家用空調(diào)銷售安裝合同家用空調(diào)銷售安裝合同ContractforHomeAir-ConditionerSalesandInstallation甲方(銷售商)：__________（以下簡稱“甲方”）PartyA(Seller):_____________(hereinafterreferredtoas"PartyA")地址：_____________Address:______________聯(lián)系電話：_____________ContactNumber:_____________乙方（安裝商）:___________(以下簡稱“乙方”)PartyB(Installer):____________(hereinafterreferredtoas"PartyB")地址：_____________Address:_____________聯(lián)系電話：_____________ContactNumber:_____________鑒于甲方經(jīng)營家用空調(diào)產(chǎn)品銷售，并能提供產(chǎn)品的安裝服務(wù)，乙方有能力完成產(chǎn)品的安裝，雙方經(jīng)協(xié)商一致達(dá)成如下合同：WhereasPartyAspecializesinsellinghomeair-conditioningproductsandcanprovideinstallationservices,andPartyBiscapableofcompletingtheinstallationoftheproducts.Thetwopartieshavereachedthefollowingagreementthroughnegotiation:一、合同產(chǎn)品1.ContractProducts甲方向乙方銷售家用空調(diào)產(chǎn)品，明確銷售數(shù)量、型號、售價(jià)及合同期限。PartyAsellshomeairconditioningproductstoPartyBandspecifiesthesalesquantity,model,price,andcontractperiod.二、安裝2.Installation乙方應(yīng)按照約定時(shí)間和安裝要求，完成甲方提供的家用空調(diào)產(chǎn)品的安裝服務(wù)。安裝時(shí)間為____________(具體時(shí)間)。PartyBshallcompletetheinstallationserviceofthehomeairconditioningproductsprovidedbyPartyAinaccordancewiththeagreedtimeandrequirements.Theinstallationtimeis____________(specifictime).三、責(zé)任和義務(wù)3.ResponsibilitiesandObligations3.1甲方的責(zé)任和義務(wù)3.1ResponsibilitiesandObligationsofPartyA(a)合法經(jīng)營：甲方保證所銷售的家用空調(diào)產(chǎn)品均為合法進(jìn)口或國內(nèi)生產(chǎn)的正品。Legaloperation:PartyAguaranteesthatthehomeair-conditioningproductssoldarelegitimateimportedproductsordomesticallyproducedgenuineproducts.(b)產(chǎn)品質(zhì)量：甲方應(yīng)保證所銷售的家用空調(diào)產(chǎn)品符合國家質(zhì)量標(biāo)準(zhǔn)要求，符合原廠技術(shù)規(guī)格，是能夠正常使用的產(chǎn)品。Productquality:PartyAshallguaranteethatthehomeairconditioningproductssoldmeetnationalqualitystandardsandOEMtechnicalspecificationsandareproductsthatcanbeusednormally.(c)保修與維護(hù)：在與甲方約定的質(zhì)保期內(nèi)，因產(chǎn)品質(zhì)量問題導(dǎo)致的故障，甲方應(yīng)選用合適的辦法予以保修或維修，并承擔(dān)相應(yīng)的責(zé)任。WarrantyandMaintenance:DuringthewarrantyperiodagreeduponwithPartyA,ifafaultoccursduetoproductqualityproblems,PartyAshalluseappropriatemethodstorepairormaintaintheproductandassumecorrespondingresponsibility.3.2乙方的責(zé)任和義務(wù)3.2ResponsibilitiesandObligationsofPartyB(a)安裝質(zhì)量：乙方應(yīng)按照行業(yè)標(biāo)準(zhǔn)要求，完好安裝甲方提供的家用空調(diào)產(chǎn)品。安裝完成后，乙方應(yīng)進(jìn)行技術(shù)檢測，確保產(chǎn)品的安裝質(zhì)量符合要求。Installationquality:PartyBshallinstallthehomeairconditioningproductsprovidedbyPartyAingoodconditioninaccordancewithindustrystandards.Aftertheinstallationiscompleted,PartyBshallconducttechnicaltestingtoensurethattheinstallationqualityoftheproductsmeetstherequirements.(b)安全保障：乙方應(yīng)嚴(yán)格遵守所有國家相關(guān)法律法規(guī)和相關(guān)政策，確保安裝工作安全，并遵守當(dāng)?shù)叵嚓P(guān)文化傳統(tǒng)和習(xí)慣。Safetyprotection:PartyBshallstrictlyabidebyallrelevantnationallaws,regulations,andpoliciestoensurethesafetyoftheinstallationworkandfollowlocalculturaltraditionsandcustoms.(c)維修服務(wù)：在約定的質(zhì)保期外，如因安裝不當(dāng)或操作不當(dāng)導(dǎo)致產(chǎn)品出現(xiàn)問題，乙方應(yīng)參考甲方提供的維修技術(shù)和配件規(guī)格解決問題，保障客戶的需要。MaintenanceServices:Ifaproblemoccursbecauseofimproperinstallationoroperationoutsidetheagreedwarrantyperiod,PartyBshallrefertotherepairtechnologyandsparepartsspecificationsprovidedbyPartyAtosolvetheproblemandmeettheneedsofcustomers.四、收費(fèi)方式4.PaymentMethod4.1甲方應(yīng)依據(jù)合同約定的售價(jià)要求乙方支付費(fèi)用。PartyAshallpaythefeestoPartyBbasedonthesalespricestipulatedinthecontract.4.2乙方的收費(fèi)標(biāo)準(zhǔn)應(yīng)合理、公開、透明，并應(yīng)依據(jù)實(shí)際應(yīng)收費(fèi)用開具專用發(fā)票。PartyB'schargingstandardsshallbereasonable,open,andtransparent,andaspecialinvoiceshallbeissuedbasedontheactualamountofthefeescharged.五、法律效力和可執(zhí)行性5.LegalEffectivenessandEnforceability本合同是在中國法律的保護(hù)下簽署，雙方本著平等、自愿、互利的原則達(dá)成的協(xié)議。合同生效后，如出現(xiàn)爭議或糾紛，應(yīng)協(xié)商解決，無法協(xié)商解決的，可通過法律途徑解決。ThiscontractissignedundertheprotectionofChineselaw,onthebasisofequality,voluntary,andmutualbenefit.Iftherearedisputesorconflictsafterthecontracttakeseffect,theyshallberesolvedthroughconsultation.Ifitcannotberesolvedthroughconsultation,itcanberesolvedthroughlegalmeans.六、違約責(zé)任6.BreachofContractLiability任何一方違反本合同約定，均應(yīng)承擔(dān)相應(yīng)的違約責(zé)任。Ifeitherpartyviolatestheprovisionsofthiscontract,itshallbearthecorrespondingbreachofcontractliability.七、其他條款7.OtherTerms對本合同未盡事宜，應(yīng)依照國家有關(guān)法律、法規(guī)的規(guī)定執(zhí)行。Anymattersnotcoveredinthiscontractshallbeexecutedinaccordancewiththerelevantlawsandregulationsofthecountry.八、合同的終止8.TerminationofContract在合同履行期限內(nèi)，雙方如需提前終止或解除本合同，應(yīng)提前諒解協(xié)商，并簽署書面解除協(xié)議。Duringthetermofthecontract,ifbothpartiesneedtoterminateorterminatethiscontractinadvance,theyshallnegotiateandreachawrittenterminationagreementinadvance.合同正本二份，甲、乙雙方各執(zhí)一份，具有同等效力。Twooriginalsofthecontractarevalid,withonecopyheldbyP
