2、手冊及其他禮品贈券 ）；3、會籍顧問將跟進會員簽收會員卡，并仔細講解、答疑會員對會員手冊 的閱讀。Naga Club Member Hand BookTERMS AND CONDITIONSThe following terms and conditions ( the Rules ) given the rights and obligations of NAGA CLUB and Members thereof.Effective Date: this hand book and all rules and regulations shall takesteffect as of 1 Ja

3、nuary, 2008.(In case of discrepancy between the English and Chinese versions, the Chinese versions shall prevail)DEFINITIONSManagement:NAGA CLUB, and its associated companies and authorized officers.Member:An individual or corporation who/which has applied and been accepted as a member of NAGA CLUB

4、to use the facilities, equipment and services provided by NAGA CLUB from time to time upon payment of the prescribed fees and in the case of a Corporate includes where applicable the nominees also.1. MEMBERSHIP AND FEES1.1 A person or corporation becomes a member of NAGACLUBby paying a joining fee a

5、nd monthly subscription fees as prescribed and completing the application form. The application must have been accepted by the management.1.2 Members must be at least 18 years old. In certain circumstances minors may be permitted only if accompanied by an adult at all times.1.3 Applications for memb

6、ership must be accompanied by payment of the prescribed fees. If the application is unsuccessful, members will be advised in writing within 14 days and the fees will be refunded in full, without interest.1.4 Upon acceptance, members will be issued with a membership card following which fees paid are

7、 non-refundable.1.5 Management may increase or reduce membership fees at any time. Such revisions may not be made retrospectivelywith regard to membership feesalready paid.1.6 The Management reserves the right to accept or refuse membership applications without assigning any reason whatsoever.2 Tran

8、sfer of Membership2.1 Any membership shall be allowed transferable except Resident memberships.2.2 No transfer of any membership shall be allowed except with the prior consent of the Club, which may be given or withheld at the absolute discretion of the Club and without prescribing any reasons there

9、fore. Although the consent of transfer on membership, the Club shall reserve the right to determine the condition on transfer, such as request the transferor:(a) A 30 days notice in writing of an application of transferring membership shall be given to the Club. All outstanding account incurred by t

10、he transferor shall be settled in full prior to the execution of transfer.(b) To provide the name of the transferee and all relevant information which demand by the Club.(c) To surrender the membership cards of transferor and his subsidiary members to the Club.2.3 The Club shall be entitled to charg

11、e a transfer fee, which is 15% of the difference between the new joining fee and the old joining fee.2.4 All transferee of Corporate Membership shall be legally registered and subsistence within the list of the Clubs recommended countries and states. In addition, the Club shall reserve the right to

12、request the transferee to produce all relevant information and evidence for the purpose of the transfer.2.5 No transfer fee shall be payable by a company which changed its name.It shall not be meant as Corporate Membership transferring. Nevertheless, the company shall inform the Club within 7 days a

13、bout its registered address or submit a copy of changing address document, which issued by government, and present a copy of (business license) under the name of the new company.3 Change of Nominated3.1 Upon retire, resign, be expelled or be fired of a nominated or Corporate Member, the Corporate Me

14、mber shall entitle to nominate another person as nominated Corporate Memberfrom time to time provided the Club shall approve the application. The Corporate Member shall pay a nominate fee to the Club which shall determine the amount of charges.3.2 Corporate Members may replace their nominees with pr

15、ior written approval of the Management and payment of the prevailing transfer fee (for one-month subscription). The Management reserves the right not to assign any reason whatsoever for refusing such approval.3.3 Corporate members are responsible for due observance of the rules, including liability

16、for payment of charges incurred and other monies due to NAGACLUBby its nominees. Its nominees are jointly and severely liable with the Corporate member for due observance of the rules,including liability for payment of charges incurred and other monies due to NAGA CLUB.3.4 Should a Corporate member

17、s nominee cease to be its employee, or when a Corporate member replaces any of its nominees, the Corporate member must in the former case immediately notify the management of the cessation and in both cases, return the nominee s membership card to the management. Pending the return of the nominee s

18、membership card, the Corporate member, together with the nominee continues to be jointly and severally liable for all charges incurred and all other monies due to NAGA CLUB by the nominee.4 Termination and inherit of Membership4.1 The Membership and all rights and legal heir of an Honorary Membersha

19、ll cease immediately and automatically Termination upon his death or bankruptcy.4.2 Upon death of an Member, his Membership shall be vested in his legalheir.His legal heir shallbe responsiblefor paying all hisoutstandingaccount tothe Club.Withouthis legal heir,hisMembership shallbe ceased immediatel

20、yand automaticallyTermination.4.3 Upon pronouncing of a companys commencement of liquidation, or individual bankruptcy, or setting up a payment agreement with creditor according to the ordinances, or be took over asset by creditor, or pronouncing offence, the member shall be revoked his Membership b

