16、遵守中國所有相關(guān)法律要求,并全面符合中國健康安全環(huán)境標(biāo)準。This Employee Manual (Manual for short) is based on the Chinese Law and its relevant regulations. Gestamp Metal Forming (Wuhan) Ltd. is fully committed to follow all legal labor requirements, and fully comply with Chinese health.適用范圍 Application Scope本手冊就海斯坦普金屬成型(武漢)有限公司

17、(以下簡稱“海斯坦普武漢公司”或公司)的勞動條件及公司員工(以下簡稱“員工”)的工作職責(zé)做出規(guī)定。其他未在本手冊里規(guī)定的事宜應(yīng)按照海斯坦普武漢公司和員工簽訂的書面勞動合同的條款執(zhí)行。海斯坦普武漢公司的員工應(yīng)遵守本手冊。This Employee Manual regulates the employment conditions and job responsibilities of employees of Gestamp Metal Forming(Wuhan)Ltd. (GMF WUHAN or Company for short). The Employee Manual is the

18、 basis of employment at GMF WUHAN. Additional and individual conditions are agreed upon in he written labor contract signed between the Company and every employee. All employees of GMF WUHAN must obey these rules.雇傭程序Employment根據(jù)中國法律規(guī)定,海斯坦普武漢公司作為一家外商獨資企業(yè)擁有其相關(guān)的管理權(quán)限。公司有權(quán)按中國勞動法自行聘用和解雇員工或終止勞動合同。Accordin

19、g to relevant Chinese Legislation, as a wholly-foreign owned enterprise, GMF WUHAN enjoys certain management rights. The Company has the right to employ and dismiss employees or terminate their labor contracts, restricted only by the Chinese labor law. 公司員工數(shù)及其任職要求由公司根據(jù)公司業(yè)務(wù)發(fā)展需要決定。According to the com

20、panys business and development, the management determines the number of employees and their required qualifications.試用期 Probation period試用期根據(jù)具體情況為1-6個月(根據(jù)勞動合同約定)。試用期屆滿,由員工上級完成試用期回顧并給予反饋。The probation period is 1 to 6 months, according to the individual situation (Based on labor contract). At the end

21、 of the probation period, the superior of this employee will review the probation development and provide feedback.公司應(yīng)與每位員工簽訂個人勞動合同。The Company signs an individual labor contract with every employee.公司每年將免費給員工提供一次健康體檢服務(wù)。The Company will provide the employee a free medical check every year.員工需在上崗第一天提

22、交下列文件的復(fù)印件一份;同時需查驗原件。如果沒有原件,需要提交經(jīng)證明核準的復(fù)印件。Employees must submit the following items to GMF WUHAN at the 1st day of work. Documents must be presented in original and 1 copy. In cases where original documents are not on hand, certified copies must be presented.a) 與先前公司解除勞動合同的文件;A document confirming th

23、e termination of the labor contract with the previous company;b) 下列證書原件及復(fù)印件:學(xué)位證書、畢業(yè)證書、職業(yè)資格證書、特殊工種的操作證書、技術(shù)等級證書、外語等級證書、前公司公積金證明等;公司有權(quán)對證書進行核實;Certificates and its certified copies of the following documents: education or graduation certificates, employment certificates , specific machine operating cert

24、ificates and technical skills certificates,foreign language certificates,housing fund information; The Company has right to check the authenticity of these certificates.c) 一份身份證或護照復(fù)印件;A passport or ID card photocopy;d) 體檢報告Health report;e) 在海斯坦普武漢公司任職時或在海斯坦普武漢公司任職前,海斯坦普武漢公司可能要求的其他信息或文件。GMF WUHAN may

25、 request any other messages and documents before or during the employment of the employee.f) 根據(jù)需要將人事檔案轉(zhuǎn)到“武漢光谷人才服務(wù)中心”的公司人事代理專戶下。Transfer the official personnel registration record to Wuhan East Lake HR Service Centre with the support of the Companys HR Dept if necessary.海斯坦普武漢公司會根據(jù)個人數(shù)據(jù)保護規(guī)定及公司員工個人檔案管理

26、的有關(guān)規(guī)定來負責(zé)收集、保持、處理和使用員工的個人資料。個人數(shù)據(jù)的收集權(quán)限于合法的以及與員工的聘用相關(guān)的目的,直接主管、部門經(jīng)理、總經(jīng)理有權(quán)了解這些資料。海斯坦普武漢公司將采取一切實際可行的措施以保證員工個人資料的安全性,并防止未經(jīng)授權(quán)的人員接觸,銷毀或使用這些資料。GMF WUHAN will file, keep, handle and use the employees personal information according to the document management rules and privacy protection regulation. The right to

27、 compile individual statistics is restricted by the law and can only be for purposes related to employment. Direct Supervisors, Department Managers and the General Manager have the right to see some of those documents. GMF WUHAN takes all the necessary measures to protect individual information and

