2023年版房屋建筑和市政基礎(chǔ)設(shè)施工程施工總承包合同（中英文對(duì)照）EPCCONTRACTFORCONSTRUCTIONOFHOUSINGBUILDINGS&MUNICIPALINFRASTRUCTUREWORKS總目錄TABLEOFCONTENTS第一部分合同協(xié)議書PartIContractAgreement第二部分中標(biāo)通知書PartIINoticeofAward第三部分投標(biāo)函及其附錄PartIIILetterofBidanditsAppendices第四部分已標(biāo)價(jià)的工程量清單PartIVListofpricedBillofQuantities第五部分合同條款通用部分PartVGeneralConditionsofContract第六部分合同條款專用部分PartVIParticularConditionsofContract第七部分技術(shù)標(biāo)準(zhǔn)和要求PartVIITechnicalStandardsandRequirements第八部分合同圖紙PartVIIIContractDrawings部分章節(jié)示例如下：6.圖紙6.Drawings6.1圖紙6.1Drawings6.1.1發(fā)包人應(yīng)當(dāng)向承包人提供圖紙，提供圖紙的日期及圖紙?zhí)讛?shù)見“合同條款專用部分”。6.1.1TheEmployershallprovidetheContractorwithdrawings,thedateandsetsnumberofdrawingstobeprovidedreferstotheparticularconditionsoftheContract.6.1.2發(fā)包人所提供的圖紙?zhí)讛?shù)無(wú)法滿足施工需要時(shí)，由承包人自費(fèi)復(fù)制。6.1.2WherethesetsofdrawingsprovidedbytheContractorareunabletosatisfytheconstructionneeds,thedrawingwillbereproducedbytheContractoratitsownexpense.6.1.3如果購(gòu)買或復(fù)制標(biāo)準(zhǔn)圖紙，購(gòu)買或復(fù)制標(biāo)準(zhǔn)圖紙的責(zé)任及費(fèi)用由承包人承擔(dān)。6.1.3Wherestandarddrawingsarepurchasedorreproduced,theresponsibilityandcostthereofshallbeaccountableontheContractor.6.2圖紙誤期和誤期的費(fèi)用6.2Drawingsdelayandexpenseofdelay由于發(fā)包人未能按時(shí)向承包人提供圖紙，已經(jīng)或?qū)⒁獙?duì)工程進(jìn)展造成影響，承包人可以書面形式通知監(jiān)理人及發(fā)包人，說(shuō)明所缺圖紙的具體細(xì)節(jié)、對(duì)工程進(jìn)展的影響以及提供圖紙的最晚時(shí)間。發(fā)包人仍然未能向承包人提供所需圖紙，應(yīng)當(dāng)依據(jù)實(shí)際延誤情況延長(zhǎng)合同工期并為承包人追加由此而發(fā)生的額外費(fèi)用。ProvidedthattheprogressoftheWorkshasbeenorwillbeaffectedbytheEmployer'sfailuretoprovidetheContractorwithdrawingsontime,theContractormaynotifythesupervisorandtheEmployerinwritingofthespecificdetailsofthemissingdrawings,theeffectontheprogressoftheWorksandthelatesttimebywhichthedrawingsshouldbeprovided.WheretheEmployerstillfailstoprovidetheContractorwiththerequireddrawings,thecontractperiodshallbeextendedandadditionalcostsincurredbytheContractorasaresultoftheactualdelay.6.3由承包人設(shè)計(jì)的永久工程的圖紙6.3DrawingsofthepermanentworksdesignedbytheContractor6.3.1如果合同文件中約定部分永久工程由承包人負(fù)責(zé)設(shè)計(jì)，承包人應(yīng)當(dāng)具有相應(yīng)的設(shè)計(jì)資質(zhì)或委托具有相應(yīng)設(shè)計(jì)資質(zhì)的單位進(jìn)行設(shè)計(jì)，并對(duì)工程設(shè)計(jì)的質(zhì)量負(fù)責(zé)。承包人同時(shí)應(yīng)當(dāng)將相關(guān)圖紙、規(guī)范、計(jì)算書及其他資料報(bào)監(jiān)理人，并經(jīng)監(jiān)理人報(bào)發(fā)包人、設(shè)計(jì)人或相關(guān)圖紙審批單位批準(zhǔn)。