21、y the Club. The Member shall resume his Membership only in the case of his offence being revoked, or discharging his offence, or be pronounced invalid offence.4.4 Upon ceasing to be a Member, such Member shall no longer have any rights, benefits or privileges of membership and shall cease to be enti

22、tled to use the Club amenities and any of the Associate Clubs.5 Membership Suspension5.1 In the event that an memberwill be absent, he /she mayapply in writing to have his name on the absent list.5.2 For any membership has two time suspension privilege.Minimum and maximum suspension period is one mo

23、nth and three months respectively.5.3 Members are needed to bringMembership ReinstatementNotice and ID Card to reinstate membership .5.4 Membership will be effective automatically without further notice no matter members receive thisNotice or not when reach ReinstateDate.6 Resignation of Membership6

24、.1 A Member may resign from the Club by giving not less than 30 days advance written notice by registered post to the Club. The Members shall cease to be a Member of the Club as from the date specified in the notice of resignation, subject to payment by such Member of all Annual Membership Dues, and

25、 other fees and charges due up to the proposed date of resignation, and the return of his Membership card(s) to the Club.6.2 Resignation of a Corporate Member shall become effective only when all its nominees cease to have the right to use the Club.6.3 Upon resignation, such Member shall no longer h

26、ave any rights, benefits or privileges of membership and shall cease to be entitled to use the Club and any of the Associate Clubs.6.4 If any members resigned their membership, they must apply again and receive approval from the Club management in addition all terminated memberships must repay the J

27、oining fee and monthly dues.6.5 Membership fees (joining fee, administration fee and monthly subscription) are not refundable upon resignation or termination for whatever cause.7 Payment of Accounts7.1 All expenses incurred in the Club are paid in cash or by credit cards. If the members paid the dep

28、osit in the Club, they can sign the bill upon payment. Any cardholder whose balance is zero or less than the required amount must pay the balance by cash or credit card.7.2 Each Member shall receive an account from the Club containing a statement of the Monthly Dues or Annual Membership Dues. Each M

29、ember shall make payment upon presentation of such account. If any account or any part thereof remains outstanding for more than 20 days from the date of account statement, the Club may at its discretion levy a late charge. Such late charge may be levied on the amount outstanding from the date of th

30、e account until full payment is received by the Club. The Club may from time totime vary the rateof such charge. If any account shall remain outstanding for a period of 40 days from the date of account statement, the Club shall send notice thereof to the defaulting Member. If such default in payment

31、 shall not be remedied within 10 days from the date of such notice, the Club may post the name of such Member and amount due at the Club and/or suspend such Member from using the Club and all relevant benefits such as Associate Clubs until full payment of the outstanding account and the late charge

32、(if any) is received by the Club. If such payment is not received within 10 days from suchposting and/or suspension, the account is deemed to be delinquent and the Club may deny the relevant Member use of the amenities of the Club as the case may be, without prejudice to any other action it may wish

33、 to take with regard to such default in payment. The Club reserves the right to suspend or terminate their membership and their membership-joining fee shall be non-refundable.8 Guests8.1 Members can entertain any his guests at the Club, but the host Member shall accompany them. The names of visiting

34、 guests must be entered into the Clubs visitor s book, which must be countersigned by the host Member, and respective host Membersshall be fully responsible for all expenses incurred at the Club by their guests.8.2 Host Membersmust advise and ensure their guests to observe the Club Rules and Regulat

35、ions, and they shall be responsible for their guest s conduct, doings, costs, expense and liabilities done while they are at the Club.8.3 The Club reserves the right to reject Members guests enters atits absolute discretion and without giving any reasons.9 Alteration of Rules and RegulationsThe Club

36、 may from time to time alter, amend, modify, and add to, vary or replace these Rules and Regulations. The Manager shall notify Members of every such alteration in such manner as it may consider appropriate and every such alteration, amendment, modification, addition, variation or replacement shall t

37、ake effect on such date as the Club may prescribe.10 MANAGEMENT10.1 The management has sole responsibility for the management of NAGA CLUB and may withdraw or add to the benefits and privileges and use of the facilities and equipment, including adding further categories of members or admitting the p

38、ublic or persons who are not members upon such terms and conditions as the management may deem fit.10.2 The management has the right to refuse to admit and/or the right toremove any member (and/or his/her guest) who in the management sopinion, is likely to be or has in the pastbeen a nuisance to oth

39、ermembers or to their guests or is likely to cause or has committed a breach of these rules or the law of the land.It is a condition of membership that membership shall not confer on any member, and such member shall not acquire any right or interest in the premises, the fixtures, the equipment, the

