2、作進(jìn)行指導(dǎo)、檢查和評(píng)估。 (三)向受聘方提供必要的工作和生活條件。 (四)配備合作共事人員。 (五)按時(shí)支付受聘方的報(bào)酬。 六、受聘方的義務(wù): (一)遵守中國(guó)的法律、法規(guī)，不干預(yù)中國(guó)的內(nèi)部事務(wù)。 (二)遵守聘方的工作制度和有關(guān)外國(guó)專(zhuān)家的管理規(guī)定，接受聘方的工作安排、業(yè)務(wù)指導(dǎo)、檢查和評(píng)估。未經(jīng)聘方同意，不得兼職。(三)按期完成工作任務(wù)，保證工作質(zhì)量。(四)尊重中國(guó)的宗教政策。不從事與身份不符的活動(dòng)。(五)尊重中國(guó)人民的道德規(guī)范和風(fēng)俗習(xí)慣。七、合同的變更、解除和終止: 雙方應(yīng)信守合同，未經(jīng)雙方一致同意，任何一方不得擅自變更、解除和終止合同。 (一)合同的變更。經(jīng)當(dāng)事人雙方協(xié)商同意后，可以變更。在未

3、達(dá)成一致意見(jiàn)前，仍應(yīng)當(dāng)嚴(yán)格履行合同。 (二)合同的解除。經(jīng)當(dāng)事人雙方協(xié)商同意后，可以解除合同。在未達(dá)成一致意見(jiàn)前，仍應(yīng)當(dāng)嚴(yán)格履行合同。 1、聘方在下述條件下，有權(quán)以書(shū)面形式通知受聘方解除合同： (1)受聘方不履行合同或者履行合同義務(wù)不符合約定條件，經(jīng)聘方指出后，仍不改正的; (2)根據(jù)醫(yī)生診斷，受聘方在病假連續(xù)30天后不能恢復(fù)正常工作的。 2、受聘方在下述情況下，有權(quán)以書(shū)面形式通知聘方解除合同:(1)聘方未接合同約定提供受聘方必要的工作和生活條件; (2)聘方未按時(shí)支付受聘方報(bào)酬。 3、當(dāng)事人一方要求解除合同，應(yīng)提前30天以書(shū)面形式向另一方提出，30天以后方可解除合同。 4、雙方協(xié)商一致，可以

4、解除合同。 (三)合同的終止。 1、合同期滿該合同即告終止。 2、經(jīng)當(dāng)事人雙方協(xié)商同意后，也可以終止該合同。在未達(dá)成一致意見(jiàn)前，仍應(yīng)當(dāng)嚴(yán)格履行合同。 八、違約金: 當(dāng)事人一方不履行合同或者未完全履行合同所規(guī)定的義務(wù)，即為違反合同，應(yīng)當(dāng)向另一方支付800一3000美元或相當(dāng)于受聘方月工資3到-10倍數(shù)額人民幣的違約金。如雙方認(rèn)為有必要約定確切數(shù)額或更高或更低的違約金，應(yīng)當(dāng)在合同附件中寫(xiě)明。 受聘方因不可抗力事件要求解除合同，需出具有關(guān)機(jī)構(gòu)證明。經(jīng)聘方同意解除合同后，受聘方離華的費(fèi)用自理;受聘方若無(wú)故解除合同，除離華費(fèi)用自理外，還應(yīng)當(dāng)向聘方支付違約金。聘方因不可抗力事件要求解除合同，經(jīng)受聘方同意解

5、除合同后，受聘方離華費(fèi)用由聘方負(fù)擔(dān);聘方若無(wú)故解除合同，除負(fù)擔(dān)受聘方離華費(fèi)用外，還應(yīng)當(dāng)向受聘方支付違約金。 九、本合同附件為合同不可分割的組成部分，與合同具有同等法律效力。 十、本合同自雙方簽字之日起生效，合同期滿即自行失效。 當(dāng)事人一方要求簽訂新合同，應(yīng)當(dāng)在本合同期滿30天前向另一 方提出，經(jīng)雙方協(xié)商一致同意后簽訂新的合同。 受聘方合同期滿后，在華逗留期間的一切費(fèi)用自理。 十一、合同爭(zhēng)議解決方式 當(dāng)事人雙方發(fā)生合同爭(zhēng)議時(shí)，盡可能通過(guò)協(xié)商或者調(diào)解解 決。若協(xié)商、調(diào)解無(wú)效，可向當(dāng)?shù)厝耸禄騽趧?dòng)仲裁機(jī)構(gòu)申請(qǐng)仲裁。對(duì)仲裁結(jié)果不服的，可向人民法院提起訴訟。 本合同于 年 月 日在 (地點(diǎn))簽字。合同一式

20、er it necessary to determine an exact sum of the breach penalty, or to determine a breach penalty higher and lower than the above-mentioned amount, it shall be explicated in the appendix of this contract.When Party B claims to cancel this contract due to force majeure, it shall produce certifying do

21、cuments issued by competent authorities; after the contract is cancelled with Party As consent, Party B shall bear the traveling expenses thus incurred; and when Party B fails to provide any valid reason to cancel this contract, it shall bear the traveling expenses thus incurred and pay the breach p

22、enalty to Party A as stipulated in this contract.When Party A claims to cancel this contract due to force majeure, and the contract is thus cancelled with Party B consent, it shall bear Party Bs traveling expenses thus incurred; and when Party A fails to provide any valid reason to cancel this contr
