Eg. 我公司的條件是3個(gè)月內(nèi)，

19、常用的 include的相應(yīng)方式有：inclusive、including和 included，用來限定含當(dāng)日在內(nèi)的時(shí)間。Eg. 本證在北京議付，有效期至 10月 1日。This credit expires till October 1 inclusive for negotiation in Beijing. or： This credit expires till and including October 1 for negotiation in Beijing. 假設(shè)不包括 10月 1日在內(nèi)，英譯為 till and not including October 1.3. 限定金額為防

20、止金額數(shù)量的差漏、偽造或涂改，英譯時(shí)常用以下措施嚴(yán)厲把關(guān)。1大寫文字反復(fù)金額英譯金額須在小寫之后、在括號內(nèi)用大寫文字反復(fù)該金額，即使原文合同中沒有大寫，英譯時(shí)也有必要加上大寫。在大寫文字前加上“SAY，意為“大寫；在最后加上“ONLY意思為“整。必需留意：小寫與大寫的金額數(shù)量要一致。Eg. 聘方須每月付給受聘方美圓 500元整。Party A shall pay Party B a monthly salary of US $500 SAY FIVE HUNDRED US DOLLARS ONLY。2正確運(yùn)用貨幣符號英譯金額必需留意區(qū)分和正確運(yùn)用各種不同的貨幣稱號符號?！?既可代表“美圓，又可代表其他某些地方的貨幣；而“不僅代表“英鎊，也可代表其他某些地方的貨幣。必需留意：當(dāng)金額用數(shù)字書寫時(shí)，金額數(shù)字必需緊靠貨幣符號，例如：Can $891，568，不能寫成：Can $ 891，568.另外，翻譯的還要特別留意金額中是小數(shù)點(diǎn) 。還是分節(jié)號 ，由于這兩個(gè)符號極易引起筆誤，稍有忽略，其后果是不堪想象的。商務(wù)合同曾經(jīng)成為職場中人必需掌握的一門知識(shí)