28、prevents unauthorized persons from accessing, removing or using this information.本手冊將提供給員工每人一份。A copy of this manual is handed to every employee.每位員工應(yīng)將下列任何事項的變動, 提交書面證明文件給人力資源部以更新員工信息:In case any of the following conditions change, the employee should inform HR department of the change by submitting

29、 relevant documents:a) 合法送達地址;Legal contact address;b) 教育程度、資歷證明;Level of education and qualification;c) 姓名;Surname and given name;d) 婚姻狀況;Marriage status;e) 其它重要個人資料或事宜。Other important personal issues.員工辭職(退)程序Procedure of leaving the Company3.1員工提出離職,須提前三十日以 HYPERLINK /view/1015221.htm 書面形式通知公司。試用

30、期內(nèi)的員工提出離職,須提前三日以書面形式通知公司。Anemployeemay terminate his employment contract upon 30 days prior written notice to the company. During his probation period, an Employee may terminate his employment contract by giving the company three days prior notice.3.2如果員工離職,無論任何原因(勞動合同到期、員工提出或公司提出解除勞動合同)都必須履行正常的離職手續(xù)

31、,包括把與工作相關(guān)的文件(含電子文件)上交給他/她的上司,歸還公司的物品(手機、電腦、文具、洗凈的工作服、勞保用品、工具等),并向他/她的上司或被上司指定的同事說明工作的進展?fàn)顩r。離職前確保所有交接工作完成,在完成程序的同時,填寫離職流程表,取得相關(guān)人員及經(jīng)理的簽字同意,公司才為其辦理其他離職手續(xù)。If an employee leaves the Company, no matter for what reason (e.g. expiration of labor contract, notice by the employee or by the Company to terminate

32、 the contract), he or she has to complete the proper leaving procedures. These include handing over all work-related documents (including electronic documents) to his or her superior, returning all Company objects that he or she may have used during work (e.g. mobile phone, computer, stationary, the

33、 washed work uniform, safety items, tools etc.), and explaining the status of his or her work to his or her superior or a colleague designated by the superior. A proper and complete handover to a colleague or superior is an important matter when terminating the employment. After completing all these

34、 procedures, the employee should fill in and sign the Leaving Employee Checklist and submit it for approval by signature to his superior and relevant manager. Then Company can deal with the leaving procedures.勞動合同Labor Contract本手冊任何一條規(guī)定,如果與員工和海斯坦普武漢公司之間勞動合同不一致或有沖突,所涉及的員工的事宜應(yīng)該遵照或服從勞動合同的條款執(zhí)行。If there

35、is a conflict between any of these rules in this manual and the labor contract signed between GMF WUHAN and the employee, the issue shall be handled according to the individual labor contract.公司規(guī)定Company Regulations員工必須遵守海斯坦普武漢公司的規(guī)定,聽從上級管理人員的工作要求,盡職盡責(zé)。The employees must obey the company regulations,

36、 follow the instructions and orders of their superiors, and fulfill their duties and responsibilities as best they can.上級管理人員必須正直地履行他們的職責(zé),以寬厚和指導(dǎo)的方式領(lǐng)導(dǎo)其下屬。Superiors must fulfill their responsibilities in a fair manner, manage their subordinates in an honest and kind way and provide guidance to them.遵守

Personal benefit comes after the Companys benefit.在履行職責(zé)時,員工應(yīng)尊重海斯坦普武漢公司的政策,相互協(xié)作,積極努力推動業(yè)務(wù)順利進行。When carrying out their duties, employees should resp

44、ect GMF WUHANs policy, support each other, and do their best to facilitate the successful development of the business.不要做有損海斯坦普武漢公司的榮譽和信譽的事情。Not do anything that might damage the reputation and credit of GMF WUHAN.不要在授權(quán)之外武斷專行。每位員工的授權(quán)范圍在其工作范圍及核準的技能中做了界定。Not do anything they are not authorized to do.

45、The authorization scope of every employee is described in his job scope and approved skill level. 每位員工應(yīng)遵守商業(yè)事務(wù)絕對保密的規(guī)定。合同、圖紙等只可以在相關(guān)上級管理人員允許的情況下復(fù)印。不要透露公司商業(yè)機密或任何可能損害海斯坦普武漢公司的其他事情。Every employee shall respect the rule that business issues are strictly confidential. Documents such as contracts and drawing

46、s may only be copied with the relevant superiors permission. Do not disclose any confidential information on the Company or anything that might harmGMF WUHAN.除非與海斯坦普武漢公司的工作有關(guān),否則在私人交易中不許使用海斯坦普武漢公司的名字。Apart from carrying out official GMF WUHAN work, the employee is not allowed to use GMF WUHANs name f

47、or personal financial transactions.未經(jīng)海斯坦普武漢公司允許,不得從海斯坦普武漢公司的商業(yè)聯(lián)系人處接受金錢或向他們借錢;對于禮物,必須拒絕或退回,除非價值很小,不影響員工遵從海斯坦普的經(jīng)營目標(biāo)及道德標(biāo)準Without the permission of GMF WUHAN, the employee is not allowed to accept monetary gifts or borrow money from business contact people of GMF WUHAN. The employee has to reject or ret

