1、甲方:體育局 Party A: Sports Admini strati on Bureau乙方:承包方 Party B: Con tractor第一條承包項(xiàng)目 The Item of Con tract本合同約定承包經(jīng)營(yíng)的 游泳館座落在,游泳館建筑面積約3895 平方米(含所有附屬用房,以本合同所附甲方加蓋公章的平面圖為準(zhǔn))。The swimmi ng pool being con tracted for man ageme nt herein is located at , with_ the con struct ionarea is about 3895 square meters i
2、n cludi ng all an cillary buildi ngs, subject to the plan with party A s official seal.第二條承包經(jīng)營(yíng)期限 The Term limited of Contracting Management游泳館的承包經(jīng)營(yíng)期限為 9 年,自起至止,期滿(mǎn)后在同等條件下乙方可以?xún)?yōu)先 續(xù)簽。The term limited of con tract ing man ageme nt of swimmi ng pool is nine (9) years.On the expirati on Party B shall have
3、priority to renew this con tract un der thesame con diti on and terms.第三條租金交付 The Payme nt of Rent游泳館承包經(jīng)營(yíng)期間,前三年免繳租金,乙方從起開(kāi)始向甲方繳納租金,每年繳納租金 15 萬(wàn)元。租金于每年_月_日之前一次性繳清。(上述承包經(jīng)營(yíng)期以實(shí)際交付日 期為準(zhǔn))The first three years within the term limited hereof will be free of rent. The rent shall be paid by party Bfromat the an
4、nual rent of $ 150,000 which being made in alump sum on or before. (The above term of con tract ing operati ons will besubject to the actual delivery date)第四條 甲方的責(zé)任和義務(wù) The respo nsibilities and obligati ons of Party A1、負(fù)責(zé)游泳館及附屬用房的水、電、通訊、空調(diào)和水加溫等設(shè)施配套到位并安裝好計(jì)量表(附資產(chǎn)明細(xì)表)。Responsible for the installation o
5、f compounded equipments such as water, electricity, communications,from _toair conditioning, water heating facilities and the measure meters in swimming pool and ancillary building.2、運(yùn)行二個(gè)月內(nèi),確保游泳館及附屬用房的房屋及設(shè)備正常運(yùn)作。Within the two months of operation of management party A shall ensure the normal operatio
6、n ofbuildings of swimming pool, ancillary houses and equipments.3、積極鼓勵(lì)和協(xié)調(diào)各中小學(xué)校開(kāi)設(shè)游泳課,把游泳館建成學(xué)生的教育活動(dòng)基地。Encourage and coordinate actively setting up swimming lessons in schools and enable the swimmingpool as the educational activities beyond school.4、本合同期限屆滿(mǎn)或終止,在結(jié)清全部租金、各項(xiàng)費(fèi)用和可能發(fā)生的滯納金、違約金、 賠償金后一個(gè)月內(nèi),將履約保證金
7、返還乙方(不計(jì)利息或補(bǔ)償)。The performance bond will be returned to Party B without interest or other compensation within onemonth after the settlement of all rent, fees and maybe late fees, liquidated damages and compensationsupon the expiration or termination of the term of this contract.第五條 乙方的責(zé)任和義務(wù) Responsib
8、ilities and Obligations of Party B1、在承包經(jīng)營(yíng)過(guò)程中必須遵守國(guó)家有關(guān)法律法規(guī),做到依法經(jīng)營(yíng),自覺(jué)接受相關(guān)職能 部門(mén)的監(jiān)督管理,維護(hù)游泳館的對(duì)外形象。在承包經(jīng)營(yíng)過(guò)程中不得轉(zhuǎn)包和改變游泳館 及附屬用房的體育功能。Party B should, duration of contracting, comply with the relevant laws and regulations of State and dooperation in accordance with laws, accept consciously the supervision and ma
9、nagement of the authoritydepartments and maintain the reputation of the swimming pool. The transfer contracting of and/ orchange of the sports function of pool and ancillary houses therewith shall be under prohibition.2、承包經(jīng)營(yíng)游泳館及附屬用房的一切經(jīng)濟(jì)、法律和安全的責(zé)任均由乙方承擔(dān),所涉的 稅收、規(guī)費(fèi)等亦由乙方負(fù)責(zé)繳納。The liabilities and responsi
10、bilities of any and all economic, legal and security related to contractingmanagement of swimming pool and ancillary spaces and all tax and fees shall be responsible for thepayment by Party B.3、承包經(jīng)營(yíng)游泳館及附屬用房期間,必須有明確的救生安全等責(zé)任措施,對(duì)游泳館工 作人員和顧客的安全負(fù)全責(zé)。Party B should, In the term of contracting, made specifi
11、c measures related to lifesaving and security andtaken any and all responsibilities of the safety of staffs and clients.4、承包經(jīng)營(yíng)游泳館及附屬用房期間,承擔(dān)游泳館及附屬用房設(shè)備的保養(yǎng)、維修、管理 和運(yùn)行的所有費(fèi)用并按規(guī)定及時(shí)支付。Party B should, In the term of contracting, born all fees relating to the maintain, repair, management andoperation of swimm