40、 goods or whatsoever used by NAGA CLUB, or any part thereof.10.3 The management is entitled to revoke, cancel, or terminate the membership of any member by notice in writing if a member has committed breach of these rules. The member will not be entitled toa refund of the membership fee paid in the

41、event that his/her membership is terminated.10.4 Members should report and advise the Management in writing immediately of any loss or theft of their membership card and also of any change of address. A charge will be levied to cover the cost of issuing a new card.10.5 Members are required by the ma

42、nagement to produce their membership cards prior admission to NAGACLUB, and to register at the reception counter.11 EXEMPTION AND INDEMNITY11.1 The memberis aware that participation in a sport or physical exercise may result in accident or injury, and the member assumes the risk connected with the p

43、articipation in a sport or exercise and represents that the member is in good health and suffers from no physical impairment, which would prevent his/her use of NAGACLUBs facilities.11.2 The member acknowledges that NAGA CLUB has not and will not renderany medical services including medical diagnosi

44、s of member s physical condition. It is further agreed that all exercise including the use of weights, number of repetitions, and the use of any and all machinery, equipment, facility including lockers and apparatus designed for exercising whether defective or not shall be at member s sole risk, not

45、 withstanding any consultation on exercise programs which may be provided by NAGA CLUB employees. It is hereby understood that the selection of exercise programs methods and types of equipment shall be the member s respo nsibility, and NAGA CLUB shall not be liable to a member for any claims, demand

46、s, injuries, damages, or actions for negligence arising on account of death or due to injury, loss or damage to a members person or propertyarising out of or in connection with the use by a member of the services and facilities of NAGA CLUB, the premises or parking lot where the same is located and

47、a member hereby holds NAGA CLUB and its employees and agents harmless from all claims which may be brought against them by a memberor on a member s behalf for any such injuries or claims afore said.11.3 A membershall indemnify NAGACLUBfor all loss and /or damagehowsoever arising or caused (whether t

48、hrough negligence, misuse or otherwise howsoever) by premises and /or from the use of the facilities and/or equipment. A Corporate memberis jointly and severally liable together with its nominee with regard to the nominees obligations to indemnify NAGA CLUB under this rule.11.4 Members must keep the

49、 management, the owner, its servants or agents indemnified against all claims and demands of any guest of the member, which such guest may make, connected with any embarrassment, injury,NAGA CLUB.losses, or the guest s presence in11.5 NAGA CLUBalso closes any part of NAGACLUBat any time for maintena

50、nce or repair and charge for any damage caused through misuse or negligence.12 GENERALMember shall observe the Rules and Regulations to use the Club facilities.a. All membersmust possess a valid membership card and must present it when entering the Club or upon request. Failure to do so will result

51、in patrons being unable to use the facilities.b. Club membership cards are not transferable.c. Persons granted temporary privileges should be governed by the Rules and Regulations as if they were members.d. All members, guests and their drivers shall conform to the instructions of the parking lot at

52、tendants/security with regards to the parking of the vehicles on the club premises.e. Privately owned audio equipment (except personal audio equipment with headphones) is not permitted on the Club premises without the written consent from the Club management.f. The Club accepts a smart but casual dr

53、ess code. Casual dress shall mean informal attire that is clean, neat and in good taste. Unclean or unkempt personal appearance is unacceptable.g. No food or beverage may be brought into the Club premises for consumption.h. No pets of any description will be admitted inside the Club premises at any

54、time.i. Drivers and Service (Servants) are not allowed to use the club facilities and loiter inside the Club premises.j. Children under 12 must be accompanied by a responsible adult member at all times to use the Club facilities.k. Members shall not bring any advertising materials or other literatur

55、e to the Club for generaldistribution, except withthe prior written consent of the Management.l. No property of the Club shall be removed from the premises without the approval of the Club Manager.m. The Manager on Duty during operation hours will be available through contacting the Reception Counte

56、r.n. The management is not responsible or liable for the loss of valuables, injury or accidents that may occur while using the facilities. All persons using these facilities do so at their own risk.o. Members and guests will be held responsible for any damage to the club facilities.p. Villas is a pr

57、ivate property. Non-residents or landlords are prohibited to enter the villas. For any assistance, please contact the reception counter.q. NAGA CLUB shall be open daily at such other hours as the management may at its sole discretion decide.r. Members shall pay the charges (if any) for the use of ce

58、rtain facilities and/or services in NAGACLUB. All charges incurred shall be fully settled on the same day as such use or signed for in the case of signing rights, prior to the member sdeparture from NAGA CLUB premises.s. Each member may bring into NAGACLUBat any one time a maximum of three guests. The guests must be accompanied by such member, who shall be responsible for the fees for admission and other charges levied by THE Clubbing respect of such guests. Guest admission shall be subject
