PerformanceRelatedtoHongKong,TaiwanandMacao

Inaccordancewiththe"RegulationsonAdministrationofCommercialPerformance'oftheStateCouncilofthePeoplesRepublicofChinaand"TheDetailedRulesfortheImplementationoftheRegulationsonAdministrationofCommercialPerformance'oftheMinistryofCultureofthePeoplesRepublicofChinaandinaccordancewiththerelevantrequirementsoftheShanghaiAdministrationofCulture,Radio,FilmandTelevisionconcerningstrengtheningtheforeign-relatedcommercialperformance,performancesponsoringunits(thenotifyingparty)andperforminggroupsandindividuals(thepromiseparty)shallsignthisletterofnotificationandpromiseconcerningforeign-relatedcommercialperformanceorcommercialperformancerelatedtoHongKong,TaiwanandMacaotodefinetherights,obligationsandlegalresponsibilitiesofthetwosidesfortheircommonobservation.

I.TheNotificationofPerformanceBrokerageInstitutions

1.Theperformancebrokerageinstitutionthathasobtainedthegovernmentapprovaldocumentsforaperformanceprojectisalegalperformancebusinessentityandshallundertaketheresponsibilityforsponsoringperformanceactivities.Article23ofthe"DetailedRulesfortheImplementationoftheRegulationsonAdministrationofCommercialPerformance'oftheMinistryofCulturesprovidethatabusinessentityofcommercialperformancewhensponsoringcommercialperformanceshallhandletheapplicationformalitiesforperformance,arrangeprogramcontents,determinethepricefortheperformanceandtakechargeofthesettlementofpaymentandexpenditureoftheperformance,payorwithholdrelevanttaxesandfeesinaccordancewiththelaw,consciouslyacceptthesupervisionandadministrationoftheculturaladministrationdepartmentofthelocalitywheretheperformanceisheldandfulfillotherspecificobligations.

2.Whensponsoringforeign-relatedcommercialperformanceorcommercialperformancerelatedtoHongKong,MacaoandTaiwan,thesponsoringunitshouldberesponsibleforhandlingtheentryandexitproceduresforforeign,HongKong,MacaoandTaiwancultural,artandperforminggroupsandindividualsinaunifiedmannerandifsponsoringaperformancetour,theunitshouldalsoberesponsibleformakingarrangementsforcommunicationandprogramcontentsfortheentiretour.

3.Article26ofthe"RegulationsonAdministrationofCommercialPerformance'oftheStateCouncilprovidethatcommercialperformancemustnot

1).opposethebasicprincipleslaiddownintheConstitution;

2).endangertheunity,sovereigntyandterritorialintegrityofthestate,jeopardizethesecurityofthestateorharmthehonorandtheinterestsofthestate;

3).inciteethnichatredordiscrimination,harmethniccustomsandhabits,hurtethnicsentiments,underminetheunityofethnicgroupsandviolatereligiouspolicies;

4).disruptsocialorderandunderminesocialstability;

5).harmsocialethicsorfinenationalcultureandtraditions;

6).advocateobscenity,pornography,evilcults,superstitionorplayupviolence;

7).insultorslanderothers,infringeuponotherslegitimaterightsandinterests;

8).behorribleorcruelintheformsofperformanceandruinperformersphysicalandmentalhealth;

9).solicitaudiencebymakinguseofthephysicaldeformitiesorbyshowingphysicalvariationsoftheperformersor

10).commitanyactsthatareprohibitedbylawsandadministrativeregulations.

Asasponsoringunitforforeign-relatedcommercialperformanceorcommercialperformancerelatedtoHongKong,MacaoandTaiwan,theunitshouldspeciallyassignapersontoparticipateinthestagesupervisionworkattheperformancesite.Foraprogramitemwhichisstagedbyaperformingpartywithoutapplicationforapprovalorwhichviolatesthelawsandregulationsofourcountry,thesponsoringunithastherighttostopitonthespotandmakeareporttothegovernmentadministrationdepartment.Theperformingpartyshouldbearcorrespondingresponsibilityforbreachingtheagreementforitsregulation-violatingacts.

II.ThePromiseofPerformingGroupsandIndividuals

Authorizedbytheperformingparty,thisrepresentativesolemnlystatesthatIhavereadandaccepttheaboveletterofnotificationoftheperformancebrokerageinstitution.Theperformingpartypromisesthatitwillstrictlyimplementtheagreementandobservethelawsandregulationsofthelocalitywheretheperformanceisheld.Itwillgivetheperformancewiththeprogramcontentsapprovedinaccordancewiththelawandwillnotchangethecontentswithoutauthoriza