6.3.1Wherethedesignofpartofthepermanentworks,asagreementoftheContractDocuments,istheliabilityoftheContractor,theContractorshallhavetheappropriatedesignqualificationorcommissionaunitwiththeappropriatedesignqualificationtocarryoutthedesignandshalltaketheresponsibilityforthequalityofthedesignoftheworks.TheContractorshallatthesametimesubmitrelevantdrawings,specifications,calculationsandotherinformationtothesupervisorthroughwhichsubmittheEmployer,theDesignerortherelevantdrawingapprovalunitforapproval.6.3.2承包人還應(yīng)當(dāng)依據(jù)竣工資料的相關(guān)要求將詳細(xì)的使用維修手冊(cè)以及竣工圖紙等報(bào)監(jiān)理人。6.3.2TheContractorshallalsosubmittothesupervisorthedetaileduseandmaintenancemanualandas-builtdrawingsinaccordancewiththerelevantrequirementsforas-builtinformation.6.4加工圖、大樣圖、安裝圖及協(xié)調(diào)配合圖6.4Machiningdrawings,generaldrawings,installationdrawingsandcoordinationdrawings6.4.1按照工程技術(shù)規(guī)范的相關(guān)要求需要制作加工圖、大樣圖、安裝圖、協(xié)調(diào)配合圖等圖紙的，承包人應(yīng)當(dāng)制作，并在開始施工前報(bào)監(jiān)理人審批，在獲得監(jiān)理人批準(zhǔn)后按圖施工。此類批準(zhǔn)并不能解除承包人根據(jù)本合同約定應(yīng)當(dāng)承擔(dān)的責(zé)任。Providedthatthedrawingssuchasmachiningdrawings,generaldrawings,installationdrawings,coordinationandcoordinationdrawingsarerequiredtobepreparedinaccordancewiththerelevantrequirementsofthetechnicalspecificationsoftheworks,theContractorshall,priortothecommencementofconstruction,makeandsubmitthesametothesupervisorforapproval,andconstructtheworkinaccordancewiththedrawingsuponobtainingtheapprovalofthesupervisor.SuchapprovalshallnotrelievetheContractorofitsliabilityhereunder.6.4.2監(jiān)理人應(yīng)當(dāng)在收到承包人報(bào)送的上述圖紙后7天內(nèi)提出審核意見。逾期未提出的，視為同意。6.4.2TheSupervisorshall,withinsevendaysuponreceiptthereoffromtheContractor,submithiscommentsontheabovedrawings,iffailingwhichshallbedeemedtobeagreed.6.5現(xiàn)場(chǎng)圖紙準(zhǔn)備6.5Preparationofthesitedrawings承包人應(yīng)當(dāng)在現(xiàn)場(chǎng)保留一套完整圖紙，供發(fā)包人、監(jiān)理人及有關(guān)人員進(jìn)行工程檢查時(shí)使用。TheContractorshallmaintainacompletesetofdrawingsonsiteforusebytheEmployer,SupervisorandrelevantpersonnelincarryingoutinspectionsoftheWorks.7.發(fā)包人7.Employer7.1發(fā)包人義務(wù)7.1Employer’sObligations發(fā)包人應(yīng)當(dāng)按照合同文件的約定全面履行合同義務(wù)，并承擔(dān)相應(yīng)的費(fèi)用。其義務(wù)包括但不限于：TheContractorshallfullyperformitsobligationsundertheContractDocumentsandbearthecorrespondingcosts.Itsobligationsinclude,butarenotlimitedto.7.1.1在履行合同過(guò)程中應(yīng)當(dāng)遵守任何適用的法律、法規(guī)、規(guī)章和規(guī)范性文件。7.1.1Anyapplicablelaws,rules,regulationsandnormativedocumentsshallbecompliedwithintheperformanceoftheContract.7.1.2委托設(shè)計(jì)人完成本工程的設(shè)計(jì)（按照第6.3款約定應(yīng)當(dāng)由承包人負(fù)責(zé)完成的設(shè)計(jì)除外），并負(fù)責(zé)對(duì)設(shè)計(jì)人的工作及其進(jìn)度做出妥善的監(jiān)督和協(xié)調(diào)。