6、ity and quantity guaranteed.3、甲方本著“1專多能、1職多崗”的用人原那么,可以根據(jù)經(jīng)營需要及乙方的工作能力調(diào)整乙 方的工作職務(wù)和崗位,乙方應(yīng)服從安排.Based on the principle of “one skill with multiple ability, one post with multiple work” , and according to the business demand and Party B s competence, Party A may adjust Party B s duty and post, while Party

7、B should obey the adjustment.3、勞動(dòng)保護(hù)和勞動(dòng)條件 Labor Protection & Labor Condition1、甲方根據(jù)國家有關(guān)安全生產(chǎn)、勞動(dòng)保護(hù)、職業(yè)衛(wèi)生的規(guī)定,為乙方提供必要的工作條件和 勞動(dòng)保護(hù)設(shè)施,保厚乙方的安全與健康;According to the related stipulation of safety manufacture/labor protection/occupational health from the state, Party A provides necessary working condition and labo

8、r protection facilities, insuring Party B s safety and health.2、甲方根據(jù)國家有關(guān)規(guī)定制定工時(shí)規(guī)章,乙方確因生產(chǎn)經(jīng)營需要延時(shí)的,甲方應(yīng)當(dāng)依法安排乙 方補(bǔ)休或支付相應(yīng)的加班費(fèi);假設(shè)乙方實(shí)行的是級別工資,那么在當(dāng)月的績效考核中表達(dá);According to the relevant regulations of working hour system,if Party B needs to extend the working hours due to the need of production and operation, part

9、y A shall arrange party B compensatory time off or pay overtime salary in accordance with the law; If party B is implemented wage levels, the compensation should be reflected in the performance appraisal for the month.3、甲方根據(jù)國家有關(guān)規(guī)定為孕期、產(chǎn)期、哺乳期的女職工提供勞動(dòng)保護(hù);Party A should provide protection for women worke

10、rs in pregnancy, childbirth, breastfeeding, in accordance with the relevant provisions of the State.4、甲方負(fù)有責(zé)任對乙方進(jìn)行政治思想、職業(yè)道德、業(yè)務(wù)技術(shù)、勞動(dòng)安全衛(wèi)生及有關(guān)規(guī)章規(guī)章 的告知、教育和培訓(xùn).Party A is responsible to provide political ideology, professional ethics, business technology, labor safety and hygiene, and related rules, educati

11、on and training for Party B.4、勞動(dòng)報(bào)酬 Labor remuneration根據(jù)“按勞分配”原那么,實(shí)行同工同酬,乙方的報(bào)酬不允許低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn),具體薪酬標(biāo) 準(zhǔn)、支付方式以及支付時(shí)間按公司制定的薪酬管控規(guī)章執(zhí)行.According to the principle of distribution, and equal pay for equal work, remuneration of Party B shall not be lower than the local minimum wage standard. 12、 standards, payment, and time is set by the “the system of compensation management by the company5、社會(huì)保險(xiǎn)協(xié)議Social Insurance甲方應(yīng)按照國家有關(guān)社會(huì)保險(xiǎn)協(xié)議的法律條文、法規(guī)和政策為乙方繳納基本養(yǎng)老、基本醫(yī)療、 失業(yè)、工傷、生育保險(xiǎn)協(xié)議費(fèi)用;社會(huì)保險(xiǎn)協(xié)議費(fèi)個(gè)人繳納局部,甲方從乙方工資中代扣代繳.In accordance with national laws, regulations and policies relating to social insurance, Party

16、tract.7、勞動(dòng)合同或者協(xié)議的變更The change of labor contract訂立本合同或者協(xié)議所依據(jù)的客觀情況發(fā)生重大變化,致使本合同或者協(xié)議無法繼續(xù)履行的, 經(jīng)雙方協(xié)商同意,予以變更勞動(dòng)合同或者協(xié)議相關(guān)內(nèi)容.If the objective situation this contract based on, changes significantly, to result the contract unable to perform, by mutual consent, related content in labor contracts shall be changed

17、.8、勞動(dòng)合同或者協(xié)議的解除The remove of labor contract(1)雙方協(xié)商1致,勞動(dòng)合同或者協(xié)議可以解除.The two party may terminate the labor contract with mutual agreement.(2)乙方有以下情形之1的,甲方可以即行解除勞動(dòng)合同或者協(xié)議:Of any of the following circumstances, party A may immediately terminate the labor contract.1、在試用期內(nèi)被證明不符合錄用條件的;Been proven not to meet

18、the conditions of employment during the trial period.2、采取欺詐 手段訂立 本合同 或者協(xié)議的;Adopted fraudulent means to enter into this contract.3、嚴(yán)重違背勞動(dòng)紀(jì)律或規(guī)章規(guī)章給甲方造成重大損害的;Seriously violated labor discipline or regulations to cause significant harm to the Party A.4、嚴(yán)重失職、營私舞弊,或泄露甲方商業(yè)秘密,給甲方利益造成重大損失的;Gross negligence, m