12、ing pool and ancillary spaces and effect in time the payment thereof.5、承包經(jīng)營(yíng)期間,游泳館每年開(kāi)放時(shí)間不少于240 天(含白天與晚上),每年根據(jù)甲方需要,向甲方無(wú)償提供使用游泳館 12 天(含白天與晚上);In the term of contracting the opening period of swimming poop shall not less than 240 days (includingday and night) each year and be offered in free to Party A
13、s using for 12 days (including day and night)each year.6、對(duì)學(xué)生訓(xùn)練應(yīng)積級(jí)配合并做好各方面的服務(wù)工作,費(fèi)用給予優(yōu)惠,具體收費(fèi)標(biāo)準(zhǔn), 甲乙雙方另行協(xié)商并報(bào)縣物價(jià)局核準(zhǔn)。對(duì)老年人、殘疾人應(yīng)按規(guī)定給予優(yōu)惠。The services of active cooperation of training and favorable charge shall be given to students, thescheme of fees thereof shall be negotiated separately by parties hereto a
14、nd applied to approve of theCounty Price Bureau. The favorable fee shall be give to the elderly and disable person in accordance ofthe regulations thereon.7、本合同簽訂后三十日內(nèi),即向甲方支付履約保證金人民幣十萬(wàn)元,該保證金可用于 清償可能積欠甲方的租金、各項(xiàng)費(fèi)用、滯納金、違約金、賠償金等。Party B should ,within 30 days upon signature of this contract, pay the secu
15、rity deposit of One Hundredthousand Yuan to Party A for the satisfaction of any sum of owed rent, fees of each item, late fee, breachfine and compensation.8、本合同期限屆滿(mǎn)或終止,須將承租的游泳館及附屬用房按可經(jīng)營(yíng)現(xiàn)狀完好地交還甲 方(其中乙方投入的不動(dòng)產(chǎn)歸甲方無(wú)償所有,可動(dòng)產(chǎn)歸乙方處置)。Party B should, upon the expiration or termination of this contract, deliver
16、 tenanted swimming pool andancillary space under the status in quo of operation to Party A among which real estate invested by PartyB shall be owned by Party A in free and movable property under the disposal of Party B.第六條 違約責(zé)任: Responsibility of Breach1、甲方無(wú)故干擾乙方正常營(yíng)業(yè),造成乙方較大損失的,視為甲方違約,乙方有權(quán)終止 本合同,并可按照
17、合同法追究甲方的經(jīng)濟(jì)責(zé)任。If, Party A s interference without reason to Party B s normal business andmaterial loss occurred therein, shall be deemed as Party A s breach, for which PartyB in entitle to terminate the contract and impose any liability upon the economic liability of Party A.2、有下列情形之一的視為乙方違約,乙方應(yīng)承擔(dān)相應(yīng)的違
18、約責(zé)任,甲方有權(quán)終止本合 同并沒(méi)收履約保證金。Party B shall be deemed as breach of agreement if in any of the following circumstances and assumecorresponding liability to which Party A is entitle to terminate the contract and forfeiture of performancebond.(1)乙方不支付租金或者延期支付租金達(dá)三十天以上的;Party B fails to effect the payment of re
19、nt more than 30 days.(2)乙方所欠費(fèi)用累計(jì)達(dá)五萬(wàn)元以上的;Accumulative sum owed by Party B is more than five thousand Yuan.(3)未經(jīng)甲方同意,乙方將游泳館及附屬用房轉(zhuǎn)包給第三者(包括與他人合伙經(jīng)營(yíng)) 的;Without the consent of Party A , Party B subcontract the swimming pool and ancillary space to the thirdparty include partnership with other.4)乙方擅自改變游泳館及附屬
20、用房的用途或房屋結(jié)構(gòu)的;Party B change without authorization of party A the purpose of the swimming pool and ancillary space orstructure of house.(5)乙方在承包經(jīng)營(yíng)中進(jìn)行違法活動(dòng)或損害公共利益的。Party B to carry out illegal activities in the contract operation or damage to the public interest.第七條 本合同因下列情況可終止:Termination under the fol
21、lowing circumstances:1、一方違約,另一方可按本合同的規(guī)定終止合同;If a party defaults, the other party may terminate the contract in accordance with the provisions of thecontract;2、雙方協(xié)商一致同意終止合同;Parties hereto agree to terminate this contract through consensus;3 、因法定不可抗力的情況發(fā)生; Due to the statutory force majeure ;4、因法律法規(guī)政策
22、規(guī)定的原因,導(dǎo)致本合同無(wú)法繼續(xù)履行。Due to laws and regulations, policies and regulations, this contract can not be continue to fulfill.除上述第 1 項(xiàng)外,甲、乙雙方均不承擔(dān)合同終止的責(zé)任。Except 1 item provision above party A and B shall assume no liability related to the termination toopposite party.第八條 本合同簽訂之日,雙方應(yīng)出具詳細(xì)的資產(chǎn)明細(xì)表Article VIII.