7.1.2ToentrusttheDesignertocompletethedesignoftheWorks(ExceptforthedesignwhichshallbetheresponsibilityoftheContractorasspecifiedinarticle6.3)andtoprovidepropersupervisionandcoordinationoftheDesigner'sworkanditsprogress.7.1.3委托監(jiān)理人對(duì)工程進(jìn)行監(jiān)理，對(duì)監(jiān)理人的職責(zé)和權(quán)力做詳細(xì)定義并以書面形式通知承包人，或?qū)⑽斜O(jiān)理合同的一份副本轉(zhuǎn)交承包人。7.1.3ToentrusttheSupervisortosupervisetheproject,definetheresponsibilitiesandpowersoftheSupervisorindetail,andnotifytheContractorinwrittenform,ortransferacopyoftheentrustedsupervisioncontracttotheContractor.7.1.4委派發(fā)包人代表，并以書面形式通知承包人及其他相關(guān)單位。7.1.4AppointarepresentativeoftheEmployerandnotify,inwriting,theContractorandotherrelevantentities.7.1.5按照合同文件的約定履行付款義務(wù)。7.1.5Performanceofpaymentobligationsinaccordancewiththecontractdocuments.7.1.6發(fā)包人應(yīng)當(dāng)委托監(jiān)理人提前7天以書面形式向承包人發(fā)出開工通知。7.1.6TheEmployershallentrusttheSupervisortogivetheContractorsevendays'noticeinwritingofthecommencementoftheWorks.7.1.7現(xiàn)場(chǎng)的準(zhǔn)備和移交7.1.7PreparationandhandoverofSite發(fā)包人應(yīng)當(dāng)在合同簽訂后的7天內(nèi)，向承包人提供施工現(xiàn)場(chǎng)及毗鄰區(qū)域內(nèi)供水、排水、供電、供氣、供熱、通信、廣播電視等地下管線資料，氣象和水文觀測(cè)資料，相鄰建筑物和構(gòu)筑物、地下工程的有關(guān)資料，并保證資料的真實(shí)、準(zhǔn)確、完整；并在按照合同文件約定的時(shí)間向承包人移交現(xiàn)場(chǎng)前負(fù)責(zé)完成現(xiàn)場(chǎng)準(zhǔn)備工作。向承包人移交現(xiàn)場(chǎng)的時(shí)間見“合同條款專用部分”。發(fā)包人向承包人移交的現(xiàn)場(chǎng)應(yīng)當(dāng)具備以下條件：Thecontractorshall,withinsevendaysupontheconclusionofthecontract,providethecontractorwiththeinformationonundergroundpipelinessuchaswatersupply,drainage,powersupply,gassupply,heatsupply,communications,radioandtelevision,meteorologicalandhydrologicalobservations,therelevantinformationonadjacentbuildings,structuresandundergroundworkswithintheconstructionsiteandadjacentareas,inadditiontoensuretheinformationtrue,accurateandcomplete;andtakeresponsibilityforthecompletionofsitepreparationworkpriortohandingoverthesitetothecontractoratthetimeagreedinthecontractdocuments.ThetimeforhandingoverthesitetotheContractorreferstotheSpecialSectionoftheContractConditions.ThesitetransferredbytheEmployertotheContractorshallmeetthefollowingconditions:（1）完成現(xiàn)場(chǎng)內(nèi)及其空中任何障礙物的清除。包括但不限于現(xiàn)有房屋的拆遷及拆遷渣土等的清除、青苗樹木的保護(hù)或遷移、現(xiàn)有管線的改位或遷移等，保障現(xiàn)場(chǎng)內(nèi)場(chǎng)地平整；(1)Tocompletetheremovalofanyobstructionswithinthesiteandoverhead,includingbutnotlimitedtothedemolitionofexistinghousesandremovalofdemolisheddebris,etc.,theprotectionorrelocationofseedlingsandtrees,therepositioningorrelocationofexistingpipelines,etc.,andensurethesitelevelingwithinthesite.（2）提供水源及接口；(2)Provisionofwatersourcesandconnections.（3）提供雨水和污水排放接口；(3)Provisionofconnectionsforstormwaterandsewagedrainage.（4）提供電源及接口；(4)Provisionofpowersupplyandconnections.