19、alpractice, or disclosure of trade secrets Party A, to cause heavy losses to the interests of the Party A.5、乙方同時(shí)與其他用人單位建立勞動(dòng)關(guān)系,對完本錢單位的工作任務(wù)造成嚴(yán)重影響,或者經(jīng)用 人單位提出才巨不改正的;Party A built labor relationships with other unit, to cause a serious impact on the completion of the tasks of the unit, or refused to corr

20、ect the rules made by the em ployer6、被依 法 追究刑 事責(zé)任 和義務(wù) 的.Be investigated for criminal responsibility according to law(3)有以下情形之1的,甲方可以提前30日以書面形式通知乙方解除勞動(dòng)合同或者協(xié)議:Of the following circumstances, Party A can give notice to inform Party B to terminate the labor contract ahead of 30 days.1、乙方不能勝任工作,經(jīng)培訓(xùn)或調(diào)整工作崗

21、位仍不能勝任工作的;Party B is not competent for work, after training or adjustment of jobs.2、乙方患病或者非因工負(fù)傷,醫(yī)療期滿后,不能從事原工作,也不能從事甲方另行安排工作的; Party B was ill or injured due to non-work relation, after completion of medical, Part A is not competent for his original work, or alternative arranged jobs.3、勞動(dòng)合同或者協(xié)議訂立時(shí)所依據(jù)

22、的客觀情況發(fā)生重大變化,致使勞動(dòng)合同或者協(xié)議無法履 行,雙方協(xié)商不能就變更勞動(dòng)合同或者協(xié)議達(dá)成合同或者協(xié)議的.If the objective situation this contract based on, changes significantly, to result the contract unable to perform, mutual consent can not be reached, in change of this labor contracts.(4)有以下情形之1的,甲方可以提前30日通知工會(huì),經(jīng)工會(huì)同意后,與乙方解除勞動(dòng)合同或者 協(xié)議:Of the follo

23、wing circumstances, Party A can give notice ahead of 30 days, to inform the Labor Union, after agreement, Party A may terminate the labor contract.1、甲方依照企事業(yè)單位破產(chǎn) 法規(guī)定進(jìn)行重整的;Party A restructured pursuant to the Enterprise Bankruptcy Law2、甲方生產(chǎn)經(jīng)營發(fā)生嚴(yán)重困難的;Production and business operation of Party A met ser

24、ious difficulties.3、甲方轉(zhuǎn)產(chǎn)、重大技術(shù)革新或者經(jīng)營方式調(diào)整,經(jīng)變更勞動(dòng)合同或者協(xié)議后,仍需裁減人員的; production, technological innovation or business method of Party A adjusted, after the change of labor contracts, still needed to reduce staff.4、其他因勞動(dòng)合同或者協(xié)議訂立時(shí)依據(jù)的客觀經(jīng)濟(jì)情況發(fā)生重大變化,致使勞動(dòng)合同或者協(xié) 議無法履彳亍的.If other objective situation this contract ba

25、sed on, changes significantly, to result the contract unable to perform.(5)乙方有以下情形之1的,甲方不允許解除勞動(dòng)合同或者協(xié)議:Of any of the following circumstances, party A can not terminate the labor contract.1、在本單位患職業(yè)病或者因工負(fù)傷并被確認(rèn)喪失或者局部喪失勞動(dòng)能力的;Injured due to occupational disease or work-related reasons, and was confirmed a

26、s having lost or partially lost the ability to work.2、患病或者非因工負(fù)傷,在規(guī)定的醫(yī)療期內(nèi)的;Illness or non-work related injury within the prescribed period of medical treatment.3、女職工在孕期、產(chǎn)期、哺乳期的;women workers in pregnancy, childbirth, breastfeeding.4、在本單位連續(xù)工作滿105年,且距法定退休年齡缺乏5年的;Worked continuously for 15 years and les

27、s than five years away from his legal retirement age In this unit.5、法律條文、行政法規(guī)規(guī)定的 其他情形.Other circumstances stipulated by laws and administrative regulations.(6)乙方解除勞動(dòng)合同或者協(xié)議,應(yīng)當(dāng)提前310日(試用期內(nèi)提前3日)以書面形式通知甲 方,甲方在乙方完成業(yè)務(wù)以及清理完債權(quán)債務(wù)的情況下,可以解除勞動(dòng)合同或者協(xié)議.Of the following circumstances, Party B shall give notice to in