48、urn presents, except when they are of small value and do not harm the employees loyalty to Gestamps business goals and ethical standard.未經(jīng)上級管理人員批準,不許在工作時間離開工作場所。Except with the permission of the superior, the employee is not allowed to leave the work place during working hours.未經(jīng)海斯坦普武漢公司的允許不得以雇員、承包商

49、、管理人員或董事的名義為其它公司工作,也不允許從事可能影響海斯坦普武漢公司利益的私人業(yè)務(wù)。只有在公司事先允許的情況下,員工才能從事私人業(yè)務(wù),第二份職業(yè),或任何形式的其他業(yè)務(wù)。Without the permission of GMF WUHAN, the employee must not work for other companies pretending to act on behalf of business partners, contractors, the management or directors of GMF WUHAN. The employee must not en

50、gage in personal business that might have an impact on GMF WUHANs benefits. An employee is only allowed to have a private business, secondary employment or ownership of any kind in another business if it has been permitted by the company. 保持工作場所整潔有序,盡力防止偷盜、火災(zāi)或其它損失,遵守有關(guān)衛(wèi)生安全規(guī)定。The work place has to be

51、 kept clean and tidy. The utmost has to be done to prevent theft, fire, or other damages. The hygiene and safety regulations have to be respected.保護好設(shè)施和裝備以及其它海斯坦普武漢公司的財產(chǎn)、節(jié)約用水、電和文具用品等。Protect the facilities, equipment and other possessions of GMF WUHAN. Do not waste water, power or stationary etc.雇員不

52、得在工作場所飲酒或濫用其他藥物;并不得在醉酒或處于任何其它藥物控制情況下開展工作。操作員工不允許在工位因個人目的使用手機。Employees are not permitted to consume alcohol or abuse other substances at the work place, and must not carry out their tasks when they are drunk or under the influence of any other drug / substance. The personal use of mobile phone is fo

53、rbidden in shopfloor workstation.員工有什么抱怨,可以向上級管理人員或海斯坦普武漢公司總經(jīng)理申述。If employees have any complaints, they can appeal to their superior or the General Manager of GMF WUHAN.任何盜竊,損害公司財產(chǎn),工作場所使用暴力,參與暴動的行為都需要承擔(dān)相應(yīng)的損失賠償,嚴禁未經(jīng)允許進行大規(guī)模集會,違反將可能導(dǎo)致其雇傭關(guān)系的終止。Theft, damage of company property, engaging in physical viol

54、ence, participating in riots, organizing large meeting in the company without permit, will trigger compensation claims and possible dismissal.出勤Attendance工作時間 Working Hours公司應(yīng)該根據(jù)中國政府有關(guān)工作時間的規(guī)定,設(shè)立基本工作周的工作時間以達到充分的生產(chǎn)能力。The Company determines the working hours of the regular working week so that optimum

55、production capacity is achieved. The working hours must be in line with the relevant regulations of the Chinese Government.如無特殊原因,正常工作時間為每周40 小時,生產(chǎn)部員工的正常班次工作時間根據(jù)生產(chǎn)部的具體安排。工作時間始于員工開始正式工作(勞保用品,工作服穿戴完畢),工作時間結(jié)束于員工離開工作崗位。更換衣服,個人衛(wèi)生,休息時間不視作工作時間。The normal working hours of staff and workers related to produc

56、tion are 40 hours a week. For the actual shift schedule refers to the plan of the production department. The work time starts when the employee is ready to carry out his/her task, i.e. fully dressed in work uniform including necessary PPE. The work time ends when the employee leaves his/her job posi

57、tion and intends to terminate work for the day. Time spent in the company for changing clothes, personal hygiene or rest are not work time.如遇特殊情況,如電力供應(yīng)不足,公司將臨時調(diào)整所有員工的工作時間,包括周末工作。In the event of exceptional circumstances, such as power shortage, the working hours of all employees can be temporarily a

58、djusted accordingly, including work at the weekend.根據(jù)生產(chǎn)經(jīng)營的需要或因為不可控情況,在遵守勞動法的前提下,公司可以改變部分或全部員工的工作時間表,包括周末工作。變動之后的工作時間表應(yīng)成為員工正常的工作時間。If required by production needs or when uncontrollable circumstances occur, the company can change the time schedule of part of or all of the employees at any time, inclu

59、ding work at the weekend, in line with the Labour Law. In this case, the changed working time schedule becomes the regular working schedule of the employees.加班程序 Overtime procedures公司可以按勞動法的相關(guān)規(guī)定與員工協(xié)商之后延長工作時間或加班。 除非雙方另行書面同意,海斯坦普武漢公司應(yīng)根據(jù)中國相關(guān)法律補休或支付加班工資,補償方式由海斯坦普武漢公司決定。According to the relevant regulati

60、ons of the Labour Law, the Company can extend the working hours or arrange overtime after consulting with the employees. Except when a written agreement exists between the Company and the employee, GMF WUHAN compensates overtime by time off on another day, or by paying overtime compensation. GMF WUH