（5）提供電話和通訊線路及接口；(5)Provisionoftelephone,communicationlinesandconnections.（6）連接現(xiàn)場(chǎng)與市政公共道路的交通通道（但不包括現(xiàn)場(chǎng)內(nèi)的臨時(shí)道路和設(shè)計(jì)圖紙上標(biāo)明的所有永久市政道路）；(6)Trafficaccessconnectingthesitetothemunicipalpublicroad(howeverexcludingtemporaryroadswithinthesiteandallpermanentmunicipalroadsasindicatedonthedesigndrawings).（7）提供水準(zhǔn)點(diǎn)及坐標(biāo)控制點(diǎn)；(7)Provisionoflevelandcoordinatecontrolpoints.（8）提供的其他條件見“合同條款專用部分”。(8)OtherconditionstobeprovidedrefertotheparticularconditionsoftheContract.對(duì)上述條件或工作的具體要求（如水源管徑、電源的額定功率、接口的位置等）見“技術(shù)標(biāo)準(zhǔn)和要求”。發(fā)包人應(yīng)當(dāng)承擔(dān)與現(xiàn)場(chǎng)準(zhǔn)備有關(guān)的上述工作的一切費(fèi)用。承包人應(yīng)當(dāng)在合同履行期間妥善保管上述所移交的設(shè)施，以保證該等設(shè)施始終處于可正常使用的狀態(tài)。Thespecificrequirementsfortheaboveconditionsorwork(e.g.diameterofwatersupply,powerrating,locationofconnections,etc.)refertotheTechnicalStandardsandRequirements.TheContractorshallbearallcostsfortheaboveworksinconnectionwithsitepreparation.TheContractorshalltakepropercareofthefacilitieshandedoverasstatedaboveduringtheperformanceoftheContracttoensurethesameareinaserviceableconditionatalltimes.7.1.8按照國(guó)家對(duì)施工的要求，提供場(chǎng)地、環(huán)境、工期、資金等方面的保障。7.1.8Providethesecurityandguarantee,inaccordancewithState’srequirementsforconstruction,forsite,environment,constructionperiod,capitalandotheraspects.7.1.9在開工日期之前應(yīng)當(dāng)辦妥任何必要的批準(zhǔn)、許可、核準(zhǔn)、報(bào)備等手續(xù)，并及時(shí)辦理合同文件約定的其他應(yīng)當(dāng)由發(fā)包人辦理的本工程相關(guān)手續(xù)。7.1.9Anynecessaryapprovals,permits,aratification,filings,etc.shallbecompletedpriortothecommencementdateandotherformalitiesrelatingtotheWorksspecifiedintheContractDocumentsshallbegonethroughwithoutdelaybytheContractor.7.1.10按照合同文件的約定親自或通過(guò)監(jiān)理人向承包人下達(dá)指令，以保證本工程的順利進(jìn)行。7.1.10togiveinstructionstotheContractorinpersonorthroughtheSupervisorasstatedintheContractDocumentstoensurethesmoothrunningoftheWorks.7.1.11按照合同文件的約定回復(fù)、審批或確認(rèn)承包人提出的任何詢問(wèn)或申請(qǐng)。未在合同文件約定的時(shí)間內(nèi)回復(fù)、審批或確認(rèn)的，應(yīng)當(dāng)視為已獲得發(fā)包人批準(zhǔn)。7.1.11Respondto,approveorconfirmanyenquiriesorapplicationsfiledbytheContractorasspecifiedintheContractDocuments.Failuretoreply,approveorconfirmwithinthetimespecifiedintheContractDocumentsshallbedeemedtohavebeenapprovedbytheContractor.7.1.12應(yīng)當(dāng)按照合同文件約定向承包人提供圖紙并在開工日期前組織承包人、監(jiān)理人和設(shè)計(jì)人進(jìn)行圖紙會(huì)審和技術(shù)交底。7.1.12TheEmployershall,inaccordancewiththecontractdocuments,providethedrawingstothecontractor,andorganizethecontractor,thesupervisorandthedesignertoconductthejointdrawingreviewandtechnicaldisclosurepriortothecommencementdate.7.1.13應(yīng)當(dāng)及時(shí)協(xié)調(diào)處理施工場(chǎng)地周圍地下管線和鄰近建筑物、構(gòu)筑物（包括文物保護(hù)建筑）、古樹名木的保護(hù)工作，并承擔(dān)有關(guān)費(fèi)用。