29、;Party A forced Party A to labor by violence, threat or illegal restriction of personal freedom.3、甲方未按勞動(dòng)合同或者協(xié)議約定提供勞動(dòng)保護(hù)和勞動(dòng)條件的;Party A failed to provide the labor protection and labor conditions.4、甲方未按照勞動(dòng)合同或者協(xié)議的約定支付工資報(bào)酬的;Party A failed to pay wages in accordance with the labor contract.5、法律條文、行政法規(guī)規(guī)定勞動(dòng)

30、者可以解除勞動(dòng)合同或者協(xié)議的其他情形.Other circumstances stipulated by laws, administrative regulations by which employee may terminate the labor contract.9、勞動(dòng)合同或者協(xié)議的終止Termination of labor contracts(1)有以下情形之1的,勞動(dòng)合同或者協(xié)議即行終止:Of any of the following circumstances, the labor contract may be immediately terminate1、勞動(dòng)合同或者協(xié)

31、議期滿的;The labor contract expired.2、勞動(dòng)者開始依法享受養(yǎng)老保險(xiǎn)協(xié)議待遇的;Workers began to enjoy endowment insurance treatment lawfully.3、勞動(dòng)者死亡,或者被人民法院宣告死亡或者宣告失蹤的;Laborer died, or was declared dead or missing by the peoples court.4、甲方被依法宣告破產(chǎn)的;Party A was declared bankrupt by the peoples court5、甲方被撤消營業(yè)執(zhí)照、責(zé)令關(guān)閉、撤銷或者提前解散的;B

32、usiness license of Party B was revoked, ordered to close, cancellation or early dissolution of.JJ6、法律條文、行政法規(guī)規(guī)定的其他情形.Other circumstances stipulated by laws, administrative regulations.(2)乙方應(yīng)在勞動(dòng)合同或者協(xié)議期滿前30天通知甲方,甲方同意續(xù)訂,乙方應(yīng)及時(shí)申請辦理續(xù) 訂手續(xù);假設(shè)甲方不同意續(xù)訂,到期即辦理終止合同或者協(xié)議手續(xù).乙方未辦理終止合同或者協(xié)議手續(xù) 而離職的,甲方保存追究其法律條文責(zé)任和義務(wù)的權(quán)利.Pa

34、h of duty of the labor contract(1)貝宮償經(jīng) 濟(jì)損 失 Compensation for economic losses甲方有以下情形之1,給乙方造成經(jīng)濟(jì)損失的,應(yīng)當(dāng)承當(dāng)賠償責(zé)任和義務(wù):Of any the following circumstances, party A shall be liable for compensation of the economic losses of party B.1、由于甲方制定的勞動(dòng)合同或者協(xié)議條文無效的;Since Labor Party established the terms of the invalid co

35、ntract;2、違背勞動(dòng)合同或者協(xié)議法規(guī)定的條件解除勞動(dòng)合同或者協(xié)議的.Conditions in violation of the provisions of the Labor Contract Law “to terminate the labor contract.乙方有以下情形之1,給甲方造成經(jīng)濟(jì)損失的,還應(yīng)當(dāng)承當(dāng)賠償責(zé)任和義務(wù):Of any the following circumstances, party B shall be liable for compensation of the economic losses of party A.1、乙方違背勞動(dòng)合同或者協(xié)議法規(guī)定

36、的條件或者勞動(dòng)合同或者協(xié)議的約定解除勞動(dòng)合 同或者協(xié)議,給甲方造成經(jīng)濟(jì)損失的,應(yīng)當(dāng)按照損失的程度,承當(dāng)賠償責(zé)任和義務(wù);Party B violated the conditions in the Labor Contract Law or terminated the labor contract to cause the economic losses of party A, Party B shall be liable for compensation of the economic losses of party A.2、乙方違背勞動(dòng)合同或者協(xié)議約定的保密事項(xiàng),給甲方造成經(jīng)濟(jì)損失的,應(yīng)

37、當(dāng)依法承當(dāng)賠償責(zé) 任和義務(wù); Confidential matters Party violations of labor contract, causing economic losses to the Party shall be liable for compensation according to law.3、乙方在合同或者協(xié)議期內(nèi)嚴(yán)重違背甲方的有關(guān)規(guī)章規(guī)章、操作規(guī)程給甲方造成損失或致 甲方聘用的其他勞動(dòng)者人身損害的,由乙方根據(jù)責(zé)任和義務(wù)的大小負(fù)有責(zé)任賠償.In the contract period, if Party B caused serious violations of

38、relevant rules and regulations of the Party, procedures, or caused losses, or causes personal injury of other workers employed by the Party A. Party B shall pay compensation in accordance with the size of the responsibility.(2)違約金Penalty1、甲方為乙方提供專項(xiàng)技能培訓(xùn),乙方違背培訓(xùn)合同或者協(xié)議,須向甲方支付違約金;Party A shall provide sp
