6、n detail, and agrees to be bound by them:委托方在委托中國(guó)船級(jí)社（CCS）進(jìn)行船舶審圖時(shí)，接受該船舶所適用的本社入級(jí)規(guī)范以及其他有關(guān)規(guī)范或規(guī)則中的全部條款約束。When applying to China Classification Society (CCS) for plan approval, the applicant accepts to be bound by all the provisions as specified in the classification rules or other relevant rules or regul

7、ations of CCS applicable to the ship.在本社與委托人之間沒有其他合同時(shí)，本協(xié)議即為本社與委托方之間的合同。在本社與委托方就被委托船舶的檢驗(yàn)（包括審圖）簽有其他合同的，本協(xié)議各項(xiàng)內(nèi)容是CCS與委托方簽訂的有關(guān)合同的組成部分。本協(xié)議內(nèi)容與有關(guān)合同以及適用的入級(jí)規(guī)范、其他有關(guān)規(guī)范或規(guī)則有不一致的，在本協(xié)議的委托事項(xiàng)范圍內(nèi)，以本協(xié)議內(nèi)容為準(zhǔn)。Where no any other contract is signed between CCS and the applicant, the application constitutes the contract betw

8、een CCS and the applicant. Where CCS has signed any other contract with the applicant in respect of the survey of the ship (including plan approval), the contents of the application form an integral part of the relevant contract signed between CCS and the applicant. In the event of any conflict or i

9、nconsistency between the contents of the application and the relevant contract, applicable classification rules, or other relevant rules and regulations, the contents of the application shall prevail, so far as the items specified in the application are concerned.委托方應(yīng)按照本社的要求提供審圖所需的圖紙、報(bào)告、文件、資料以及其他信息，

10、并對(duì)所提供圖紙、報(bào)告、文件、資料以及其他信息的真實(shí)性、及時(shí)性和完整性負(fù)責(zé)。The applicant shall submit to CCS plans, reports, documents, data and other information necessary for plan approval in accordance with the requirements of CCS and shall be responsible for the truthfulness, timeliness and completeness of such plans, reports, docum

11、ents, data and other information.委托方應(yīng)根據(jù)上述信息參數(shù)所適用的本社規(guī)范及船旗國(guó)政府的要求（公約、法規(guī)等）進(jìn)行設(shè)計(jì)及必要的計(jì)算，并提交審圖。承諾建立適當(dāng)?shù)馁|(zhì)保體系，以保證船舶和產(chǎn)品的設(shè)計(jì)質(zhì)量。The applicant shall carry out design and necessary calculations, in accordance with CCS rules and the requirements of the government of the flag State (conventions and regulations etc.) a

12、pplicable to the above information, and submit them for plan approval. The applicant undertakes to establish an appropriate quality assurance system for the design quality of ships and associated marine products.本社入級(jí)規(guī)范、有關(guān)規(guī)范或規(guī)則對(duì)本社批準(zhǔn)圖紙有效性做出了規(guī)定，委托方在本協(xié)議中填寫的相關(guān)信息的變更可能導(dǎo)致CCS審批圖紙的失效。The validity of approved

13、plans is stipulated in classification rules of CCS, relevant rules or regulations. The approved plans may be invalidated due to any change of relevant information given by the applicant in the application.委托方應(yīng)為本社的審圖工作提供方便，保證支付本社由審查批準(zhǔn)圖紙產(chǎn)生的費(fèi)用，即使由于委托方撤回委托使此項(xiàng)審圖未能由完成，委托方也應(yīng)據(jù)已進(jìn)行的工作按比例向本社支付相應(yīng)的費(fèi)用。The applica

14、nt shall facilitate CCS in plan approval and undertake to pay fees arising from plan approval. In case of the plan approval not being finished due to withdrawal of the application by the applicant, the applicant shall pay on pro rata basis for the service provided.本審圖服務(wù)產(chǎn)生的任何文件的內(nèi)容僅限委托方使用。委托方應(yīng)對(duì)本中心提供的文

15、件和信息給予保密，未經(jīng)本中心書面同意，不得向船舶所有人、船舶設(shè)計(jì)方、船舶制造方以外的其他方透露。如其他方接受本審圖服務(wù)產(chǎn)生的文件的內(nèi)容導(dǎo)致的任何損害或損失，本社概不負(fù)責(zé)。The contents of any document produced during the plan approval service shall be only available to the applicant, who shall keep confidential the documents and information provided by the Center and shall not disclos

16、e them to any party other than the shipowner, ship designer and shipbuilder without written permission from the Center. CCS will not be liable for any damage or loss due to accepting such documents by any other party.本社對(duì)因委托方或他人的過錯(cuò)造成的損失不負(fù)責(zé)。如委托方同時(shí)委托本社和其他船級(jí)社審圖，并要求本社接受其他船級(jí)社的審圖意見時(shí)，本社不對(duì)所接受的其他船級(jí)社的審圖意見的準(zhǔn)確性負(fù)

17、責(zé)。如依法判定委托方所遭受的損失或損害確由本社或本社雇員、代理人或本社其他代表方的疏忽行為造成的，本社將承擔(dān)責(zé)任，并將支付賠償其直接損失費(fèi)用，但此賠償?shù)臄?shù)額不超過該項(xiàng)服務(wù)收費(fèi)的2倍，且最大不超過人民幣80萬元。CCS will not be liable for any loss due to any error of the applicant or any other person. Where the applicant applies to CCS and any other classification society for plan approval at the same ti

18、me and requires that CCS accept the comments of the other classification society, CCS will not be liable for the accuracy of such comments. CCS will be liable for the loss or damage sustained by the applicant due to any negligent act judicially attributed exclusively to CCS or its employees, agents

19、or other parties acting on behalf of CCS and will pay compensation to the applicant for its proved loss. And in no case shall the amount of this liability exceed two times the fee(s) charged by CCS in respect of the service(s) in question or 800,000 RMB in maximum.本協(xié)議適用中華人民共和國(guó)法律。除與本社另有約定外，凡因本社入級(jí)服務(wù)有關(guān)

20、的任何爭(zhēng)議，均應(yīng)提交中國(guó)海事仲裁委員會(huì)，按照委托仲裁時(shí)該會(huì)現(xiàn)行有效的仲裁規(guī)則進(jìn)行仲裁。仲裁裁決是終局的，對(duì)雙方均有約束力。The laws of the Peoples Republic of China shall apply to the application. Unless otherwise agreed with CCS, any dispute of whatsoever nature in respect to the classification service provided by CCS shall be referred to China Maritime Arbit

21、ration Commission and arbitrated in accordance with its arbitration rules effective at the time of request for arbitration.