7.1.13Shallcoordinateandhandlewithoutdelaytheprotectionofundergroundpipelinesandadjacentbuildings,structures(includingculturalrelicsprotectedbuildings)andancientorfamoustrees,inadditiontobeartherelevantexpenses.7.1.14為避免正常施工時(shí)產(chǎn)生的噪音、震動(dòng)、光線等因素導(dǎo)致周圍的居民和公眾對(duì)工程進(jìn)展造成影響，發(fā)包人應(yīng)當(dāng)及時(shí)采取合理措施對(duì)施工場(chǎng)地周圍的居民和公眾進(jìn)行協(xié)調(diào)并在必要時(shí)支付補(bǔ)償金。7.1.14Forthepurposeofavoidanceofnoise,vibration,lightandotherfactorsarisingfromoroutofnormalconstructioncausingthesurroundingresidentsandthepublictoaffecttheprogressoftheWorks,theEmployershalltakereasonablemeasureswithoutdelaytocoordinateand,ifnecessary,paycompensationtotheresidentsandthepublicaroundtheconstructionsite.7.1.15在承包人按照合同實(shí)施完成本工程達(dá)到實(shí)際竣工的標(biāo)準(zhǔn)，并辦理本工程相關(guān)竣工驗(yàn)收手續(xù)后，發(fā)包人應(yīng)當(dāng)接收承包人交付的工程及現(xiàn)場(chǎng)。7.1.15TheEmployershalltakedeliveryoftheWorksandtheSitefromtheContractoruponcompletionoftheWorksbytheContractor

應(yīng)當(dāng)按照合同文件約定的工作內(nèi)容和施工進(jìn)度要求，編制施工組織設(shè)計(jì)，并對(duì)整個(gè)現(xiàn)場(chǎng)的施工組織和施工方案的適用性、完備性和安全可靠性全面負(fù)責(zé)。8.1.7Theconstructionorganizationdesignshallbepreparedinaccordancewiththeworkcontentandconstructionschedulerequirementsspecifiedinthecontractdocumentsandshallbefullyresponsibleforthesuitability,completenessandsafetyandreliabilityoftheconstructionorganizationandconstructionprogramforthewholesite.13.4進(jìn)度報(bào)告13.4.Progressreport13.4.1除非合同文件另有約定，承包人應(yīng)當(dāng)在合同履行期間，按照監(jiān)理人要求的時(shí)間間隔和內(nèi)容，及時(shí)提交工程的進(jìn)度報(bào)告與進(jìn)度圖片，記錄工程的每日進(jìn)展或階段進(jìn)展，其相應(yīng)費(fèi)用已包含在合同價(jià)款中。13.4.1UnlessotherwisespecifiedintheContractdocuments,theContractorshall,atsuchintervalsandinsuchdetailastheSupervisormayrequireduringtheperformancehereof,submittheprogressreportsandprogresspicturesoftheWorks,recordthedailyprogressorprogressinstagesoftheWorks,thecorrespondingcostsofwhichhavebeenincludedintheContractPrice.13.4.2進(jìn)度報(bào)告的格式和內(nèi)容應(yīng)當(dāng)獲得監(jiān)理人的同意，內(nèi)容可包括：（1）每一階段的工程進(jìn)展情況的照片與詳細(xì)說(shuō)明；（2）反映工程進(jìn)展情況的任何必要的圖表；（3）主要材料和工程設(shè)備的制造商名稱、制造地點(diǎn)、進(jìn)度百分比、以及運(yùn)達(dá)的實(shí)際日期或期望日期等；13.4.2TheformatandcontentoftheprogressreportshallbesubjecttotheSupervisor’sconsentandmayinclude:(1)PhotographswithdetaileddescriptionsoftheprogressoftheWorksateachstage.(2)AnynecessarydiagramsreflectingtheprogressoftheWorks.(3)Themanufacturer’snameofmajormaterialsandengineeringequipment,theplaceofmanufacture,thepe
